Flash flooding leveled much of the tri-state area last Friday, Sept. 29, prompting a state of emergency declaration for Long Island while unleashing damage and halting some services.

The National Weather Service issued a coastal flood watch for Long Island Friday, which remained in effect into the night. Heavy rainfall and intense flooding throughout the region prompted Gov. Kathy Hochul (D) to declare a state of emergency for Long Island, as well as for New York City and portions of the Hudson Valley.

Heavy flooding caused roadway closures at state Route 110 in Huntington between Mill Lane and Prime Avenue near Madison Street at Heckscher State Park, according to a NWS report. In Commack, a stranded motorist on Town Line Road required an emergency service response, the same report indicated.

In an emailed statement, Town of Huntington Supervisor Ed Smyth (R) maintained that much of the town’s infrastructure and services remained undisturbed despite the heavy rainfall.

“Highway Superintendent Andre Sorrentino and the Highway Department, along with our Environmental Waste Management Department, were out in full force with pumps and tree crews clearing and cleaning,” Smyth said. “Our sewage treatment plants received more than double their normal water flow without any reported spillage.”

He added that garbage collection continued as scheduled, though the storm had disrupted and canceled numerous local events. “However, normal government operations continued without interruption. Although there were no significant issues, the town is currently assessing all departments to determine any and all issues relating to the storm.”

Joana Flores, media liaison for the Metropolitan Transportation Authority, indicated that operations along the Long Island Rail Road’s Port Jefferson Branch were largely undeterred.

“Friday’s weather event did not have any impact on MTA infrastructure in the Port Jefferson area or to Port Jefferson train service,” Flores said. “With the exception of one train that was momentarily delayed due to a non-weather-related matter, the Port Jefferson Branch operated on or close to schedule.”

“Crews did perform periodic patrols of the Port Jefferson Branch to monitor conditions of the infrastructure,” she added.

Electrical infrastructure had similarly avoided major damages, according to Jeremy Walsh, a spokesperson for PSEG Long Island. “Friday’s flooding did not impact the electric infrastructure,” he said in an email. “Overall, the system performed well. While we did experience scattered outage activity, it was mainly as a result of the heavy rains and gusty conditions impacting trees and tree limbs, not flood damage.”

Given projections for more frequent and intense storm events over the coming years, Walsh added that the utility company is continuing efforts toward mitigating the associated risks to the electrical grid.

“PSEG Long Island has been storm-hardening the electric grid since 2014, including elevating equipment at some substations to protect against flooding, and this has helped reduce the impact of severe weather events,” he noted. “We continue to storm-harden the infrastructure using the best projections for future flooding and wind conditions that are available to us.”

The storm’s impacts were not limited to public infrastructure, however. The New York State Department of Environmental Conservation temporarily closed much of the North Shore to shellfishing due to “extremely heavy rainfall and extraordinary amounts of stormwater runoff and localized street flooding … which may result in conditions causing shellfish to be hazardous for use as food,” a NYSDEC report said.

At a press conference the following day, Sept. 30, Hochul announced that there had been no recorded fatalities due to the flooding, thanking the public for heeding emergency warnings.

“What had been described by myself as a potentially life-threatening event ended up being a time when people listened, they reacted properly, they took precautions and no lives were lost,” the governor said.

A Three Village Civic Association Meet the Candidates event Monday, Oct. 2, hosted nine hopefuls (with one absentee) for local government positions — namely Suffolk County executive, Brookhaven Town supervisor, Brookhaven supervisor of highways, county legislator and town council — asking them questions through moderator Herb Mones relevant to current issues in the community.

Brookhaven Town Council: 1st District

Incumbent Councilmember Jonathan Kornreich (D-Stony Brook) is facing special education teacher Gary Bodenburg (R) in his bid to keep the seat he won in a special election in March 2021.

Kornreich, who previously served on the Three Village school board and as civic president, said he has a deep understanding of the main issues facing Brookhaven today — land use and planning, including an undersupply of affordable housing and an oversupply of vacant retail and commercial properties.

“One of my most important goals is to help guide the redevelopment of those properties in a way that doesn’t tax our already overburdened infrastructure,” he said, referring to the current system of dealing with sewage primarily through cesspools and its impact on the town’s sole drinking water source, as well as traffic.

Bodenburg acknowledged land use is a major function of the town, but added that assuring quality of life is equally important, pointing to how the many expenses of living on Long Island are straining for families.

“Sometimes we need an outsider, somebody with a fresh set of eyes to look at the issues that we face and create solutions that are somewhat creative, but are keeping our main focus of our families and our children in mind,” he said.

Both candidates said they wanted to ensure community members have the same level of access to government as land developers, as well as increased transparency in the process of member selection for planning and zoning boards.

Kornreich expressed particular concern about overdevelopment of areas like Three Village, as well as frustration about the current notification process of proposed zoning changes to nearby residents. He called the required notification letter “arcane” and confusing, and said he sends his own letter with a map and narrative explanation to residents explaining what is proposed for their neighborhood.

