Suffolk County officials have set their sights on the wallet of a disgraced ex-police chief, looking to recoup costs of litigation.

Nearly three months after Suffolk County legislators tabled a proposal to sue former police chief James Burke over the $1.5 million settlement it paid out to his victim, the Suffolk County Legislature passed a measure March 5 to begin a lawsuit in an attempt to recoup compensation and salary Burke had received up to when he resigned in October 2015. 

“Burke clearly breached the oath he took as an officer and the duty he owed the county to serve in his capacity faithfully and lawfully,” Legislator Rob Trotta (R-Fort Salonga) said. The Smithtown legislator was the main sponsor of the bill. 

The bill would authorize the county attorney to file a lawsuit by using “the faithless servant doctrine,” which dates back to the 19th century and allows employers to recoup all compensation paid to an employee while they acted in a disloyal manner. 

The resolution was drafted to recover the compensation paid specifically to Burke and no other county employee. 

“It feels great,” Trotta said. “Finally a victory for Suffolk County taxpayers.”

Originally, Trotta wanted to recoup money from a 2018 settlement the county paid to Christopher Loeb, who was shackled and beaten by Burke back in 2012 as part of a cover-up. County attorney Dennis Brown said at a December 2018 Ways and Means Committee public hearing there was no basis for a possible lawsuit and there was no way to recover or recoup the settlement dollars paid in the lawsuit, according to previous reporting by TBR News Media.  

In the federal civil lawsuit, the county agreed to pay the settlement amount for the civil rights offenses as they were the ex-police chief’s employer at the time. The county also paid the settlement for the actions of six other police officers who helped cover up Burke’s actions when he allegedly beat a handcuffed man for stealing a duffle bag from his vehicle.  

At the same hearing, Howard Miller, a Garden City-based attorney with the law firm Bond Schoeneck & King, presented a case for the county suing Burke for his wages and compensation paid by the county under the faithless servant doctrine.

Miller mentioned that he had successfully represented clients at the state level in similar lawsuits, including the William Floyd School District.

“This doctrine is designed to create a deterrent to future acts like this, of corruption and misconduct,” Miller said at the December 2018 public hearing.

Brown also said in a statement that the Suffolk County Charter authorizes either the county executive or the Legislature to direct legal action. The resolution that was passed by the Legislature provides a framework specific to that action, but does not limit the ability of the county executive to pursue additional legal action.

Trotta hopes the measure sets a precedent that anyone, whether in government or not, will be held accountable for their actions. 

“Former District Attorney Spota empowered and conspired with Jim Burke and Chris McPartland,” County Executive Steve Bellone (D) spokesperson Jason Elan said in a statement. “Clearly, all three fall under the faithless servant doctrine so any legal action to recoup taxpayer-funded salary and benefits should include each individual.”

According to a representative from the county executive’s office, Bellone signed the legislation to recover salary and benefits from Burke on March 11 and further directed a similar suit be filed against ex-District Attorney Thomas Spota and his top aide who have also been indicted on related charges.

In the coming weeks, Mother Nature will show us both sides of her personality as the cold darkness of winter melts into colorful spring. It’s a time of opposites, with life and death at the center of it all.

The Smithtown Township Arts Council’s Mills Pond Gallery in St. James is reflecting on these themes with its newest fine art exhibition, In the Garden of Eden: Artist Reflections, on display now through April 14.

“Each artist I selected helped tell a story for me — the origin of choice, good and evil, light and darkness, the origin of creation,” said guest curator Melissa Masci, who developed the concept for the exhibit. “The premise of this show is that there’s balance to every aspect of life, in the experiences we have and the decisions we make that define us. There’s a duality at play — you can create something incredibly light and beautiful from the darkest experiences.”

It is the first time that STAC director Allison Cruz has invited a guest curator to the gallery, and while she admits it wasn’t easy to hand over the reins, she knew Masci’s vision had to be shared.

Masci, a Seaford resident, is a graduate of the Fashion Institute of Technology in Manhattan. Her career has led her from designing women’s apparel and store window displays to teaching art classes for children. Cruz invited her to teach at the St. James gallery, and they’ve built a fierce friendship since.

