The Golden Rule, a peace ship operated by Veterans for Peace, docked in Port Jeff on Friday, May 26, encouraging conversations about ending wars, raising environmental consciousness and promoting nuclear disarmament.

Over a dozen people welcomed the vessel into Port Jeff Harbor. As it arrived, crew members, led by Captain Steve Buck, symbolically asked permission to dock and come ashore from members of the Setalcott Nation. This Native American tribe had initially inhabited the land. 

Myrna Gordon, a member of the North Country Peace Group and coordinator of the docking ceremony, said plans for the event were in the works for over four months. NCPG had also collaborated with the South Country Peace Group and the Conscience Bay Quakers, among other local peace groups.

Veterans for Peace were looking for a North Shore harbor to dock their ship. When their original plans to bring their boat to Northport didn’t work out, Port Jefferson was suggested. 

“I jumped on board and said this is the most beautiful harbor on the North Shore,” Gordon said. “We have a park. We have all the facilities. We have an agreeable government who will willingly accept the boat for a few days.” 

After docking, Catherine Green, a representative of Suffolk County Legislator Kara Hahn (D-Setauket), read a proclamation in which the Suffolk County Legislature recognized the efforts of the crew of the Golden Rule in the cause of peace on earth. Town of Brookhaven Councilmember Jonathan Kornreich (D-Stony Brook) also presented a proclamation on behalf of Brookhaven, establishing the date as Veterans for Peace Day.

Breon Peace, United States attorney for the Eastern District of New York, announced this week the federal government settled upon terms for the future of the Lawrence Aviation Industries Superfund site, ending years of litigation. This agreement will enable the sale of about two-thirds of the 126-acre Port Jefferson Station property by a subsidiary of Suffolk County Landbank.

A 2019 trial had found Lawrence Aviation, with its former CEO and owner Gerald Cohen, in violation of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 and liable to the Environmental Protection Agency, among other claimants, for over $48 million.

This week’s announcement resolved the last unsettled question on the priority of claims against the property by New York State, Suffolk County and other agencies.

In a statement, Peace said the U.S. District Court approved a consent decree that allows for the sale and redevelopment of the Superfund site.

“This settlement will enable a previously contaminated property to be put to uses that will benefit Port Jefferson [Station] and the greater Suffolk County community,” the U.S. attorney said. “In the process, the EPA will recover at least some of the enormous costs expended in remediating the LAI Superfund site and protecting our environment from hazardous substances.”

Suffolk County Legislator Kara Hahn (D-Setauket), whose 5th Legislative District includes Port Jefferson Station, has been involved in the deliberations over the site. Reached by phone, she confirmed plans are ahead for demolishing the remaining derelict buildings on the property, an initiative subsidized by the federal government. “The first real step we’re going to see is the demolition of the buildings,” she said. “That is long overdue.”

The county legislator regarded the recent developments as a victory for Suffolk County taxpayers who “have been shouldering the burden of the taxes for the property for decades,” she said.

Hahn indicated that, under the plans, the site would be partitioned into three sectors — a third designated for a railyard to facilitate operations for the Metropolitan Transportation Authority, another third for an industrial solar farm and the final third for open space. The county legislator added that cleanup efforts, which include two pumping and filtration systems, will likely linger on for decades.

She tied plans for the Lawrence Aviation property to the decades-long proposal to electrify the Port Jefferson Branch of the Long Island Rail Road, referring to the combined efforts for the two projects as “transformational for the region.”

“This is a very early step in the process for electrification,” Hahn said, adding, “The full-scale electrification of the branch is at least a decade away, but it would never happen if we weren’t able to rehabilitate this Superfund site.”

The newly reconfigured executive board of the Port Jefferson Station/Terryville Civic Association went straight to work Tuesday night during the body’s general meeting April 25.

Nearly six dozen people turned out as former civic president Ed Garboski and vice president Sal Pitti left their posts, transitioning leadership authority to Ira Costell and Carolyn Sagliocca, respectively. 

Village of Port Jefferson Mayor Margot Garant, former New York State Assemblyman Steve Englebright (D-Setauket) and representatives of state Sen. Anthony Palumbo (R-New Suffolk) and Suffolk County Legislator Kara Hahn (D-Setauket) were all in attendance.

Town of Brookhaven Councilmember Jonathan Kornreich (D-Stony Brook) officiated over a formal swearing-in ceremony for the newly elected civic officers. He thanked the departing civic leaders and congratulated their successors.

“There’s an energy in this community that we haven’t felt in years,” he said. “It’s a whole new optimism, and in large part, that’s because of the drive out of this civic organization.”