He said he’s working with the town’s legal department to require more robust and transparent communication. “That type of notification and that type of process makes a big difference,” he said.

Bodenburg promised to take on long wait times for things like permits. He said he planned to ensure different departments are sharing information and working cohesively to improve the efficiency of government services.

“We can do that very easily by surveying each department and finding out from the people that are serving our community: How can we help you? What makes your job easier? How can we make your job easier, so we can get our residents to get what they need faster,” Bodenburg said.

Brookhaven superintendent of highways

Newcomer Michael Kaplan (D) is challenging current Highway Supervisor Daniel Losquadro (R), who has served in that position for a decade.

Kaplan, a veteran who spent time in the Middle East with the U.S. Army, is trying to capitalize on his 30 years of experience with highway departments, from a laborer to a road inspector to working for the superintendent of highways in Huntington.

“The highway department should be run by someone who possesses the skill, someone who actually filled potholes, ran a street sweeper, plowed in many snowstorms, cleaned up things like Hurricane Sandy,” he said, adding that he also knows well the administrative side, and what needs improvement. “I want to get rid of pay-to-play. I want to get rid of basically politics in highways — people will be promoted with their merit and not by, per se, writing a check to their political party. That needs to end.”

Losquadro highlighted his accomplishments at the department, including conversion from analog to digital since his election 10 years ago. “We were a department that was hand-writing notes on work orders,” he said. “All my foremen now have iPads with a simple graphic user interface. They’re able to take photos, they’re able to upload that information instantaneously.”

That digital revolution, he added, “not only allows me to track how those work orders are being done, but it gives me a measurable metric by which I can gauge the performance of my employees.”

Both candidates shared their desire to improve safety for bikers and pedestrians, but also acknowledged the challenge of retrofitting modern infrastructure into one of the oldest parts of Long Island.

Another area of agreement was the frustration of unfunded mandates from the state and county — particularly for road and sidewalk maintenance. “I don’t know why the Department of Transportation even bothers to call themselves the state Department of Transportation anymore, because they seem to want to abdicate the responsibility for state roads almost entirely,” Losquadro said, adding that repairing sidewalks along state roads that were installed by the state has not traditionally been part of the town’s budget, and he would like to push back and request funding from the state for this work.

Kaplan suggested a more forceful response. “You need a more fierce attitude dealing with Suffolk DOT and state DOT,” he said. “I think we need fresh eyes — someone that’s really going to go up against the state government and the county government and say, ‘No, we’re not doing this anymore, and if you want us to do it, give us some money for it.”

Suffolk County executive

Town of Brookhaven Supervisor Ed Romaine (R) has thrown his hat in the ring to lead Suffolk County after 11 years at the helm of the town. He said he’s proud of his accomplishments in Brookhaven and hopes to make the same kind of changes at the county level.

“When I came into Brookhaven, we had a lot of financial trouble and we had a divided board that was very argumentative — that ended within a few months,” he said. “My colleagues on the board right up to the present day will tell you, we work together. We have unity on the board. We have a focus to go forward.”

He said he also helped repair the town’s financial distress, pointing to the fact that the town currently has a AAA credit rating, and the New York State Comptroller’s Office just gave the town a perfect “0” score for fiscal and environmental stress indicators. He said he would also work to invite wind energy into the area, noting he’d like to move the county away from fossil fuels.

Challenging Romaine, businessman Dave Calone (D) is a Three Village resident and former federal prosecutor who sought accountability for international economic crimes, particularly in oil and gas, and for terrorism after the September 11 terrorist attacks. He later participated in assisting start-ups on Long Island and around the country.

He said he is passionate about protecting the environment and, while serving as chair of the Suffolk County Planning Commission, helped streamline and expedite the permitting process for residential solar panels, something that became a model for other counties and states. He said he even spoke at a conference on the topic in Chicago. 

“I think I’m the only person ever who has gone from Long Island to somewhere else to teach them how to cut red tape,” he said.

Calone also pledged to reintroduce a bill that would allow residents to vote on whether to raise sales tax by 1/8 of a cent to establish a water quality protection fund, which would help add sewers and update septic systems, in light of a summer that saw several days of beach closings due to poor water quality.

Marine scientists and other water experts have said prolific outdated cesspool systems in Suffolk are harming area waterways and the aquifer. The county Legislature blocked a referendum on the wastewater fund in July.

“For me, it’s about focusing on safety, opportunity, affordability and, obviously, environmental protection,” Calone said.

Both candidates agreed the county has significant areas to improve, especially in cybersecurity as well as in increased staffing for Child Protective Services, 911 operations and the police. Both blamed traffic fatalities on insufficient enforcement.

Calone said he would seek funding to create more “complete streets,” that is, roads friendly and safe for multiple uses: pedestrians, bikers and motorists.

