The 34th annual Roth Pond Regatta at Stony Brook University took place Friday afternoon, April 28. Participating students had to make boats out of cardboard, duct tape, string and paint in order to be eligible to race. The theme of this year’s event was “A Fairy Tale Regatta: This is Our Swamp.”

A press release for the event stated that the event “customarily draws about 3,000 spectators.” However, Riccardo McClendon, dean of students, said, “It’s probably more than that right now. This is one of the largest student events that we have on campus.”

“The beauty about this is that their whole purpose is to be in community with each other,” McClendon added. “The designs are really cool that we see throughout the entire race, and it’s a lot of fun. We’ve got faculty, staff, students, community members all around enjoying the event, and it’s one of those kind of traditional events that everyone comes out for.”

The regatta included individual award categories for the boats that displayed the best “design, appearance, apparent seaworthiness, originality, spirit, environmental sustainability, endurance and adherence to the rules,” according to the press release.

The event featured races for two different categories of boats. One was the “speedster” races, where two people would ride in a small construction, while the other was the “yacht” category, where four people would ride in larger boats.

“After two years of COVID and trying to come back and build community, that’s what this is about,” McClendon said. “We try to keep these traditions going just to remind students that we are a campus, we are thriving, we are engaged in everyday life with each other. So this helps with that.”

New York State has introduced its Automated Work Zone Speed Enforcement program. 

The system clocks vehicles traveling above the speed limit in specified work zones. A registered owner of a vehicle will be ticketed by mail if the posted work-zone speed limit is exceeded by more than 10 miles per hour, according to the legislation signed into law by Gov. Kathy Hochul (D) in September, 2021.

The law states that the “owner of a vehicle shall be liable for a penalty” when that “vehicle was traveling at a speed of more than 10 miles per hour above the posted speed limit in effect within such highway construction or maintenance work area, and such violation is evidenced by information obtained from a photo speed violation monitoring system.”

The ny.gov website indicates that this new program will be “located in construction or maintenance zones on New York State controlled access highways and parkways.” It also indicates that signs leading up to the enforcement areas will make it clear that a driver is entering one.

In a phone interview, Stephen Canzoneri, a spokesman for Region 10 of the state Department of Transportation, said that there will be “two signs posted in advance of the camera.” He added that these cameras are “only being placed in active work zones where there are boots on the ground.”

During the first 30 days of the program —which began Monday, April 17, according to Canzoneri — New York State will issue warnings by mail instead of actual fines. After this initial warning period, drivers violating the posted work-zone speed limits in the enforcement areas will receive a $50 fine by mail.

For a second violation, a violator will receive $75 fine, so long as this violation is within an 18-month period of the first violation. Any third or subsequent violations will result in a $100 fine if, once again, these are within 18 months of the first violation.

The website also states that “there will be 30 work-zone speed units … that will be moved around to work zones throughout the state.” To see an up-to-date listing of where the speed cameras are currently being utilized, go to www.ny.gov/work-zone-safety-awareness/automated-work-zone-speed-enforcement-program and scroll down to “Locations” on the left-hand side. The cameras are “being placed on the limited access highways, such as the Long Island Expressway, Northern State Parkway, a portion of Sunrise [Highway] in central Suffolk,” Canzoneri said.

The ny.gov website clarifies that drivers will not receive points on their licenses for violations in these zones and that these penalties are strictly “civil in nature, with no criminal implications.”

In 2021, there were 378 “work-zone intrusions” and that more than 50 of these intrusions resulted in injury for either a highway worker or a vehicle occupant. “A work-zone intrusion is defined as an incident where a motor vehicle has entered a portion of the roadway that is closed due to construction or maintenance activity,” the ny.gov website states.

“We are seeing an increase in work-zone intrusions throughout the Island,” Canzoneri said. “More people are back on the roads after the COVID shutdowns. And traffic patterns are returning to what they were. And unfortunately, it means that there’s more danger for our workers on the road.”

