Suffolk County Crime Stoppers and Suffolk County Police Sixth Squad detectives are seeking the public’s help to identify and locate the man who allegedly robbed a Miller Place business this month. 

A man entered Speedway, located at 370, Route 25A on September 11 and asked for a carton of cigarettes. As the clerk was getting the cigarettes the suspect allegedly pulled a hammer from his waistband and demanded money. The clerk complied and the suspect fled with cash and the cigarettes.

Suffolk County Police arrested a man on Sept. 22 for allegedly passing counterfeit currency in Suffolk County.

Southampton Police Department advised Suffolk County Police Seventh Squad detectives that Nicolas Munoz was in custody after he was arrested for allegedly using counterfeit cash throughout the Seventh and Fifth Precinct of Suffolk County, as well as Westhampton Village, Southampton Village and Easthampton Village.

Following an investigation, it was determined that Munoz was responsible for passing counterfeit $100 bills at the following locations:

  • Aby’s Deli & Catering, 459 Montauk Highway, East Moriches, on September 1
  • The Tipsy Duck Wine Co., 509 Montauk Highway, Eastport, on September 1
  • It’s Only Natural, 118 S Country Road, Bellport, on September 3
  • Aegean Cafe, 35 Main St., Sayville, on August 31
  • Tola, 136 S Country Road, Bellport, on September 3
  • Sayville Bean, 59 Main St., Sayville, on August 31
  • Sayville Cheese, 110 Main St., Sayville, on August 31 and September 17
  • Café Joelle, 25 Main St., Sayville, on August 31
  • Wayward Kitchen and Cocktails, 98 Main St., Sayville, on August 31
  • Mini Monet, 122 Main St., Sayville, on September 17

Munoz, 22, of Queens, was charged with eleven counts of Criminal Possession of a Forged Instrument 1st Degree.Detectives are continuing the investigation to determine if Munoz is responsible for using counterfeit cash in additional jurisdictions. Southampton, Westhampton Village, and Easthampton Town Police Departments are also investigating. Anyone with information is asked to call the Seventh Squad at (631) 852-8752. At the time of his arrest, Munoz was operating a 2002 blue Honda CRV, with a switched New York license plate of TYLC-4466.

Suffolk County District Attorney Raymond A. Tierney announced on Sept. 22 that Rupert Cruz, 63, of Coram, was indicted for Predatory Sexual Assault, Rape, Sexual Abuse, and Strangulation, after he allegedly raped a woman to whom he had offered a ride home after being discharged from a hospital.

“This defendant allegedly preyed on the victim in order to violate her,” said District Attorney Tierney. “We will pursue justice for the victim by making sure her alleged attacker is held responsible and taken off the streets so he can no longer harm others.”

According to the investigation, Cruz allegedly met the 32-year-old victim in June 2023 while they were both patients at St. Charles Hospital in Port Jefferson. When both Cruz and the victim were being discharged, Cruz offered the victim a ride home and she accepted. While the victim was in Cruz’s vehicle, he allegedly gave her a drink from an opened soda can.

Shortly after they left the hospital and while Cruz was still driving, Cruz allegedly began making sexual advances towards the victim, which she rejected. The victim’s friend called her during the time she was struggling with the defendant, and she could allegedly hear the victim screaming for help before the victim’s cell phone fell in between the seats of the vehicle.

Cruz allegedly picked the victim up from the passenger seat and forced her on top of him while he was still seated in the driver’s seat. The victim did not remember anything after that and woke up naked the following morning in a wooded area at Bartlett Pond Park in Middle Island. The victim was in pain, with scratches and bruises on her body, red marks on her neck, and broken blood vessels in her eye. The victim then located a few items of her clothing and left the park. The victim’s phone allegedly remained in Cruz’s vehicle until its battery died.

On June 15, 2023, the victim used a device finder through the Internet to locate her phone and allegedly traced it to Cruz’s residence in Coram. The victim reported the incident to the police, and Cruz was subsequently arrested on September 8, 2023.

On September 21, 2023, Cruz was arraigned on the indictment before County Court Judge, the Honorable Karen M. Wilutis, for the following charges:

  •   Predatory Sexual Assault in the First Degree, a Class A-II violent felony;
  •   Rape in the First Degree, a Class B violent felony;
  •   Sexual Abuse in the First Degree, a Class D violent felony; and
  •   Strangulation in the Second Degree, a Class D violent felony. 

    Judge Wilutis ordered that Cruz be remanded without bail during the pendency of the case. Cruz is due back in court on October 4, 2023, and he is being represented by the Legal Aid Society.

    This case is being prosecuted by Assistant District Attorney Danielle Carter of the Major Crime Bureau, with investigative assistance from Detective Travis Pfeffer of the Suffolk County Police Department’s Sixth Squad.

The Suffolk County Police Department Impound Section will hold a vehicle auction on Saturday, Sept. 23 at the department’s Impound Facility, located at 100 Old Country Road in Westhampton. The auction will begin at 9 a.m. and will be held rain or shine.