Romaine called out the current county executive, Steve Bellone (D), saying there are essential positions left “deliberately” vacant, leaving police officers, 911 operators and CPS caseworkers overloaded and unable to keep up with demand for services. 

“I’m supervisor of a town,” Romaine said. “If I put a job in the budget, it gets filled. If it becomes vacant, it gets filled. That is not true in the county of Suffolk,” calling the practice dishonest. “If we fill those jobs, it’s not that you’d have to pay more because you’re already getting taxed for that.”

County legislator: 5th District

Anthony Figliola (R-East Setauket), a Three Village resident with experience in economic development and government relations, and former New York State Assemblyman Steve Englebright (D-Setauket) are vying to replace the vacant seat left by Kara Hahn (D-Setauket), who would have been term limited in any event.

A geologist by trade with a long association with Stony Brook University, Englebright served in the Suffolk County Legislature from 1983 to 1992, before his long term in the state Assembly until the end of 2022. He said he was particularly inspired to reenter the county’s political sphere when he heard the Legislature in July rejected the opportunity to let people vote on the clean water bill. He said the move took away a chance for public education on how aging septic infrastructure affects the county’s sole-source aquifer and local harbors.

“The reason I’m running for the county Legislature is the work that I began there to protect clean water and protect us environmentally, and in order to encourage the growth of renewable energy — those issues are still very, very much in need, I believe, of some of the attention that I can give to them,” he said. “Let the people vote for clean water.”

Figliola, who indicated he was also disappointed the Legislature did not allow the clean water referendum, said he wants to bring to Suffolk his experience helping small businesses grow and assisting municipalities seeking federal funds for infrastructure.

“I care about this community, which is why I want to bring a private-sector mindset to the county Legislature because we have fiscal problems,” Figliola said. He also said he’d like to help small businesses succeed in order to decrease the number of vacant storefronts in the area.

Both candidates agreed red-light cameras should be used in a more thoughtful and disciplined way — for public safety and not as a revenue stream. “People feel that it is a cash grab, and I want to make sure their pockets are not being picked,” Figliola said.

Brookhaven Town supervisor

In the race to replace Romaine as town supervisor, Lillian Clayman (D), a SUNY Old Westbury adjunct professor and former mayor of Hamden, Connecticut, is facing off against Brookhaven Deputy Supervisor Dan Panico (R-Manorville).

Clayman, who also worked as an organizer for a health care union and chair of the Brookhaven Town Democratic Committee, was unable to make the event, but said previously her priorities include bringing “good government” to Brookhaven, and solving issues of waste management in light of the planned closure of Brookhaven’s landfill.

At the event, Panico detailed his long service in public office, including 13 years at his current post as councilman for the 6th District. He said Brookhaven is “light-years” from the “sordid history that unfolded from decades ago,” thanks in part to anti-nepotism and ethics laws he was part of passing.

He said a key to his collaborative style is to represent all constituents and work collaboratively with others, no matter their political leaning. He also does not talk about national politics.

“I find it to be extremely divisive,” he said. “A lot of times when elected officials are so willing to jump into the fray of national politics and culture wars, it’s because they’re not necessarily spending that time that they should be doing the job they were elected to do.”

Panico pledged to do his best to protect open spaces from overdevelopment, an issue of particular interest to area residents, and something he has had success doing. “Land use zoning and planning is my expertise,” he said, adding that the area where he grew up — Mastic Beach — was a victim of “haphazard” development, which is difficult and expensive to redevelop. He said he would like to avoid that issue in places with historical properties and such a sense of place. “You have something special here in the Three Village area,” he said.

He also said he would address issues of illegal student housing in local neighborhoods by working with Stony Brook University to find solutions — especially in light of record donations to the school that could enable additional appropriate student housing. He said he has experience in cracking down on illegal housing situations and pledged to do the same in the Three Village area. “It’s like cancer,” he said. “If you, as a government representative, do not address the issue, and the people don’t believe their government is listening and doing something, what happens? The ‘for sale’ sign goes up, especially in this market, and it spreads down the block.”

Election Day is Tuesday, Nov. 7.

Members of the community have been inquiring about how the courts have dealt with their calendars for personal injury cases caused mainly by motor vehicle accidents during more recent variants of COVID-19. Clients are naturally concerned about their health and the progress of their personal injury cases. 

Moreover, people who have gotten into various types of accidents while last year’s Omicron variant was raging wonder if they, or we, should be doing anything different. Finally, with the recent uptick in COVID-19 reported by the media, we are receiving additional inquiries of this nature over the summer. 

Just ‘how open’ were the courts before the Omicron variant became widespread?

Before the Omicron variant of the COVID-19 virus became prevalent, the courts in Suffolk County and throughout the state were beginning to “open up” and conduct “in person” appearances for conferences and other matters. 

Trials started when these appearances became more commonplace and seemingly conducted without danger to the court personnel, litigants, and lawyers. First, the court scheduled criminal trials in cases with incarcerated defendants, and then serious felony trials began in the fall of 2021. 