In a phone interview, Jaime Franchi, Long Island Contractors’ Association director of communications and government relations, said, “Anything that is a deterrent that makes people pause while they’re driving in a zone where our highway workers are vulnerable is something that we would absolutely advocate for.”

Franchi added that LICA has been advocating for highway safety for many years, particularly on winding stretches of the Southern State Parkway. “They deserve to get home to their families,” Franchi said about highway workers.

Canzoneri agreed. “We want everybody to go home at the end of the day to be with their families,” he said.

The ny.gov website indicates that this five-year program is a joint effort by the state Department of Transportation and the state Thruway Authority.

Smithtown Town Board met for its bi-weekly meeting at Town Hall Thursday, April 20. The meeting was sparsely attended with around 10 people present. All five members of the board were present.

The meeting began with a site plan presentation from Liam Trotta of the Planning Department. The site plan application was in reference to The Preserve at Smithtown, which is a development by The Northwind Group. Its website describes the development as “a new boutique apartment community located in the picturesque hamlet of Nesconset.”

“The proposal is for a revised site plan for the proposed increase in gross floor area of the buildings from 172,873 square feet to 201,323 square feet,” Trotta said, “which is a net increase of 28,450 square feet overall, in accordance with the recent zone change modification, and to allow the project to
be phased.”

Phase one would include the construction of the sewage treatment plant. The next phases would include construction of apartment buildings on the property as well as a clubhouse in phase four.

“The phasing will essentially allow the occupancy of the buildings that have already been built while also allowing the future construction of the northernmost apartment units,” Trotta said. “The applicant has agreed to six conditions of approval, and the Planning Department supports the project as well.”

The Town Board unanimously approved this proposal.

During the public participation portion of the meeting, St. James resident Laurie Kaufmann-Robedee raised concerns about the traffic situation on Woodlawn Avenue in the hamlet. “There are tractor trailers traveling down that road, every day, at very high speeds,” she said.

According to her, Suffolk County Police Department previously told her that they did not have the manpower to post an officer there each day to ticket speeding vehicles in order to mitigate this issue.

“I don’t know where to turn to stop this type of traffic,” she said. “I don’t want there to be a fatality. If anyone has a suggestion where I should take my concern to, I would really appreciate it.”

Supervisor Ed Wehrheim (R) recommended making an appointment with Councilman Tom Lohmann (R), who liaises with SCPD 4th Precinct. “He’s usually pretty successful,” Wehrheim said. “I would set up a meeting with the councilman, and I’m sure he would be willing to help
you out.”

On Saturday, April 22, Town of Huntington councilmembers Joan Cergol (D) and Sal Ferro(R) co-sponsored an Earth Day event at Manor Farm Park. Other elected officials in attendance included Suffolk County Legislator Stephanie Bontempi (R-Centerport), Legislator Manuel Esteban (R-Commack), Huntington Town Clerk Andrew Raia and Receiver of Taxes Jillian Guthman. 

The event featured a number of different interactive opportunities. The Volunteers for Wildlife set up a booth and had a 20-year-old, one-eyed turtle for attendees to look at. She lost her eye in a dog attack, so she could no longer live in the wild. Cornell Cooperative Extension brought a marine touch tank with clams, a horseshoe crab, mud snails and other creatures. Children excitedly gathered around the booth to pet and touch them.

The Little Shelter Animal Rescue and Adoption Center showed up to raise awareness for their not-for-profit shelter. They brought a litter of five 6-week-old kittens for attendees to play with through the bars of their cage.

There was also a beekeeping demonstration put on by local resident Joe Schwartz. He showed a large crowd of people frames from beehives, which displayed the brood in the honeycomb as well as how the bees cap their honey.

Brandon Stephan Davis, a local Huntington resident, said that the highlight of Earth Day so far for him was the beekeeping display. “I learned a lot,” Davis said. “I didn’t know so much about the details of the hive. I’m grateful that he’s doing this event.”

Schwartz said that he volunteers a lot of his resources at Manor Farm, which is run by Starflower Experiences. He keeps roughly a dozen hives on the property. “They have a farming program,” Schwartz said. “They do a sunflower maze. That’s so much pollen, so much nectar for them. It’s just an ideal place.”