To Garboski and Pitti, the councilmember added, “You two are fantastic civic leaders, and I have every confidence that the new board will continue to focus and do the work that you’ve done.”

Land use

Costell quickly got moving, announcing the creation of a land use committee headed by Sagliocca, which will monitor development and related land use activities within the hamlet.

Further expanding on this theme, Costell articulated his vision for overseeing the redevelopment of the area, narrowing his focus around the projected $100 million proposed investment into Jefferson Plaza, owned by Staller Associates.

“The Staller project is the keystone, if you will, about the entire development of our little hamlet,” he said.

Between the Jefferson Plaza proposal, several planned retirement communities throughout the hamlet and significant residential development in Upper Port, Costell described PJS/T as looking at challenges associated with population density.

“I think it’s incumbent upon us as an organization to register our desire and intention to seek new planning overall, to bring a traffic study and some of the impacts of all of these things cumulatively,” the civic president said. 

He added, “I’d like to go in front of the [Brookhaven] Town Board and express our concern that our little hamlet needs some attention, that we’ve gotten a whole lot of multifamily activity here that we welcome but want done in a fashion and manner that’s going to ameliorate the impacts on existing residents and invite new people in.”

Kornreich concurred with this assessment in part, stating that overdevelopment represents a danger to the quality of life in the area.

“I agree with you that overdevelopment is one of the gravest threats that we face in the destruction of the suburbs, both in respect to our way of life and from an environmental standpoint,” the councilmember said.

Town natural gas program

Kornreich informed the body on a cost-savings strategy for consumers of natural gas. 

Recently, the town launched its Community Choice Aggregation program, partnering with Manhattan-based Good Energy to deliver a fixed rate on natural gas at 69 cents per therm. [See story, “Community Choice Aggregation: Town of Brookhaven joins energy revolution,” March 9, TBR News Media website.]

The councilmember said ratepayers could potentially save hundreds of dollars per year by strategically opting in and out of the CCA program based on the gas price from National Grid.

“Essentially, you can opt in and out at any time as many times as you want for free,” he said.

To save money, he encouraged residents to closely monitor National Grid’s service rates, published at the beginning of every month. “When that price is lower than 69 cents, you stay on National Grid,” he said. “When it goes over, you switch over.”

Based on a model he had conducted for his bill measuring the CCA against the National Grid price, Kornreich projected he would have saved approximately $250 last year.

“This month, in the month of April, National Grid’s price is 35 cents a therm,” he said, adding, “It’s half the price of the CCA … so I’m opting out.”

Reports

A Suffolk County Police Department officer delivered a report on public safety, noting that the phenomenon of catalytic converter theft within the area remains ongoing. The 6th Precinct also observed a slight increase in petit larcenies from this time last year.

He remarked on the new speed cameras installed on the Long Island Expressway. [See story, “New York implements new work-zone enforcement program.”] . The officer reported that during testing, the cameras generated roughly 6,500 summons within a 45-minute window. 

“Please be careful when you get on the LIE,” he said, adding jokingly, “That’s not a county thing. That’s a state thing, so please don’t call us and complain.”

Comsewogue High School students Kylie and Max updated the civic on various developments within the school district. The Spanish Honor Society at the high school recently held a fundraiser to buy Progresso soup donated to the Pax Christi Hospitality Center in Port Jefferson.

Andrea Malchiodi, assistant director of Comsewogue Public Library, announced that the library is conducting a raffle for all cardholders as part of National Library Week. “We’re doing a huge raffle basket, so anybody who is a library card holder can go and put in a raffle to win this fun basket,” she said.

The library is also collecting pet food for a collection drive through Long Island Cares.

PJSTCA corresponding secretary, Charlie McAteer, reported that the town would be holding a Drug Take Back Day on Saturday, April 29, from 10 to 11:30 a.m. at the Train Car Park in Port Jefferson Station.

McAteer also said that the Friends of the Greenway would conduct their next cleanup on Saturday, May 13, at 9 a.m. at the Port Jefferson Station trailhead. This cleanup will coincide with this year’s iteration of the Great Brookhaven Cleanup.

PJSTCA will meet again on Tuesday, May 23, at 7 p.m. at Comsewogue Public Library.

Suffolk County Legislator Kara Hahn (D-Setauket) recently teamed up with the Comsewogue High School Business Honor Society to help pets on Long Island. 

On Tuesday, April 25, Hahn met with students and club advisors Anthony Ketterer and Anthony Rovello to pick up over 100 pet-related food items.