“Melissa visited the gallery just by chance about seven years ago, and we struck up a conversation,” Cruz recalled in a recent interview. “She fell in love with the space — the light and the spirit of it. And she’s such a genuine and creative person.”

The unique exhibit, which fills four gallery rooms and the center hall gallery on the first floor of the historic 1838 Greek Revival mansion, will feature the works of eight artists using a variety of mediums and styles, including oil, acrylic, mixed media and sculpture.

All of the artists are contemporary, and the majority are local to Long Island. Masci aimed to choose artists from a mix of backgrounds and experiences to expose visitors to something new, she said.

Brooklyn-based painter AM DeBrincat creates layered works on canvas, blending painting, digital photography and even printmaking for a unique style. She uses images pulled from online searches and Xerox transferring for her pieces, which explore how we create a sense of self in the digital age. “I have always felt compelled to make art, ever since I was young. I’m not sure why, but it’s always been such a strong impulse and brought me joy, so I don’t over analyze it – I just go with it,” she said.

Nicholas Frizalone of Lake Grove attended Stony Brook University and Long Island University before becoming an art educator and creator. He paints, draws and creates prints that explore the implication of language in art. “Through the use of painting, drawing, and printmaking, I wish to investigate the implications of language in art, and communicate in a way words will never be able to accomplish,” he said.

Jennifer Hannaford is more than just an artist ‒ the Port Jefferson resident is also a forensic scientist. To get in touch with her creative spirit, Hannaford began to create artistic mug shots using her fingerprints. Working primarily in oils, she enjoys exploring themes that include life, ascension and balance.

Ashley Johnson of Buffalo works with ceramics, collage and photography but expresses her creativity most through stippled ink drawings and large-scale ink paintings. “Creating art is a therapeutic way for me to work through my emotions … to dig deep and explore my trauma, joy, confusion, anger, love, and anything else I need to release,” she said.

Smithtown artist Yvonne Katz believes art is the “elixir that allows us to fluidly slip and break the threshold of all boundaries.” She loves working with oil and bronze because there is a maneuverable interaction with these mediums, as if the materials collaborate in the process of realizing the results.

Neta Leigh is a surreal-impressionist photographer from Locust Valley. Inspired by the sights and locales that surround her daily life, Leigh is most drawn to photograph in natural light during times of fog, clouds, snow or rain. She also enjoys photographing fruit and flowers in her dining room before and after destruction.

Peter Bragino of Copiague is a multidiscipline, mixed-media artist, designer, treasure hunter and soul searcher. “In the same way we build layers in life to become who we are as human beings I allow my creations to take on the same life, the same layering, the same history. This process naturally led me to a mixed-media workflow where any medium is a viable medium to complete the formation of the life that the creation would like to take,” he said. Bragino will be collaborating with artist Kevin Corcoran for this exhibit.

“I’m always looking for something unique to bring into the gallery – not just landscapes or realism or abstracts all the time,” said Cruz. In regards to the exhibit, “I had only seen a few of the pieces initially. But the themes in it are so evident, strong and beautiful. It’s unlike anything else in this area, and I think people will really enjoy the experience.”

The community is invited to an opening reception on March 16 at 5:30 p.m.

There were applause and cheers at the Town of Smithtown’s March 11 affordable housing lottery for seven new homes located at Country Pointe Woods at Smithtown.

Sixty people applied for the chance to qualify to purchase the owner-occupied, one- and two-bedroom units located on Route 111. The average projected purchase price is estimated to be $350,100. Twenty-one people attended the lottery, which was offered by the town together with Long Island Housing Partnership and 347 Building Company LLC.

The drawing of names was held at town hall. Applicants did not have to be present to be considered, and their housing applications were ranked and will be processed in the order in which their names were drawn.

Smithtown adopted a Municipal Workforce Housing Policy in October 2017, in accordance with New York State’s Long Island Workforce Housing Act. The policy requires developers who build subdivisions of five or more units to create 10 percent of the development for affordable housing.

To be eligible to participate in the affordable housing lottery program, an applicant must be a first-time homebuyer and must meet all program requirements including a total household income not to exceed 130 percent of the area median income for Nassau and Suffolk counties. Applicants must have an acceptable credit history as defined by the program’s guidelines.