Next, the court started trying civil cases as a backlog of personal injury accident trials had developed. The judges throughout the state were encouraged to reduce the backlog, as it is well known that personal injury cases arising out of car accidents, slip and fall incidents, and medical malpractice usually settle only when a trial is about to begin. Therefore, the need to schedule trials became essential. 

What happened to trials that were scheduled before the Omicron variant became widespread? 

Just as civil trials for personal injury cases were beginning to be held with little or no noticeable spread of the virus, by the end of 2021, the Omicron variant hit New York State and most of the country. 

Several personal injury trials had been completed by jury verdict or settlement in Suffolk County; however, as 2022 began, the Omicron variant caused a pause in starting most civil personal injury trials. While a few such cases proceeded to trial while Omicron was spreading, the cases that involved several parties, such as multi-car accident matters, were postponed until the variant subsided.

What is the status of personal injury cases as of the Summer of 2023? 

Despite the emergence of the apparent new strain of COVID-19, the entire country clearly is enduring its spread. Whether it is a result of the vaccines, people developing immunity, or the availability of medications, most cases seem to be relatively mild. As a result, the courts are operating as they were in 2019, and trials are proceeding in virtually all personal injury cases. 

Needless to say, if you have a case pending or were involved in an accident that caused personal injury, be sure to keep in touch with your lawyer or consult with an attorney if you haven’t done so already, as no one can predict how new variants of the virus will evolve. 

According to epidemiologist Nathan Grubaugh of Yale University, “Delta was never going to be the last variant—and Omicron is not going to be the last one, as long as there is a COVID-19 outbreak somewhere in the world, there is going to be something new that emerges.”

I commend this newspaper for its thorough and balanced Sept. 14 and Sept. 21 articles on the proposed conversion of the Long Island Power Authority into a fully municipal utility that would directly operate the electrical transmission and distribution system that it has owned for decades.

LIPA, which is the country’s third largest municipal utility, is legally required now to outsource its operation to another entity. Right now that is PSEG Long Island. Before that, it was National Grid.

LIPA’s staff of 60 experienced utility professionals supervises PSEGLI’s performance according to metrics taking 207 pages to outline. Each year, LIPA pays PSEGLI $80 million for just 18 executives to plan and direct the 2,500-line call center and other workers whose pay is provided by LIPA. That’s more than $4 million for each PSEGLI-supplied executive.

There is considerable overlap between the top PSEGLI staff and the LIPA staff that supervises and grades PSEGLI’s performance. Both the Legislative Commission on the Future of the Long Island Power Authority and LIPA agree that if LIPA hired a dozen more staffers, it could run the system itself, dispensing with PSEGLI’s management and saving about $75 million each year.

This savings would be real, even if PSEGLI were doing a good job. But it hasn’t been. Their performance in storm restoration after Tropical Storm Isaias in 2020 was so bad, and their reports on the causes of the failure of the outage management system were so dishonest, that LIPA considered PSEGLI to be in default of their contract.

Beyond PSEGLI’s shortcomings, the problem is the structure of the unique and convoluted “hybrid” system itself. Besides the extra cost, the inefficiency of this two-headed structure is why LIPA is the only large municipal utility in the country to be operated this way.

As a LIPA trustee for five years, I saw the difficulties, delays and expense that this structure results in. For example, it required three months and a resolution voted by the LIPA Board directing PSEGLI to develop and implement an accurate and modern asset management system for the billions of dollars of LIPA-owned assets before PSEGLI would take such action.

The delays and inefficiency of this management structure do not show up as a specific dollar cost in LIPA’s budget, but they are there and impede LIPA’s adaptation to the new reality of stronger storms and a faster transition to a renewable energy system.

LIPA needs the simple, common municipal utility structure recommended by the state’s Legislative Commission. The Board of Trustees should be reorganized so some trustees are appointed by both Suffolk and Nassau County executives, rather than now where all the trustees are appointed by the state’s political leadership in Albany.

Locally appointed trustees should give LIPA needed credibility with its Long Island customer base and might make it more responsive to local concerns. In recent years, there has been significant hostility resulting from inadequate understanding by both PSEGLI and LIPA of the impact of changes in tariffs, and from the location and details of new facilities or even just taller and thicker poles.

Finally, one trustee should be named by the union — IBEW Local 1049 — representing the utility’s workforce to ensure that their interests are represented at the highest level.

The legal structure in which the workforce is actually housed is critical. Their transfer from PSEGLI to LIPA must be done in a way that continues their employment under federal labor jurisdiction and preserves their well-earned pension rights. Any proposal that might put them under weaker state labor jurisdiction and possibly jeopardize their pensions has no chance of passing the Legislature, nor should it.

Long Islanders should support this once-in-a-generation opportunity to fix a broken utility structure.

Suffolk County’s transportation network may soon undergo significant transformation.

