Brookhaven Town Board held its recurring meeting on Tuesday evening, Dec. 19. Supervisor Ed Romaine (R) opened the meeting with a brief moment of silence to reflect on the giving nature of the holiday season and wished the town a clean bill of health and prosperity in the new year.

Following the moment of silence, Chief Fire Marshal Christopher Mehrman gave a brief presentation on the damages sustained from the Dec. 17-18 storm. Several photographs of the related damages accompanied the presentation. Although the fire marshal’s presentation concentrated on Fire Island and the barrier beaches, he explained that every community sustained some damage.

“Though we are mainly concentrated on the barrier beach, Fire Island, every community sustained some degree of damage,” Mehrman said. 

The presentation provided a detailed estimate of the loss of height and width on the shoreline of the Fire Island Pines community. The loss of dunes will affect the overall protection of this area from the nearby ocean. Romaine emphasized the importance of recuperating from this loss.

“It is something that Councilman Foley (R-Blue Point), Councilman Panico (R-Manorville), and I warned about several months ago,” Romaine said. “Our fear would be exactly what has happened, threatening the stability of the island and several of the homes.”

Upon conclusion of the presentation, the meeting continued with its usual discourse before addressing the dedication of the Edward P. Romaine Nature Preserve, an approximately 8-acre property in East Moriches. The land is a mix of native grasses and shrubs that provide a habitat for various species and will be preserved for open space. 

“There’s no better gift you can give than open space on an island that has sometimes been overdeveloped,” Romaine said. 

“Edward P. Romaine, a long-standing elected official in Suffolk County and supervisor of the Town of Brookhaven for the past 11 years, has been an advocate to protect natural resources and the environment,” the town notes in its resolution. “It is the town’s desire to recognize the many contributions made by Edward P. Romaine to the Town of Brookhaven and the environment by naming this nature preserve in his honor.” 

In conjunction with land preservation, a $60,000 grant — that the town will match — was approved as part of the Suffolk County Water Quality Protection and Restoration Program. The project will restore habitats along Cedar Beach by the removal of invasive plants, establishing native plant species, installing wildlife tunnels, promoting coastal resiliency, enhancing habitat, improving water quality in Mount Sinai Harbor and the Long Island Sound, and supporting the improvement of vulnerable local diamondback terrapin population.

On December 15,  Suffolk County District Attorney Raymond A. Tierney announced his “Evergreen Initiative” – a combined legislative and law enforcement agenda that aims to halt devastating pollution and dumping at the county’s parks, beaches, and forests.

Joined by County Executive-Elect Ed Romaine, Suffolk County Sheriff Errol D. Toulon, Jr., Crime Stoppers President Patrick Fazio, Brookhaven Supervisor-Elect Dan Panico, and Winter Brothers owner Jim Winters, as well as leadership from the State Department of Environmental Conservation, the Pine Barrens Commission, the State Police, the Suffolk Park Rangers, District Attorney Tierney outlined a multi-point plan to turn the tide on environmental assault.

The Evergreen Initiative will:

1. Raise and sustain awareness of rewards available to citizens who report dumping and pollution under current Suffolk County Law, as well as posting reward signage;

2. Encourage more reporting of environmental crimes by increasing the rewards for tips to 33% of the fines collected by the District Attorney through the criminal justice process;

3. Increase the fine schedule for dumping/polluting on county land to $15,000 for individuals, with corporate fines reaching $25,000;

4. Encourage municipalities to mirror the county fine schedule, so that town and village parks are equally protected;

5. Invest an additional $10,000 into environmentally-friendly covert surveillance equipment and deploy the trip-alert system throughout county parklands;

6. Coordinate with Crime Stoppers and the Suffolk County Parks Watch reporting systems to facilitate easier reporting;

7. Seize and impound all vehicles that are utilized to dump or otherwise pollute public lands;

8. Ensure that fines and clean-up money are used locally in Suffolk County;

9. Putting offenders to work cleaning Suffolk parks and beaches as part of their sentences; and

10. Seek maximum financial penalties on all environmental cases. The combination of increasing fine schedules and reward percentage will mean that a Good Samaritan report of dumping can receive up to $8,250 from fines and up to $5,000 from Crime Stoppers.