At the March 11 lottery drawing, LIHP executive vice president James Britz said housing lotteries help people who otherwise might not be able to afford to live in Suffolk County and specifically in the Town of Smithtown. Attracting these people to live and work in the area “is a critical component in helping municipalities continue to grow,” he said. Those who apply for the Town of Smithtown housing lottery are “a very good combination of different age groups and generations,” Britz said.

Susan Baldridge, 44, was No. 10 in the drawing, and she proudly proclaimed herself “Smithtown born and raised.” Baldridge currently is renting a place in Smithtown. She is a single mother with two daughters and said the opportunity to own a home in the town she loves “seems like fate.” The mother brought her brother Michael — “my good luck charm” — to the drawing, as well as her daughter Felicia.

People that benefit from affordable housing lotteries, said Town of Smithtown supervisor Ed Wehrheim (R), are young people who grew up on Long Island but can’t afford to live here.

“This is a very expensive place to live,” he said, adding he believes affordable housing “can work to keep our talented young people. It’s been proven to work in other municipalities.”

The town’s next housing lottery will be held March 26 at 10 a.m. at town hall. Applications must be submitted no later than 5 p.m. March 22. The housing to be offered will be three one-bedroom rental units and one two-bedroom rental unit at the 36-unit Hudson Place at Kings Park development.

Gurwin Jewish Nursing & Rehabilitation Center in Commack invites all amateur photographers, including students, to submit entries for its 26th Annual Photo Contest.

Winners of the unique contest have the distinct honor of not only receiving recognition and prizes for their work, but also the privilege of helping to enhance the lives of the 460 residents who call Gurwin “home,” as winning photographs are permanently displayed in the center’s renowned Tiffin Gallery and throughout the facility for the enjoyment of residents, staff and visitors.

Students, teachers and parents in Commack recently went bald for a cause.

For the 10th year running, members of the Commack School District and surrounding community gathered at the high school March 1 to shave their heads in support of childhood cancer research. Over 100 people participated to raise money for the St. Baldrick’s Foundation, a not-for-profit whose goal is to raise funds to find cures for childhood cancer. 

In the past nine years the district has held the event, Commack has raised over $650,000. This year the district raised close to $45,000, with some teams donating well over $10,000. 

The annual event is organized by Commack High School teachers Lee Tunick, Bill Scaduto and Dan Revera. Since its inception, close to 1,000 people have shaved their heads in solidarity to those suffering childhood cancer. Hairdressing students from Eastern Suffolk BOCES donated their time to cut the participants hair.

The idea for the fundraiser came about through a cancer awareness club that Revera and Scaduto ran at the high school for quite some time. 

“Bill Scaduto and myself have been working in this building for 20 years,” said Revera. At that time St. Baldrick’s didn’t exist as we know it today. When we first found out about St. Baldrick’s, we would go to a school in Northport and a colleague of mine thought why don’t we host our own event here [at the high school].” 

Now with the event in its 10th year, Revera said it is great to see Commack School District students and community come out to support this.  

“One of the main influx of people [that come here] are the elementary students,” the high school teacher said. “Anything that we can do to generate [money] to help these kids who are going through this is great.” Revera added that the students that came to the event have shown bravery, have stood up for what’s right and are dedicated to a good cause. 

“That’s why we are here,” he said. “Just the thought of a family going through something like this and dealing with their child battling cancer — I can’t even imagine. If providing one day where we can support them and try to help however we can, it’s the least we can do.”

Suffolk County financial reform has leaped to the tops of the minds of members of both parties in county government.

County Executive Steve Bellone (D) announced proposals aimed at strengthening Suffolk’s financial future at a press conference in Hauppauge Feb. 27. As part of the Securing Suffolk’s Financial Future Act, Bellone proposed amending the county Tax Act to allow the county to collect tax revenue that is owed in January, instead of waiting until June. Officials said the plan is the latest in the county’s efforts to streamline operations and be more efficient. 

Bellone said the goal of the plan is to help strengthen the county’s financial condition going forward. 

“It would ensure the county would get tax revenue that it is owed at the beginning of the year instead of waiting until June and [being] forced to borrow funds.”

“When we look at planning ahead, looking beyond where we are today and thinking about where we’ll be five, 10, 15 years down the road — it’s important that we do that,” the county executive said. 

