While the beginning of the year is typically tax season, it is important to remember that property tax exemptions can be applied for at this time. There are different programs that homeowners should be aware of in order to potentially save with respect to property taxes. 

Most individuals are familiar with the STAR program, which is the New York State School Tax Relief Program. Another program that people may not be as familiar with is the exemption for persons with disabilities. New York State offers local governments and school districts the ability to opt into a grant reduction on the amount of property taxes paid by qualifying persons with disabilities.

The eligibility requirements for this exemption is based on the individual’s disability, income, residency and ownership. For the disability component, the individual must demonstrate a physical or mental impairment that substantially limits the person’s ability to engage in one or more major life activity (e.g., walking, hearing, breathing, working). The applicant must submit proof of disability via an award letter from the Social Security Administration, an award letter from the Railroad Retirement Board, a certificate from the State Commission for the Blind and Visually Handicapped, an award letter from the U.S. Postal Service or an award letter from the U.S. Department of Veterans Affairs. 

If the disability is not permanent, the applicant will be required to certify the disability each year. For the residency requirement, the property must be the “legal residence” of the disabled person and currently occupied by the disabled person. There is an exception for absence due to medical treatment. For the ownership requirement, all property owners must be disabled. The only two exceptions are for spouse- or sibling-owned property. In those cases, only one owner needs to be disabled.

With respect to the income eligibility, the basic exemption is a 50 percent reduction in the assessed value of the legal residence. New York State allows each county, city, town, village or school district to set the maximum annual income limit at any figure between $3,000.00 and $29,000.00. If the disabled person makes between $29,000.00 and $37,399.99, the localities can give a less than 50 percent exemption based on a sliding scale. Proof of income of the most recent tax year is required to be submitted with the application. 

All income sources are countable except Social Security Income (SSI), Foster Grandparent Program Grant monies, welfare payments, inheritances, return of capital and reparation payments received by Holocaust survivors. Certain medical expenses can be used to offset gross income. For example, medical and prescription drug expenses that are not reimbursed or paid by insurance may be deducted from total income. 

Additionally, if the owner is an inpatient in a residential health care facility, the monies paid by the owner, spouse or co-owner will not be considered income in determining the exemption eligibility. Each municipality may be more generous with the exception than others.

Finally, even if all requirements are met, if there are children living in the home and attending public school, the disabled owner is typically not eligible for the exemption. This can be waived by the school district under specific circumstances.

New York State sets out broad eligibility requirements that each municipality can narrow down. It is important to find out the exact requirements for your specific municipality to determine if you qualify for the exemption. The exemption for persons with disability can offer a substantial relief for those who qualify.

The film “1917” is a good news, bad news movie experience.

In a race against time, World War I soldiers Lance Cpl. Blake (played by Dean-Charles Chapman) and Lance Cpl. Schofield (George MacKay) maneuver through dangerous, German-controlled territory to stop an attack by the British that is destined to fail.

The good news for the Universal Pictures movie, which was written by Krysty Wilson-Cairns and Sam Mendes, is that it is a tour de force in direction and cinematography. Audiences track the movements of Schofield and Blake, who has a vested interest in completing a mission that will also likely save his brother, so closely that they feel as if they are on the battlefield. The soldiers trudge through mud, hunch low to avoid incoming bullets, and wade through icy cold water during their difficult mission.

The relatively unknown actors do an incredible job as everymen, portraying the soldiers asked to do the impossible with resources often limited to their survival instincts and their reliance on each other.

Directed by Mendes, the movie includes a few heart-stopping moments, as audience members in a packed theater hold their breaths along with the actors to avoid giving away their position to the unseen but omnipresent enemy.

Even the scenes that don’t involve bullets and combat have a gritty feel. The camera moves through cramped trenches, where the spaces narrow in some areas to places where barely two people can fit shoulder to shoulder.

The film succeeds in portraying so many elements of the horrors of the battlefield. The enormous responsibility of saving 1,600 men weighs heavily on the two soldiers. The film immerses the audience completely in the time period, the action and the goal.

The bad news is that the script is noticeably thin. We don’t know much about either character and, apart from the set up lines uttered by Colin Firth as Gen. Erinmore and Benedict Cumberbatch as Col. Mackenzie, the script isn’t nearly as memorable as the visuals.