Students, such as senior Riley Hughes, earned community service hours by making dog toys. Hughes also braided multiple strands of fabric to create a colorful chew toy. The team collected wet and dry food, treats, leashes and more.

The business department presented its collection to Hahn on a table in their classroom, then listened as she addressed the organization about the importance of giving back to the community. 

“There are so many families who need help,” the county legislator said. “Unfortunately, many have to face tough choices between paying the bills, feeding themselves and feeding their pets.”

The proceeds from this effort will go to Baxter’s Pet Pantry and the Port Jeff Station-based animal shelter Save-A-Pet. 

Comsewogue Superintendent of Schools Jennifer Quinn and High School Principal Mike Mosca also attended the event. “It is important to help those who cannot advocate for themselves,” Quinn said. “I’m so proud of our students.”

The race to replace Suffolk County Legislator Kara Hahn (D-Setauket) is now a three-way contest as Jen Dzvonar, president of the Port Jefferson Station/Terryville Chamber of Commerce, has declared her candidacy.

Hahn’s 5th Legislative District spans Three Village, Port Jefferson, Port Jefferson Station, Terryville and parts of Coram and Mount Sinai. The incumbent cannot seek reelection due to 12-year term limits for county offices.

Former New York State Assemblyman Steve Englebright (D-Setauket) and 2022 GOP primary candidate for New York’s 1st Congressional District, Anthony Figliola of East Setauket, have received their respective party committee’s nominations. Dzvonar’s campaign is unaffiliated with a political party. She owns the Port Jefferson Station-based Bass Electric and has served as chamber president for over a decade. She is also a Port Jefferson Rotary Club member.

In an exclusive interview, Dzvonar told TBR News Media she entered the race to build upon ongoing efforts within the 5th District.

“I wanted to make sure that our community is moving in a forward direction, still making progress, still revitalizing,” she said.

The chamber president suggested local initiatives often stagnate due to bureaucracy. She expressed interest in “streamlining” government services, limiting paperwork and removing other impediments within the county government.

“Especially being in the chamber, I see the struggle of local and small businesses — even small developers — that have a hard time getting things to happen,” she said. “It just seems to take so long, and I want to streamline that whole process.”

Among other policy concerns, Dzvonar said she would focus on addressing homelessness, maintaining that the county offers valuable services that are not used to their full potential. Accessing social services, she noted, should be simple.

“There are so many great programs already established for homeless people, people with addiction, with mental health,” the candidate said. “We just need to make those services more readily available.”

She added, “There just seems to be a disconnect somewhere. They don’t make it easy for people that have these issues to be able to obtain help.”

Dzvonar also proposed expanding sewer access into Port Jefferson Station, a measure she contended could bolster further community development. “We can’t get rid of the blight until that is done,” she said.

Dzvonar added that increasing the number of mental health personnel within the county and promoting the Safer Streets initiative are also items on her agenda.

To get on the ballot, Dzvonar has a tall task ahead, needing to obtain 1,500 signatures between April 18 and May 23. Election Day is November 7.

Narcan kits will be placed in close proximity to automated external defibrillators in county facilities. Stock photo

A new bill sponsored by Suffolk County Legislator Kara Hahn (D-Setauket) has been approved by the county Legislature.

Her resolution requires kits of naloxone — or Narcan, its brand name — to be supplied in close proximity to automated external defibrillators  in all county facilities. The bill was co-sponsored by county Legislator Tom Donnelly (D-Deer Park).

An April 4 press release stated that Narcan “is a lifesaving medication that can reverse the effects of an opioid overdose when administered in a timely manner.” Hahn believes this bill will help to improve the outcomes of the opioid overdoses seen in the county.

Hahn has been passionate about fighting the opioid epidemic for more than a decade now. In April of 2012, she sponsored a resolution which enabled police officers to administer Narcan to overdose victims. The press release for the current resolution noted, “According to SCPD statistics, patrol officers equipped with Narcan have saved thousands of lives in the 10 years since the [original] bill was enacted.”

Old Field resident Carole Trottere came up with the idea for this legislation and brought it to Hahn’s attention only a few months ago.    

“It’s really a no-brainer,” Trottere said. “Put them in wherever we have AEDs. … If you save one life, it’s sparing the parents the horrible grief that I go through and giving someone a second chance to try to get into recovery.”

Trottere has been reaching out to grieving parent groups. “You cannot believe how many groups there are on Long Island alone and nationally of grieving parents who have lost children to fentanyl and overdoses,” she said.

She has also been working with the Suffolk County Police Department’s Behavioral Health Unit. Trottere lost her son, Alex Sutton, to a drug overdose in 2018, and last year planned an event in memory of him at his favorite pizza place. Police attended and carried out Narcan training at the event. This is something they would offer to anyone else who would like to plan an event in memory of a loved one.