District Attorney Tierney also emphasized that the statute of limitations on certain dumping crimes can reach back to 2018 and reports leading to convictions are always welcome and will be rewarded in accordance with the law. As part of the Evergeen Initiative, the increased rewards for reporting dumping and pollution will be posted on the public entrance of every county park.

“I am confident that these measures will make an impact,” said District Attorney Tierney. “Our office will continue to seek maximum financial penalties, which will translate to higher rewards for those who report polluters. All local municipal leaders are encouraged to adopt similar local legislation at the town and village level so that our incentives do not redirect the illegal dumping to your parks. We all must work together so that Suffolk’s natural beauty is universally protected.”

“Over the past year, Brookhaven has conducted more than 750 roadside cleanups and 32 other cleanups requiring heavy equipment for illegal dumping, which has included everything from residential waste to boats, campers and even floating docks. The new Evergreen Initiative will be an important tool in curbing illegal dumping and protecting our environment,” said County Executive-Elect Ed Romaine. “I want to thank District Attorney Tierney for his leadership on this issue to protect our open space, our groundwater and our residents from the impacts of illegal dumping.”

“The Suffolk County Sheriff’s Office has been involved in the patrol of the Central Pine Barrens region for the past three decades and we have seen numerous cases of illegal dumping. We’ve discovered garbage of all sorts, from paperwork and yard debris to larger items like furniture, mattresses and even boats,” said Suffolk County Sheriff Errol D. Toulon, Jr.

“Illegal dumping is lazy, illegal and harmful to our environment and our island’s resources. Make no mistake, if you are dumping illegally in Suffolk County, especially in our pine barrens, we will find you and you will be held accountable.”

n addition to increasing fines, rewards, and signage, District Attorney Tierney’s Evergreen Initiative will allocate more than $10,000 worth of additional environmentally friendly covert surveillance equipment, such as cameras, drones, and license plate readers, to undisclosed park lands to catch those who pollute in the act.

Another component of District Attorney Tierney’s Evergreen Initiative will partner his office’s Biological, Environmental, and Animal Safety Team (BEAST) Unit and Asset Forfeiture Bureau with local police departments to penalize those who are caught in the commission of an environmental crime by having their vehicles impounded and held until all fines are paid off – including the cost of clean-up. The fines collected will be kept locally and used to cover all costs of prosecution. In addition, offenders will be put to work cleaning Suffolk County beaches and trails, planting trees, sorting recycling, and contributing efforts to the county’s environmental organizations.

The District Attorney will track all reports that lead to convictions so that appropriate rewards are paid.

Huntington Town Councilwoman Joan Cergol and Councilman Eugene Cook received a send-off at their final Town Board meeting Tuesday, Dec. 12.

Cergol (D) joined the board in 2017 but has worked in the supervisor’s office for 16 years. Several presenters, from thankful constituents, staff and co-workers — including former Town Supervisor Frank Petrone, fellow councilmembers and former Deputy Supervisor Patricia DelCol — commended Cergol on her public service record.

Tom Hogan, a member of the Huntington Small Business Economic Recovery Task Force, expressed his gratitude for Cergol’s achievements, which include securing millions in grant funding and for Huntington’s downtown, working to increase affordable housing and establishing a shellfish garden.

Ken Patrick Johnson, director of the African American Task Force, said, “Joan’s tenacity, no excuses, getting-it-done work ethic inspired me to get interested in how local government works.”

Town Clerk Andrew Raia (R) added, “Joan, you helped teach me how to be a better elected official when it comes to bipartisanship because you look right past the politics and get right to the issue.”