Schwartz went on to say that these should be one of the best-producing hives out there, but they can still struggle due to pesticides in the area, since bees can travel up to a couple of miles to get pollen.

Schwartz said that pesticides and insecticides are bad for the environment and that alternatives like setting up bat boxes may be preferable for getting rid of ticks. He said that bees can survive modern pesticides, but they then bring tainted pollen back to the hive, and then when their larvae feed in the spring, many of them die, and the hive collapses.

Schwartz is also passionate about getting children involved in outdoor activities. In the summer, he does beekeeping classes at Manor Farm twice per month. “We need to get the kids out of the house,” Schwartz said. “I know what COVID did to the kids. It was not a help. You need to get them back outside. They need to appreciate what we have here, and this is one way to do it.”

Ferro was pleased with the results of the event. “It was great to see the large turnout at this year’s Earth Day festivities at Manor Farm Park,” he said in an email. “The event was filled with fun and educational programs for people of all ages with the shared goal to safeguard our environment.”

Ferro’s office estimated that over the course of the day 500 people had shown up for the event.

Stony Brook University students and faculty gathered Tuesday, April 25, at the Charles B. Wang Center for a special town hall meeting that marked the creation of the New York Climate Exchange on Governors Island in New York City. The event was free and open to the public.

The panelists included Maurie McInnis, SBU president; Jed Shivers, senior vice president for finance and administration; Kevin Reed, associate dean for Research in the School of Marine and Atmospheric Sciences; and Keith O’Connor, principal at Skidmore, Owings & Merrill, which has been developing this project.

The event was moderated by Craig Allen, chief meteorologist for WCBS-880 and a former Stony Brook University graduate.

McInnis spoke on her excitement regarding this opportunity for Stony Brook to be the anchor institution for the climate exchange.

“Setting ambitious goals, responding to society’s greatest needs and propelling our university to even higher levels of excellence … this is the Stony Brook way, and it’s why we’re here today,” McInnis said. She added that SBU is going to “bring together the world’s most innovative organizations across sectors to problem solve and turn solutions into action.”

Shivers explained that “the climate exchange is a separate and distinct charitable organization” from the university and that “no Stony Brook University funds shall be utilized as part of the capital that needs to be raised to do the design or the construction work or support the initial operating expenses.”

Reed followed by noting that while SBU will not be making financial investments, “what Stony Brook is going to get to invest is our ideas and, as the president already mentioned, our problem-solving skills.”

O’Connor spoke on how “all of the energy will be generated on-site” because it is going to be a “100% electric campus.” He added that “one of the objectives is the buildings, the landscape and the systems all coming together to demonstrate how you build a sustainable long-term campus.”

After the conclusion of the town hall, which included a brief Q&A that allowed some members of the audience to speak, TBR spoke to some attendees to get their reactions to this announcement.

Sergio Perez, a professor from the Marine Engineering Department of the U.S. Merchant Marine Academy in Kings Point, expressed excitement at the promise and potential of this project since hundreds of millions of dollars will go into it. “We can do a vast improvement to Governors Island,” Perez said. “At the very worst it’s going to create lots of jobs. But at the very best it will have an effect on climate change.” 

Sky Freeman, a student studying journalism and political science, said he believes “it’s going to be a fantastic opportunity for Stony Brook to combat climate change.”

“I think if I had the opportunity to get involved, it would definitely be something I would seriously consider,” Freeman said. “I think the design of the building is very unique, very cool — it’ll create a great atmosphere on the island.”

He added that he does not think that most students are aware of the plans for the climate exchange, but that he knows there is a lot of excitement from the administration and from faculty.

Paul Shepson, dean of the School of Marine and Atmospheric Sciences at SBU, said that he anticipates his school being a “contributor to the success of the exchange.”

“Our faculty will be involved in many ways in developing programs and engaging in some of the research that goes on there,” Shepson said. “I love that Stony Brook is leading in the creation of this exchange where we’re going to be a convener of the best minds in the world in identifying and implementing solutions to the climate crisis.”