According to the press release, the Long Island Council on Alcoholism and Drug Dependence also supports Hahn’s efforts.

She said this bill will be beneficial because Narcan kits need to be readily available. “What is frightening about the disease of addiction is that it can happen to anyone,” she added. “So it does need to be everywhere.” 

Hahn also mentioned that street drugs are now sometimes laced with fentanyl, so someone could be taking what they think is a simple Xanax, but it’s actually unexpectedly laced with fentanyl.

“It’s probably the person who unexpectedly overdoses that will benefit the most from its placement,” she said. “If it’s ubiquitously placed, then more people will be saved.”

Hahn said she’s working with local universities to build the pipeline of clinical social workers, psychologists and psychiatrists that can help people battling mental health issues. She indicated the system is under-resourced, and she would like to work toward strengthening child, adolescent, and adult mental health in our communities.

Public officials and drug prevention advocates are sounding the alarm over cannabis products packaged for children.

During a recent Port Jefferson Station/Terryville Civic Association meeting, civic vice president Sal Pitti circulated a flier revealing various cannabis products resembling commonplace children’s foods and household snacks. 

Pitti, who is also active with the Town of Brookhaven’s Drug Prevention Coalition, suggested these products are branded for children and attributes the problem to false advertising.

“We all grew up with Trix and Cocoa Pebbles when we were kids,” he said. “It’s a branding that people know, they recognize and might more easily purchase.”

Pitti detailed several potential dangers associated with tetrahydrocannabinol, the active ingredient in marijuana commonly known as THC, getting into the hands of young people. He said processed edible cannabis often has exponentially higher THC concentrations, which can get kids hooked on the substance more efficiently and create a gateway to harder drugs.

Recent statistics from the National Institute on Drug Abuse substantiate this claim. Samples analyzed by the U.S. Drug Enforcement Agency since 1995 indicate that today’s cannabis products are nearly four times as potent as those collected in that year.

“They’ve sophisticated this technique to great extents,” Pitti said. “Now they’re making gummies, candies, granola bars, honeys and spreads out of this stuff. But the problem is, in processing all of this, that THC level has gone up dramatically.”

Pitti said packaging highly potent THC products to children signals potentially severe societal harm. “This is going to open up a door to our youth that’s going to hurt them,” he said. “This is just a bomb that’s waiting to go off.”

A crisis for children

Pitti is not alone in these concerns. Suffolk County Legislator Kara Hahn (D-Setauket) has introduced legislation targeting the practice. 

Her bill cites the risks associated with underage THC consumption, such as impaired memory and coordination, and the potential for hallucinations and paranoia among minors. 

In an interview, Hahn suggested marketing cannabis in a manner that makes it desirable to children represents a public safety hazard.

“If it’s intentionally designed to look like candy, the purpose is to confuse the consumer,” she said, adding, “If an adult purchases marijuana gummies that are packaged similarly to candy-type gummies and a young child gets their hands on it and eats it unknowingly, that’s a very dangerous situation for the child.”

Hahn’s bill would require packaging of THC products to be plain, containing clear warning labels and prohibiting the words “candy” or “candies.” She noted that the measure’s goal is to make THC products less enticing to kids.

“The packaging of the products is incredibly important,” the county legislator said, stating the bill would prevent merchants from “mimicking candy wrappers, having logos that are like cartoons or characters or having flavors that are attractive to children.”

Suffolk County Legislator Sarah Anker (D-Mount Sinai), chair of the county’s Addiction Prevention and Support Advisory Panel, has signed on as a co-sponsor to Hahn’s bill. She referred to child-friendly THC packaging as a harmful way for cannabis sellers to market their products.

“These cannabis folks see this as a marketing strategy,” she said. “It’s creating a problem, we know for a fact, and we’re trying to address that.”

State oversight

Marijuana was legalized in New York state in 2021 under the Marihuana Regulation and Taxation Act. The New York State Office of Cannabis Management is the regulatory arm overseeing the licensure, production, sale and taxation of cannabis throughout the state. In an email statement, the office confirmed the uptick in packaging branded for children.

“We have seen illicit sellers marketing products clearly imitating candies and snacks that target children,” said Lyla Hunt, OCM’s deputy director of public health and campaigns. “New York State would never allow those products to be sold in licensed cannabis dispensaries. Our enforcement teams are working every day to shut those sellers down.”

