A Smithtown garbage contractor has been sentenced for defrauding the Town of Smithtown for $222,000.

The scheme entailed illegally passing off over the course of several years consumer waste from locations across Long Island as commercial waste generated by businesses in the Town of Smithtown. 

“These defendants were stealing money from the taxpayers in the Town of Smithtown and from their own hardworking employees,” said Suffolk County District Attorney Tim Sini (D) at a Sept. 20 press event following the sentencing.

Mario Garofalo, 61, of East Northport, and his cousin Robert “Bobby” Garofalo, 64, of Kings Park, each pleaded guilty to felony charges May 13 for attempted enterprise corruption. The corporate entity, V. Garofalo Carting Inc., also pleaded guilty to enterprise corruption. The three defendants were sentenced by Suffolk County Supreme Court Justice William J. Condon to conditional discharges, which include restitution payments of $222,000 to the Town of Smithtown. The case also found that the business had violated prevailing wage laws and was ordered to pay $32,000 to underpaid company employees.

The Garofalo attorney did not respond to a telephone request for comment. Details in the plea agreement show that the company forfeited $1.1 million in cash plus assets that include a front end loader and a metal container. Payments were made to the town from that forfeiture.  The remaining assets were used to cover court costs and other public safety initiatives. 

The case, according to the DA, was an extremely complex investigation and prosecution. 

In 1990, New York State ordered most Long Island landfills closed, according to the town. Consequently, the town has paid Covanta Waste Management for the disposal of commercial waste from certain businesses operating within the town. To be acceptable, the commercial waste must be generated from known businesses within the town, registered by unique accounts with the town, and the registered businesses must pay fees and receive a unique medallion identifying the establishment as part of the plan. Carting companies, including Garofalo Carting, submit a manifest each time Smithtown commercial waste is brought to Covanta, attesting to the contents.

The investigation revealed that the Garofalos and their company repeatedly disposed of waste at Covanta’s facility in East Northport that was collected throughout Long Island from their customers, including through roll-off containers, then falsely attesting that the waste was solely Town of Smithtown commercial waste. 

In total, the investigation found that the Garofalo corporation unlawfully avoided paying $222,000 in fees, which were instead paid by the town as a result of the scheme.

“That’s $222,000 in residents tax dollars that these defendants pocketed for no reason other than their own greed,” Sini said. 

The defendants profited from the scheme by falsifying business records, including their garbage disposal manifests, and submitting them to the Town of Smithtown for payment, the DA stated. The defendants also profited from the fees collected from their private customers for both garbage pickup as well as roll-off container rentals, according to the DA.

“Today’s verdict is the product of an intricate intergovernmental investigation, which was exceptionally well litigated,” said town Supervisor Ed Wehrheim (R). 

During the course of the investigation, the Town of Smithtown also referred to the District Attorney’s Office the issue of prevailing wage claims by employees of Garofalo Carting. 

With the criminal enterprise effectively shut down, the DA said justice has now been served for Smithtown residents.

“Enterprise corruption cases are often extremely complex, and certainly require a lot of hard work and dedication by investigators and prosecutors, but our office is determined,” Sini said. “We are committed to dedicating resources and utilizing innovative strategies to seek justice in each and every case, and that’s exactly what was done here today.”

This case was prosecuted by county Criminal Investigations Division Chief Megan O’Donnell and Assistant District Attorney Lucie Kwon, of the county Financial Investigations & Money Laundering Bureau.

“I would like to commend the detectives who worked diligently on this case and I hope our strong partnership with the Suffolk County District Attorney’s Office sends a message that fraudulent business practices will not be tolerated in Suffolk County,” said county Police Commissioner Geraldine Hart.

The Town of Smithtown’s six-year contract with Garofalo Carting, which was from 2014 to 2020, is now void, according to the supervisor’s press office. The Town Board has instead hired National Waste Services, of Bay Shore, to replace services for garbage pickup at its Sept. 3 meeting. National Waste Services recently purchased Garofalo Carting and has retained the Garofalo trucks and employees, according to Smithtown’s Attorney Matthew Jakubowski. 

