At the Feb. 25 Port Jefferson Station/Terryville Civic Association meeting, the many services of the Town of Brookhaven Clerk’s Office were reviewed and various developments were discussed, including the Baylis Avenue site proposal and Jefferson Plaza. 

The association established their position on the proposed annexation of the 5.6-acre site on Baylis Avenue by the Village of Port Jefferson. Northwind Group, after their rezoning proposal was shot down by Brookhaven, preventing their plans for an apartment complex on the parcel, moved to transfer ownership of the land to the Village of Port Jefferson. 

“I would really like to reiterate that it is my objection…this is a thinly veiled backdoor move to get approval he otherwise wouldn’t have gotten,” Port Jefferson Station/Terryville Civic President Ira Costell said. The rest of the board, as well as civic members, seemed in agreement. 

March 6, Northwind Group will appeal the ruling to the Town of Brookhaven council and a public hearing will be held. The annexation would set a “bad precedent,” said civic member Charlie McAteer. 

Newly elected Port Jefferson Station/Terryville Civic Vice President Lee Brett lamented how the annexation would complicate the execution of services by putting a burden on the Terryville Fire Department and the Comsewogue School District. “Just because it says Port Jefferson Village and they get to go to the beach for free, I can care less, I want my town safe,” he said.

Brookhaven Town Clerk Kevin LaValle reviewed his department’s services and processes, including administering marriage licenses, disability parking passes, death certificates and record digitalization. 

He has also worked to use technology to his advantage, now sending people notices of renewals and allowing them to complete the form from home. 

“The most valuable thing in business is time, from the minute your client asks you for a service from the minute you get it done…we want to be a township that makes it easier for people to come in and do business with our township,” he said, adding that developers can now submit land-use applications online. Further, project information is now advertised through signs that have QR codes leading to the town website.

“It makes it a lot easier to get information on a project out there,” LaValle said. 

LaValle also discussed the prevalence of text message and phone call scams, sometimes under the guise of a bank or a police department saying a loved one is in jail.

LaValle got a scam himself in the form of a text. Presumably, it was his bank informing him of fraud. “I didn’t click the link they had there, I didn’t use the phone number they had on it. I went online…I called the number online that I know is the actual credit card company…they said absolutely that is not [us], can you send us the information,” LaValle said. 

“Don’t rush making decisions,” said LaValle, who attended a presentation on the subject by the Suffolk County district attorney.

Next month, Staller Associates will meet with the civic to discuss architectural design for their development of Jefferson Plaza.

A proposed 48-unit apartment complex in Port Jefferson Station, Brook Meadows, has sparked a potential boundary restructuring between Brookhaven Town and Port Jefferson Village. Developer Northwind Group wants to annex the project site on Baylis Avenue to Port Jefferson Village. 

This unusual move comes after Northwind’s initial attempt to secure a zoning change from Brookhaven Town for the 5.6-acre parcel at 16 Baylis Ave. failed amid community and official opposition.

Baylis Avenue, a dead-end street with only 6 properties, presents a unique situation. While physically located within the Town of Brookhaven, its sole access point is via Sheep Pasture Road, which lies within Port Jefferson Village.

If both the town and village consent to the annexation, Brook Meadows would be assessed by Port Jefferson’s land-use boards instead of those of Brookhaven’s.

However, Ira Costell, president of the Port Jefferson Station-Terryville Civic Association, said in a recent Newsday article that he thinks the annexation “has the feel of a backdoor move to circumvent both the town and the residents of Port Jefferson Station” to bypass town zoning laws. 

“If this was a constant process and policy now, we are eating away at the margins of what’s been long-term, long-established as the governmental jurisdiction. It still remains part of our school district. Everybody around that parcel will be Port Jeff Station residents. I mean, what’s the logic behind this,” Costell said.  

There is a public hearing, scheduled for March 6 at Brookhaven Town Hall in Farmingville, is poised to be pivotal in determining the fate of the Brook Meadows development and its implications for municipal boundary adjustments. 

Ultimately, the fate of the annexation and the Brook Meadows project will hinge on a joint decision by Brookhaven Town and Port Jefferson Village.

2025 Rocky Point Civic Association

On Feb. 3, the Suffolk County Water Authority delivered a presentation to the Three Village Civic Association, addressing water quality concerns and water main breaks.

SCWA Director of Water Quality and Lab Services Thomas Schneider said that the SCWA tests for more than double the number of compounds than required by the Environmental Protection Agency and endeavors to keep levels of these contaminants well under the maximum amount deemed safe. 