Further compounding the issue, Hunt added that illicit dealers often do not follow the same protocols as their licensed counterparts. “We also have heard reports unlicensed storefronts are not checking ID when selling illicit cannabis products, heightening the importance of shuttering these operators before they can do more harm,” she said.

According to her, OCM has worked to curtail the issue through stringent guidelines, putting forth regulations regarding packaging, labeling and marketing to mitigate this technique. 

“We at New York State’s Office of Cannabis Management are committed to building a safe, regulated cannabis industry for consumers ages 21 and over that also protects those under 21,” the deputy director said.

OCM’s regulations concerning packaging echo several of the items raised in Hahn’s bill, restricting words such as “candy” and “candies” while mandating that packages be resealable, child-resistant and tamper evident. The guidelines also limit the use of cartoons, bubble-type fonts and bright colors on the packaging.

Despite OCM’s approach, Anker said the work of local and state government remains unfinished. “More must be done,” the county legislator said. She added, “This product is legally new to the market, and you need to be aware and do your part as a parent and as a teacher … to protect the kids.”

The Port Jefferson Station/Terryville Civic Association met Tuesday, Feb. 28, for an evening packed with local business.

Lawrence Aviation

Sarah Lansdale, the Suffolk County economic development and planning commissioner, updated the body on the proposed conceptual layout of the Lawrence Aviation Superfund site in Port Jefferson Station.

“We have come up with a plan of three basic uses of the property,” she said. “One is a light-industry use … for a proposed solar development. The property south of the Greenway is proposed to be for open space … and then a railyard, or railroad usage, on the northeastern section of the property.”

Lansdale also reported that the U.S. Department of Justice recently approved language within a global settlement agreement between 11 claimants, adding, “Now we’re getting them to sign on to the agreement. Of the 11, we have three remaining that have yet to sign on.”

The county is working to finalize a bid package to demolish the remaining buildings on-site during the warmer months.

County Legislator Kara Hahn (D-Setauket) thanked Lansdale for continuing her efforts on behalf of county residents. 

“Very few people want to deal with difficult, complex projects like this,” Hahn said. “This was very difficult, we are so close, and I’m just grateful.”

Civic member Ira Costell objected to a Feb. 23 op-ed in The Port Times Record, “Village elections and Port Jeff’s rapidly changing challenges,” in which former Port Jefferson Village trustee Bruce Miller suggested expanding the limits of the village to derive tax revenue from the Superfund site.

“I think that’s something we need to discuss and take a position on shortly,” Costell said, adding that such a proposal “impacts our community and a potential tax base to the Comsewogue School District.” 

Civic president Ed Garboski and vice president Sal Pitti objected to the annexation proposal. Corresponding secretary Charlie McAteer said a discussion on the matter would be appropriate during next month’s meeting.

County sewers

Deputy County Executive Peter Scully delivered a presentation outlining the county’s clean water initiative, remarking that a comprehensive sewer plan has eluded county officials for decades.

“Most of Suffolk County is without sewer infrastructure,” he said. “Sewers throughout Suffolk County have not happened for a variety of reasons,” namely the enormous costs associated with their construction.

Cesspools remain the only waste treatment technology available to many county residents, which Scully indicated can impair the sole-source aquifer upon which residents depend for their drinking water. Leakage associated with septic tanks, Scully said, can contribute to brown tides, rust tides, algal blooms and fish kills throughout the county’s waterways.

To address the problem, the administration is pitching the Suffolk County Clean Water Plan, which includes a one-eighth of a penny per dollar sales tax, to create a local match program for federal and state subsidization of sewer infrastructure.

“Right now, there are tremendous funding sources available on the federal and state levels,” he said, noting the $1.2 trillion Bipartisan Infrastructure Law passed by Congress in 2021 and the recently passed New York State $4.2 billion environmental bond act. 

“Those are the two sources of funding that we’re all anxious to make sure our communities get a fair share of, and to do that we need a local match,” the deputy county executive said. “The [clean water plan] funding source that we’re talking about provides that local match.”

Reports

Andrea Malchiodi, assistant director of Comsewogue Public Library, announced that the library’s budget vote and trustee election would take place Tuesday, April 4.

Comsewogue High School students Kylie and Max updated the body on the news from the Comsewogue School District. Kylie reported that the high school’s business academy and work-based learning program were both approved career and technical education pathways by the New York State Education Department. 

Max noted Comsewogue’s recent athletic achievements, with the Warriors girls and boys basketball teams advancing to the postseason. The wrestling team vied for the county final, while the varsity cheerleading team competed at the national tournament in Florida.

