Suffolk County Police arrested an East Setauket woman on Jan. 22 for Leandra’s Law for allegedly driving while intoxicated following a motor vehicle crash with two 14-year-old girls in her vehicle.

Alison Drain was driving a 2018 BMW X5 northbound on Old Town Road in East Setauket with her daughter and her daughter’s friend in the vehicle, when she attempted to turn left on to Sheep Pasture Road and crashed into a southbound 2004 Lexus RX330 at approximately 5:25 p.m.

When Sixth Precinct officers arrived at the scene, they determined Drain was allegedly intoxicated and arrested her. The two 14-year-old girls were treated for minor injuries at Huntington Hospital at their request. A passenger in the Lexus was transported to Stony Brook University Hospital for treatment of minor injuries.

Drain, 52, was charged with Aggravated Driving While Intoxicated with a Child Passenger 15 Years Old or Younger (Leandra’s Law), Felony Driving While Intoxicated and 2 counts of Endangering the Welfare of a Child. The BMW was impounded for evidence.

Detectives are asking anyone with information on the crash to call the Sixth Squad at 631-854-8652.

A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.

Suffolk County Police arrested an East Northport man on Jan. 21 for Leandra’s Law for allegedly driving while
intoxicated following a motor vehicle crash with his 11-month-old daughter in the vehicle.

Second Precinct police officers responded to a motor vehicle crash during which a 2021 Hyundai stuck
the rear of a 2020 Mazda on Elwood Road, at the intersection of Pulaski Road, at 6:40 p.m.

It was determined that the driver of the Hyundai, Matthew Gibney, was allegedly intoxicated. Gibney’s 11-month-old daughter was a passenger in the vehicle. The baby was transported by the Northport Fire Department to Huntington Hospital for evaluation. Gibney and the driver of the Mazda were not injured.

Gibney, 33, was charged with Aggravated Driving While Intoxicated with a Child Passenger 15 Years Old or Younger (Leandra’s Law) and Endangering the Welfare of a Child. The Hyundai was impounded for a safety check. Detectives are asking anyone with information on the crash to call the Second Squad at 631-854-8252.

A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.

Suffolk County Police arrested a woman on July 19 for Leandra’s Law for driving while impaired by drugs following a car crash in Commack.

Kristine Mazza was driving a 2005 Hyundai southbound on Harned Road, near Cutchogue Lane, when she rear-ended another vehicle at approximately 9:50 a.m.

When officers arrived, they determined that Mazza was under the influence of drugs. Her 4-year-old daughter was unharmed in the backseat of the vehicle.

Mazza, 33, of Smithtown, was transported to St. Catherine of Sienna Medical Center in Smithtown, and later transported to the Fourth Precinct where she was charged with Aggravated Driving While Intoxicated with a Child Passenger 15 Years Old or Younger (Leandra’s Law), Driving While Under the Influence of Drugs, Criminal Content 2nd Degree and Endangering the Welfare of a Child. Her daughter was released to a family member.

Mazza will be held overnight at the Fourth Precinct and is scheduled to be arraigned at First District Court in Central Islip at a later date.

Suffolk County Police last night arrested a man for Leandra’s Law for driving while allegedly intoxicated with his three children in the vehicle following a crash in Commack.

Ryan McDonald was driving a 2019 Nissan Pathfinder northbound on Townline Road, just south of Old Northport Road, when the vehicle left the roadway and crashed into a large boulder at approximately 7:10 p.m. McDonald’s three children, a 6-month-old boy, a 3-year-old boy and a 5-year-old girl, were in the backseat of the Pathfinder. Fourth Precinct police officers responded to the scene and determined McDonald was intoxicated.

McDonald and the children were transported to a local hospital. McDonald was treated for minor injuries. The children were not injured and were released to the custody of their mother at the hospital.

Fourth Squad detectives charged McDonald, 33, of Commack, with Aggravated Driving While Intoxicated with a Child Passenger 15 Years Old or Younger (Leandra’s Law), Driving While Ability Impaired by Drugs, and three counts of Endangering the Welfare of a Child. He is being held overnight at the Fourth Precinct and was scheduled to be arraigned at First District Court in Central Islip Aug. 19.

Suffolk County police arrested a Coram woman for Leandra’s Law after she was allegedly involved in a single-vehicle crash May 28 that injured her three children.

Tyleen Smith was driving a 2004 Saturn Vue northbound on West Yaphank Road when her vehicle left the roadway and struck a tree in front of 99 West Yaphank Road at 6:07 a.m. Smith had four passengers in the vehicle, including the three children.

Smith’s 11-year-old twins, a boy and girl, were transported to Stony Brook University Hospital for treatment of broken bones. Smith and her 8-year-old son were also treated at Stony Brook University Hospital for minor injuries. Front seat passenger Talisha Thomas, 43, of Bellport, was transported to Long Island Medical Center in East Patchogue for treatment of minor injuries.