Cook (R) was elected in 2012, and during his service has maintained his contracting business. Often referred to as a “self-made man,” Cook began his career as a welder before becoming a business owner and councilmember. Petrone complimented Cook’s determination, insight and fresh approach to politics. Veteran affairs was a signature concern of Cook’s.

Richard McGrath, member of the Zoning Board of Appeals, wrote in a letter to Cook, “Your commitment to focus on public service instead of politics became good politics. … You always still seem to find the time and often the resources to help anyone who needed help and asked you.”

“You put the pieces together, and the veterans will always be grateful,” Raia said of Cook, who often worked on behalf of veterans and taxpayers. For example, he repaved the Northport VA golf course at no cost to taxpayers.

In addition to celebrating the service of Cergol and Cook, the town staged a public hearing exploring the possibility of designating two properties as historical landmarks.

Barry Lites thanked the board for their role in the receipt of a county grant of $500,000 for the development of the Huntington African American Museum. Lites is president of the museum board. Cergol sponsored the resolution to dedicate town-owned land for the museum’s 99-year lease.

Brooke Lupinacci and Theresa Mari were elected to fill the seats of Cergol and Cook, and will be sworn in at the next Town Board meeting Jan. 3. 

“In the rough and tumble of politics and government you can get a little beat up, but it is worth it for times like this,” Cergol said of her farewell.

As on any other weekday, traffic buzzed along Vanderbilt Motor Parkway in Hauppauge on Tuesday afternoon, Dec. 12. Yet unknown to those in their vehicles, it was no ordinary weekday.

At the Suffolk County Water Authority’s Education Center and Laboratory, Gov. Kathy Hochul (D) joined public officials, environmentalists and SCWA staff to launch $479 million in grants statewide to invest in clean water.

The program earmarks $30 million for the state’s clean water septic system replacements, directing $20 million of that sum into Suffolk County. Another $17 million will support protecting drinking water from emerging contaminants, Hochul added.

The governor projected the initiative would spur 24,000 new jobs statewide and save ratepayers $1.3 billion annually.

“This is a great day for the people of this county and the people of this state,” she said. “It’s an investment in our environment. It’s an investment in justice. And it’s an investment in our future for all of our children.”

Outgoing Suffolk County Executive Steve Bellone (D) reported that 360,000 homes and businesses within the county operate on aging septic systems and cesspools, contaminating the sole-source aquifer on Long Island. He said this stimulus, coupled with a $10 million investment by the county Legislature, would enable the county government to fund septic replacements in 2024 and 2025.

“This is an exciting moment because we can see the path to solving the crisis,” Bellone said, adding the funds would bolster the clean water septic industry in Suffolk while advancing the administration’s two primary objectives of establishing a countywide wastewater management district and the Clean Water Restoration Fund — blocked by the county Legislature earlier this year.

SCWA board chair Charlie Lefkowitz said the funds would assist the public utility in its mission of eliminating emerging contaminants from the drinking supply.

“This announcement today is historic,” he said. “It’s historic that the sewer projects, the septics that contaminate and get into our bays and streams and harbors — we can finally address it.”

He added, “We look at some of these large infrastructure projects that we’re working on — sewer projects, the electrification of the Long Island Rail Road’s Port Jeff Branch — these are projects that when you look back 100, 150 years and none of us are here, they’ll say, ‘That group of people really did it the right way.’”

Village board hires financial firm to untangle information gaps in capital fund record keeping

Concerns were raised by newly-appointed village treasurer Stephen Gaffga about the bookkeeping practices that track the village’s capital project fund, prompting a call for a full accounting of the fund’s financial records going back at least seven years.

Gaffga was recently the treasurer for the Village of Greenport. He was hired this past summer by Port Jefferson Village, replacing Denise Mordente who served as treasurer for the previous administration.

During the Nov. 20 meeting of the Port Jefferson Village Board of Trustees, Gaffga described the capital fund’s bookkeeping as having a “severe information gap” in the fund’s ledger. Standard financial procedures “were not followed as best practice,” according to Gaffga.

