Over the last month, elected officials on both the county and village levels have been trying to tackle reckless bicyclists on the road.

Last week, Suffolk County voted on a new bill aimed to give bicyclists distance with a new 3-foot passage rule — the first county in New York State to implement the law.  

According to the new legislation, “The operator of a vehicle which is overtaking, from behind, a bicycle proceeding on the same side of the road shall pass to the left of such bicycle at a distance of at least 3-feet until safely clear thereof.”  

Violators can face fines not to exceed $225 for a first offense, $325 for a second offense and $425 for any subsequent offense. The minimum distance requirement, however, will not apply on roads that have clearly marked bicycle lanes.

Authored by Legislator Kara Hahn (D-Setauket), it was originally in response to a bill sponsored by Legislator Rudy Sunderman (R-Mastic) which aimed to ticket and condemn bike riders who popped wheelies, swerved into traffic or biked while intoxicated across Long Island.

Hahn said she filed her bill, and abstained from Sunderman’s, to focus more on education for drivers and bike riders, as well as keeping veteran bicyclists safe. 

“I filed a bill that looks to fix the problems that existed,” she said. “I felt there were problems in the one that passed a few weeks ago.”

Sunderman’s bill was originally passed by the Legislature in February but was vetoed by Suffolk County Executive Steve Bellone (D) earlier this month. 

“We believe this legislation is overly broad and that current law provides the necessary tools to address this issue,” Derek Poppe, a representative with Bellone’s office said in a statement. “We remain committed to working with the Legislature address safety concerns around bicycling practices.” 

On March 16, the Legislature approved Hahn’s bill, and Sunderman’s veto override failed the same day. 

Hahn said that the county was named by Bicycling Magazine as the most dangerous county in the country for bike riders and has since continuously been in the top 10.

“There are approximately 350 accidents a year in Suffolk County,” she added.

The vote brings Suffolk County closer to becoming the first county in the state to adopt a 3-foot-rule requirement. 

“I think it’s just really important that people know they have to give bicyclists room when they pass them,” Hahn said. “They might not hear you and the tires of a bike cannot handle roadway obstacles the same way a car can.”

Hahn noted that things such as sand, sticks, leaves, trash, a storm drain or pothole can be life-threatening to bikers. 

“A car can handle those, no problem, but a bike tire makes those obstacles potentially deadly,” she said. “Sometimes the cyclist needs to swerve a little bit and this 3-foot buffer gives them space.”

The bill will now go to the county executive for a separate public hearing and his signature within the next 30 days.

“I am thrilled,” she said. “This is a real concrete step to improve safety, and at the same time it makes a statement that we care about our residents on the road.”

The Village of Port Jefferson 

Village officials have been tirelessly enforcing their own rules when it comes to reckless bicylists.

Last year, when outdoor dining began, there were concerns over individuals harassing diners and drivers while they popped wheelies and swerved into traffic on Main Street. 

They began enforcing a code created in 2019, with new training, to keep residents and visitors safe. 

Mayor Margot Garant said a new bicycle task force has been unveiled, encouraging business owners and residents to call code enforcement when something doesn’t look right. 

“Our code specifically looks toward curbing the behavior of the individual riding a bike down the middle of the street or sidewalk in a dangerous and reckless manner,” she said. 

With rules penned by trustee Kathianne Snaden, the bicycle task force is comprised of Snaden along with a representative of the Suffolk County Police Department, the chief of code enforcement, Deputy Village Attorney Richard Harris, the Port Jefferson Chamber of Commerce and members of the business community. They simply ask, “If you see something, say something.”

The “see something, say something” campaign encourages business owners to keep their eyes peeled on issues throughout the village, and to call code immediately before the problem accelerates. That way the code officer can talk with the individual and give a warning before someone gets hurt.

“This time of year, we don’t see the issue,” Snaden said. “But the minute warm weather hits, it becomes an issue.”

And the last few weekends have shown how popular Port Jefferson is when the sun is out, and a light jacket is needed.