To filter the water, the SCWA integrates varying types of filtration systems depending on what contaminants are issues in that specific area. Commonly, the SCWA simply needs to add chlorine or adjust the ph level, but in other areas they filter with granulated activated carbon. 

“[At] each of the pump stations or well fields, the treatment at those is specific to what the water quality is at that particular well…its very distributed architecture rather than, as we referenced, in New York City where it all flows through one main source.” 

With contaminants that are especially difficult to extricate additional treatment is required. One such contaminant is 1,4-dioxane. 

Schneider said,”1,4-dioxane is a manmade chemical. It is used as a stabilizer in solvents and it is also found in a lot of consumer products, specifically laundry detergents, shampoos, and conditioners…this one is very difficult and expensive to remove.” 

In order to remove this contaminate the SCWA uses advanced oxidation procedure systems that use ultraviolet light to break down the 1,4-dioxane. Schneider added that the water authority has put in 16 of these systems so far, mostly in western Suffolk. 

In 2023, SCWA added two advanced oxidation procedure treatments in Northport, three in Halesite, one in Huntington Station, one in Kings Park and one in Huntington. 

According to the SCWA’s water quality reports from 2024, leeching from septic tanks and runoff from fertilizers, and pesticides were common likely sources of inorganic compounds.

In 2024, the SCWA added a new well and a GAC system at Stem Lane and Oxhead Lane. 

“Any disruption in the continuity of water mains or sometimes it could be a surface line. So it could be anything from a small break in the water main or a larger blowout of the water main. Sometimes it is a small trickle bubbling up from the ground,” said Director of Construction/Maintenance Brendan Warner. 

Water main breaks are caused by age or from outdated materials. Since Dec. 1 SCWA has already recorded 300 water main breaks, the second most in the last 10 years during this time. The average for the whole year is 500 breaks. Weather circumstances also play a factor in causing a main break; the freezing and thawing of soil and rapid temperature changes put stress on the pipes. The majority of the water main breaks happen to pipes made out of cast-iron, which are over half of the mains in the county. 

John Marafino, customer growth coordinator, urged civic members to reexamine their water use, get their irrigation systems checked and enact habits that limit water use, both helping conserve water and decreasing the water bill. 

“We have a sufficient but not limitless supply of water,” he said. “Watering everyday is not necessary to keep a green and healthy lawn.”

The Suffolk County Water Authority will host the next installment of its WaterTalk series of educational forums in collaboration with the Three Village Civic Association on Monday, February 3 at 7:30 p.m at the Setauket Fire Department, located at 190 Main Street In Setauket. This event provides an opportunity for residents to learn more and ask questions about their drinking water.

“It’s important that we engage directly with our customers and the local business communities across Suffolk County,” said SCWA Chairman Charles Lefkowitz. “Partnering directly with the Three Village Civic Association gives us an opportunity to meet with customers who we may not be able to reach otherwise. When two years ago, a significant development threatened to reshape the character of his tight-knit community dramatically, Ira Costell knew he had to act. 

As the recently elected president of the Port Jefferson Station/Terryville Civic Association, Costell became more determined than ever to ensure his neighbors’ voices were heard.

“I figured, this was an opportunity for me to pitch in and try to do my best to give voice to those issues that I felt some of my neighbors and myself were concerned about,” Costell said.

Over the past two years, Costell has done just that, reinvigorating the Port Jefferson Station/Terryville Civic Association and transforming it into a powerful platform for community advocacy. 

“I try to do it to the best of my ability. It’s a learning experience, but I think I’ve grown into the position, and [I] do my best to be an honest broker so that it’s not just about my opinion. I really try to facilitate what I think the group is trying to say,” Costell said.

Through Costell’s leadership, the organization has seen a surge in engagement. It has over 200 people on its mailing list, over 50 voting members and countless other community members who show up at meetings to voice their concerns. 

This grassroots mobilization has allowed the civic group to have a tangible impact on key issues facing the area, from influencing the outcome of a contentious rezoning proposal to securing a commitment for a comprehensive traffic study, all completed under Costell’s leadership.

While the association has accomplished many things under Costell’s leadership, his decades-long commitment to community service extends far beyond the organization.

“I have a background of giving service to protecting the environment. I was the former chair of an environmental commission in the county of Suffolk,” Costell said. “I [also] continuously give service as a family advocate for people struggling with problems with drugs and alcohol,  connect people to treatment and give them help, and I try to educate and assist families that are struggling with loved ones who are challenged with the disease of addiction,” Costell continued. 