“I came into Port Jefferson in September, and I saw a negative balance with the capital fund,” the treasurer said. “I tried to figure out how that came to be.”

Gaffga explained at the meeting that capital projects were approved and money was spent, but all these expenses were recorded as a “running tally on the ledger.” This accounting method makes it seem like there is a negative balance for all these projects. 

“That’s not the case — we borrowed money, got grant funding, transferred money from the general fund, but the trail is very difficult to follow,” he said.

Gaffga recommended the board hire an outside specialized CPA firm, PKF O’Connor Davies of Hauppauge, to receive assistance in analyzing the record keeping of the capital fund going back in time. As stated at the trustees meeting, the cost of the lookback should not exceed $4,500 per year analyzed. The goal of the analysis is to uncover the financial history of each capital project and “establish a clean slate,” Gaffga said. 

“It is entirely possible that everything is OK dollarwise, and it is just a mess on the books,” he told TBR News Media. 

Former village Mayor Margot Garant, objected to Gaffga’s characterization of the records. “We did a lot in 14 years, and we used our money very carefully,” she said in an interview, adding, “The documents in place are pretty easy to follow. I don’t know what their issue is.” 

The New York State Office of the State Comptroller requires municipalities to undergo an annual audit of financial records. According to the 2022 audit done by the independent accounting firm Cullen & Danowski of Port Jefferson Station, the village had areas for improvement. 

Firstly, the village neglected to properly inventory its capital “hard” assets, according to Chris Reino, who represented the auditor at the August trustees business meeting.

The village has no running list of assets like trucks, buildings, computer equipment and furniture, for example, since “at least 2014,” Reino said. 

As a consequence, if something goes missing or “there is a catastrophe, it will be hard [for the village] to make a claim to an insurance company to replace it,” Mayor Lauren Sheprow noted.

Secondly, the report indicated that the “village did not maintain adequate accounting records” of the capital project fund.

Cullen & Danowski did not respond to email and phone requests for comment for this story.

Capital project fund

The capital project fund financed a range of projects over time for the village, such as restoring the East Beach bluff, repaving walkways at Harborfront Park, creating the Barnum Street parking lot, building bathrooms at Rocketship Park, digitizing records and more.

The trail of money for a project should be easy to follow by a citizen, according to the state Comptroller’s Office. Bookkeeping for the capital fund should tell the complete story of how taxpayer dollars are appropriated and spent for each project to prevent overspending or leaving financial holes in the funding for essential village improvements. 

“I want this board to be educated about this process, so we are all aware of where the money’s coming from and how it’s being spent,” the mayor said at the November board meeting. 

Financial transparency

At the August board meeting, Sheprow complained that members of the previous board “never saw the 2022 audit.” 

“I don’t recall specifically, but I know I had a discussion with [the trustees] and the treasurer that [the audit report] was in, and I believe that was January,” Garant told TBR News Media.

While financial audits should be posted, along with other yearly financial records on the village website after the Board of Trustees reviews them according to OSC best practice, the 2022 audit submitted to the village administration in January this year was not posted to the village website until this past week, shortly after TBR News Media requested to review the audit report (see portjeff.com/fiscalyear2022auditdocuments).

Mordente did not respond to requests for comment for this story about the village’s 2022 auditing process.

Moving forward, Sheprow said she wants to remedy this perceived gap in transparency.

Gaffga said at the November board meeting the village wants to establish a clean slate so there are no “skeletons bookkeeping-wise that could hold the village back.”

Suffolk County District Attorney Raymond A. Tierney and Long Island Council on Alcoholism and Drug Dependance (LICADD) Executive Director Steven Chassman held a joint public service announcement on Dec. 14 to remind Suffolk County residents that, in light of the increased prevalence of overdose during the holiday season, there are reputable agencies in Long Island that can help those struggling with addiction as well as their families.