Indeed, apart from compelling music, which includes an original score from Thomas Newman that was nominated for an Oscar, the movie could easily have been a silent film with a few subtitles sprinkled between the visuals.

As a movie watching experience, “1917” is immersive and compelling, but its visuals show a better story than its thin script.

Moving from one horrifying and dangerous scene to another, we feel as if we’re running alongside strangers we would like to succeed, if only to reach their important destination and save other troops for whom we have almost as much information as the two lance corporals.

At times, the R-rated movie has overtones with other war films, like “Gallipoli,” a Mel Gibson film with a far superior script, and even with “Saving Private Ryan,” the Steven Spielberg directed epic with Tom Hanks.

In many scenes in “1917,” the effort, amid raining bullets and bombs that fall everywhere, make it seem impossible to survive. Some of the bullet and bomb dodging strains credibility.

The film also includes a quietly touching scene between Schofield and a random French woman, who is caring for an infant. The dialog, however, doesn’t make much sense, though, as she speaks only French and he speaks English, and yet they seem to understand each other.

Looking past the shortcomings of “1917,” the film offers an engaging visual experience, even if we don’t become invested in the characters whose singular mission forms the action and scenery-driven plot.

Twenty years ago this week, my wife and I got married.

Over the course of the next two decades, we have gone through numerous changes and challenges together, providing a united front for our children, hosting relatives during birthday parties and celebrating landmark occasions.

As I think about the many roles we’ve played in each other’s lives I am grateful for my wife, the teacher. In addition to taking time to help educate our children, she has also been an extraordinary educator for me.

Starting with something easy, she taught me to relax. Before I met her, I felt the need to move, almost all the time. Sitting on a beach, a bed or a rock at the top of the mountain seemed like a waste of time. Over the years, taking a moment to soak in the sun, to observe the trees and birds around us, or to talk and laugh about the events of the day have become increasingly enjoyable ways to spend time and connect.

While my wife has taught me the fine art of relaxing, she has also demonstrated an incredible work ethic, balancing between the needs of our family and the demands of her job. She finds time to respond to work emails, to read work material and to answer important calls, all while supporting our children at everything from sports scrimmages to concerts to graduations.

Neither of us is particularly fond of shopping. She has, however, demonstrated how to speed-shop in a store. She has a gift not only for finding what she or any member of our family needs — a black shirt for a coming concert, a white dress for a party or specific socks that are cool enough for school — but also doing it in the most efficient manner, enabling the four of us to race back to the car and on to other activities.

She has also taught me how to laugh. Of course I laughed before I met her, but the laughter wasn’t as frequent and it didn’t continue to help cement my relationship to someone as well as it does with my wife. The absurd surrounds us, if you know what to look for and how to find it.

Of course, I don’t necessarily cherish every lesson the same way. You see, my wife is a cat person, a trait she shares with her mother and siblings. When my wife was pregnant and during the months when she breastfed, I learned the fine art of scooping cat litter and, once a week, changing the pan. I learned how to do this unpleasant but necessary maintenance task as quickly as possible, leaving me with only a slight scent of cat litter on my clothes. Our young children enjoyed watching me expectorate for a full minute after the process ended.

She also taught me the sheer joy of walking the Earth with someone. Before I met her, I was an avid walker, trekking up and down West Meadow Beach, walking around neighborhoods in Manhattan and crossing the Brooklyn Bridge. Ever since then, we have covered thousands of miles in all types of terrain as we share our observations of everything from nature to the events of the day or week. Walking together in stride, I have felt a part of something larger and more meaningful than my own existence.

Ultimately, however, my wife taught me how to turn my dreams into a reality. When I was 13, I read about the Galapagos Islands. When I heard about how all the marine and island life ignores people, I knew I had to visit. Spurred on by my wife, we planned this journey, which in 2013 far exceeded my lofty expectations, just as each year does with the woman I married two decades ago.