The town paid $2.1 million to Garofalo Carting in 2018 for its services, which included garbage  pickup for six of the 12 solid waste districts in the town. The contracts are based on weight of waste collected annually.

Suffolk County District Attorney Tim Sini (D) was joined by the New York State Department of Environmental Conservation and the Suffolk County Police Department on Sept. 23 to announce the sentencing of a self-proclaimed “dirt broker” who was indicted as part of the District Attorney’s Office’s Operation Pay Dirt investigation into an illegal dumping conspiracy on Long Island.

“The defendant, with no regard for the safety and well-being of Suffolk County residents, facilitated the dumping of solid waste on residential properties, properties near schools, and other sites,” Sini said. “Many of the sites contained materials that were hazardous or acutely hazardous. This is a major issue for those individual homeowners who were affected and a major issue for the general public.”

Anthony Grazio, aka Rock, 54, of Smithtown, pleaded guilty on May 2 to two counts of criminal mischief in the second degree, a D felony; two counts of endangering public health, safety or the environment in the third degree, an E felony; conspiracy in the fifth degree, an A misdemeanor; and operating a solid waste management facility without a permit, an A misdemeanor.

Grazio was sentenced today by Suffolk County Court Judge Timothy Mazzei to two to four years in prison. He was also ordered to pay restitution in the amount of $500,000 for a crime that the DA has previously stated is the state’s largest illegal dumping case.  

In February 2018, the DA’s office, DEC and county police department began an investigation into a conspiracy to illegally dump solid waste in various locations across Long Island. The months-long investigation, known as Operation Pay Dirt, involved the use of electronic surveillance, including court-authorized eavesdropping, and physical surveillance. The investigation resulted in a 130-count indictment against 30 individuals and nine corporations for illegally disposing of solid waste at 24 locations. Grazio’s then 19-year old son Anthony was among the 30 people indicted in the case, which was unsealed in November 2018.

Some of the more than 24 identified locations contained acutely hazardous and hazardous materials including pesticides and the metals arsenic, beryllium, cadmium, cobalt, chromium, copper, lead, nickel, zinc and mercury and pesticides.

Between January and July 2018, as part of the illegal dumping conspiracy, Grazio would act as a dirt broker by arranging for locations where trucking companies could illegally dispose of solid waste. Grazio posted advertisements on the website Craigslist and on OfferUp, a marketplace app, for “Clean Fill,” or material that could be used for residential landscaping projects. He also solicited homeowners over the phone and in person for locations to use for dumping.

Grazio would then coordinate with the owners or operators of trucking companies and solid waste management facilities to have solid waste illegally dumped at those properties.

“This sentencing should serve as a reminder that there is a cost associated for those who engage in illegal dumping for financial gain,” Suffolk County Police Commissioner Geraldine Hart said. “The Suffolk County Police Department is committed to working with our partner agencies to apprehend those who commit environmental crimes in our county and Operation Pay Dirt is an example of the success of our collaborative efforts.”

The commissioner also said that the department is not only committed to serving our residents but also dedicated to protecting the land that makes our communities a great place to live.

Operation Pay Dirt was part of a statewide DEC law enforcement initiative known as Operation TrashNet. To date, Operation TrashNet has led to the discovery of more than 100 illegal dumping sites throughout New York’s downstate region, including 44 in Suffolk County, and resulted in 582 DEC-issued tickets involving 40 trucking companies.

“Illegal dumping poses a serious threat to our environment, and New York will not allow businesses to continue to harm the state’s environment and its citizens while putting profits over public health,” DEC Commissioner Basil Seggos said. “I commend the work of DEC’s officers and the Suffolk County District Attorney’s Office in bringing this case to fruition.”

This case was prosecuted by assistant DAs Adriana Noyola and Laura Sarowitz of the Enhanced Prosecution Bureau and former assistant DA Luigi Belcastro.

As a New York State ban on flavored e-cigarettes goes into effect Oct. 4, community members and officials on Long Island are hopeful that this will be a good first step in curbing youth smoking. 