The plan would build upon previous undertakings by the county, which include bipartisan efforts to bring the county in line with the best finance practices set forth by financial experts from the Office of the New York State Comptroller and the Government Finance Officers Association, according to Bellone. 

In doing so, the county would press to amend the Tax Act, which would require state legislation. The county executive said the 100-year-old law is seriously outdated.

“It would ensure the county would get tax revenue that it is owed at the beginning of the year instead of waiting until June and [being] forced to borrow funds,” he said. “This is an issue that crosses party lines, this is not an issue that is partisan or [one] that should be partisan.”

The county executive called for the authorization of a four-year budget plan, which would allow the county to focus on long-term projects as well as updated debt management and fund balance policies. New computer software will be purchased to enhance transparency and
accountability.

Suffolk Comptroller John Kennedy Jr. (R), a known critic of Bellone, announced plans in February to run for county executive in November. His campaign has attacked Bellone on the current state of the county’s finances, placing a lot of the blame on his Democratic contender for a downgrade in Suffolk’s bond rating and for raising county fees. 

Kennedy said Bellone is just attempting to look fiscally responsible.

“Steve Bellone doesn’t know how to spend less,” Kennedy said. 

In a Jan. 31 TBR News Media article, Eric Naughton, Suffolk’s budget director, said while the county’s bond rating has dropped, Kennedy were “overstating” the impact. He said Moody’s, which gives the bond grades to municipalities, was only looking at the past and not the future. Kennedy has said he plans to consolidate county offices in order to reduce taxes.

Legislator Rob Calarco (D-Patchogue), deputy presiding officer, said fiscal responsibility is the top priority when talking about taxpayer dollars. 

“These policies that we are laying out are common-sense ways to ensure that we are transparent with the public,” he said. 

The county executive also called for re-establishing an insurance reserve fund, originally created in 1980, which would assist in paying unexpected legal expenses. There was a call as well to reorganize the county’s audit joint committee and add more members.

Bellone said the changes would allow for a more robust and diversified review of the fiscal condition of the county. 

Deputy County Executive Jon Kaiman (D), who helped piece the plan together along with a team from the county executive’s office, said its goal was to figure out how Suffolk County can be best managed and reach its fullest potential. 

“What we can do is to present reform in a manner to get the best out of what this county can offer,” Kaiman said. 

County officials indicated legislation has been filed and expect a hearing to be set at the end of March and the proposals could be up for consideration into law sometime in April.

I want to share my thoughts regarding the recent efforts to update the Town of Smithtown’s long-standing comprehensive plan, which was first adopted in 1961.

As part of the research process for its award-winning body of analytical and reported work on Long Island’s land use and development issues, The Foggiest Idea regularly reviews the planning efforts that directly impact communities throughout Nassau and Suffolk counties.

Located in the heart of western Suffolk County, Smithtown was at the forefront of the post-World War II suburban developmental boom, experiencing rapid suburban expansion up through the 1980s. In recent years, the town finds itself needing to balance its suburban landscape with the economic, environmental and social needs of the 21st century.

As policymakers, it is critically important to be cautiously skeptical when it comes to the ambitions and motivations of those who will seek to use this process to transform the town. As you’re well-aware, Smithtown has been unchanged for decades. While partly due to political inertia, there is some merit to the municipality’s long-standing maintenance of the status quo -— from the planning perspective, the town has been essentially built-out for decades.

In 2015, I argued this point on the pages of Long Island Business News, writing that “…with its road network overburdened, water quality declining, and limited vacant open parcels that would allow for transformative development, Smithtown isn’t so much the ‘town that time forgot,’ but rather, the ‘town that has reached its limits.’”

Community-based plans should be driven by policy solutions that are both data backed and grounded in public input, not shaped by those who have something to gain by advocating for strategies that allow for additional growth. It is my hope that the document eventually adopted reflects the realities Smithtown faces, as well as some of the still-relevant recommendations that were made in the 2015 Draft Town of Smithtown Comprehensive Plan Update that was never formally accepted.

Smithtown’s latest road map will be an opportunity to strike the right balance between maintaining the community’s quality of life, while charting sustainable and viable solutions for the area’s future.

I applaud the municipality for undertaking a renewed comprehensive planning effort and look forward to following the progress that is made in the coming months.