This is a happy tale about a lifesaving rescue that particularly pleases me. It must also have pleased The New York Times since the paper gave it a full-page spread under the National news banner this past Monday. The hero is an unlikely 71-year-old retired computer programmer and labor economist named Carl Butz. A fourth-generation Californian, he was aware, like the some 300 other residents of Downieville in the mountainous northern countryside, that the local newspaper, the state’s oldest weekly, was folding with the retirement of its publisher. We know that newspapers across America have been dying, especially in rural areas, and this Sierra County town, like a movie set preserved from the Old West days, was about to become the latest “news desert.”

Downieville’s weekly, The Mountain Messenger, was founded in 1853 and was as constant a fixture over the years as a Thursday is in every week. Mark Twain wrote several articles for the paper that were “a few unremarkable stories,” according to the Messenger’s former publisher, Don Russell, who had run the paper for nearly 30 years and read Twain’s stories on microfilm before he sold it to Butz. “They were awful. They were just local stories, as I recall, written by a guy with a hangover.” Twain was reportedly hiding out there from the law, or so the legend goes.

Then one night Butz, a recent widower, was watching “Citizen Kane” on cable, and had an epiphany. “I can do that,” he decided. He made a deal quickly with Russell, who was a good friend, to pay in the “four figures,” plus assuming some of the paper’s debts, and he never looked at the books. Russell told him he was “a romantic idealist and a nut case,” because the paper was a losing proposition “and someone who would want it would be crazy.”

So why did he do it?

In a letter to the readers of the first edition, Butz explained. “Simply put, the horrible thought of this venerable institution folding up and vanishing after 166 years of continuous operation was simply more than I could bear.” The newspaper was “something we need in order to know ourselves.” The rest of the residents felt the same way, apparently, and the editor of an online news site in town said, “It was devastating for everybody that we were going to lose The Mountain Messenger.”

The paper’s publishing software, Butz learned, was from the mid-1990s. There was no website, no social media platform. The only other employee, Jill Tahija, has been with the paper 11 years and takes to work her small black-and-white dog, Ladybug. Tahija’s
business card reads, “She who does the work.” 

The paper relies mostly on legal notices, from the county and other government offices, which bring in about $50,000 for the bulk of its revenue, has about 700 subscribers throughout the county and a print run of 2,400. “I’m not going to lose a million dollars but I know I’m going to have to subsidize some of it,” the new owner said. “My daughter is already aware that her inheritance is shrinking.”

Butz’s first edition was filled with the usual complement of local news stories: a supervisor’s meeting, wildfire prevention, the upcoming census and a local poetry competition. Russell, meanwhile, was on vacation with his wife, driving his RV up the coast — probably his first time off in three decades.

Downieville has become a popular destination as an old Gold Rush town at a fork of the Yuba River in distant western Sierra County. It has a corner saloon, one-lane bridges over the river, and the newspaper is located in a second-story office above a beauty salon on Main Street and next to the fire department, whose sign on the door reads, “Oldest volunteer fire department west of the Mississippi.” Gold mining and sawmills were once the economic engine. Now it relies on mountain biking and fly fishing. And the paper is a repository of the county’s history, with its vast archives. 

Carl Butz has become to the The Mountain Messenger what Jeff Bezos is to the The Washington Post: A savior who cares who we were and where we are going.

Fear can be a great motivator. Fear of failing a test can lead someone to study harder, to pay attention in class and to do whatever is necessary to learn the material.

In many movies, the lead character has to face his or her fears to accomplish something. Luke Skywalker from the “Star Wars” films had to face his father, Darth Vader, to become a Jedi.

Fear, however, can also bring out the worst in people, especially when that fear is misplaced and misdirected.

Last week, the University of California’s Tang Center, in Berkeley, listed a set of normal reactions to the new coronavirus on its Instagram account. Among other reactions, like feeling anxiety, worry or panic, the school suggested that xenophobia, or “fears about interacting with those who might be from Asia” was also normal. The Instagram post went on to add that having “guilt about these feelings” was normal, too. Chances are, if you’re feeling guilty about a feeling, it’s probably misdirected and uninformed.

Amid an enormous backlash from alumni at the school, whose current freshman class is about 43 percent Asian, the university has since apologized and taken down the post.

The school hopefully learned, and also offered a valuable lesson.