Smith, 36, was charged with aggravated driving while intoxicated with a child passenger 15 years old or younger (Leandra’s Law) and three counts of endangering the welfare of a child. She will be held overnight at the 4th Precinct and will be arraigned at 1st District Court in Central Islip May 29.

Suffolk County Child Protective Services was notified.

Suffolk County police arrested a man for an alleged DWI after a traffic stop in Centereach in which there were three 14-year-old female passengers in the vehicle.

David Michels was driving a 2010 Toyota Corolla northbound on Stanley Drive when he was stopped for a traffic violation at approximately 6:30 p.m. May 24.

Michels, 46, of Centereach, was arrested and charged with allegedly driving while intoxicated, aggravated driving while intoxicated with a child passenger 15 years old or younger (Leandra’s Law) and three counts of endangering the welfare of a child.

The three 14-year-old passengers were released to family members at the scene.

Michels was held overnight at the 6th Precinct.

Suffolk County police arrested a Centerport man for driving while intoxicated with one stepson in the vehicle, after he was involved in a motor vehicle crash in Centerport Sept. 4 in which he hit another stepson with his car.

Scott Lipton was driving his 2017 Jaguar southbound on Laurel Hill Road when his vehicle struck his 13-year-old stepson, who was walking his dog, and then a pole at approximately 5:50 p.m.

The 13-year-old was transported by Suffolk County police helicopter to Stony Brook University Hospital for treatment of a broken leg. Lipton’s 9-year-old stepson, who was a passenger in the car, was transported by Centerport Fire Department to Huntington Hospital for treatment of non-life-threatening injuries. Lipton, 42 of Laurel Hill Road, was not injured. The dog was not injured.

Second Squad detectives charged Lipton with aggravated driving while intoxicated with a child passenger 15 years or younger (Leandra’s Law) and endangering the welfare of a child. He will be held overnight at the 2nd Precinct and is scheduled to be arraigned at First District Court in Central Islip Sept. 5.

Suffolk County Police arrested a Coram woman for driving while intoxicated with a child in the vehicle after she was involved in a motor vehicle crash in Centereach July 18.

Melinda Duncan, 56, was driving a 2014 Ford Focus southbound on South Coleman Road near Hettys Path when she struck a 1999 Chevrolet Suburban that was parked on the shoulder. Duncan and her 11-year-old grandson, who was in the backseat, were not injured.

Sixth Precinct Patrol officers arrested and charged Duncan with aggravated driving while intoxicated with a child passenger 15 years or younger (Leandra’s Law), driving while intoxicated and endangering the welfare of a child. Duncan will be held overnight at the 4th Precinct and will be arraigned at First District Court in Central Islip today.

Suffolk County Police arrested a man Feb. 25 for driving while impaired by drugs with a child in his vehicle after he was involved in a crash in Huntington Station.

Suffolk County Police Patrol units responded to 911 calls of a person driving erratically in a white Honda in the Huntington Station area. A short time later, police arrived at a two-vehicle crash between the Honda and a 1999 Dodge Pickup Truck at the intersection of Jericho Turnpike and Longfellow Road at about 2:50 p.m.

After an investigation, police determined the driver of a 2015 Honda Accord, Mathew Moscowitch, was operating a vehicle while his ability was impaired by drugs. There was a five-year-old boy in the back seat at the time of the crash.

Victoria Nathan, 49, of Kings Park, a passenger in the pickup truck, and the boy were transported to Huntington Hospital with non-life-threatening injuries.

Moscowitch, 33, of Staten Island, was charged with aggravated driving while intoxicated with a child passenger 15-years-old or younger, otherwise known as Leandra’s Law, felony aggravated unlicensed operation, endangering the welfare of a child, and possession of a hypodermic needle. He was arraigned at First District Court in Central Islip Feb. 26.

The investigation is continuing.

Suffolk County Police arrested a man for driving while intoxicated with his daughter in his car in Selden Feb. 11.

Alan Bauser was driving a 2008 Hyundai southbound on North Ocean Ave. and Middle Country Road, when he was observed by Sixth Precinct Patrol Officer Christopher Weiner failing to maintain his lane of travel, crossing the roadway’s lane marking and crossing onto the shoulder of the road numerous times at approximately 11:35 p.m. Officer Weiner initiated a traffic stop and conducted sobriety tests, which Bauser failed. Bauser also admitted to overusing his prescription medication. Bauser’s 12-year-old daughter was in the car.

Further investigation revealed the daughter had a Family Court Order of Protection requiring Bauser to refrain from misusing prescription medication in her presence. The daughter was released to a family member.

Bauser, 42, of Medford, was arrested and charged with driving while intoxicated, aggravated driving while intoxicated with a child passenger 15 or younger (Leandra’s Law), endangering the welfare of a child and second degree criminal contempt.

Bauser will be held overnight at the Sixth Precinct and was scheduled to be arraigned at First District Court in Central Islip on Feb. 12.
