On April 10, Supervisor Ed Romaine (R) met with Cub Scouts from Pack 354 and their leader, Rob DeStefano, to present them with a certificate of congratulations for cleaning up the Setauket-Port Jefferson Station Greenway. The supervisor also presented Town of Brookhaven pins to commemorate their efforts.

Suffolk County Legislator Kara Hahn (D-Setauket) helped kick off the service project by joining the Scouts along the cleanup — filling a full five-gallon bucket with trash along the way.

The Setauket Port Jefferson Station Greenway is a three-mile-long trail that wanders its way from the east trailhead on Route 112 in Port Jefferson Station to Limroy Lane in Setauket. Parking is available at both locations. Construction was completed in two phases with the first trail section opening in 2009 and the subsequent phase opening in 2014.

A true linear park, the Setauket to Port Jefferson Station Greenway is the longest paved multi-use trail in Suffolk County. The Greenway utilizes land acquired by the NYS Department of Transportation in the 1960s for a planned bypass of Route 25A. This bypass has been re-purposed, and today you can walk or bike through an amazing variety of terrains and landscapes: an old growth forest, rolling hills, rhododendron woodlands, neighborhoods, county parkland, old farmland, etc. With the recent opening of Phase II of the trail, you are now able to pedal from the Setauket Post Office to upper Port Jefferson Station. The path runs approximately four miles and is handicapped accessible.

The experts were right. U.S. Federal Reserve System Chair Jerome Powell recently said that raising interest rates 50-basis-points, which converts to .5%, is on the table for the central bank’s May meeting.

The May rate increase will follow the Fed’s decision to raise rates in March. It would be the first time since 2006 that rates were raised in back-to-back meetings. And, the half-point increase would be the first in 22 years.

Mortgage rates

Since January, mortgage rates for a 30-year fixed mortgage have climbed from an average of 3.11% to a current 5.35%. It’s the first time that the rate has gone above 5% in a decade. We’ve mentioned in several past articles that experts have always projected rising interest rates spread across 2022, even though they are still on the low side.

Mortgage rates on the rise and inflation fluctuating may prompt people to question where the housing market is leading. People may also wonder how home prices and home unit sales will be affected.

According to Sam Khater, Freddie Mac’s chief economist, mortgage rates increased for seven consecutive weeks. “While springtime is typically the busiest homebuying season, the upswing in rates has caused some volatility in demand,” Khater said. “It continues to be a seller’s market, but buyers who remain interested in purchasing a home may find that competition has moderately softened.”

This softening makes sense as many potential buyers may start looking for houses in a lower price range or take a break from looking at homes.

Debunking some myths

Some buyers may want to wait until home prices and mortgage rates decrease, which isn’t a financially-savvy move. It’s imperative to keep in mind that rates and prices will continue to rise, so the longer you wait, the more it will cost you.

Homeowners, don’t think you can set the asking price at whatever amount you want because of a seller’s market. Your house still needs to be priced appropriately. Real estate professionals have seen homes that have remained on the market for months, even though most properties have sold in days around them. It’s all about pricing.

Despite memories from the early 2000s, the housing market is not in a bubble ready to pop. The 2006-08 bust happened because of the foreclosures that flooded the market due to purchasers who weren’t qualified for the mortgage they had and homeowners using the equity in their homes as if it was an ATM.

What has happened in the real estate market the last few years has happened naturally and hasn’t been generated by financial institutions easing lending requirements. Today’s market is continuing as a seller’s market with homes continuing to appreciate due supply and demand, because the pandemic increased the number of people who realized the importance of having their own home, especially in the suburbs.

Takeaway

A recent article in The New York Times, “The Sky-High Pandemic Housing Market Finds Gravity Does Exist,” summed up the current real estate market best.

“By any standard that prevailed before 2020, this would be a hot real estate market.” While demand is subsiding slightly, home prices remain high, with economists predicting a continued rise in the near future.

Concerned local property owners were joined by members of Saint James-Head of the Harbor Neighborhood Preservation Coalition and other representatives to block the planned subdivision by Gyrodyne to repurpose the 63-acre Flowerfield site. A legal challenge was filed April 26 to overturn the March 30 preliminary subdivision approval by the Town of Smithtown Planning Board.

The application proposal from Gyrodyne included a multistory 125-room hotel along with 250 assisted living housing units, 175,000 square feet of office space, parking to accommodate over 2,000 cars and a 7-acre sewage plant. 