People in the United States are no more likely to contract a virus that currently has a 2 percent mortality rate from an Asian person than they are from anyone else who is sniffling and coughing.

In fact, at this point in the year, someone near you who is sneezing, coughing or looks sick is exponentially more likely to have the flu.

Yes, the vast majority of the almost 25,000 cases of the coronavirus — with about 3,200 critical — are located in China and, yes, many countries, including the United States, have taken strong steps to limit the possibility of turning this epidemic into a pandemic, causing the virus to spread to two or more continents.

Where someone’s ancestors come from, or where they themselves were born, is much less relevant than where they themselves have traveled in the last two weeks.

And, on top of that, even if someone — Asian, Caucasian, African American, Native American or otherwise — has been to Asia in the last month, if that person has been back in the United States for more than two weeks without showing any signs of illness, then he or she falls into the same category as anyone and everyone else with whom we ride the Long Island Rail Road, sit in a movie theater or stroll through a mall. The mandatory quarantine period for people returning from Wuhan, the Chinese center of the outbreak, is two weeks.

Fear of this virus shouldn’t encourage any of us to avoid people with a specific heritage because the virus doesn’t care about the small genetic differences that create races. It only seeks the receptor in our cells that allow it to get inside and cause respiratory infections.

So, how do we manage our fear of the virus? We tackle it the same way we do our fear of getting a flu. We wash our hands regularly, we try not to touch our face, and we don’t shake hands with anyone who has a stuffy nose or is coughing.

We can also boost our own immune system by getting enough sleep and eating the right foods.

The coronavirus, for which there are currently no treatments or vaccines, has generated a steady drumbeat of horrible news, from the number of people infected to those who have died, which has climbed to almost 500 but with more than 1,000 recoveries.

Fear of the virus can be and is healthy, motivating countries to protect their citizens and limiting the spread of the virus. The fear, however, of any group will never be “normal” and certainly isn’t acceptable.

This was the week that was. And what a week of atypical news it was. Let’s start with the coronavirus and its progression toward a pandemic. The global death toll stood at 492 as of Wednesday morning, according to NBC News, and confirmed cases top 24,000 in mainland China. More than 185,000 people are currently under medical observation, Chinese health officials said. Hundreds of U.S. nationals were removed from locked-down Wuhan and have arrived in the United States, as two more rescue planes landed at Travis Air Force Base in Northern California. Passengers will be quarantined for 14 days before being released. So far, there have been 11 cases in the U.S. Trailing China with confirmed cases are Japan with 35, Singapore with 28, Thailand with 25 and South Korea with 19. But the virus has definitely spread beyond Asia and has been found in Germany, France, Britain, the United Arab Emirates, Sweden, Finland and beyond. There are even 10 passengers with the virus from a cruise ship quarantined off the coast of Japan. Another cruise ship, with 3,600 aboard, has been quarantined in Hong Kong. 

While there is talk of work on a coronavirus vaccine, health professionals agree it will take up to a year before such a vaccine would be available to the general public.

A traditional news event with an unusual twist was the president’s State of the Union address Tuesday night in the House of Representatives that had voted to impeach him. Extreme partisanship was on display at the start when President Donald Trump (R) did not shake hands with House Speaker Nancy Pelosi (D) — second in the line of succession to the highest office next to Vice President Mike Pence (R). Then the speaker tore up a text of the speech as the cameras were rolling immediately at the end of the president’s talk.

As residents listened for the results of the Iowa caucuses, the first indication of voter sentiment in a presidential election year, the new app relaying the results that the Iowa Democratic Party planned to use broke down, and those trying to log in or download it had no training for the task. Fortunately, there seems to be paper backup for the votes, but it takes time for the voting cards to be counted by hand. According to partial returns so far, still only 71 percent, former Vice President Joe Biden is trailing the other three leaders: Pete Buttigieg, the former mayor of South Bend, Indiana, and the youngest candidate at age 38, has a slim and unpredicted lead over Sen. Bernie Sanders followed by Sen. Elizabeth Warren. Even as people await the final results, the scene is now shifting to the second voting site and the first primary in the nation, that of New Hampshire.