The ban comes in the wake of several deaths experts have linked to e-cigarettes. According to the U.S. Centers for Disease Control and Prevention, more than 450 cases of lung illness nationwide have been associated with e-cigarette products containing nicotine or THC. A number of those cases have occurred on Long Island.

Suffolk County Legislator William “Doc” Spencer (D-Centerport) said he believes the ban is a great first step in limiting access of addictive products to young people. 

“I think [the ban] is wonderful news,” he said. “We have seen a disturbing trend, we know this stuff is not good for you.”

Spencer cautioned that they have to be prepared for the unintended consequences of such a ban, particularly he said he wants to make sure that there are support systems and resources available to addicted individuals who may seek help. 

“I want to make sure there are plans for parents who may have a child who is addicted [to e-cigarettes],” he said. “I will be working with the health department on a plan to deal with this.”

Despite the ban, Spencer believes there’s more to do to curb e-cigarette use and vaping, pointing to the ubiquitous e-cigarette product Juul as another concern. 

“One Juul pod is equivalent to smoking a pack of cigarettes,” he said. “You have kids smoking two or three of these pods.”

The legislator also mentioned that there are a number of loopholes on the state and federal level that he feels still need to be addressed. 

There has been an increase in use of e-cigarettes in middle and high school students in recent years. Port Jefferson School District in particular is hosting a vape seminar at its next school board meeting Oct. 15. District officials are hopeful that the ban prevents further teens from thinking of vaping.  

“Any step in the right direction is a good step,” said Paul Casciano, superintendent of the Port Jefferson School District. “Unfortunately, people, including teens, were duped into believing that vaping was a safe alternative to smoking. There is still much more to be done including discussions about peer pressure and the fear of not fitting into a group.”

Casciano said the district has provided information and held numerous presentations on vaping for students and parents. Last December, the district took part in a county pilot program called Vape Out where high school students watched a presentation on the health hazards of vaping and were given advice on how to refuse a hit. They then shared the lessons they learned with other classmates and students in the middle school. 

“No singular program or curriculum is going to eliminate vaping among teens however constant and consistent messages from many voices may begin to stem the tide.” Casciano said.

Vape shop and small business owners have long been opposed to legislation on the sale of e-cigarettes. Back in December 2018, at a public hearing to discuss legislation that would have banned the sale of flavored e-cigarettes in Suffolk County, owners said the issue isn’t the flavors but rather an issue of access and enforcement of the sale of tobacco products to individuals over the age of 21. 

Alex Patel, owner of the Rocky Point Smoke and Vape Shop, is concerned about the looming ban on flavored e-cigarettes as it is a popular item purchased at vape shops. 

 “Of course, it is going to affect our business,” he said. “We could close down.” 

Dr. Rachel Boykan, clinical associate professor of pediatrics at Stony Brook Medicine, said while she is supportive of the new ban, she thought it would be better if it included menthol. 

“We know that youth are attracted to these products because of the flavors; this should decrease their appeal,” she said. 

In addition, Boykan mentioned some ideas to further curb youth smoking.    

“We need to regulate advertising, which teens respond strongly to and which is ubiquitous and unregulated, compared with advertising of cigarettes, which is restricted,” she said. “We need to decrease availability by including e-cigarettes in Tobacco 21 legislation … include e-cigs in the same indoor air laws as combusted tobacco.” 

Boykan said she and her colleagues have dealt with many children who vape and they try to educate them on the harm associated with it. 

“We try to educate them about the risks of the flavorings and heavy metals such as copper, in the aerosol, and the recent severe lung illnesses and deaths — which we don’t yet understand,” she said.

The professor provided some advice to parents if they think their child may be vaping. 

“They may smell a fruity smell, they may notice signs of nicotine addiction such as agitation, anxiety, or if they are using marijuana as well,” she said. “The best approach is to establish trust, ask without judgment and be supportive if a child admits to having a nicotine addiction — and take them to their pediatrician for help.”

As part of a two-week undercover sting operation dubbed “Operation Vape Out,” Suffolk Police found that more than two dozen business had been illegally selling e-cigarettes and tobacco to individuals under 21.

The operation, which occurred from Sept. 4 through Sept. 18. It resulted in 32 violations issued to employees of those businesses.