Costell’s dedication to his community has not gone unnoticed. His tireless efforts and passionate advocacy have earned him the respect and admiration of his peers and neighbors.

“Ira Costell goes about his business in a quiet way. His planning background and decades-long residency in Port Jefferson Station and Terryville are priceless. He uses both to assist in his decision-making as it pertains to our community,” Lou Antoniello, treasurer of the Port Jefferson Station/Terryville Civic Association, said. 

Costell’s ability to galvanize community support and his commitment to addressing local concerns have significantly impacted the Port Jefferson Station/Terryville community. His leadership has not only revitalized the civic association but also empowered residents to actively participate in shaping the future of their neighborhood.

As Costell continues to serve his community, he inspires others to get involved and make a difference. His story is a testament to the power of individual action and the importance of community engagement at every level.

Savion Energy representatives stood before the Three Village Civic Association membership Monday, Nov. 4, to present their proposed battery storage facilities in East Setauket. Savion is a Shell Group portfolio company that develops utility-scale solar and energy storage projects. 

One project is proposed for a lot off Sheep Pasture Road, while another location would be between Parsonage Road and Old Town Road. 

Environmental benefits 

These proposals arrive in the midst of a statewide effort to increase green energy sources and transition away from fossil fuels. In 2022, Gov. Kathy Hochul (D) doubled the state’s energy storage goal. Further, the Climate Leadership and Community Protection Act, signed by Gov. Andrew Cuomo (D) in 2019, aims for 100% zero-emission electricity by 2040. 

These battery storage facilities is one among many being proposed across Long Island as power plants like the fossil-burning plant in Port Jefferson close. 

Savion’s facilities will consist of containers of lithium-ion batteries that store excess energy during peak hours and discharge electricity as needed. The batteries, which have a life of about 20 years, will be charged and discharged on a daily basis but would be especially useful during increment weather when renewable energy sources are unreliable. 

The batteries would take eight hours to charge and allow Long Island to ease its reliance on nonrenewable energy. The transition is intended to diminish adverse environmental effects by lessening greenhouse gas emissions. 

Location and safety 

The location is one of the major topics of contention. The locations are in close proximity to neighborhoods, making some residents uneasy.

Nicholas Petrakis, senior consultant of consulting firm Energy Safety Response Group, assured civic association members that scrupulous measures were instituted to minimize the chances of thermal runaway. This process occurs when a damaged cell releases heat and gasses, thus triggering the same reaction in nearby cells. 

James McDaniel, senior battery storage engineer at Savion, said their systems are containerized and “designed to burn themselves out” and “fail safely”. The sites will be remotely monitored constantly by a team of experts, Petrakis said, and there is a sensor system that would notify the fire department and shut down the battery if anything is amiss.

Toxic off-gassing is a possibility — one that Petrakis said is a possible effect of most residential fires as well. Many present were apprehensive by this prospect. Further, the water used to counter any fires was a cause for concern, but Sean Flannery, senior director of permitting & environmental at Savion, said that “water runoff has not shown to be an issue” and that it will be contained on the property. 

Residents from across the Island were present at this meeting, hoping to learn more about the battery storage systems that are proposed in their own towns. Many questioned the location, asking why it was necessary to install the facilities in such a dense area. 

“Why would you consider putting something like this in this dense area?” one man asked. “The fact that in your proposed pictures you can see people’s houses doesn’t instill support.” 

Indeed, the buffer wall intended to keep the noise to the 50 decibels allowed in the Town of Brookhaven code is visible in a picture of what Savion expects each site to look like from a surrounding residential area. 

William Miller, managing partner at Clearview Consultants, explained that the project needs to be close to the electrical load it serves. Savion plans to lease the land for both sites. 

County Legislator Steve Englebright (D-Setauket) and town Councilmember Jonathan Kornreich (D-Stony Brook) empathized with their constituents. Englebright, who throughout his career has supported environmental initiatives, said the locations have been historically difficult places to fill, given the zoning as light industrial. 

“Something that is environmentally complicated and potentially harmful is not anything new to this area,” he said. Although he said he sympathizes with “all these correct uncertainties,” he added that residents have “to understand the larger context of what’s coming at us” in regards to the changing environment. 

In response to a question of who will bear the financial burden of damages in the case a fire hypothetically causes damage to surrounding properties, Thom Rainwater, director of development at Savion, said, “In the case of an incident the company will be responsible. Full stop.”