While there is still more planning and development to be done, McInnis said it is anticipated that ground will be broken on the project in 2025 for completion by 2028.

Last week felt a little more like summertime than springtime. Although it was an unusually mild winter, many individuals might be looking forward to the warmer weather, and recently they’ve been able to get a preview of the summertime heat. 

On Friday, April 14, on a beautiful, 80-degree, sunny day, we went out to T. Bayles Minuse Mill Pond and Park in Stony Brook village to ask people what summer activities they are most looking forward to. The following are their responses.

“Being with our family outside, not trapped inside,” Genine Spinelli said. “Definitely concerts, fairs, hot dog wagons,” Joe added. Bilka said that she was looking forward to family barbecues and teaching Angelina and Thomas how to swim.

 

Eddie McGee, South Setauket

“Definitely hiking,” McGee said. “I’ve been big lately on mental health, specifically for men because we don’t really address it or do anything about it.”

 He said that it can be a bit harder to work on your mental health in the winter months. 

“Being outdoors now and hiking and just being physical and whatever you can do … being in nature, soaking it all in, being mindful of your surroundings,” he said, adding that Mill Pond and Cold Spring Harbor are two of his favorite locations for being outdoors. In reference to his guitar, he said, “That’s another thing that also helps with my journey of peace.”

 

Christine Burkhardt and anonymous friend, East Northport

“Just hanging out at a place like this and going to the beach,” Burkhardt said. “Walking on the boardwalk. Any of those kinds of activities.” 

She would not miss any winter activities. “I’m more of a spring/summer/fall girl,” she said. “I’m not really a winter girl.” Burkhardt said that one of her favorite locations to dine during the summer is Salt Shack, a restaurant in Babylon that features live music.

 

Lawrence and Debra Batton, Middle Island

“My favorite spot: the beach!” Debra Batton said. She usually goes to Smith Point on the South Shore or to Cedar Beach in Mount Sinai. “Lawrence said fishing was his favorite warm-weather activity. “That’s what I’m waiting for,” he added.

Lawrence said he didn’t make it out at all last year, but he’s planning to do a lot of fishing this season, come summer.

There have been rumblings recently regarding the state of the commercial real estate market. With the onset of the COVID-19 pandemic, people were forced to leave the workplace and instead work virtually, if possible.

Though going back to the office full-time is now an option for many businesses, some are satisfied with employees working from home. Experts now worry that remote work could be driving down the demand for commercial real estate. 

“If these commercial landlords can’t make money, they’re going to file for … property tax relief,” said Martin Cantor, director of the Long Island Center for Socio-Economic Policy, in a phone interview. “And if they get it granted because they’re not making money, that property tax is going to be shifted to residential.”

Deputy Comptroller for New York City Rahul Jain also shed light on the topic, noting that the industrial market is doing very well right now but office markets remain questionable.

“Real estate generally pays a higher rate on the value of the property than residential does,” he said in a phone interview. “If you have a real decline in the value of that property … that means somebody else has to pick up the remainder. And so that burden could end up potentially falling on residential taxpayers.”

Phil Shwom, president of the Long Island-based industrial and commercial realtor Schacker Realty, added further context.

“We’ve seen a couple of deals where they’ve taken an office building and converted it to industrial,” he said in a phone interview. “There’s also been talk about taking down some office buildings and building residential, which I think is happening in the city, but less so on Long Island, although I wouldn’t be surprised if it does happen at some point.”

When asked if commercial property owners might consider repurposing some locations as residential developments, as Shwom said, Jain agreed that that could be a possibility.

“When you look at the economics of it, it might make sense not only on the demand side,” Jain said, referencing that there are now fewer people going to offices to work. “But on the supply side, there’s clearly some push to increase the number of housing units because housing in the metro area has always been more expensive than the rest of the country.”

Jain emphasized that the burden of commercial taxes potentially falling on residential taxpayers and the possibility for commercial spaces converting into residential development are very complex issues. 