In 2020, the Suffolk County Department of Economic Development and Planning published its Hike and Bike Master Plan, which calls for 1,200 miles of new pedestrian and biking infrastructure countywide.

To mark Car Free Day on Friday, Sept. 22, county officials joined transit advocates along a bike path in Kings Park, announcing a new program to achieve the goals of this master plan through intermunicipal coordination.

“Today on Car Free Day, I am proud to announce that we are taking our Hike-Bike Master Plan further, taking additional steps to create a safe and comfortable biking environment in Suffolk County,” said Suffolk County Executive Steve Bellone (D).

The new program, GEAR — Guidance for Enhancing Active Recreation — Up Suffolk, will authorize the county’s Department of Economic Development and Planning to provide free technical and design assistance to municipalities to implement active transportation projects. This undertaking aims to help Suffolk’s towns and villages expand trail access by reconfiguring local roadways.

While various trail networks already exist, Bellone said the GEAR Up initiative could help “fill in the gaps” between existing trail infrastructure.

“Where are the gaps? They’re roads,” he said. “In many cases — most cases even — they’re local roads.”

Bellone said the county government seeks to offer conceptual and preliminary designs, conducted in coordination with local municipalities, tailored to meet a community’s needs. 

These proposals may include corridor designs, bike lanes, sidewalks, crosswalks, curb extensions and flashing beacons, among other design elements.

“We want to create an interconnected biking and hiking network that you can use [to] travel across the county,” Bellone said.

Marty Buchman, a member of the board of the New York Bicycling Association, pointed to the deficiencies of past planning and its impacts today on local communities.

“Suffolk County was never designed for the amount of population that it contains right now,” he said. “The roads were designed for a rural county,” adding, “The situation of cars in Suffolk County is going to get worse.”

Buchman advocated for planners and municipalities to view the bicycle as an alternative to the automobile. He suggested trails could help alleviate several of the challenges drivers experience on roadways.

“I’d like to see more paths — not just recreational paths but paths for transportation,” he said, advising “that a bicycle be looked at as more than just a fitness tool or an outdoors tool but a way for people to get from point A to point B.”

He added, “That’s not going to happen without the required or needed infrastructure.”

Bellone outlined multiple benefits of expanding trail access, such as environmental protection, economic development and downtown revitalization.

Amid escalating fears of a youth exodus from Long Island, Bellone said promoting alternative modes of transit can help the county retain and attract young people.

“We are in a competition for innovators, young people, entrepreneurs and skilled workers,” the county executive said. “We want them living in our downtowns. We want them raising their families here because that will bring more jobs, businesses and sustainable economic growth.”

“You get that when you make investments in the things that improve people’s quality of life,” he added.

Buchman referred to hiking and biking infrastructure as an apolitical policy area: “This is not a political issue,” the transit advocate said. “Republicans ride. Democrats ride. People ride.”

In achieving the goals of the master plan, Bellone said intergovernmental collaboration would remain crucial while working toward the objectives of the 2020 master plan. 

“Having an interconnected hiking and biking network throughout Suffolk County helps every community and family across the county,” he said.

The county will accept applications for the GEAR Up program on a rolling basis.

Major party candidates for three local offices went before the public Tuesday evening, Sept. 26, for a Meet the Candidates forum at the Comsewogue Public Library hosted by the Port Jefferson Station/Terryville Civic Association.

Brookhaven Town Council

Vying for Brookhaven’s 1st Council District, which encompasses Port Jeff Station/Terryville, incumbent Councilmember Jonathan Kornreich (D-Stony Brook) is defending his seat against Republican Party challenger Gary Bodenburg, a special education teacher at South Huntington School District.

Kornreich was first elected to the Town Board in 2021 following a special election for the vacated seat of former Councilwoman Valerie Cartright (D-Port Jefferson Station).

Kornreich served on the Three Village Central School District Board of Education and as president of the Three Village Civic Association. His professional background is in construction and real estate finance.

“I understand the economics of what drives boom and bust cycles, and how to evaluate our current stock of real estate and what can make a project viable,” he said.

Bodenburg, along with his role as an educator, has conducted local advocacy work for at-risk youth, serving on several committees within the Comsewogue School District.

“I have always been somebody that is willing to help and put my hat in the ring with anything that goes on in our community, and I’m looking forward to expressing that in this capacity as well,” he said.

On land use, Bodenburg objected to the trend of developing new apartment complexes in and around PJS/T.

“I do believe there’s a need for housing,” he said. “Once I’m able to get involved in it and I can see a little deeper, a little clearer, it makes it a lot easier.”

Kornreich said the board needs to incentivize redevelopment, citing mixed-use development as a potential means for making redevelopment economically viable.

“If it were up to me, we wouldn’t add any new residences — I think we’re already at our carrying capacity,” the councilmember said. “We all know traffic is a nightmare, but in order to revitalize these areas, we have to be able to make it work financially for the developers.”