Back in Washington, the vote in the Senate to impeach the president was another historic and unprecedented news item. The partisan wrangling in the House and Senate between the two major parties has been constantly on display throughout the impeachment hearings the past months. The drama was put forth with an eye to the coming elections and promises a hard and bitter fight from now until November.

A little bit of relief was provided by the annual football contest, the Super Bowl, this past Sunday evening. For those who watched, the fourth quarter provided much excitement and an intensity that blocked out even the loudest grim news. Three cheers for the 24-year-old quarterback, Patrick Mahomes of the Kansas City Chiefs, who brought his team back from defeat and became the youngest winner of both a Super Bowl and a regular season NFL (2018) MVP award.

Then there is Harvey Weinstein and the trial that, for me, is too much in the news. The constant stream of rape details that are being eagerly reported is a nauseating backdrop for the aforementioned news. There will undoubtedly be a movie.

Speaking of movies, the Academy Awards, popularly known as the Oscars, are coming this Sunday, and they should provide distraction from the heavier events. And isn’t it interesting to learn from a recent news article, that there are probably more than 10 million American nudists? See, you can find happy news if you just try.

This week’s shelter pet is Chloe, a 4-year-old female domestic shorthair mix at the Smithtown Animal Shelter. 

Chloe is a special girl with special needs. She suffers from a seizure disorder that is easily managed by two separate medications and biannual blood work. Her ideal furever home is a caring, low-stress environment where she can bask in the sunlight, take in the occasional cat nap and purr through endless petting. 

Chloe is wonderful around other cats and children and would make a great addition to a loving family.

THE FACTS: My brother Tom recently passed away. I am the administrator of his estate. Tom had no children and was not married at the time of his death, but he was living with Sue. They had been living together for over 10 years. 

About a month after Tom’s funeral, Sue told me that she and Tom had been seeing a fertility specialist with hopes of having a child together. Even though Tom had died, Sue still wanted to have his child and she advised me that she planned on using Tom’s frozen sperm to that end. She also claimed that the child that was born using Tom’s sperm would be entitled to a share of Tom’s estate, even though Sue and Tom were not married. 

THE QUESTION: Is Sue correct? Is a child who is conceived and born after the death of a biological parent entitled to a share of the estate of a parent he/she never knew?

THE ANSWER: Without any additional information, my answer to your questions is, “It depends.” Under the New York Estates, Powers & Trusts Law (EPTL), a child who is conceived and born after the death of its genetic parent (the person who provides the sperm or ova used to conceive the child) is, in fact, considered an heir of the deceased genetic parent provided certain steps were taken both prior to and immediately following the death of that genetic parent. 

EPTL Section 4-1.3 is quite explicit as to the requirements that must be met for a posthumously conceived child to be entitled to a share of the deceased genetic parent’s estate. Because of the complexity of the issues surrounding this situation, courts are inclined to interpret the law very strictly.

In order to be deemed the legitimate heir of the deceased genetic parent, at least seven years prior to his/her death, the deceased genetic parent must have expressly consented in writing to the use of his/her genetic material for the posthumous conception of a child. The deceased genetic parent must not only give consent for the use of his/her genetic material, but he/she must also name the person who has the authority to use the material. 

Within seven months of the issuance of letters testamentary or letters of administration, the authorized person must give written notice to the estate representative and to other beneficiaries of the estate that he/she has the authority to use the decedent’s genetic material for the purpose of conceiving a child. The timing of this notice is different if the court has not been petitioned for letters. In addition to giving the estate representative and beneficiaries notice of the authority to use the genetic material, the authorized person must also file with the surrogate’s court the written statement that was signed by the deceased genetic parent in which authority to use the genetic material was granted. 

The genetic material must be used by the authorized person and the genetic child must be in utero no later than 24 months or born no later than 33 months after the genetic parent’s death. If the initial writing of the genetic parent giving consent to the use of his/her genetic material and authorizing an agent does not meet the statutory requirements, or if the notice of requirements and deadlines set forth in the statute are not met, the court will likely deny the genetic child a share of the deceased genetic parent’s estate. 

There is clearly a lot at stake here for people who do not have children but, are hoping to have them in the future. There is also a lot at stake for the potential genetic child and for the other heirs of a deceased genetic parent’s estate. 