It may still be a few years until the full effects of the pandemic on commercial office spaces become evident and what domino effects may result from that.

On the evening of Wednesday, April 12, the Huntington Town Planning Board approved The Northwind Group’s development proposal at Indian Hills Country Club in Fort Salonga.

Throughout the meeting, a recording of which can be viewed at huntingtonny.gov/meetings, residents can be seen in the background holding up “Vote No” signs in a show of disapproval of the proposal. Signs also read, “Let Us Speak on Indian Hills,” since members of the public were not permitted to speak openly at this meeting.

At the outset, Anthony Aloisio, the town’s director of Planning & Environment, said,      “What I would want to do is just point out some of the improvements that we’ve made in the plan since the last plan that you approved was the preliminary plan.” 

“In the revised plan we’ve asked for some depressions to be built on the property,” he added. “This was to capture stormwater runoff from the proposed development areas as well as from the golf course.”

Board chairman Paul Ehrlich defended      the plan. “We’ve taken a long hard look at every aspect of this plan,” he said. “We’ve allowed the maximum amount of public input by having multiple public hearings, and even extending the comment period for months, well beyond those public hearings.” At this point  rumblings could be heard from the crowd.

Ehrlich said in the beginning of the process, the Planning Board passed a resolution directing The Northwind Group      and the planning staff to perform “a  broad and comprehensive environmental review. ”     

According to Ehrlich, at Northwind’s expense the town also brought in outside consultants to review their engineering study.

 “As a result of all of this, important aspects of the environmental conditions that currently exist are being significantly improved,” he said. “This application could have easily moved forward without any of these actions.” He also said that the “proposed resolution will ensure that the land of the golf course remains open space in perpetuity.”

Planning Board member Joseph Tantillo said that he has done extensive research on this project. “I would like the record
to note that I feel confident that I can make an objective decision on this plan,”
Tantillo said.

Judge Robert Lifson also said  he had done research into this project. “I feel no reason not to participate and vote, and I would vote to approve the project,” he said.

Judge Mara Manin Amendola addressed some of the residents present at the meeting.      “I see your signs,” Amendola said. “I understand how the neighbors feel.” She went on to say that “you have to agree it is an improvement” from the original proposal, adding, “Yes, we see you’re not happy, and we’re sorry for that.”

The proposal passed 4-0. The building then erupted in a chorus of boos. Chants of “shame on you” echoed throughout the room for several minutes. This then led to Ehrlich banging the gavel several times with requests for everyone to “clear the room” since the board still had more business to attend to.     

As the disturbances continued, Amendola said to a uniformed individual, “Can you make them leave? This is unacceptable.” While the yelling gradually quieted as the room was cleared, Amendola said to other members of the Planning Board: “I do feel bad for them, I do,” and then said, “This is bugging me,” in response to one individual shouting, “Corruption!”

Don McKay, who is running for a Town Board seat, attended the meeting and was not pleased with the way the approval was handled. In a phone interview, he said, “My primary objection is I think the entire application should have been a change of zone application.”

“Why this application did not go to the Town Board for full review and instead went to the Zoning Board of Appeals and the Planning Board, I believe was inappropriate. It should have gone to the Town Board as a change of zone application.”

“The way that this community was treated by the town was reprehensible,” McKay said. “They should have been given a lot more respect, courtesy, and they weren’t. That needs to change.”     

“I understand the fact that the developer does have a right to build some residential units on the property if he wants to,” McKay said. “But what he has proposed is too intense, too high of a density for this property.”

John Hayes, president of the Fort Salonga Property Owners Association, which was founded specifically for the project, was      also not pleased with how the Planning Board handled the situation.

“It was a so-called public hearing at which the public could not be heard,” Hayes said of the meeting in a phone interview.

“This hearing originally took place in February of 2022, and it was adjourned,” Hayes explained.      

“In the meantime, three new plans had been filed by the developer, considerably different in grading, drainage, tree preservation. And we were not allowed to speak on any of this. No public input allowed on it.”