Suffolk County COPE officer Casey Berry said the vehicle theft crime surge throughout the local area remains unresolved. “Lock your cars in your driveway and when you’re going to Starbucks,” she told the body. “Don’t leave the fob in the car.”

Berry also reported that officers within the department are being more active. “I think COVID affected law enforcement as well as the rest of the community in many ways,” she said, adding, “Our leadership is saying, ‘We really need to protect our community.’”

This boost in police activity, Berry added, is reflected by rising numbers of summons written by police officers, along with the department’s ongoing body camera initiative.   

Civic elections

Garboski reported the results of the nominating committee created last month after he and Pitti declared they would be leaving the hamlet before the year’s end, thereby vacating their posts.

Christine Allen and Costell were each nominated for the position of civic president, and Carolyn Sagliocca was the sole candidate nominated as vice president. The three candidates publicly accepted their nominations. 

Additional nominations will be accepted from the floor during the next meeting March 28, on which date a vote will take place. The newly electeds will formally enter their posts in April.

During the meeting, Town of Brookhaven Supervisor Ed Romaine (R) presented proclamations to Garboski and Pitti for their long service to the Comsewogue community.

“You cannot put a price on the time, effort, energy, knowledge and dedication they have brought to this task,” Romaine said. “They have worked around the clock to improve the quality of not their lives, but the quality of life of everyone in this community.”

The Suffolk County School Bus Safety Program has drawn scrutiny from Republican county officials targeting the program for alleged mismanagement.

Enacted unanimously by the county Legislature in 2021, this traffic safety program uses cameras attached near the stop arm of school buses to enforce the New York Vehicle and Traffic Law. The county has partnered with Virginia-based BusPatrol to operate the program.

Under state law, offenders caught passing buses while the stop arm is extended receive a $250 fine. The county code states, “net proceeds of any penalty … shall be expended for programs related to improving traffic safety and/or school district safety in Suffolk County.”

County Comptroller John Kennedy Jr. (R) recently announced his office is conducting an audit of the School Bus Safety program. He stated the program had captured his attention when numerous residents complained about receiving potentially erroneous violations.

“My interest in any program is always that a program is being operated as the laws that adopted it … sought to have it operate,” Kennedy said. “How is the revenue that’s being collected from the program being allocated? Is it being done under the terms of the contract? Is the vendor fulfilling all of their requirements?” 

He added, “That’s the audit function, and it is universal across the board.”

Legislative purpose

Marykate Guilfoyle, a spokesperson for Suffolk County Executive Steve Bellone (D), summarized the motive for developing the program in the first place.

“The goal of the School Bus Safety program is to protect children as they get on and off the bus and to reduce the number of drivers illegally passing stopped school buses, which endangers the lives of students,” Guilfoyle said in an email. “The program is completely violator funded, and county proceeds are used to support public safety, traffic safety and school safety initiatives.”

County Legislator Kara Hahn (D-Setauket) defended the School Bus Safety program. She said her office’s most frequent complaints are related to roadway safety and other traffic concerns.

“Red light cameras and school bus cameras are a way to prevent death and injuries without needing a paid police officer at every intersection and following every bus,” she said. “It’s a very efficient way for providing the consequence for breaking the rules of the road.”

Before the program took effect, Hahn added, few violators ever got caught. Today, they receive a fine, incentivizing better roadway behavior and creating a safer traffic environment.

“Now people have to change their behavior to no longer do the illegal action that puts people’s lives at risk,” the county legislator said. 

Questions over potential misapplication

County Legislator Rob Trotta (R-Fort Salonga) said the School Bus Safety program is one of the few measures for which he wishes he could rescind his “yes” vote. He said the Legislature was misled when the program was pitched.

Figures obtained by Trotta indicate the program grossed $23 million last year, with $13 million retained by the county and the outstanding $10 million collected by the vendor. Kennedy estimated the county government netted approximately $11 million.

“We don’t have all the net revenue,” Kennedy said. “That’s been another consequence of the hack” against the county government in September. By statute, the net proceeds generated by the School Bus Safety program must support various educational programs related to school bus and traffic safety. Asked how the revenue is being spent, an administration official said the 2022 revenue figures are still being finalized.

Guilfoyle, however, cited specific examples of how the revenue supports countywide traffic education initiatives: “Examples of the county’s efforts include dedicating more than $1 million to school districts and $125,000 in [public service announcements] during the back-to-school months to educate drivers on the state law surrounding stopping for buses.”

Trotta viewed the school bus program as a lucrative moneymaker for the county and vendor rather than a measure promoting bus safety. He said the law is applied unfairly, ticketing busy multilane corridors in the same manner as residential neighborhoods.