November for most of us is a time to celebrate our democracy by voting. And later that month we conjure Pilgrims and Indians celebrating harvest plentitude in peace, as we similarly gather with friends and family to feast and give thanks. But today when vocal individuals and groups are arguing that history and culture are controversial subjects, it’s important to remind us all that there is much more about Native Americans that we can learn from and that should be shared. 

American Indian Day was first celebrated in New York 107 years ago — after Red Fox James (a member of the Blackfoot Nation) rode across our country seeking approval from 24 state governments to have a day to honor  American Indians. But it wasn’t until 1990 that Pres. George H.W. Bush signed a joint congressional resolution designating November “National American Indian Heritage Month.”

The U.S. Census Bureau conducted population surveys which were released as part of their 2020 census:  the U.S. American Indian and Alaska Native population (9.7 million in 2020) is one of the six major race categories defined by the US Office of Management and Budget. There were 1.5 million people who identified as Cherokee. That group has a tragic history, since they and the other “Five Civilized Tribes” of what’s referred to now as the American Deep South were subject to Andrew Jackson’s Indian Removal Act of 1830 leading to the “Trail of Tears.”

This was an effort to forcibly relocate tribes/sovereign nations to Oklahoma and for the federal and state governments to dissolve their tribal boundaries and annex their lands. In today’s world, it can be termed “ethnic cleansing” and it anticipated the U.S. Indian reservation system. And the fighting over Indian lands was not only a 19th century blot on our history. 

Killers of the Flower Moon (book by David Grann, as well as the recent film) recounts the true story of how a white businessman and self-proclaimed “true friend” of the Osage Nation orchestrated the brutal murders of numerous members of the tribe in early 1920s Oklahoma after big oil deposits were discovered beneath their land. 

The ”Trail of Tears” tragedy and the legacy of government disregard (in spite of court decisions supporting tribal land sovereignty and finding against federal and state land seizures) continues to the current day. For example, the Shinnecock Nation continue their efforts to regain control over their ancestral land. The Shinnecock Indian Nation is one of the oldest self-governing tribes in the State of New York and was formally recognized by the United States federal government as the 565th federally recognized tribe on October 1, 2010. 

But Governor Hochul recently vetoed the Montaukett tribe’s state-recognition bill, which had passed the NYS legislature unanimously early in 2023, citing a 1910 judicial decision which claimed that the Montaukett community no longer functioned as a governmental unit in the state. Historian John Strong called those 1910 rulings “racist.” In 1998, a Newsday investigation unearthed documents that appear to be “deceit, likes and possible forgery” in deals that wrested tribal lands from the Montauketts and the Shinnecock Indian Nation. 

Women’s Suffrage leaders in upstate New York in the mid-19th century were strongly influenced by the Native Americans — specifically the Haudenosaunee (Iroquois Confederacy) whose tribal government  was organized to maintain a balance of equality between men and women. There was a wide range of information in local newspapers like the Syracuse Standard, creating a sophisticated understanding of Haudenosaunee culture and tribal government. Also there was a great deal of personal interaction; friendship and visiting were commonplace activities. 

Elizabeth Cady Stanton and Matilda Joslyn Gage, as major theoreticians of the woman’s rights movement, claimed that the society in which they lived was based on the oppression of women. However, their neighbors, Haudenosaunee society, was organized to maintain a balance of equality between women and men; women had decisive political power, control of their bodies, control of their own property. custody of the children they bore, the power to initiate divorce, satisfying work, and a society generally free of rape and domestic violence. Women chose their chief, held key political offices, and decision making was by consensus. Thus those early feminists believed women’s liberation was possible because they knew liberated women who possessed rights beyond their wildest imagination — Haudenosaunee women.

Conversations over ethics are ramping up in Port Jefferson, where the village board of trustees is nearing sweeping changes to its Code of Ethics.