“After years of a steady decline in nicotine addiction and cigarette sales, the introduction of vaporizers has reversed this positive trend so that nicotine addiction is once again on the rise,” said Suffolk County Executive Bellone (D). “This is unacceptable and will not be tolerated in Suffolk County. In a coordinated effort with the Suffolk County Police Department and the Department of Health, a sting operation uncovered 30 establishments that allegedly sold these products to minors and arrests have been made.”

In 2014, 73 percent of high school students and 56 percent of middle school students who used tobacco products in the past 30 days reported using a flavored tobacco product during that time, according to the Center for Disease Control and Prevention.

Some local businesses that were charged with the sale of e-cigarettes or liquid nicotine to persons under 21 were:

  • VaporFi, located at 229B Smithtown Blvd., Nesconset
  • Aroma Smoke Shop, 6 East Main St., Smithtown
  • Island Wood Cigars and Vapors, located at 298 Maple Ave., Smithtown
  • James Vape Shop, located at 448 Lake Ave., Saint James

The following businesses were charged with unlawfully dealing with a child 2nddegree:

  • 76 Gas, located at 1714 New York Ave., Huntington Station
  • The Barn, located at 2020 Jericho Turnpike, East Northport
  • Hemp Clouds , located at 1515 Route 25, Selden
  • Hookah City, located at 202 Main St., Port Jefferson

“The department will continue to target the issue of vaping with increased education and enforcement efforts,” said Suffolk County Police Commissioner Geraldine Hart. “We urge businesses to check IDs when selling vape products and abide by the ban on the sale of flavored e-cigarettes because we will continue to check for compliance.”

In addition, Bellone announced the expansion of the Health Department’s vaping prevention and intervention program, known as VAPE OUT!, by adding community youth vaping cessation classes. The program also includes peer and parent education forums and alternatives to suspension enforcement programs.

Over 200 high school students were trained as peer educators and they presented VAPE OUT! to over 1,840 middle school students, Bellone said in a statement.

 

It was a scoreless game Sept. 23 for the first 60 minutes as the Comsewogue boys soccer team looked to put more points on the win column in the early season, but the Bulls of Smithtown East peppered the scoreboard with three unanswered goals in the final 18 minutes to put the game away. Senior Noah Lavrenchik scored for the Bulls as did junior midfielder Nicholas Zodda. Sophomore forward Liam Stanley rounded out the scoring to lift the Bulls to 4-0-1 in league IV, 5-0-1 overall. The Comsewogue Warriors currently sit at 2-3.

Comsewogue hit the road Sept. 25 against East Islip. Smithtown East looked to build on their winning momentum when they took on Deer Park at home — also on Sept. 25. Game times are 4:30pm and 4:00pm respectively.

On Sept. 22, visitors to the Smithtown Heritage Society had the opportunity to explore the organization’s grounds during its annual Heritage Country Fair.

Attendees enjoyed live music, traditional dancing, crafts, pumpkin painting, horse riding demonstrations, a petting zoo and more.

Visitors also had the opportunity to learn about fire engines and work trucks, see a blacksmith at work, climb into a DeLorean inspired by the “Back to the Future” car and explore the historic homes found on the property.

During the first week of September, the nation watched as Hurricane Dorian ravaged the Bahamas. Thousands of people have been left without homes, and many have also lost contact with their pet dogs. Some animals were lost in the storm, while other dogs may have been left behind as families attempted to reach safety.  

Animal organizations estimate that hundreds of dogs in the Bahamas are now in need of being brought to safety and provided with medical care and food. 

Guardians of Rescue, a Smithtown nonprofit that specializes in bringing together people and dogs in need, has stepped in to help. It’s bringing in the stranded dogs on chartered planes from the Bahamas to safe spots in Florida and New York.

The animal rescue organization reports that it initially brought back its first 30 dogs Sept. 9. A second flight took off 24 hours later and more flights are scheduled in the days ahead, the group said, until all of the abandoned animals are in safe haven in the United States. They initially planned to eventually relocate 98 pets, but now have created a rescue network to save more animals. 