“I’ve checked with all the school districts, and kids aren’t crossing major thoroughfares,” Trotta said. “I’m all for giving a ticket to someone who passes a school bus on a residential avenue because it’s dangerous. I’m not at all for 1,000 people on Jericho Turnpike getting tickets.”

While the county code imposes rigid reporting requirements regarding expenditures of revenues generated from the program, Kennedy said he has yet to see any reports to date.

Competing perspectives

Following an initial spike when programs such as this are first instituted, Hahn said offenses start to wane “because people begin to change their behaviors — they stop at red lights because they’re afraid of getting a ticket.” 

In time, the legislator added, drivers throughout Suffolk “will no longer go around stopped school buses,” but “if they choose to break the law, they will get tickets.”

Trotta said he is pushing to repeal the School Bus Safety program altogether. “The reality is it’s a sham, and it’s not what we were told it was going to be,” he said.

While Kennedy acknowledged the importance of traffic safety, he held that the audit is to determine whether the program is administered correctly.

“I never want to see somebody blowing a stopped school bus sign — it’s just heinous,” the county comptroller said. “But if [the program] is not being operated in a fair and proper and consistent manner by the school bus drivers and the vendor … then it’s a problem.”

Kennedy expects the audit to be finalized by the second quarter of 2023.

New York State Assemblyman Steve Englebright (D-Setauket) has held elective office continuously since 1983. Englebright’s long tenure now comes to a close. 

In a tight state election for District 4 last month, Englebright narrowly lost to his Republican Party challenger Ed Flood (R-Port Jefferson). In an exit interview, the outgoing assemblyman reflected upon his pathway into government, the legislative victories throughout that time and the meaning of public service.

The road to politics

Growing up, the young Englebright spent much of his time in libraries. He found refuge in books, which satiated his curiosity and “compelling interest in how things worked.” He also nourished a lifelong fascination with history through those hours devoted to learning.

Leading up to his first run for office, Englebright said he was deeply disturbed by the environmental degradation characteristic of those times. The “almost daily reports” of overdevelopment and sprawl, oil spills and drinking water contamination, each had left a deep and abiding impression on him.

He was teaching geology at Stony Brook University when he began considering public life. “I realized that drinking water was the first limiting factor for the continued well-being of this Island, and I was not really seeing any meaningful public policy growing out of the reports of chaos,” he said.

The late professor Hugh Cleland, from the SBU Department of History, would prove to be the catalyst behind Englebright’s ascent to politics. Cleland sat down with him at the campus student union. For several hours, the two discussed a possible bid for a Suffolk County legislative seat.

“This was a really serious and credible and well thought-out request that he was making,” Englebright said. “So I didn’t just wave it off. I gave it some thought and, sure enough, I found myself saying, ‘What’s next?’” 

After that meeting, Englebright decided to run and was elected to the county Legislature in 1983. He won election after election for the next four decades.

County Legislature

Upon entering the county Legislature, Englebright simultaneously confronted an array of environmental dilemmas. He described the defunct Long Island Lighting Company, the precursor to today’s Long Island Power Authority, as “at that time wanting to build a small galaxy of nuclear power plants on Long Island.” He stressed that the utility company was favoring its shareholder interests at the residents’ expense. 

Englebright successfully championed, along with a grassroots movement of LILCO ratepayers, against the construction of the Shoreham Nuclear Power Plant and other nuclear plants to follow. Their resistance efforts were grounded primarily in the risks associated with evacuation.

Another major policy issue during his early political career was the protection of groundwater and surface waters in Suffolk County. “I pushed successfully for the largest county-level open space program in the nation,” he said. He was one of the earliest critics against sprawl. 

As a county legislator, he initiated the first plastics ban in the nation. Though ahead of his time on the issue, he admitted that not enough has been done elsewhere to counteract the problem, which he said “has exploded into a worldwide catastrophe.”

He sponsored legislation excising a small fee on hotel and motel rooms, considering the measure as a fee on tourists allowing for their continued enjoyment of the area through reinvestment into the county’s most attractive destinations.

“If you wonder why county Legislator [Kara] Hahn [D-Setauket] is able to have some discretion to provide funding to Gallery North or the Reboli Center, that funding is coming from the hotel/motel room fee,” he said.

As a state assemblyman, Englebright quickly picked up where he left off, building upon and expanding his county policies at the state level. Among his earliest actions was the Long Island Pine Barrens Protection Act, a state law ensuring the preservation of the Pine Barrens as open space.

He sponsored some of the original laws in New York state related to solar power and other renewables. “In my first year in the state Legislature, I was successfully pushing for legislation that had paved the way for the electronic age,” he said.

