The Town of Brookhaven has come close to  finishing a single section of a much larger project along North Country Road.

This past weekend, Brookhaven finished paving and painting the lines along North Country Road in Miller Place from Honey Lane to the Miller Place Duck Pond, over to the entrance to the Laddie A. Decker School on Lower Rocky Point Road. The new resurfacing includes fixing the drainage along the side of the road and the installation of sidewalk and curbing. The new road and sidewalks pass in front of several area staples like the Town & Country Market, McNulty’s Ice Cream Parlor and the William Miller House.

According to the town Highway Department and Highway Superintendent Dan Losquadro (R), the North Country Road Highway project is actually a combination of three separate capital improvement projects. 

The New York State Department of Transportation grant received by the Highway Department funded 60% of the “complete streets” portion of this project, which is the new paving in Miller Place. The contractor responsible for this section of the project should complete their work within the next few weeks. This part of the project came now in order to finish before schools reopened in September.

The second section of this project was the sidewalk and curb installation on North Country Road that was completed in 2019 from the entrance to the Laddie Decker School to Echo Avenue. The Highway Department resurfaced that section of North Country Road Aug. 6.

The final section of this project is North Country Road from Washington Avenue to Route 25A in Sound Beach. Highway crews are completing the preparation work on this stretch of road this week, with the milling and resurfacing of this section to be completed within the next few weeks.

The Brookhaven Highway Department has included in its 2021 budget request to install a significant amount of drainage infrastructure on North Country Road from Pipe Stave Hollow Road to Honey Lane to remove the water from the roadway. Once the drainage work is complete, that final section of roadway will be resurfaced.

This will complete the paving of North Country Road from the Village of Port Jefferson border to Route 25A at the Rocky Point/Miller Place border.

In July, the town announced the finalized resurfacing of Lower Rocky Point Road from Woodhull Landing Road to Rocky Point Landing Road, as well as Hagerman Landing Road. The town is also currently active milling 37 roadways all over Sound Beach. Once milling is complete at a near future date, weather permitting, all roads will be resurfaced. 

Final details about the North Country Road project, including the total cost, grant funding and photos will be available when the project comes to completion in the next few months.

McDonald’s was granted a change of zoning Thursday, Aug. 13, by the Brookhaven Town Board in order to raze one and restructure two other restaurants on the North Shore. Representatives of the fast-food chain said it was to add new tandem drive-throughs and make the buildings more Americans with Disabilities Act compliant.

The three McDonald’s locations include the ones in Rocky Point and Miller Place on Route 25A and the one in Stony Brook along Route 347. Stony Brook is set to be demolished and remade into a restaurant with a tandem drive-through. Engineers hired by McDonald’s said doing so will actually reduce the buildings’ overall footprint. 

The ones in Rocky Point and Miller Place will have signage changed and some extra work done on the exteriors. The two buildings will also be adding new ADA compliant walkways to allow better access to the buildings from the parking lots and sidewalks along Route 25A. 

All three were zoned J-2 Business, but a rules change in 2003 mandated all sites with a drive-through had to be zoned J-5 instead. To complete the renovations, McDonald’s needed to get approval of the zone change from the Town Board. All three were granted zoning change approval at the Aug. 13 meeting. 

Brookhaven officials said they received letters from the Three Village, Miller Place and Rocky Point civics indicating they did not have issues with the development. Councilwoman Valerie Cartright (D-Port Jefferson Station) said during the meeting the Three Village civic did have some concerns when the project was originally proposed but those were resolved by the developer.

One resident of Strathmore Gate Drive in Stony Brook, a gated community, asked about trees buffering behind the local McDonald’s property. Developers said the site will have 7-foot evergreens as a way to block line of sight to the restaurant.

Landowners were unanimously granted approval of plans Aug. 17 by the Brookhaven Planning Board for a housing development on land in Wading River currently in use by the local Bakewicz Farms.

The preliminary plans revolve around 13 subdivisions for homes at the corner of Route 25A and Randall Road in Wading River. This is in addition to a recharge basin to be located at the westmost corner between the two roads. 

The Rocky Point-based Manzi family owns the property but is being represented by Rocky Point-based attorney Steven Losquadro. 

Losquadro said in a phone interview that the family is not immediately going with the housing development, but is instead “keeping their options open” regarding any future plans, whether or not it becomes a new housing development or something else. He did not wish to comment on the record about what future plans could be.

The site is currently being leased by Justin Bakewicz and his mother Marianne of Bakewicz Farms. The small 11-acre farm is active in the summer and autumn months supplying local produce, giving a place for children to pet a few farm animals and allowing children into their corn maze filled with cut out wood characters from pop culture such as Harry Potter and Buzz and Woody from “Toy Story.”  

Losquadro said the property owners are not at all immune to calls from the community for the farm’s preservation. Nothing has been officially determined yet.

“Many people in the community would like to see it preserved as a farm,” the attorney said.

Bakewicz did not wish to comment fully on the record about what could be happening in the future, but did mention there could be positive news coming down the pike.

“This is what I’ve been hoping for,” he said.

Last year property owners proposed putting down a large solar storage battery on an unused portion of the property. Those plans were opposed by the local civic groups, and Losquadro said at the time that without the solar battery the land could instead turn into a residential development. 