The Town of Smithtown has begun efforts to expand its town hall. Specifically, conceptual plans are being developed to add wings to the existing building. Most recently, the town sought appraisals for four satellite, or annexed, buildings as a first step in consolidation. No doubt consolidation of office space will increase efficiency and improve external user’s interaction (regarding “one stop” vs. being shuffled from one building to another). A vacated annexed building can consequently be used for redevelopment (e.g., further redevelopment of old Nassau Suffolk Lumber property), transit-oriented development (e.g., Long Island Rail Road adjacent apartments) or parking.

The Smithtown United Civic Association supports efforts and has advocated for consolidation and resulting efficiency for some time, but expansion of the existing town hall is not the only option. Specifically, utilization of the existing New York Avenue School must be formally explored. Proper business cases must be developed, become completely transparent and the best option for Town of Smithtown taxpayers (e.g., town vs. school tax) selected.

The Smithtown school district can function without the New York Avenue School building, as best evidenced by its recent attempt to sell the property. Not much has changed, except the school board membership. The school district had only informal discussions with the then town leadership, and as legend goes, was told to seek dense redevelopment. The bid by Southern Land Development was met with very strong opposition, forcing it to withdraw its bid offering. Leadership was embarrassed, in a he said, she said situation between town leadership and the school district. Consequently, no trust and no open communication has subsequently transpired, only legal posturing.

Clearly, an opportunity for the school district to reduce operating expenses exists, especially valuable during times of declining enrollment, increased labor costs, reduced state aid and increasing taxes. Yes, school district relocation costs must be understood and properly funded in the process. Clearly, an opportunity for town consolidation exists, arguably enabling redevelopment and launching the long overdue downtown revitalization. Yes, the New York Avenue building needs some remediation work, but let’s not lose sight of the fact that people are currently occupying the building. We need to call upon our elected officials and school board to seriously consider this option.

The school building, also known as the Joseph M. Barton building, sits on 13 acres, was built in 1924, and is about 76,000 square feet in size. It was built as a secondary school, used as a junior high school and became the district’s administrative offices in 1986. Today it serves its function as the district’s central office, adult education programs and board of education meetings. The site also includes athletic fields used by many, such as the Smithtown Kickers Soccer Club. The grounds are the last available green space within the downtown business district. It sure seems like a great opportunity exists to repurpose this historic building, while preserving open green space.

The concept of a town buying a school building is not new to Long Island. We need only to look to our neighbors in the towns of Huntington, Islip or Babylon. As an example, the Huntington Union Free School District sold its building on Main Street in 1978 to the Town of Huntington for $1.

Before moving forward we need transparent business cases developed for each option so that the right decision for a Town of Smithtown taxpayer is selected. We need to hold all of our elected officials accountable. The Smithtown United Civic Association is committed to creating the necessary visibility, driving accountability and facilitating the necessary dialogue. Maybe we need to start by getting everyone in the same room. Any objection from either town or school board?

We live in a wonderful community. We love our schools, local businesses and our beautiful homes. Please help and show support by attending town board meetings. If you can’t go, call or write our council members and let them know you share the Smithtown United Civic Association vision. We need to explore the New York Avenue School purchase and preservation of the last available green space in downtown Smithtown. Together let’s make Smithtown an even better place to live.

A Smithtown man has pleaded guilty to threatening to harm United States senators.

On Feb. 28, Ronald DeRisi pleaded guilty at the federal courthouse in Central Islip to threatening to assault and murder two U.S. senators in retaliation for their support of the nomination and confirmation of Justice Brett Kavanaugh to the U.S. Supreme Court.

“This defendant threatened to assault and murder two sitting United States senators in an effort to intimidate them and interfere with their performance of official duties,” said U.S. Attorney Richard Donoghue. “Ours is a system of laws — not threats — and the Department of Justice will vigorously prosecute those who seek to undermine the integrity of our constitutional system through violence.”

In September and October of 2018, DeRisi telephoned and left more than 10 threatening voice messages at the offices of two United States senators using a prepaid cellular telephone that was recovered when DeRisi was arrested Oct. 19, 2018. Live ammunition during the execution of a search warrant was also seized. Federal prosecutors have not identified the two senators threatened.