There will be a vehicle preview on Thursday, Sept. 21 and Friday, Sept. 22 between 9 a.m. and 4 p.m. at the impound yard. Vehicles will also be available for preview for one hour prior to the start of the auction. Approximately 120 vehicles will be auctioned off including sedans, SUVs, pickup trucks, and vans. All vehicles will start with a minimum bid of $500 and are sold as-is.

Suffolk County Police Fourth Squad detectives are investigating a multi-vehicle crash that critically injured a woman in Islandia on Sept. 20.

Amanda McDermott was driving a 2006 Ford Econoline van, when the traffic slowed and was involved in a chain reaction crash approximately 1⁄4 mile east of Old Nichols Road at approximately 10:45 a.m. A total of six vehicles were involved and detectives are investigating what caused the chain reaction crash.

McDermott, 35, of Mastic Beach, was transported to Stony Brook University Hospital in critical condition. Five other people were transported to local hospitals for treatment of non-life-threatening injuries.

Two commercial vehicles were given safety checks at the scene by the Suffolk County Motor Carrier Safety Unit. Two other involved vehicles were impounded for safety checks. The Econoline van is registered to Independent Group Home Living.

Suffolk County Police arrested a Bay Shore man on Sept. 19 for allegedly releasing pepper spray inside a Commack business.

Carl Goode walked into Marshalls, located at 6A Henry St., and allegedly released pepper spray into the air at
approximately 6:40 p.m. Goode was arrested near the location at 6:55 p.m.

Nine people were evaluated at the scene, with one being transported to Huntington Hospital. Another
person called 911 from their home and was transported to South Shore University Hospital in Bay
Shore. Both victims were treated and released.

Goode, 57, of 7A Hemlock Drive, was charged with Unlawfully Possessing or Selling Noxious Material
and Criminal Nuisance 2nd Degree. Goode also had an active warrant.

A man allegedly stole a package from the mailroom of an apartment complex, located at 1615 Main Street, on June 19.

A man allegedly stole approximately $422 worth of assorted groceries from Target, located at 265 Pond Path, on August 2. He fled the store in a tan SUV.

Suffolk County Crime Stoppers and Suffolk County Police Fourth Precinct Crime Section officers are seeking the public’s help to identify and locate the man who allegedly struck another man following a road rage incident in Smithtown in June.

A delivery driver was stopped on 4th Avenue in Smithtown on June 26 when he was approached at 4:40 p.m. by a man he was previously involved in a road rage dispute with. The suspect allegedly struck the delivery driver in the head multiple times and displayed what appeared to be a knife before getting back in his vehicle and leaving the scene. The suspect was possibly driving a blue Subaru. The victim declined medical attention.

Suffolk County D.A. Raymond Tierney

Suffolk County District Attorney Raymond A. Tierney announced on Sept. 19 that Leo Flores-Gracias, 26, of Huntington Station, was indicted for Aggravated Vehicular Manslaughter and other related charges, for allegedly driving while intoxicated and crashing into another vehicle, killing his own passenger, Marlon Nunez-Cuellar, 25, of Huntington Station.

“This defendant’s alleged decision to drive while under the influence of alcohol caused the tragic death of Marlon Nunez-Cuellar,” said District Attorney Tierney. “My office will seek justice for the victim and his loved ones, as we continue the push to keep our roadways in Suffolk County safe.”

According to the investigation, on July 4, 2023, at approximately 8:06 p.m., Flores-Gracias and three others left a party where he had allegedly been drinking alcohol and they got into Flores- Gracias’ 2017 Honda Accord. Flores-Gracias allegedly began driving northbound on Sweet Hollow Road in Huntington at a high rate of speed, and crashed head-on into a vehicle that was driving southbound.

Marlon Nunez-Cuellar, one of Flores-Gracias’ passengers, was transported to Plainview Hospital where he was pronounced dead from injuries he sustained in the crash. The operator of the vehicle that was struck head-on, was uninjured.

When police officers arrived at the scene, they noticed that the defendant exhibited indicia of intoxication, and placed him under arrest.

On September 19,  Flores-Gracias was arraigned on the indictment before Acting Supreme Court Justice, the Honorable Steven A. Pilewski, for the following charges:

  •   One count of Aggravated Vehicular Homicide, a Class B felony;
  •   One count of Manslaughter in the Second Degree, a Class C felony;
  •   One count of Vehicular Manslaughter in the Second Degree, a Class D felony;
  •   One count of Aggravated Driving While Intoxicated, an Unclassified misdemeanor;
  •   Two counts of Driving While Intoxicated, Unclassified misdemeanors; and
  •   One count of Reckless Driving, an Unclassified misdemeanor.

Justice Pilewski order Flores-Gracias held on $250,000 cash, $500,000 bond or 2.5 million partially secured bond during the pendency of the case. If convicted of the top count, Flores- Garcias faces up to 25 years in prison. Flores-Gracias is due back in court on October 25.