“I want everyone to be aware if bicyclists are doing the right thing, obeying the traffic laws, we welcome them with open arms,” the trustee said. “We want to be ready to intervene before it becomes a problem — we’re not going to intervene if there is no problem.”

Along with the campaign, the village has begun using officers on bikes and has instituted a designated officer to patrol on foot throughout Main Street. Snaden said there will always be someone on duty, with no absence in shift changes. 

“I’m confident to date we have bridged that gap,” she added. “The communication is now there. We work as team to dissuade any potential issues.”

Crossfit DHP in Port Jefferson Station was the site of a tense confrontation between the owners of a local gym and a crowd of children and teens on bikes. Though police said nobody was hurt, owners said this could be a learning experience that parents make sure kids show respect.

Suffolk County Police said around 20 young people on bikes were roving around the Port Jeff Station area July 23, and that officers responded to two disturbances outside the gym at 5:30 and then around 6:15 p.m. Police said once they arrived, the groups dispersed with no injuries on either side.

Police said the young people then traveled to Wendy’s on Nesconset Highway and allegedly threw drinks and cursed at patrons. 

Two tickets were issued to two of the juvenile’s parents.

In a statement, gym owners said a group of young men and women on their bikes were seen smoking weed behind the building when they started harassing gym members who were going on their run.

We asked them to be aware of our presence but then they started hitting our members with their bikes,” the statement reads. “At that point we asked them to leave and that we would call the cops to which they said they were proud that the cops were chasing them around all day. With a lot of vulgar language and verbal harassment, they did start to leave as the cops escorted them out.”

On the way out, gym owners said one kid tried to throw a barbell at one of the gym members. The bikers left after police were initially called, but about 10 minutes later came back to harass the gym again. That is when the video was recorded, and owners said the bikers took pipes from their bikes and swung them at member’s heads. 

“To go even further, several of them spit on us, which during a pandemic is unquestionably wrong,” the statement read.

On July 31, police announced they have made two arrests, namely two males, both 15 years old, of Centereach, whom police said were involved in the incident.

One of the teens was charged with 2nd degree reckless endangerment for throwing a barbell at a gym member, and the other was charged with second degree menacing for swinging a bicycle seat at another gym member.

The teens were issued desk appearance tickets and scheduled for arraignment at Suffolk County Family Court in Central Islip Aug. 14.

A viral video posted to the Comsewogue Community Facebook page has since been taken down, but in that video the crowd of young people, most not wearing masks, surrounded the front of the gym’s parking lot where owners and a few gym members confronted them. 

One unidentified young person in the video in a light blue shirt became physical with one unidentified person from the gym, seemingly throwing a punch that doesn’t connect. Young people could be heard swearing and threatening the adults. Another man stepped forward holding a rod of some kind, but in the video he does not appear to use it on the bikers. 

At one point in the video, somebody tried to grab something from a woman at the gym, and a brief struggle ensued but was quickly broken up. 

Owner of the gym Ryder Champouillon and his wife and fellow gym coach Jen posted a video to their gym Facebook page the day after the original video was released, thanking community members for their well wishes.

In the statement, the gym owners thanked Suffolk County Police along with Suffolk Legislator Kara Hahn (D-Setauket) for their genuine response to the incident. 

In the gym’s statement, they said this is not the first episode of harassment in the local community, and many more have posted about such incidents to community Facebook pages. Though thanks to the community, owners said they have already been able to identify many of the people in that video.

Our sole purpose within our facility is to offer the community a single outlet to find healthcare, nutrition and exercise that improves our lives, which improves our community as a whole,” the statement read. “We spoke earlier with members of the local government about moving forward with programs for the community and youth to have an outlet surrounded by positive role models.”

As hundreds packed the auditoriums of Shoreham-Wading River and Miller Place high schools the same sentiment reverberated off the walls — there’s not only a want, but a need for a safe place for children to ride their bikes.

After the deaths of two local children, the desire for the Rails to Trails project to push forward was prevalent among the Port Jefferson Station, Mount Sinai, Miller Place, Sound Beach, Rocky Point, Shoreham and Wading River residents who live along the proposed 10-mile trail.