Whenever Steve Englebright, 5th District county legislator (D-Setauket) and geologist, is asked about the East Beach bluff stabilization project, chances are he will start by explaining the big picture of bluff erosion on the North Shore of Long Island. 

“We [Port Jefferson] are at the doorstep of the greatest amount of erosion of the entirety of the North Shore,” he said to a rapt audience of about 40 people at the Port Jefferson Civic Association meeting Oct. 14.

Englebright spent 40 minutes in an educational deep dive about the shoreline’s composition and history, focusing on how erosion along the 50 miles of the North Shore impacts the village-owned sliver of bluff at the East Beach.

The meeting represents another moment in the ongoing debate among residents and village officials about the project strategies and costs. Mayor Lauren Sheprow, trustee Xena Ugrinsky and several members of the Port Jefferson Citizens Commission on Erosion were present. 

Using a whiteboard and marker, Englebright diagrammed how thousands of years of erosion have shaped and reshaped the shoreline. The audience gasped as he recounted the 1904 Broken Ground Slide, in which almost a mile of land just east of Northport let loose and fell into the Long Island Sound in one day. 

“The reason I want you to get the big picture is that this is a very unstable shoreline. The basic premise of stabilizing it for a given property [the country club] is mission impossible. Because any given little property is part of a larger dynamic,” he said. 

Englebright explained that erosion of the North Shore is accelerating because of our overheating oceans, producing more powerful and frequent tropical storms, further destabilizing the area. “[Bluffs] are not cemented together, so it doesn’t take much to disturb them — like a hurricane. They come apart easily,” he said.

“The county club was unwisely [decades ago] placed too close to the bluff edge,” he said. In the long term, more than just tennis courts will be in harm’s way.” 

“What does this all mean?” 

“We have to ask some serious questions when we get involved in spending millions of dollars,” he said. 

Weighing the pros and cons

Englebright shifted the conversation from a big picture discussion about coastal erosion to a conversation about the project’s immediate and long-term goals.

“I think we’ve already spent something like $5 million in a community of 8,500 people. Do the math: It’s already a significant investment, much of which has already been at least partially compromised in just a couple of seasons,” he said.

He added: “It’s really a cost-benefit analysis that has to be made.” 

Cost update 

Village treasurer, Stephen Gaffga, told TBR News Media in a follow-up phone interview that the costs for Phase 1 of the East Beach Bluff Stabilization project — which included the construction of a large rigid wall already installed at the base and bluff face plantings — have reached $5.3 million. 

Additional costs of $640,000 related to engineering designs and administration bring the total cost to $6 million for Phase 1.

According to the treasurer, the village is currently negotiating with the company that installed the Phase 1 bluff face plantings to determine coverage of the costs for the work destroyed during last winter’s storms. 

Phase 2, the upper wall project — which includes installing a rigid wall with a steel plate at the crest of the bluff — will be partially funded by federal taxpayer dollars as a $3.75 million FEMA grant. Village officials announced final federal approval for this grant money last month. Local taxpayer dollars will fund the remaining Phase 2 expenses. 

According to the treasurer, village officials will better understand the total costs of Phase 2 once the village bids for the work of constructing the upper wall. 

Village trustees approved a $10 million bond resolution in 2021 to fund the project (phases 1 and 2) overall. To date, $5.2 million of the $10 million approved has been borrowed. 

Additional potential costs to date include a possible drainage project at the bluff’s crest, and additional expenses related to repairing recent storm damage to the bluff face. 

Sheprow told TBR that the village is exploring possible additional grant funding to supplement identified additional costs. 

Relocating Port Jeff Country Club

“The bad news is that there’s no single solution,” Englebright said. “The good news is that you [the village] own 178 acres due to the wise investment by the mayor’s father, former mayor Harold Sheprow, made in [1978].” 

“That gives you the ability to relocate the building,” he added, referring to Port Jefferson Country Club.

Englebright suggested that project options be costed out over time and compared before more is done. He would like to see more than engineering expertise weigh into decisions about the project. “Engineers will always tell you they can build anything,” he said. 

He envisions a retreat scenario as done in phases or possibly all at once. “But those decisions have to be costed out,” he said. 

Englebright ended his lecture by commending the current mayor. “I can tell you this, I have met with the mayor and she is doing her homework,” he said.

The next civic association meeting will be held Nov. 11 at 6.30 p.m. at the Port Jefferson Free Library.