Englebright added that the Climate Leadership and Community Protection Act was the most crucial legislation he ever sponsored. This ambitious law aims to reduce statewide greenhouse gas emissions by 85% from 1990 levels by 2050.

Englebright also successfully led a statewide ban on purse seining, a highly efficient fishing technique responsible for the depletion of menhaden, or bunker, in New York’s surrounding waters.

“The marine world all depends on having this abundant fish at the base of the food chain,” the assemblyman said. Purse seining allowed large-scale fishing operations to collect “whole schools of menhaden, millions and millions of fish.”

One of the fondest moments throughout his tenure happened just last summer. On a boat trip off the coast of Montauk Point during early morning hours, the sun rising off the horizon line, he witnessed entire schools of menhaden beneath the water.

“The sea was boiling with fish,” he said. “Menhaden, they were back by the billions.”

Reminiscent of his earliest years in libraries, historic preservation would be a significant point of emphasis for Englebright. “I’m very proud of the many properties that are preserved, the historic sites.” Such sites either preserved or to be preserved include Patriots Rock and Roe Tavern in Setauket and William Tooker House in Port Jefferson, among many others.

Even in his final days in office, Englebright made historic breakthroughs. Though his reelection bid was unsuccessful, Englebright rejoiced in yet another major victory for environmental sustainability. Last month, New Yorkers overwhelmingly approved a recent $4.2 billion environmental bond act, a multiyear investment in clean water, air, wildlife and the environment.

Reflections from his community

During his extended time in political service, Englebright has worked alongside countless public representatives at all levels of government. He maintained “they’re not all scoundrels,” adding that many were “superb public servants.”

In a series of written statements and phone interviews, several public representatives and close Englebright associates and friends had an opportunity to weigh in on his legacy of service and commitment to his community. 

Englebright “proved himself to be an environmental pioneer, a champion for the causes and concerns of his constituents and an unflinching fighter for the communities he served,” Hahn said. “For those of us who served in elected office with him during his tenure, irrespective of political persuasion or level of government, Steve proved himself to be a friend and mentor who embodied the role of effective leadership in the lives of those we represent.”

 As recently as Dec. 6, the Three Village Community Trust honored the assemblyman by renaming the Greenway trail as The Steve Englebright Setauket to Port Jefferson Station Greenway.

Port Jefferson Mayor Margot Garant commented on the characteristics that set Englebright apart from other politicians. She said his scientific background and wide-ranging interests added depth to his political persona.

 “He’s a unique legislator in that he’s so well rounded in those other areas and that he’s not just focused on the hard line of the law,” she said. “He’s involved with his community, he’s approachable, he’s caring, he’s kind. He’s a very unique representative, and we’re going to miss him sorely.”

 Like Englebright, Port Jefferson village trustee Rebecca Kassay worked in environmental advocacy before entering government. She discussed Englebright’s ongoing extended producer responsibility legislation, which would require producers of packaging materials, rather than taxpayers, to be responsible for managing post-consumer packaging material waste.

 “This can be a step toward addressing a multitude of waste management, environmental and financial issues facing municipalities and individuals,” Kassay said. “I hope to see the assemblyman’s colleagues and successor continue advocating for policies with long-term solutions,” adding, “Englebright is the type of commonsense representative we’d like to see more of in government.”

 In a joint statement, George Hoffman and Laurie Vetere of the Setauket Harbor Task Force reflected upon Englebright’s importance to local harbors.

 “In his time as our state representative, Steve Englebright never forgot the importance of the harbor,” they said. “Assemblyman Englebright found ways to secure needed dollars from Albany to help the task force in its mission of protecting water quality and the sustainability of Setauket and Port Jefferson harbors.” 

Joan Nickeson, community liaison of the Port Jefferson Station/Terryville Chamber of Commerce, credited Englebright for the continued flourishment of her area. She said the hotel/motel tax he sponsored had enabled the chamber to conduct its annual summer concert series at the Train Car Park.

 “Assemblyman Englebright has continued to be a friend of the chamber by supporting our local businesses and attending our ribbon-cutting ceremonies,” she said.

 Within those 40 years, countless other acts and initiatives have come to fruition with Englebright’s assistance. Reflecting on his time in public service, he outlined his political doctrine.

 “The proper role of government is to protect the people who sent you,” he said. “If you keep your eye on the prize, you can achieve things for the people who invested their trust in you.” 

 On the role of the public representative, he added, “Use the office as a bully pulpit, speak truth to power, identify things that are wrong and right them, and treat the office as an opportunity to do good.”