Among those who spoke at Tuesday’s press conference on the corner of Mills Pond Road and Route 25A outside of Flowerfield were local attorney Joseph Bollhofer; Town of Brookhaven Councilmember Jonathan Kornreich (D-Stony Brook); legal counselor E. Christopher Murray; and Judy Ogden, Head of the Harbor village trustee and neighborhood preservation coalition spokesperson. 

“Our lawsuit has been filed and the decision to file this litigation against the Smithtown government was not made lightly,” Bollhofer said. “Like many of you, I love this town. I grew up here, my wife was born in St. James. In the 1970s, I did my Eagle Scout project for the benefit of the people in this town.”

Bollhofer went on to say that the “Smithtown government is doing a very good job” yet its handling of the Gyrodyne application has been bungled. “It’s been our hope that we are able to preserve this property,” he added. “We’ve been doing our best to get the people involved with this to come together to try and find a way to get the money to pay Gyrodyne fair compensation for this open space.”

Representing Three Village Civic Association was Herb Mones. “Smithtown has to go back and review its determinations on this property,” he said, while also saying that in the opinion of many in the civic association, the Town of Smithtown did not pay close enough attention to the law that required them to “carefully review what the buildout would mean to the surrounding community.”

Living just 600 feet up the road from Flowerfield, Ogden spoke on behalf of residents in the communities of both St. James and Head of the Harbor. Together, Ogden said community members have been speaking publicly against the Gyrodyne subdivision application for the past two years.

“We’ve been speaking at public forums, at Zoom meetings, writing letters and sending emails at every opportunity that has been provided to express our concerns with the proposed Gyrodyne megadevelopment,” she said. “But no matter what we say or how many people show up, our voices have been ignored.”

For more than a year, opponents to the subdivision application have said that the environmental impacts of changes Gyrodyne made to its original plan after the initial environmental review was completed have not been evaluated and “did not comply with state law,” according to a press release issued on the day of the event.

“The role of government is to show leadership, which represents all people of the community and follows a comprehensive plan steering development in the right direction, while preserving and enhancing the nature of our community and natural resources,” said Ogden.

On April 21, representatives from local environmental groups joined U.S. Rep. Tom Suozzi (D-Glen Cove) at Sea Cliff Municipal Beach for an announcement affecting the Long Island Sound.

Suozzi said he helped deliver more than $33 million of federal funds that will be allocated for the Sound and environmental cleanup projects across the Island and Northeast Queens. 

Out of this allocation, $300,000 will be used for shellfish seeding of Hempstead Harbor, Oyster Bay and Huntington Harbor to purchase approximately 10 million seed clams to be placed in the three harbors. The clams will be strategically placed in areas where they will not only filter the water, but also produce sufficient larvae to greatly expand those populations well into the future.

“Community Project Funding allows members of Congress to request funding to support specific community projects that will have the most real-life impacts in their districts,” Suozzi said. “Of the eight projects that I secured in the federal budget, five of them are environmental cleanup and restoration projects. I have devoted a significant part of my past 25 years in public service to cleaning up the pollution, dramatically reducing nitrogen, modernizing sewage treatment plants, and restoring shellfishing in our local waters. Since coming to Congress in 2017, I have fought for and successfully helped increase federal funding by 900% to clean up and restore the Long Island Sound. This $33 million, one of the largest single federal investments in environmental cleanup and restoration across Long Island and Northeast Queens, will go a long way in restoring and improving the Long Island Sound for generations to come.”

The funding is part of the federal budget signed into law last month. It represents one of the largest single federal investments in environmental cleanup and restoration across Long Island and Northeast Queens.

Adrienne Esposito, executive director of Citizens Campaign for the Environment, at the press conference, called the funding a reason to celebrate. 

“Long Island Sound is a natural treasure that offers all segments of society the opportunity to enjoy fishing, swimming, beach-filled days, and water-based family activities,” she said. “Restoration efforts are working and the Sound is getting cleaner. Increased funding will help us continue progress on reducing nitrogen pollution, filtering stormwater runoff and restoring wetlands. It will also help us address new challenges to the Sound including impacts from climate change, invasive species and plastic pollution.”    

The Town of Smithtown Highway Department began the paving season last week, equipped with new machinery geared at saving tax dollars and executing projects at a much more efficient pace. The new BOMAG milling and Cimline pothole repair machines were approved for purchase by the Town Board last Summer (July 2021) and acquired by the Highway Department early this year. On Tuesday, April 12th, Highway crews used the new milling machine to remove old asphalt along Brooksite Drive. The paving of Brooksite Drive from New Mill Road to Jericho Turnpike was completed within two days.  Additionally, the Highway Department did not have to seek private contractors to perform the work, which results in significant savings for the taxpayers.