Hayes also said that they are not completely opposed to development at this location, only that the proposed plans go “way too far” and that there have not been any concessions made that he would consider reasonable. “We’ve never ever said no development,” Hayes said. “But we are very passionate about the fact that it should be minimal, and the houses should be placed away from existing residents.”

Hayes went on to explain that some residents that own homes by the golf course would now have several more houses adjacent to their properties. Some of these residents obtained professional appraisals to investigate what the potential effects of these new houses would be, and they were told their property values could decrease by as much as 10%. 

In a phone interview, Jim Tsunis, CEO of The Northwind Group, disagreed with this claim. “The homes in the area will actually go up [in value] as a result of this community being built,” he said.

Tsunis, who has been in the real estate business for over 30 years, explained that “being in real estate for as long as I have and building communities in other areas, the homes in the area will benefit from this community being built.”

Tsunis said The Northwind Group has “met every single condition imposed by the Town of Huntington” and has “spent years studying and analyzing the site.” He also said that he has met multiple times with a different group, the Fort Salonga Association, a Fort Salonga-based civic association. “They helped me shape the community and they were able to endorse the community when the plans were completed,” he said.     

“The Fort Salonga Association has approved every iteration of the plan since it came into being,” Hayes countered. “We can understand why the Fort Salonga Association was not opposed to the principle of developing on the golf course. What we do not understand is how they could endorse the fact that these houses were right next door to existing properties rather than in the interior of the course.”

Additionally, when asked about the Fort Salonga Property Owners Association, Tsunis said that members have not been in contact for over four years to discuss the proposal to come to some sort of compromise. He indicated he would be more than willing to meet with the organization to discuss the situation.

Hayes said the association had negotiated with Tsunis years ago, adding, “We mutually agreed that we were too far apart. Since then, we haven’t had any contact, but he hasn’t had any contact with us either.” Hayes said that when they talked “there was really no attempt to reduce the number [of houses] that had already agreed on with the town.”

The Fort Salonga Property Owners Association is undergoing the process of filing lawsuits against both the town’s Zoning Board of Appeals and the Planning Board. “This is not a frivolous filing by any means,” Hayes said. “We would not be doing that if we didn’t think we had a very good chance of winning.”

On Sunday, April 16, Three Village Dads Foundation ran an event to raise money for a local chapter of the St. Baldrick’s Foundation. The St. Baldrick’s website states it is “a volunteer and donor powered charity committed to supporting the most promising research to find cures for childhood cancers and give survivors long and healthy lives.”

Over the years, Three Village Dads have raised over $225,000 for local causes. They adopted the local St. Baldrick’s chapter last year and moved the event to the Veterans of Foreign War Post 3054 in East Setauket. 

David Tracy, chairman and CEO of 3VDF, is a VFW member.

“We had about 60 or 70 people come down last year,” Tracy said in a phone interview. “It was a bit rainy. So, it kind of muted the overall attendance. However, we still ended up raising $22,000 for St. Baldrick’s.”

This year 3VDF followed the same format but it was a much nicer day, with about 100 guests in attendance. There were vendors donating their time to feed the guests, and Setauket Fire Department brought a fire truck for children to climb on.

About 45 minutes into the event, two women showed up, one wearing a jacket with the words “Suffolk County Health Department.” “They both have clipboards, and they have very serious faces,” Tracy said. “They’re just saying, ‘You need to shut down, this is not a permitted event.’”

This surprised Tracy, as he explained to them that this was a private event on private property. They countered that the event was advertised to the public, so it was a public event. Tracy then offered to buy a permit, but he was informed that that is impossible on a Sunday.

“I asked [one of them] to maybe use discretion, to maybe call her boss and just let me talk to him — and just nothing,” Tracy said. “She wasn’t having it.”

Tracy believes that one of the two women works for the Tobacco Enforcement Unit of the Suffolk County Department of Health Services. “They were there to target the one vendor whose business model is a cigar and bourbon experience.”