“We are no strangers to helping dogs in dire situations, this is exactly why our organization exists,” explained Robert Misseri, president of Guardians of Rescue. “We will do everything we can to help as many dogs as we are able to, but we can’t do it without the help of the public. This is going to be a very costly endeavor, so we can use all the financial assistance we can get.”

The organization has started a website fundraiser for the cause. It’s goal is to raise $20,000 and has so far received close to $6,000 in donations.

The organization is working with Chella Phillips, a Nassau, Bahamas, resident, who manages The Voiceless Dogs of Nassau. She took in nearly 100 stray dogs when the storm was approaching to provide them with a safe place. Her story went viral in the news and on social media. 

The Smithtown organization has also teamed up with two other nonprofits for the mission, Animal Aid USA, based in New Jersey, and Animal Wellness Foundation in Los Angeles to help prepare and load the dogs for a flight to Florida. The relationship has allowed for transportation of the dogs to a safe place and has enabled the people in the Bahamas to take in more abandoned dogs.  

The networks’s overarching goal is to take in displaced pets and either return them to their owners or place unclaimed pets up for adoption, according to Lorenzo Borghese, founder and president of Animal Aid. Animals shipped to the U.S. are fed and receive a health examination and undergo a two-week quarantine until they find the animals permanent homes. 

“We are on a mission to help these animals, and we hope that the community will help support the mission,” said Misseri. “There are many dogs in need of food, medicine, shelter and permanent loving homes. Together, we can make a wonderful difference.”

Misseri added that animals that have already made the trip to America are still quarantined and not yet ready for adoption. People interested in adopting a pet should monitor the guardian website at www.guardiansofrescue.org. Misseri expects adoption information should be available in the days and weeks ahead.

Guardians of Rescue provides assistance to animals out on the streets. They are located in the Village of the Branch and also have a chapter in Miami, but they help animals in many places beyond their chapter locations. Their members are also involved with Paws of War, which helps train service dogs for veterans suffering from post-traumatic stress disorder.

It’s been 14 years since the world was first introduced to Alex the Lion, Marty the Zebra, Melman the giraffe and Gloria the hippo in DreamWork’s computer-animated comedy “Madagascar.” Since its release, there have been two sequels, a spinoff (“Penguins of Madagascar”) and more recently a stage adaptation.

The latter opened at the Smithtown Center for the Performing Arts last weekend in the form of “Madagascar A Musical Adventure Jr.,” a show for kids performed by kids, and the end result is a fabulous afternoon of live theater. Sitting in the balcony during last Saturday’s performance, I was quickly reminded of just how clever and funny and entertaining this story is.

Living the good life at the Central Park Zoo, Alex (Hunter Pszybylski), Gloria (Gianna Oppedisano) and Melman (Jacob Christie) help Marty (Thomas Lau) celebrate his 10th birthday. When asked to make a wish, Marty wishes he can go back to the wild (aka Connecticut). Moments later he escapes with “cute and cuddly” penguins, Rico (Ari Spiegel), Kowalski (Hannah Waller), Private (Laurie Kratochvil) and Skipper (Max Lamberg) who are determined to get back to Antarctica “where we belong, on the ice.”

When Marty’s friends go looking for him, the entire group is cornered in the halls of Grand Central Station by the zookeepers and tranquilized. When they awaken, they find themselves in crates on a ship headed to a wildlife preserve in Africa. When the penguins escape their confinement and seize the ship, their antics cause the crates to fall overboard and the four friends wash up on the shores of Madagascar.

There they are met by King Julien (Zachary Podair), his sidekick Maurice (Emily Warner) and a tribe of ring-tailed lemurs who hope that Alex can protect them from the terrible foosa, cat-like animals that “are always trespassing, interrupting our parties and ripping our limbs off!” However, when Alex’s stomach starts rumbling and the lemurs can only offer him seaweed on a stick, things take a turn for the worse.

Expertly directed by Tommy Ranieri, the young cast (19 in all) do an excellent job bringing the personalities of these zany characters to life in this musical about the importance of friendship.