“Milling work has been farmed out to private contractors in the past. When you look at the big picture, all the roads that are paved inside of one season, adding to that, the cost of inflation, this machine will save a noteworthy amount of tax dollars this year and in the years to come. Additionally, both the milling machine and the pothole repair machine give our road crews an edge to complete high quality work more efficiently, which translates to less traffic, safer roads and happier residents, myself included,” said Supervisor Ed Wehrheim.

In addition to the recent work on Brooksite Drive, Highway crews have begun the final phase of work in a three year road reconstruction project for the Forestwood area. This initiative was a community collaboration between the Highway Department and the Forestwood Civic Association. The project involved repairing or replacing damaged concrete, sidewalks and curb cuts, and paving New Mill Road, Flamingo Drive, Larkspur Drive, Cygnet Drive, Teal Lane, Dove Lane, and Mark Drive. This week, the Smithtown Highway Department began the last of the concrete curb and driveway apron work along Cygnet Drive. Final asphalt paving will commence upon the completion of the Cygnet Drive effort.

“We can’t just go in and pave over already damaged roads. When concrete is broken, water gets in and that badly damages the roads. Performing road reconstruction projects such as the one in the Forestwood area will sustain the infrastructure for upwards of 20-30 years. That results in fewer resources required to maintain the Town’s 470 miles of roads, which in turn nets a major savings for Smithtown Taxpayers. This course of action is the responsible thing to do. But we’re also building safer streets for pedestrians, bicyclists and drivers, preventing costly motor vehicle repairs, and preventing dangerous and costly flooding from occurring. In conclusion, rebuilding infrastructure with this path forward addresses everyone’s interests, needs, wallets and future,” said Robert Murphy, Superintendent of Highways

Highway crews have begun a similar concrete and road program in the Mills Pond Estates this week. The work is being done in house and will include the replacement of curbing, aprons (where applicable) and curb cuts throughout the subdivision roads. Temporary patch work is currently underway along Meadow Road, while school is out for the Spring break. The Town is actively working with Congressman Zeldin’s office to secure additional federal grant funds to replace the drainage infrastructure and to permanently repair Meadow Road. Additionally, materials required to begin pothole repairs, with the newly acquired machine, are expected to arrive within the next two weeks. Work will begin immediately following. Residents can download the Town of Smithtown Mobile App for real time updates regarding roadwork, detours and potential travel delays.

Suffolk County Executive Steve Bellone has announced that the Suffolk County Veterans Service Agency will host its third annual Drive-thru Resource and Stand Down Event on Saturday, April 30 in the north parking lot of the H. Lee Dennison Building located at 100 Veterans Memorial Highway in Hauppauge from 11 a.m. to 12:45 p.m.

This year, 22 organizations and county agencies will participate, offering a variety of resources free-of-charge.

“Suffolk County is home to the largest veterans’ population in New York State and we must do all that we can to support our nations heroes,” said County Executive Bellone. As part of the event, our local veterans will have access to critical information about services currently available to them, along with a host of supplies, including COVID-19 test kits.”

Attending veterans and their families will have an opportunity to receive clothing, fresh produce, personal hygiene items, cleaning supplies, gift cards, blankets, and much more. Information on various nonprofit veteran services, including for physical and mental health, will also be available. Registration is encouraged, but not required. To register, click here.

Over the last two years, more than 200 veteran attendees have received resources from the various organizations and county agencies at the Drive-thru Resource and Stand Down Event. The County anticipates 200 to 300 veterans will attend this year.

Founder of the Bald Eagles of Centerport Facebook group honored

At the April 12th general meeting of the Suffolk County Legislature, Legislator Stephanie Bontempi (Centerport) formally recognized Robert Schwartz, founder of the Bald Eagles of Centerport Facebook group. In addition to Bontempi sharing a little bit about Mr. Schwartz’s contributions to the community, he was presented with a proclamation to commemorate such.

Schwartz’s group has an enormous following and has become an important advocacy platform for the protection of the local bald eagles and the environment in general. The group’s presence on social media also provides an opportunity for bald eagle admirers to share their photos and stories associated with their unique encounters with the national bird.