In the situation you described, if Tom had, in fact, signed the requisite consent and authorization and Sue meets the statutory deadlines, the child that she has using Tom’s genetic material will be the sole beneficiary of Tom’s estate. Because so much hangs in the balance for all concerned, it is critical that anyone considering the possibility of having a posthumously conceived child and anyone who is handling the estate where such a child was born to seek the advice of an estate planning attorney.

Calamari. When did it get so popular? Great as a snack, an appetizer, part of a main dish or a main dish itself, its chewy but tender texture and mild seafood flavor explains why it’s featured on so many menus. Calamari is fairly easy to cook (usually one minute in boiling water) before deep frying, sauteing, marinating for a salad or adding to a pasta sauce. Available at most fish mongers or supermarkets, it’s nicely cleaned, frozen and conveniently packaged to be thawed, then sliced into rings.

Fried Calamari

YIELD: Makes 4 servings.

INGREDIENTS:

1 pound thawed, frozen cleaned squid

1 cup buttermilk

2/3 cup flour

2/3 cup corn flour

1/3 cup fine yellow cornmeal

Salt and pepper to taste

2 cups or more canola oil

DIRECTIONS: 

Cut calamari tubes into half-inch rings; leave small tentacles whole. Place in a medium bowl, pour buttermilk over it, toss to coat thoroughly, cover and refrigerate at least 2 hours, preferably more. When ready to fry, in large skillet or Dutch oven heat oil to 375 F.  With a slotted spoon remove calamari from buttermilk and let excess drip off. In a shallow dish combine flours, cornmeal, salt and pepper. Dredge calamari with flour mixture and gently place in hot oil; fry, turning if necessary, until golden, about one minute. With a slotted spoon remove the calamari quickly to paper towels and drain. Serve hot with lemon wedges and marinara, cocktail or tartar sauce.

Calamari Salad

YIELD: Makes 4 servings.

INGREDIENTS:

11/2 pounds thawed, frozen cleaned squid, cut into 1/2-inch rings

2 tablespoons freshly squeezed lemon juice

1 tablespoon red or white wine vinegar

1/3 cup extra virgin olive oil

2 garlic cloves, minced

Sea salt and pepper to taste

Half red onion, finely chopped

1/2 cup pitted Kalamata olives, sliced

2 cups halved cherry or grape tomatoes

1 celery rib, cleaned and cut into thin slices

1/2 small fennel bulb, finely chopped

1 handful fresh flat-leaf parsley, washed and finely chopped

DIRECTIONS: 

Bring a medium pot of salted water to a boil; add calamari and cook one minute, then immerse in ice water to stop cooking. When cool, drain in colander; pat dry with paper towels. In a small bowl whisk together lemon juice, vinegar, olive oil, garlic, salt, pepper and red onion; let sit 15 minutes so flavors blend. In a serving bowl, toss together calamari, olives, tomatoes, celery, fennel and parsley; add dressing and toss again to thoroughly blend.  Serve at room temperature with rustic bread and extra virgin olive oil.

Spicy Calamari in Tomato Sauce

YIELD: Makes 4 to 6 servings.

INGREDIENTS:

¼ cup olive oil

1 cup finely chopped onion

4 garlic cloves, minced

One 28-ounce can diced Italian tomatoes

6 ounces clam juice or broth

½ cup dry red, rose or white wine

¼ cup chopped fresh oregano

2 tablespoons fresh thyme leaves

½ cup chopped fresh basil

¼ cup chopped fresh flat-leaf parsley

Sea salt and black pepper to taste 

½ teaspoon dried crushed red pepper flakes

2½ pounds thawed, frozen cleaned calamari, cut into ½-inch rings

DIRECTIONS: 

In a small medium pot over medium heat, warm oil. Add onion and saute until golden, about 5 minutes; add garlic and saute until it releases its aroma, about half a minute. Add tomatoes with their juice, clam juice, wine, herbs, salt and pepper and red pepper flakes. Reduce heat to medium-low and cook, uncovered, until sauce is thickened and slightly reduced, about 15 to 20 minutes. Reduce heat to low, add calamari and cook till tender, about 5 to 10 minutes. Serve with linguine and/or grilled Italian bread slices.