According to an Oct. 25, 2018, article in The Times of Smithtown, police said they believe DeRisi left two voice mails Sept. 27 for one senator, who is only identified as their home state “is not New York.” While the male caller did not identify himself, in the first message it was said he had a “present” for the elected official, specifically, “a 9mm [gun].”

In a second voice mail recorded less than an hour later, the caller ranted, “We’re tired of this guy. Sucking taxpayers’ money! Getting a free [expletive] ride! How many more years you gonna do it? None! He’s a dead man!”

In addition, DeRisi allegedly left 10 voice mails at the Washington, D.C., office of a second senator between Oct. 6 and 8, according to capital police. The male caller did not identify himself by name in any of the messages. In one call, the man police believe to be DeRisi allegedly attempted to get the senator’s home address.

“Thanks to you [Senator], we now have a sexual predator on the Supreme Court …,” the caller stated in one voice mail, according to court records. “Good job [senator], thank you very much. We will proceed to correct it …”

DeRisi has a prior record of making threatening phone calls dating back to February 2015. He pled guilty to one count of second-degree aggravated harassment in Nassau County 1st District Court after repeatedly calling a victim’s home and office more than 15 times.

DeRisi faces up to 10 years in prison, and as part of his plea agreement with the government will forfeit two rifles to the United States.

A former worker at the Commack School District has been indicted for the alleged illegal possession of weapons and drugs following an investigation by the Suffolk County Police Department.

“It’s very concerning to have an individual who has access to a school allegedly be in possession of drugs and illegal firearms,” Suffolk County District Attorney Tim Sini (D) said in a statement. “Residents in the defendant’s neighborhood saw something, said something, and the Suffolk County Police Department acted swiftly to investigate and arrest this defendant.”

Patrick Musumeci, 30, a former maintenance worker for Commack School District, was charged with four counts of criminal possession of a controlled substance in the third degree, criminal possession of a controlled substance in the fourth degree, criminal possession of a controlled substance in the fifth degree, five counts of criminal possession of a weapon in the third degree, four counts of criminal possession of a firearm, criminal possession of stolen property in the fourth degree and several misdemeanors.

On Feb. 6, at approximately 5:35 a.m., Suffolk County police detectives from the 5th Squad Special Operations Team and officers from the Emergency Service Section and 5th Precinct Gang Unit executed a search warrant at Musumeci’s residence, located at 57 Wilmarth Ave. in Patchogue. The search warrant was executed pursuant to a narcotics investigation into alleged drug dealing at the residence, which was reported to police through the Suffolk County Crime Stoppers hotline.

Commack school officials reacted to news of Musumeci’s arrest by posting a letter to district residents on its website.

“The district has found no evidence to date that he ever brought a weapon or drugs onto school property,” reads the district’s statement. “To date, we have not found any suspicious activity on school property.”

Musumeci was allegedly in illegal possession of four assault weapons and four additional firearms, namely a Bee Miller 9 mm semi-automatic rifle, a .233-caliber Bushmaster Remington semi-automatic rifle, a .233-caliber Smith and Wesson Remington semi-automatic rifle, a .22-caliber CBC long rifle semi-automatic rifle, a .40-caliber Glock Smith and Wesson semi-automatic pistol, a .40-caliber Taurus Smith and Wesson semi-automatic pistol, a .22-caliber Sturm, Ruger & Co. revolver and a .38-caliber Smith and Wesson special revolver. Musumeci also allegedly possessed brass knuckles.

Two of the handguns recovered during the search warrant were previously reported stolen.

Musumeci is also alleged to have possessed quantities of oxycodone; methadone; Xanax; morphine; concentrated cannabis, known as THC, in e-cigarette cartridges; marijuana; a digital scale; and packaging materials consistent with narcotics sales.

Musumeci was also allegedly in possession of several hand-pressed pills made to resemble oxycodone. An analysis of the pills revealed they were actually composed of a mixture of fentanyl, methamphetamine and tramadol.

Information on Musumeci’s attorney was not available.

Musumeci was arraigned on the indictment Feb. 28 by Suffolk County Supreme Court Justice Mark Cohen. Bail was previously set at $100,000 cash or $200,000 bond. He is due back in court March 19.

If convicted of the top count, Musumeci faces a maximum sentence of up to nine years in prison.