Given some local concerns over traffic impacts from new developments along the Route 112 corridor, Kornreich supported commissioning a comprehensive traffic study to assess interactions between proposed developments.

He warned against the trend of privately commissioned impact assessments. “I think at the town, we have to stop allowing people to just hire their own experts to tell [us] what they’re being paid to say,” the incumbent said.

Bodenburg acknowledged the value of impact assessments, though he warned against studying at the expense of progress.

“I think we need to fully evaluate anything that we’re doing, but there does come a point in time where we can’t continue to just study things and we have to make actual action,” he advised.

When pressed on growing density pressures within the hamlet, Bodenburg said he has been coordinating with a real estate developer and revitalizer interested in working with the town to develop properties and expand affordable housing opportunities for residents.

“We have to be a little more creative than we have been in the past, and I think that that is something that we need to look into,” he said.

Kornreich said the region offers limited residential opportunities for young families with an “insatiable” demand for affordable housing.

“The way that we can address this at the town level is pretty straightforward,” he said. “We have control over local zoning … so we could offer incentives to developers who are going to put affordable units in their development.”

But, he added, “For these projects to work, that’s where we need the state and federal government to do things like providing low-interest loans.”

Suffolk County Legislature

Former New York State Assemblyman Steve Englebright (D-Setauket) and former NY-1 congressional candidate Anthony Figliola (R-East Setauket) have both stepped forward to fill the now-vacant 5th District seat of former Suffolk County Legislator Kara Hahn (D-Setauket).

Figliola, whose professional background is in government relations with related advocacy work for the proposed electrification of the Port Jeff Branch line of the Long Island Rail Road, centered much of his platform around the electrification initiative.

Electrification would cause “less particulates going into the atmosphere,” he said. “Also for economic development, with the revitalization of Port Jefferson Station and all the [stations] along that from St. James all the way to Huntington.”

Englebright served in the county Legislature from 1983-92 and the state Assembly from 1992-2022. A geologist by training, he concentrated his platform around green energy and environmental protection.

“I sponsored most of the laws that set the stage for the creation of a renewable energy program for the state,” the former assemblyman said. “Green energy initiatives are critically important for our future.”

When asked about the future of the Lawrence Aviation Superfund site in Port Jeff Station, Englebright endorsed the idea of relocating the existing rail yard to the property while eliminating the grade crossing on Route 112.

“The whole idea of having a rail yard there and getting rid of the at-grade crossing on 112 is very much with the concept of having a workable and safe environment,” he added.

Figliola said the community is currently on a path toward a renaissance with the site’s eventual redevelopment. He emphasized the need for public input as these local transformations continue.

“Whatever happens, the community needs to be a part of it,” he said. “As your legislator, I will certainly take the lead in working with all the various agencies to ensure that your voice is heard.”

This year’s election comes amid a countywide debate over wastewater infrastructure. When asked about the Republican majority’s recent decision to block the advancement of the Suffolk County Water Quality Restoration Act from reaching the November ballot, Figliola advocated for more sewer infrastructure.

“I am absolutely for finding dollars where available,” he said, adding, “If the voters so choose that they want to have an extra tax, that’s something that I would be for in the Legislature — for the voters to make that decision.”

Englebright objected to the Legislature’s reversal on wastewater, saying it jeopardizes tourism and agriculture, the county’s two largest industries.

“I do not believe that at the last minute — at the 11th hour — this initiative should not have been given to the public,” he said.

Town supervisor

In a race to succeed outgoing Town of Brookhaven Supervisor Ed Romaine (R) — who is running against businessman Dave Calone (D) for Suffolk County executive — Deputy Supervisor Dan Panico (R-Manorville) is squaring off against SUNY Old Westbury adjunct professor Lillian Clayman.

Panico was a practicing attorney and served as senior deputy Suffolk County clerk before entering town government. He served on the Brookhaven Planning Board before his election in 2010 as councilman for the 6th Council District, an office he has held ever since.

Clayman is a Port Jefferson resident who served three terms as mayor of Hamden, Connecticut, before becoming an organizer for health care union 1199SEIU United Healthcare Workers East and later as chair of the Brookhaven Town Democratic Committee. She currently teaches labor and industrial relations.

Clayman indicated that effective public administration starts with proper personnel decisions. “I surround myself with people who I think are smarter than I am,” she noted.

To streamline the town’s existing administrative structure, she proposed revamping the Building Department, citing voluminous paperwork and other complications within the permitting process.

While Panico referred to himself as “very similar to Supervisor Romaine,” he suggested some differences in administrative approach.

He proposed staffing his administration with “people who want to work, people who care about their jobs, no one looking to clock time or [collect a] pension and people who are honest.”

Each candidate was questioned on how his or her administration would handle the impending closure of the Brookhaven Town Landfill, located on Horseblock Road, and the precipitating loss of public revenue for the town budget.