“They tell me over and over, ‘These vendors have to stop,’” Tracy said. He explained that he was “willing to pay the fines, whatever the fines may be, but this is a fundraiser for childhood cancer research. We are not shutting down. We have two more hours left.”

One woman proceeded to go up to each vendor, go into their trailers, ask them questions and take pictures, according to Tracy. He said that this upset a lot of their guests.

“There were a lot of people that were paying attention to what was going on with her and her inspections, as opposed to paying attention to the 10 brave people to get up there and shave their heads in front of the public to raise money for charity,” Tracy said.

“I guess what bothers me the most is that if they knew about this a few days ago or a few weeks ago, why not just pick up the phone and give us a call,” Tracy said. “We would have rectified it.”

“It just reeks of bad government decisions, and we would like somebody to answer for that,” he added. “Whose call was this? Whose ultimate determination? Who has it out for my friend’s business?”

“I will gladly pay that fine if need be and we will gladly get permits next year. But the way this was handled is just all wrong,” Tracy said. “I would like [to make] a public apology to my organization, to the St. Baldrick’s organization, to the vendors, because there’s a much better way of handling this, especially if they knew about it ahead of time.”

The citation that Tracy received read as follows, “Organizer found operating a temporary food service event to the public without a valid permit.” It also said that 3VDF allowed “food vendors to serve food to the public without valid permits to operate.”

Suffolk County Department of Health Services did not respond to a request for comment prior to press time.

A development proposal has caused uproar over the past month among residents of St. James, as reported in The Times of Smithtown. Mills Pond Group, owned by Fort Salonga developer Frank Amicizia, proposed the construction of an assisted living facility on the former Bull Run Farm on Mills Pond Road.     

The proposal included a two-story, 97-bed assisted living facility to be built on the property, which is 9.02 acres in total and is in residential zoning. At a public meeting with lawyers of the developers of the project in March, many residents were outspoken in their disapproval of the proposal. This ultimately resulted in Town of Smithtown Supervisor Ed Wehrheim (R) announcing that a special exception would not be made for the assisted living facility.

Additionally, Wehrheim intends to legislate that assisted living homes will not be approved to be built in areas zoned residential. Smithtown public information officer, Nicole Garguilo, said that “for the longest time there was this loophole in the town’s code” which provided an opportunity for a “special exception” for developers when attempting to gain the rights to build on a piece of land.

“One of the most common criticisms was that developers often used this loophole to get through the process without having to go through a zone change,” Garguilo said. 

This special exception essentially enables them to “go right to the Town Board rather than going through all of the zoning boards and environmental reviews — it was very frustrating to residents.”

Garguilo went on to explain that the Town Board intended to propose legislation to remove the loophole even before this issue arose with the Bull Run Farm proposal. She said she believes this would reflect the interests of the community.

“You’re going to be hard pressed to get anybody in the whole hamlet of St. James to support an assisted living [facility] on that land,” Garguilo said. “That land people want to see preserved. They want to see it maybe become an active farm again.”

Garguilo went on to explain that “a lot of it has to do with the sentimental value of the farm and the history there.” People remember when the farm was active, she said. Some might have fond memories such as sleigh riding or feeding carrots to the horses. Garguilo herself used to spend her allowance money on Blow Pops from the farm stand, and her family would frequently buy pies from the Elderkins — the family that ran the farm.

As there does not seem to be a path to building this assisted living facility at that location, an alternative option that the developers could turn to is building homes on the property.

“When they originally presented their plan, they had presented a backup plan with it, which was to build a subdivision of homes,” Garguilo said     .

She went on to say that while members of the community would likely prefer the land simply preserved, they may be more willing to accept this alternative as it would be in line with the town’s codes.

“I think it’s a pill easier for them to swallow rather than seeing assisted living go up on that land.”

The next Town Board meeting will be held Thursday, April 20, at 2 p.m. at Smithtown Town Hall, 99 W. Main St. Garguilo said it is unlikely that the board will be prepared to vote on removing the special exception loophole at this meeting, but that residents should expect a vote in the near future.