A public hearing on the code changes took place on Nov. 20, with the village’s ethics counsel, Steven Leventhal, presenting a draft code that would repeal and replace the existing ethics standards within the Village Code. The proposed code changes include three main categories: a code of conduct, disclosure requirements and administration. The board reconvened Tuesday night, Dec. 5, for a work session spanning over four hours.

“The primary purpose of tonight’s meeting is to give you, the board, the opportunity to address any questions that you might have to me and to have a discussion and deliberation on any points that need to be resolved,” Leventhal said.

Leventhal and the trustees walked through the code line by line, clarifying and amending various sections of text along the way.

The board will meet again Monday, Dec. 11, for its monthly general meeting. Leventhal pledged to supply the board with a revised version of the draft code, along with a redline version of the text, before the meeting begins.

Residents can continue submitting written testimony to the village clerk until Thursday, Dec. 7.

The Brookhaven Town Board meeting last Thursday, Nov. 30, began at 5 p.m. and didn’t close until after 11. Many residents who attended stayed for the long haul.

The board heard public comments on the application of Hauppauge-based Staller Associates, owner of the Jefferson Plaza shopping center at the intersection of Route 112 and Terryville Road. Staller is seeking a change of zone for the 10-acre parcel from a J-2 Business District to a CRD Commercial Redevelopment District.

The CRD is a new zoning category within the town Code. Jefferson Plaza will be the first property to receive this classification if the board greenlights the application.

A town official indicated that under the conditions of the CRD code, the development would qualify for 280 residential units. The proposal includes demolishing the existing shopping center to accommodate mixed-use development.

Anthony Guardino, partner at the Hauppauge-based Farrell Fritz law firm, represents the applicant. In a presentation, he traced the property’s historical developments, contributing to “an unsustainably high vacancy rate” with today’s blighted conditions.

The CRD code “creates the planning tool which the Stallers are using to redevelop their blighted shopping center into a destination development with a dynamic mix of residential and commercial uses,” he said. “And after many years of planning and design and input from the town and the community and numerous plan revisions, the Stallers believe it is time to put pencils down. It is time to move this project forward.”

He added that the current plan accommodates 280 apartments — 224 of which will be “market rate,” with the remaining 56 units set aside as affordable housing for people with intellectual or developmental disabilities. The attorney projected that approximately 50,000 square feet of commercial space would be occupied by a restaurant, food hall, retail, office space and health club.

Public comments primarily revolved around building height, density, traffic and emergency services. Ira Costell, president of the Port Jefferson Station/Terryville Civic Association, stressed the importance of proper planning in weighing these factors.

“There is appetite and willingness to see investment in this parcel,” he said. “While this presents an opportunity, it is incumbent on us to address and mitigate the negative impacts that could follow from the intensive use on that parcel.”

Suffolk County Legislator-elect Steve Englebright (D-Setauket), whose 5th Legislative District includes Port Jeff Station, discussed the possible environmental impact of redevelopment. 

Skyler Johnson (D-Port Jefferson Station) — currently pursuing the Democratic nomination for New York’s 4th Assembly District— placed the proposed redevelopment in the context of ongoing affordability concerns.

“If we continue on this path, we will see not only young people not be able to afford to live here, but older people not be able to retire and downsize as their kids continue to need to stay in their homes,” he said.

Some spoke in favor of the redevelopment project. “I am in favor of the zone change,” Port Jeff village resident Brian Harty said. 

Bob LoNigro, whose family-owned business, Plaza Sports, was formerly in the shopping center for decades, said, “I think it is important for the community to understand who they’re dealing with. We dealt with [the Staller family], who were honorable, honest and caring about my family. They cared about our success,” adding, “I was sitting there thinking this was going to be a war, and it’s not a war. We’ve just got to tweak it and make some concessions and get to the finish line. I would love nothing more than to see that place flourish again.”

The board made no decisions on the application. Residents can continue submitting written comments up to 30 days after the meeting.