The Three Village Civic Association is hosting a community forum on Monday, September 9 at 7:30 pm at the Setauket Firehouse, 190 Main Street, Setauket to discuss future plans for Setauket Harbor Park.

The current small park in downtown Setauket, which is easily recognizable with its Kiwanis metal bridge spanning the pond, is about to expand with the Town’s recent acquisition of the East Setauket Automotive property.  The Town and the Three Village community now have a unique opportunity to create a park that helps to define and revitalize our downtown area.

There will be several speakers at Monday night’s meeting to discuss the park’s redevelopment. Suffolk County Legislator Steven Englebright, who as the former New York State Assemblyman provided funding to expand and improve the park, will be on hand to share his thoughts on the parkland.

And Joseph Betz, a local architect, professor and former chair of the Department of Architecture & Construction Management at Farmingdale State College, SUNY, will discuss conceptual design solutions to foster a sense of place and community at this site. Professor Betz will also examine the existing architectural and historical characteristics of the Setauket community, as well as other public spaces in the Three Village area, to help foster an understanding of a successful plan for the park’s redevelopment.

Town of Brookhaven Councilmmember Jonathan Kornreich will be in attendance to explain the importance of the park to the future of the Three Village community and his role in creating a new public space for all residents.  

The meeting is open to the public and attendance is encouraged to help the civic association and local elected officials to develop plans for the new, expanded harborside park.

Cornerstone Kings Park, a 50-unit luxury apartment building proposed for the corner of Meadow Road and Indian Head Road in Kings Park, was discussed at the Smithtown Board of Zoning Appeals public hearing on Aug. 6.

The 44,883-square-foot project would sit outside of the LIRR train station and would be part of the Kings Park downtown revitalization effort.

The proposed project necessitates a special exception as the surrounding area is currently zoned as commercial-business & industrial. A vacant restaurant pad site would need to be demolished if the project is to be built.

In order to progress and be considered by the Smithtown Town Board, the Smithtown Zoning Board of Appeals must approve the special exception.

The zoning board doesn’t anticipate making a recommendation to the Town Board until the Smithtown Comprehensive Master Plan is adopted, which would change the zoning of the area to transit oriented development (TOD). Further, the zoning board expressed dissatisfaction with several setbacks, which they deemed deficient even if the plan is adopted. The zoning change to transit oriented development would alter the minimum requirement for a setback.

Legislator Rob Trotta (R-Fort Salonga) spoke at the public hearing. “I am all for building something on this property,” he said. “Make no mistake about it. But 50 units in the parking lot of a shopping center is ridiculous.”

Trotta went on to suggest making a portion of the units co-ops or condominiums, an idea he has integrated in a resolution he designed to increase home ownership. The resolution was shot down in a Suffolk County Economic Development, Planning & Housing Committee meeting.

The size and magnitude of the project is one of the chief factors of concern for many. One constituent said, “I used to work in Queens and I like to come home to a backyard and a different style of life … it will kind of diminish and ruin what we are trying to have here. This kind of deviates from that kind of thinking.”

Another member of the community was eager for the project to provide more housing opportunities for the aging generation and to economically boost the downtown area.

Indeed, the developers market the project as a step towards fulfilling the goals listed in the Revitalizing Downtown Kings Park Action Plan which was developed by The Kings Park Chamber of Commerce and Kings Park Civic Association in 2016.

“Utilizing the Revitalizing Downtown Kings Park Action Plan, Terwillliger Bartone, with the Cornerstone Kings Park project, fills an important role of meeting the desires of the plan, from parking to transit oriented development to design and more” the Cornerstone Kings Park website reads.

After receiving criticism from citizens, the developers, Tanzi Properties LLC and Terwilliger & Bartone Properties, made several adjustments to the proposal, including decreasing the stories from four to three and supplementing above ground parking with an underground garage.

The developers expect the project to bring in $2 million annually in discretionary spending. Furthermore, their traffic study indicated that “it is the perfect complement to what is already existing in the area,” said the lawyer for the developers, Garrett Gray of Weber Law Group.

Gray said in his presentation that at peak hours, the parking is not expected to exceed 77% capacity.

Cornerstone Kings Park is one of the projects being considered for the $10 million Smithtown-Kings Park has received from the state for its downtown revitalization.

The application is still under review; the Zoning Board will more seriously consider making a recommendation once the Smithtown Comprehensive Master Plan is adopted, which is expected to occur within the coming months.