The songs are executed perfectly with special mention to “Relax, Be Cool, Chill Out,” “Best Friends,” “Steak,” and the big dance number “Living in Paradise” with fresh choreography by Ryan Cavanagh.

Costumes are simple but cleverly designed by Ronald Green III with the outfits matching the zoo animal’s colors with an orange wig for Alex’s mane, while his monochromatic friend Marty sports a mohawk. The set, used from the current main stage production, features panels that change to reveal different scenery and the show uses fog and incredible sound effects in telling the story.

The finale, a rousing rendition of “I Like to Move It” led by King Julien himself, is the icing on the cake. Meet the main cast in the lobby after the show for photos and autographs.

Mark Gajewski a union operating engineer worked six months straight on clearing Ground Zero after the terrorist attacks.

Out of the twisted wreckage of two collapsed New York City skyscrapers, Mark Gajewski helped erect one of the most significant 9/11 artifacts: the steel Ground Zero cross.

The symbol touched people beyond the many emergency responders who found it a source of comfort and divine inspiration. For Gajewski’s only daughter, Crystal, the 17-foot cross is one small part of her father’s legacy. As an operating engineer, he helped clear away the World Trade Center debris. He died 10 years later from a rare form of lung cancer at the age of 52.

“As I’ve gotten older, I’ve realized that it isn’t an artifact or special memento that makes a person a hero, but their innate intent to help others,” Crystal Gajewski said. “My father may not have received a medal and he will not appear in any textbooks, but to me and those that knew him best, he was one of the great unsung heroes.”

Gajewski rushed to the scene four hours after the towers fell, his daughter said, and was one of the first people to assess the situation.

“He worked six months straight without coming home at Ground Zero, nine months total,” she said.

At Ground Zero, Gajewski endured unthinkable trauma, both emotional and physical. He found human body parts in the rubble at the site, his daughter said, including the hands, bound at the wrist, of a flight attendant. And when he came down with strange ailments and coughing, his daughter said that doctors initially were perplexed. Because of his untimely death, the 9/11 cleanup worker never saw his son Sean graduate law school and become an attorney for the U.S. Coast Guard. He never got to meet his first grandchild, Mia.  

Father Brian Jordan, from St. Francis Assisi church in New York City wants people to know that Mark Gajewski represents the thousands of union construction workers who completed the remarkable task of demolishing and removing the fallen building from the site. 

“You hear about the dedication and the sacrifice of the fire fighters and police officers, but not the talented union construction workers: the operating engineers, the electricians, the welders, and others who performed an incredible task on time and under budget,” Jordan said. He also calls them unsung heroes.

Mark Gajewski’s name and the names of more than 1,200 other responders are engraved on a shiny, black granite wall in the 9/11 Responders Remembered Park on Smithtown Boulevard in Nesconset. This year, 206 more responders’ names were inscribed. Last year 163 names were added. So, the effects of 9/11 are still mounting. All of them, uniformed and nonuniformed have died of a 9/11-related illness. As the list grows, so does the crowd that attends the annual 9/11 Responders Remembered tribute. More than 500 people gathered on Sept. 14 for this year’s event.

Nesconset resident John Feal, a 9/11 responder, served as demolition supervisor for the cleanup and had part of his foot amputated after a steel beam fell on it. The tireless advocate built the park with the help of others. He has said that he has been to more than 180 funerals for responders and wants to ensure that all the people who fell ill and lost their lives as a consequence of responding to the disaster are remembered for their sacrifices. “No Responder Left Behind” is his motto. The Nesconset park, he said, is unique because it’s inclusive. The names of responders who died are not excluded because of where they lived or what job title they held, or whether or not they wore uniforms. 

So, as the tragedy continues to take its toll, Crystal Gajewski and her family and the many other volunteers remain dedicated to preserving the honor and dignity of her father and all the other people who ultimately sacrificed their lives as a result of cleaning up the aftermath of the 2001 terrorist attacks. She serves as volunteer vice president of the 9/11 Responders Remembered Park with John Feal and has created a separate foundation Ski’s Open Heart in her father’s honor.

Crystal said she hopes that her father’s story and the foundation she created for him inspires others to look within themselves and find time and the desire to help others.