“In Huntington, when one thinks of its bald eagles, Mr. Schwartz’s group will likely come to mind. The ever-growing following of the Bald Eagles of Centerport is proof of its ability to communicate how special these birds are,” said Bontempi. On top of his interest and advocacy work associated with the bald eagles, Schwartz is also a thriving beekeeper. Whenever there is an opportunity to share his knowledge in these two arenas, he does so with great enthusiasm and has likely inspired many individuals of all ages.

“Whenever Mr. Schwartz talks about the bald eagles or his beekeeping activities, you cannot help but listen intently as his passion is contagious. As a former teacher, it is fantastic to see someone with such a thirst for knowledge and the ability to motivate others to broaden their horizons in constructive and unique ways,” added Bontempi.

On Wednesday, April 13, two guest speakers presented to the Port Jefferson Harbor Commission on the state of Port Jeff Harbor and its future.

George Hoffman, co-founder of the Setauket Harbor Task Force, shared the history of the harbor commission over the last two decades.

“Up until 2000, the commission hadn’t been created and every village kind of did its own thing and the [Town of Brookhaven] did its own thing,” he said. “You had overlapping regulations in terms of boat speeds and where you could clam and where you could moor.”

This changed after the 2000 Port Jefferson Harbor Management Plan, which directed the various coastal municipalities in the area on how to best manage the harbor. Today, the villages and the town coordinate their efforts through the harbor commission, which harmonizes laws to monitor boating safety, establish mooring fields and regulate maritime traffic. While the villages have succeeded in these areas, Hoffman suggests the commission now has the experience and know-how to devote greater attention to water quality.

“Now that you have all of the other issues kind of resolved, I think now it’s time to consider how this commission can start to help manage the harbor itself as an environmental entity,” Hoffman said.

MS4 regulations

During the first hour of a storm event, rain often carries harmful contaminants from lawns, roads and sidewalks, discharging oils, bacteria and particulate metals into nearby surface waters. This phenomenon poses a hazard to marine life.

In an effort to reduce contamination of surface waters during storm events, new state regulations will require coastal municipalities to develop a more comprehensive stormwater management program. New York State Department of Environmental Conservation released guidelines regulating small municipal stormwater sewer systems, known as MS4s.

Under the existing policy, local governments are given wide latitude over the maintenance of their MS4s. “In the ’50s and ’60s, we never really gave a thought about stormwater — we just figured if it goes into the harbor, then it will dilute and everything will be fine,” Hoffman said. “We found out that that’s just not the way to go. This really has significant impacts.” 

With stricter directives and harsher penalties under these new regulations, Hoffman noted the need for personnel: “That’s never a good thing for municipalities because you have to fund those positions and budgets are always tough no matter where you are.” He added that the Port Jefferson Harbor Commission — which includes officials from the town as well as the villages of Port Jefferson, Belle Terre, Poquott and Old Field — already have the infrastructure in place through the commission to coordinate their efforts in complying with these directives. 

“I actually think that the Port Jeff Harbor Commission could be a great vehicle to help all the municipalities comply,” Hoffman said. “If every village has to go out and hire its own computer programmer to do the mapping of the stormwater, and has to hire somebody to run the public meetings and has to identify all the groups that are interested — it seems to me that it would be better if we all pulled together through this commission and handle all of our MS4 responsibilities together.” 

Acknowledging the limitations of an all-volunteer commission, Hoffman’s plan would have the various villages appropriate funds to hire part-time personnel to oversee MS4 regulatory compliance: “This can actually save your villages money because if everybody pools their resources together, you can probably just get one person in here — and it wouldn’t even have to be a full-time position — to help manage the MS4 regulations.”

Public outreach is also a major component of these new guidelines. Hoffman said that under the current policy, public hearings are not mandated. Now, municipalities must hold public hearings to identify the stakeholders in their areas and report on the quality of their surface waters. Again, Hoffman said the commission can make it easier to satisfy this condition.

With greater emphasis on water quality, he said the commission can also tap into the Long Island Sound Study, a program that offers grants to protect and restore the Sound.

“The Long Island Sound Study has been in existence now for 20 years,” Hoffman said. “It’s a pact between Connecticut and New York and all of the federal monies for the Long Island Sound go through it.” Referring to the Setauket Harbor Task Force, he added, “Our group is part of the Citizens Advisory Committee and we’re very active members of that group — that’s the one that gives out the grants for $10 million.”

Planting oysters and clams

Alan Duckworth, environmental analyst with the Town of Brookhaven, also addressed the commission during the meeting. His presentation highlighted a recent undertaking by the town to improve water quality of its harbors through the planting of large numbers of oysters and clams.