“I don’t know if this trail is going to move forward 100 percent, but so far it’s picking up momentum,” Suffolk County Legislator Sarah Anker (D-Mount Sinai) said to the March 29 group in Shoreham. “We need the ability to ride bikes in a safe place, the ability to take a walk or push a baby carriage in a safe place.”

The legislator, who is propelling the project, brought members the Suffolk County Department of Works and engineering company NV5 to her first general meeting to gather public input and answer questions.

“I need to hear what you want, because I’m here to make it happen,” Anker said.

Steve Normandy, project manager with NV5, discussed the flat surface and location being conducive to a trail.

“There’s over 1,600 rail trails nationwide over 20,000 miles,” he said. “They’re good for biking, hiking, walking, safe travel to school, and studies have shown businesses thrive and home values increase, it improves air quality and enhances sense of community.”

On March 28, the county Legislature unanimously approved a negative New York State Environmental Quality Review Act determination for the proposed 10-foot-wide trail, which would be opened from dawn to dusk. The adoption of negative SEQRA determination means that there is no anticipated environmental impact for the project.

The path will have paver markings and mile-markers for county miles, as well as emergency services to locate those in need. It will also meet Americans with Disabilities Act slope requirements. The design report was submitted to the state Department of Transportation in February. If design approval is received this summer, final design plans will be prepared in the next year in the hopes of received final design plan approval from the NYSDOT in winter 2018.

Currently, the plan is that construction will begin in spring 2019, for a fall 2020 finish.

“We’ve met with quite a few partners and discussed a bunch of different aspects of maintenance, but the biggest issue we anticipate is really going to be cutting the grass,” said county Department of Public Works chief engineer, Bill Hillman. “We’ll be asking the community for help, to pitch in with a lot of the different maintenance aspects.”

The hope is that a not-for-profit like the Friends of Greenway, which maintains the Setauket to Port Jefferson Greenway Trail, will form to beautify and preserve the attraction.

“I want to pledge my support because I think it’s a wonderful component that our community doesn’t have, and it needs,” she said, adding she is willing to help mow and maintain the piece of property, which is owned by LIPA. “I found my house on the map, and it looks like one day when I have kids, they’ll be able to get from our house through back roads to the trail, and then take the trail to the high school.”

Judy Black, who has lived in the area for 47 years, said she’s been hoping the trail would become a reality from day one, back in 2001 before plans derailed, and again in 2011 when Anker tried to revive the idea.

“I so hope we can come together and make this happen,” she said. “With a son that rode his bicycle all over the place I was always worried about him.”

She explained how she once saw a cyclist fall on North Country Road trying to maneuver around a construction sign. She was in need of medical attention, and when examiners arrived, they asked her why she was riding along a major road.

“But where else do you ride your bike?” Black said. “We need a safe place to ride, to walk with friends, to expand our community connection, and I’m so for it.”

The ideas weren’t without opposition.

There were some like 10-year Rocky Point resident Mary Anne Gladysz, who said she’s felt like she’s been kept in the dark.

“I’m not in favor of this at all,” she said, although adding she would probably be in favor of Rails to Trials if she didn’t live near it.“This is in my backyard 24/7; you come for an hour-and-a-half walk and then you leave. I’m here all the time.”

Some of her concerns included if the trail will take property from homeowners, if cesspools will be affected and what issues her dogs barking toward the trail could bring.

Hillman and Anker reassured her that she will not be losing property, and cesspools will not be affected. As for dogs barking and noise ordinances, Hillman said it’s an issue Gladysz would have to take up with Brookhaven Town.

The trial currently doesn’t have any guardrails, fences, beautification elements, toilets or lights budgeted into the $8 million plan.

Anker said she is working on a plan to protect privacy along the path, and said Eagle and Girl Scouts typically do beautification projects, which could include adding benches and other useful things along the trail.