Panico supported a more aggressive recycling campaign with greater pressure on the New York State Department of Environmental Conservation for regional sustainable planning.

“What we need to do is enhance recycling and get the DEC to go forward with a comprehensive plan to promote markets for recycling,” he said.

While acknowledging that land use is the primary function of the town government, Clayman said the town has a secondary responsibility to promote environmental protection.

“Brookhaven is supposed to protect the air that we breathe,” she said. “Brookhaven is supposed to protect the people who live around the landfill, who have since 1974 been living with that garbage.”

She added that expanding composting activities within the town would reduce the waste volume entering the landfill.

Voters will decide on these candidates in just over a month: Election Day is Tuesday, Nov. 7.

The Smithtown Town Board convened Thursday afternoon, Sept. 21, for a public meeting covering public safety, walkability and downtown revitalization.

Public safety

Suffolk County Police Department 4th Precinct Inspector David Regina delivered the department’s public safety report, alerting the community to ongoing crime trends.

Following a stabbing at Millers Pond in Smithtown [see story, “Man stabbed at Millers Pond in Smithtown,” Aug. 26, TBR News Media], Regina said the victim was transported to a local hospital and has survived his injuries.

“This is an assault that is out of the ordinary for that area,” he said. “I do feel confident in saying that I don’t feel that this is a threat to the area of that community.”

Regina referred to 2023 as “a rough year in the 4th Precinct for fatal motor vehicle crashes,” which he said have “run the gamut between pedestrian, standard motor vehicle crashes, motorcycle crashes, bicycle crashes” and accidents involving scooters.

Reporting on a recent fatal accident on Harned Road in Commack involving the death of Ilona Kaydanov, a 22-year-old pedestrian [see story, “Jogger killed in Commack crash, two others injured,” Aug. 31, TBR News Media], Regina said the 4th Squad had investigated the accident, noting, “There does not appear to be any criminality involved.”

The inspector stressed the need for pedestrians to cross roadways at crosswalks, adding that “pedestrians under New York State law are required to walk or jog against the flow of traffic.”

Purse theft — a local crime phenomenon often involving the theft of one’s credit cards at retail spaces — remains pervasive within the 4th Precinct, Regina said. [See story, “Shopping spree: Thieves targeting handbags, wallets at Suffolk County retail stores,” Aug. 24, TBR News Media.]

He reported that this theft crime variety has occurred primarily around the Smith Haven Mall, advising shoppers to “secure your things securely.”

He noted that multiple incidents have included a co-conspirator, with one criminal creating a diversion while another robs an unsuspecting victim’s shopping cart.

SCPD “were able to identify one suspect, and I’m happy to say we cleared three of those cases last week, and we were able to charge that gentleman with several counts of criminal possession of stolen property,” Regina reported.

Sideshows and street races remain an ongoing crime phenomenon countywide. Regina reported a recent sideshow gathering of 250 cars at the Walmart parking lot on Garet Place in Commack.

“These get very raucous,” he said. “They were throwing fireworks in the direction of the police officers who were responding. These are officer safety concerns for us.”

While the department has moderately succeeded in dispersing some of these sideshow events, the inspector suggested the matter is unresolved.

The Hauppauge Fire Department will host a community gathering on Thursday, Sept. 28, at 6:30 p.m. at 855 Wheeler Road to discuss the sideshow issue and its community impacts.

Downtown revitalization

Allyson Murray, principal planner in the Smithtown Planning & Community Department, delivered a presentation on a grant application for New York State downtown revitalization funds through the state’s Downtown Revitalization Initiative and the NY Forward grant programs.

Murray considered Kings Park an ideal candidate for these funds due to its substantial retail and civic spaces, compact size, centrally located Long Island Rail Road station and recent public and private investment.

“The vision is to attract public and private investment to enhance the character of downtown Kings Park,” Murray said, hoping to create “a vibrant and walkable Main Street business district with diverse mixed-use development.”

The proposal seeks to leverage existing community assets, such as the LIRR station, new sewer infrastructure and proximity to major employment centers, such as the Hauppauge Industrial Park and Stony Brook University.

Murray shared a draft list of projects to be included in the application. She encouraged community members to send ideas for other proposals by email to [email protected].

Harned Road proposal

In the wake of the recent roadway fatality, Commack resident Kevin Feit asked the board to consider several pedestrian safety enhancements on Harned Road between Vanderbilt Motor Parkway and Veterans Memorial Highway.

“Currently, there are sidewalks in some sections of Harned Road, but they abruptly end,” Feit indicated. “Where there is no sidewalk, the shoulder is extremely narrow in some places and can be completely taken up by a sewer grate.”

Given these existing conditions, Feit suggested the current roadway to be “impassable for a wheelchair or stroller.” He added that while the speed limit on Harned is 30 mph, vehicles regularly exceed 40 mph due to long stretches between traffic signals.

“Sidewalks would provide several benefits to the community,” he said, among these being public safety, environmental friendliness and walkability to nearby shopping centers and parks.