In recent years, the town has attempted to strengthen its understanding of the quality of its harbors and bays, and also the pathogens and contaminants that pollute them. While traditional testing indicates that the quality of Port Jeff Harbor has improved, Duckworth notes some notable deficiencies in these testing schemes.

“There are so many pathogens in Port Jeff Harbor and elsewhere,” he said. “Some of them are from humans, but a lot of them are from water fowl. DEC does checks for pathogens and uses E. coli as a marker.” However, acknowledging the limitations of these tests, he added, “They don’t separate human E. coli from avian E. coli. Obviously some of the pathogens are coming from human waste, but a lot of it could be coming from birds.”

The town grows approximately 1.5 million oysters and another 1.5 million clams every year that it puts out into various harbors and bays. The addition of these shellfish populations aids the local fishing industry as well as recreational shellfishing. 

The oyster and clam populations serve as “filter feeders,” flushing harmful contaminants from the waters and spitting out filtered water. These shellfish have a beneficial impact on water quality, according to Duckworth. 

The town’s planting activities also attempt to restore the natural populations that once flourished along the Island coastline. “What we see today is only a fragment of what used to occur around Long Island in the bays and harbors,” Duckworth said, adding, “Through disease and through overfishing, in some areas the natural populations are 1% of what they used to be. We put out oysters and clams to hopefully kickstart the next generation.”

With funding from the National Fish and Wildlife Foundation’s Long Island Sound Futures Fund, the town has been able to track the effects of these shellfish populations on the quality of its surface waters. Measuring water quality with an instrument called a sonde, researchers performed two experiments — one within an area of 100,000 oysters in Port Jeff Harbor and another approximately 60 feet away from the oysters, which served as the control. Measuring the removal of microalgae by the oysters, the researchers found “about 100,000 oysters are removing about 50% of the microalgae, which is a fantastic result,” Duckworth said. 

In a separate test for turbidity, a measure of the number of sediments floating around in the water, he said, “They also remove about 50% of these sediments, which improves water clarity. That’s really important for photosynthetic organisms and things that require sunlight.” Duckworth added, “If you have 10 feet of dirty water, all of the things that live on the bottom and require sunlight can’t photosynthesize. When you clean that water, it’s really important for the animals and plants that live there.”

A final experiment tested whether these plantings have any effect on restoring the natural populations of shellfish in the harbor. The researchers put out bags of empty oysters shells and found that baby oysters began to move into those shells, an indicator that the planted oysters are adapting to their new environment.

“The oysters that we put out are now adults, they’re now producing larvae, and those larvae are actually finding places to settle, in this case the oyster shells,” Hoffman said. “They‘re actually reseeding Port Jeff Harbor.”

Reflecting upon these studies, Hoffman concluded that the work being done is having a positive effect on water quality and points to an optimistic future of the harbor. “This is a good story,” he said. “We’re showing that, yes, the oysters that we put out are cleaning the water, but they’re also helping to reseed and restock the natural populations that we all want to bring back.”

In a continuing effort to report on bluff erosion near the Port Jefferson Country Club at Harbor Hills, TBR News Media reached out to the Village of Port Jefferson to discuss the recent visit by assessors from the Federal Emergency Management Agency.  

Village administrator, Joe Palumbo, detailed FEMA’s visit to the village. He said the inspectors were assigned to assess the damage caused by Hurricane Ida last September to the recharge basins on Oakwood Road, Port Jefferson. 

“FEMA’s recent visit was to inspect and assess the damage caused by Hurricane Ida to the large and small recharge basins on Oakwood Road,” Palumbo said. “For some reason, this group of FEMA inspectors were not assigned to inspect the bluff project.” Adding that he hoped to get more clarity on FEMA’s plans, he said, “I had a call with FEMA to find out why and whether they are coming back to inspect [the bluff]. I hope to have a response to these questions on, or before, my next call with them.”

In an emailed statement, the village administrator provided additional historical context surrounding this issue. He described the difficulties of working with governmental agencies that lacked the sense of urgency necessary to secure the village’s assets in a timely manner.

“The village was unable to take action to stabilize the bluff until it received permits to do so from [the Department of Environmental Conservation] and Army Corps of Engineers,” he said. “It has been a long process. We submitted our permit to DEC in 2018 and received [approval] this past June.” 