Others still worried about safety and other crime-related issues, were soothed by Sgt. Walter Langdon of the Suffolk County Police Department, and 7th Precinct COPE officer Mike Casper, who said there has been “little to no crime” at Setauket-Port Jefferson Greenway Trail, but added that there will still be a police presence along the path.

By the end of the first meeting, those like Rocky Point resident Cory Fitzgerald were heard loudest, and supported by other community members for their opinion of the trail.

Fitzgerald has daughters aged 8 and 6, and both love riding their bikes.

“We take trips to Cape Cod every summer and the rail trail up in Cape Cod is phenomenal,” he said. “My girls ride their bikes more in that one week than during the entire year in Rocky Point. The roads in Rocky Point are very narrow and hilly, so I want to give my girls that opportunity to ride whenever they want. We’ve been waiting for so long — I’ve been told this was coming and I’ve been so excited and the girls really want this to happen. It’s going to be great for our community.”

Residents in favor of the trail, which some like Wading River resident Bruce Kagan are naming the “Tesla Trail,” because it will lead to the Tesla Science Center at Wardenclyffe in Shoreham, were unanimous on the biggest topic of discussion: kids.

“This is the most deadly county for injuries and deaths for pedestrians and cyclists,” Kagan said. “There’s no place for our kids. Let us do this for our children and our children’s children.”

America has always had a love affair with motorcycles. “In a car you’re always in a compartment, and, because you’re used to it, you don’t realize that through that car window everything you see is just more TV. You’re a passive observer, and it is all moving by you boringly in a frame. On a cycle, the frame is gone. You’re completely in contact with it all. You’re in the scene, not just watching it anymore, and the sense of presence is overwhelming.” So said Robert Pirsig in his book “Zen and the Art of Motorcycle Maintenance: An Inquiry into Values.” Dan Aykroyd stated the case more simply: “You do not need a therapist if you own a motorcycle.”

Marlon Brando, Steve McQueen, James Dean. Clint Eastwood, Buddy Holly, Peter Fonda. Hijinks from Evel Knieval and Arthur “The Fonz” Fonzerelli. There is no doubt that the motorcycle occupies a unique and intriguing niche in both the national culture and the counterculture, and it is the subject of an absorbing local offering.

Following on the success of last year’s summer exhibit, the Ward Melville Heritage Organization will present The Love Affair with Motorcycles Continues! opening July 11. On view are more than 30 motorcycles, as well as motorcycle memorabilia, artwork and sculptures.

Speakers will be on hand to talk about a number of motorcycle-related topics, and visitors can view an outdoor car showcase in the WMHO Center’s parking lot and also participate in a scavenger hunt. Stony Brook Village restaurants will feature exhibit-related dishes on their menus, such as the Hog Hero, the Harley Hoagie, the BMW Burger, Knucklehead Chili, and the Screamin’ Eagle.

The evolution of the motorcycle can be traced from Mike Wolf’s restored 1912 Indian TT Racer through to a 1975 Ducati 750 Sport from 20th Century Cycles of Oyster Bay. Also on display are bikes from the private collection of Joe Buzzetta, such as his 1977 Moto Guzzi Le Mans 850, and, courtesy of Peter Nettesheim, an unrestored 1928 BMW R52.

Also on view: a 1903 Indian (the only one known to exist), courtesy of Jim Giorgio; a 1955 Pan Head Billy Bike, (Gerry Duff); a 1970 Rupp Mini Bike (Joe Amendolia); a 1975 Norton Commando (Michael Racz); a 1975 FLH Harley (Douglas Johnston); a 1975 Honda Goldwing 1000 (Bill Mabanta); a 1973 Harley “Steampunk” (Copper Mike); and a replica of a motorcycle that appeared in the iconic biker movie “Easy Rider.” Besides getting up-close looks at the Harley Davidsons, Kawasakis, Suzukis, Triumphs, Hondas and other motorcycles, enthusiasts can give vent to their fascination with motorized two-wheelers by checking out the artwork of David Uhl.

All talks begin at 2 p.m.