The Town Board will reconvene Tuesday, Oct. 3, at 2 p.m.

The rain and the wind did not stop Suffolk County Legislator Rob Trotta, other elected officials and residents from attending St. Catherine of Siena Medical Center’s free drive-thru flu vaccination on Saturday, September 23. Throughout the event, there was a steady stream of cars coming with people to get their flu shot.

According to the Center for Disease Control and Prevention, a flu vaccine is the best protection against getting the flu, and everyone six months and older should get one. Such vaccinations are available from your local health care provider and pharmacies, and it is best to check with your doctor before getting the shot. “I commend St. Catherine’s and its staff for offering free flu shots last weekend, and think this is a great public service particularly when we are still dealing with COVID,” said Suffolk County Legislator Rob Trotta.

The Village of Port Jefferson Board of Trustees was back before the public Monday night, Sept. 18, for a business meeting spanning roughly two hours and covering a range of local matters.

Parking pilot program

With Deputy Mayor Rebecca Kassay as the lone dissenter, the board passed an amended resolution 4-1 enabling the issuance of parking permits for Belle Terre residents to park in metered spaces.

In this pilot program, which will last for the remainder of the 2023 calendar year, parking passes for Belle Terre residents will be offered at a prorated expense of $25. This parking pass does not confer access to the PJV resident lot on Arden Place.

Mayor Lauren Sheprow read an email into the record from Village of Belle Terre Mayor Bob Sandak, who characterized the parking pass initiative as mutually beneficial to both municipalities.

“For many years, the residents of Belle Terre have said that they would spend much more time in the village of Port Jefferson if they could have a simple and inexpensive way to park,” the email read. “Any solution you choose to adopt would be much appreciated by the residents of Belle Terre and would, I am sure, prove to be a financial benefit to the businesses of Port Jefferson.”

Outlining reasons for the program, Sheprow said the Port Jefferson Business Improvement District unanimously supported the proposal.

Trustee Drew Biondo considered the parking pass program “cost-neutral and revenue-producing.”

In supporting the motion, trustee Bob Juliano suggested that the pilot program offers 11 weeks to test and evaluate the program: “It doesn’t mean I’m going to approve it going forward, but let’s try it for the 11 weeks and let’s see what it produces,” he said.

Explaining her “no” vote, Kassay indicated that parking accommodations for village employees remain unresolved.

“For years, I’ve heard consistent requests from Port Jefferson business owners asking the village to consider making parking passes available to their employees who are spending $1.50 per hour to go to work,” the deputy mayor said in a subsequent email. “A solution for this concept, as well as the concept of parking permits for nonresident visitors, deserves a great deal of time and discussion from the village board, staff and community at large.”

She added, “I hope the 2024 paid parking season in PJV will begin with a convenient, comprehensive parking permit program for recreational visitors and local employees alike.”

QR code scam

Parking and mobility administrator Kevin Wood updated the board of a recent scam targeting some of the village’s metered parking signs.

“Some group of people or person — most likely this weekend — placed perfectly square, fraudulent QR codes over the existing QR code on some of the signs,” Wood told the board.

Those who scanned the fraudulent code “were offered a flat fee parking rate of $20,” Wood said, adding, “We don’t know exactly how many people were defrauded, but I will tell you we caught it very early Saturday night.”

Wood estimated approximately 12-15 parking signs had been tampered with, maintaining that all fake QR codes had been removed. He added that a detailed report on the incident was sent to the Suffolk County Police Department.

Proposed schedule change

The board debated a proposal to move its regular meetings from Monday to Thursday.

Village clerk Sylvia Pirillo said the existing meeting schedule often conflicts with holidays, adding that there are other logistical challenges for village staff.

“We’re recommending instead the second and final Thursday of each month” for board of trustees meetings, Pirillo said. “We also feel that for staff and for work product that this would be a more consistent schedule. We now have warrants that are once a month, and this would help with the processing.”

Biondo supported the schedule change, saying, “It’s good to try something new. If it doesn’t work, we can caucus and decide to go back.”

Kassay referred to the logic for changing the schedule as “sound.” However, she asked the board to consider public feedback before adopting the change.

“I, as a trustee, have learned that making large, sweeping decisions like this without giving the public a chance to have their voices heard is often greeted quite negatively,” the deputy mayor said.

The board did not hold a vote on the change of schedule.

New treasurer

The village’s new treasurer, Stephen Gaffga, attended his first board meeting Monday night, delivering a brief report on his plans for the office.

Moving forward, Gaffga said he would present monthly financials, including fund balance information, expenses and revenues, also budget transfers. He proposed some changes to office procedures.

“I want to be able to tighten up the procurement procedures here a little bit to be able to allow for more transparency in how the money is being spent — taxpayer money, country club money, capital funds — and to also allow more clarity when it comes to the warrants,” he said. “I think the more information there is, the better.”