Palumbo was also asked about the concerns raised by village residents, who want a public hearing and referendum on the matter. According to him, the village has worked closely with a coastal engineer who has provided an informed assessment of the proposed projects at East Beach.

“The village has been working vigorously with an experienced and qualified coastal engineer to develop a plan that will stabilize the bluff and protect the village asset that sits atop the bluff,” Palumbo said. “This plan has been presented and approved by a majority of the Board of Trustees, and is the plan that we believe is the best to preserve the bluff for many decades to come.”

Port Jefferson is not alone in its struggle against coastal erosion. Belle Terre is also taking up measures to counteract erosion of its beaches and mitigate storm damage. When asked if there was any intergovernmental cooperation between the villages of Port Jefferson and Belle Terre, Palumbo acknowledged the limitations of coordinating village responses.

“The Village of Belle Terre is a separate entity,” he said. “Our engineers had reviewed the measures taken and material used in Belle Terre, but believe the plan developed and materials being used to stabilize our bluff is the right plan that will last for decades to come.”

While the Port Jeff Board of Trustees has already approved a $10 million bond for the two-phased bluff project, Palumbo said the village is actively seeking grant funding that may subsidize the initiative significantly. 

“The village is looking at several funding opportunities, including through FEMA disaster declarations under Tropical Storm Isaias [last August] and Hurricane Ida; discretionary funds through Congressman Lee Zeldin [R-NY1] and Senator Chuck Schumer’s [D-NY] offices; and the [FEMA] Hazard Mitigation Grant Program.”

With two of our Long Island landfills closing in the near future, we will have to work together to redesign our way of handling waste.

New York State legislators, looking for ways to reduce the plastics sent to our landfills, have designed EPR bills (Extended Producer Responsibility) which require producers to reduce the amount of plastics they use and make them responsible for their final disposal, relieving municipalities of the cost. The EPR bills were not included in the New York State budget but there is hope that the legislature will pass an EPR bill before the summer.

The good news is that this week a bill that would establish as a state goal to “source reduce, reuse, recycle, or compost no less than eighty-five percent of the solid waste generated by the year 2032” was introduced by New York State Assemblyman Steve Englebright, chairman of the Committee on Environmental Conservation, and was passed by the Assembly. We anticipate strong support in the State Senate as well.

Think about all the sources of waste on Long Island: three million people in Nassau and Suffolk (each creating almost five pounds of waste per day), thousands of businesses, dozens of municipalities, and all of these having overlapping layers of authority, interests and goals. Not only does untreated waste spread across our globe pose a major threat to our health and environment, but it also represents an unexploited source of raw material that can be used. In other words, we treat waste as garbage rather than a resource.

Current systems for collecting and disposing of household waste are part of a linear economy, often categorized as “take, make, throwaway.” By contrast, a circular economy employs reusing, repairing and refurbishing, remanufacturing and recycling to return us to a system that keeps products, materials, equipment and infrastructure in use for longer; and most importantly, produces less waste.

Fortunately we have begun to implement new ways of using our resources, many recalling systems from the past. Repair Cafes, working under the aegis of the Repair Cafe International, are creating facilities where consumers teach one another to repair their furniture and appliances. This month, a Repair Cafe will open in Greenport at 539 First Street from 10 a.m. to 1 p.m. on April 23; it will join 2,333 cafes that exist in eight countries. There are also reuse facilities that fix, update, and sell items that have been discarded, taking the concept of a thrift shop closer to a self-supporting business that keeps waste from the landfill. Producers are looking for more markets for the items created by recycling, which would keep them out of the landfill and make recycling programs more effective.

A Fair Repair Act (S149) was introduced last year and passed in the NYS Senate. This would recognize that consumers have a right to repair the devices they own or use independent repair shops, and require that equipment be designed for durability rather than replacement or disposal. Other states have passed many such bills, but it hasn’t passed in the NYS Assembly.

We need to meet the goals of Assemblyman Englebright’s bill if we are to combat climate change. We have the tools to transition to a circular economy, which will reduce the waste in landfills. The EPR programs that have been designed can reduce the plastics in landfills and other waste depositories. But we need local municipalities and community organizations to educate consumers about what to do — what and where to recycle, where to contribute cast-offs so others can use them, how to compost and how to use the compost.

They will need the support of the county government, the farm bureau, local civic associations, community organizations, churches, and local civic associations to provide training and encourage citizen involvement.

Assemblyman Englebright’s bill was passed by a large margin, suggesting that there is broad public support for building a zero waste economy.