The preliminary plans themselves call for the creation of a new street that ends in a court called Dante Way. The road allows both a left and right turn onto Randall Road but no access onto Route 25A. Plans show the land redesigned for 13 single family homes, which would be located in the Shoreham-Wading River school district. The development also abuts the ongoing construction of the North Shore Rail Trail projects which when finished will create a 10-mile walking and bicycle path from Wading River to Mount Sinai.

Revised plans after comments from the planning board also maintain a 40-foot proposed buffer on the north end of the proposed development and a 75-foot buffer on the southern end. Both buffers would be granted to the town for open space purposes. In the proposed development, 10 feet off the western end would be left to the town for adding a real shoulder to the side of Randall Road.

Officials from the Town of Brookhaven highways department said they were still in the process of picking up all debris from Tropical Storm Isaias that residents put out to the curb Sunday, Aug. 9. It may be another two weeks for the town to fully pick up every tree limb and leaf.

The town originally asked residents to bring organic debris strewn about by Tropical Storm Isaias to the curb by Sunday, Aug. 9 for pickup the following day. In a statement, town Highways Superintendent Dan Losquadro said the amount of debris has meant it has taken time to get to every single street in the thousands of miles of town roads. All debris is being taken to 18 highway department yards and temporary staging areas across the town.

“We appreciate residents getting their debris to the curb in a timely fashion,” Losquadro said in a statement. “I anticipate it will take at least another two weeks before we are able to get to all 3,700 lane miles of road in Brookhaven town. If we have not made our way to your neighborhood yet, please leave all brush and debris at the curb for this one-time bulk collection.”

A spokesperson for the highways department said the town is broken up into four quadrants, and the head of each quadrant is effectively going through it street by street to make sure all the debris is cleaned up. This, combined with the excess amount of debris kicked up by Isaias is why it has taken long for some streets to see pickup. Otherwise roads that are being milled or paved have been given priority.

Officials asked that residents keep the debris in front of their house in the time being until the pickup process has concluded.

In a town board meeting Aug. 13, Supervisor Ed Romaine (R) thanked the town highway workers who he said have been working 12 to 14 hour shifts working on the cleanup effort. The town saw over 1,600 trees come down, and more than 400 were involved with power lines.

PSEG Long Island plans to restore power to the remaining 400 Long Island customers by midnight who haven’t had electricity since last Tuesday, when Tropical Storm Isaias hit.

“We remain committed to getting all customers related to last Tuesday’s storm restored by midnight tonight,” PSEG President and Chief Operating Office Daniel Eichhorn said on a media call Wednesday.

PSEG has 6,500 line workers and tree trimmers who are working to restore power from a host of states and continues to accept any other workers who are available.

This morning, PSEG moved workers from New Jersey, where it is headquartered.

Eichhorn assured residents that their bills would reflect the energy they used, which means that they won’t have to pay for electricity during the time their power was out.

The total number of outages in Long Island, including those who have been without power since the storm hit, stands at 10,500, which is a number that might increase this evening amid the predicted thunderstorms. Of those who are out, approximately 7,500 have lost power related to the storm, although Eichhorn said they are unlikely to have been without power for over a week.

Amid concerns about the pace of restoring power, the number of homes and businesses who were out and a communications problem on the day of the storm that made it difficult for residents to connect with their power company, Eichhorn said PSEG plans to use this experience to improve on the company’s storm-related processes.

Once the company restores power, PSEG will do a self assessment, which will include a “deep dive” into “lessons learned,” at which point the company will make immediate and long term changes to makes sure they are ready for the next storm.

Indeed, County Executive Steve Bellone (D) joined a growing chorus of politicians who expressed their concerns about the company’s readiness for the remainder of the hurricane season, which extends through the end of November.

“As we move towards the fall, we could be struck with a much more significant storm than this tropical storm,” Bellone said on a separate media call. “If that is the case, these issues need to be fixed. They need to be resolved before then.”

Eichhorn said PSEG hasn’t given much thought at this point to making the company’s assessment about its performance during the storm public.

Meanwhile, New York State Senator James Gaughran (D-Northport) called for the resignation of Eichhorn and Long Island Power Authority President Thomas Falcone.

Asked about the call for his resignation, Eichhorn said he was “aware of that” and the response of the company to the storm will be “part of our lessons learned and review. I’m pretty proud of the restoration efforts from our team. People have worked extremely hard and are very dedicated.”

Eichhorn added that PSEG would look into the IT issues that caused the frustration from customers and would “get better” and “make sure, for the next storm” they are “fully prepared.”

Eichhorn said he recognized the frustration people have been feeling, especially during a pandemic. Amid a discussion of residents in Cold Spring Harbor who blocked in a utility crew, preventing them from leaving until they restored electricity, Eichhorn said he understood that it’s a tough time to lose power, especially when so many people are working from home.

Still, he urged residents not to limit the ability of crews to react to the order of jobs. When crews are blocked in, they might help one or two homes or families at the expense of 100 or 200, he said.

PSEG wasn’t prepared today to discuss the possibility of reimbursing families for lost food during the outages, even as several politicians, including Brookhaven Town Supervisor Ed Romaine (R) requested that the company provide $500 to each household that lost power for more than two days.

“Our plan is to really focus on making sure we get customers’ [power] back today,” Eichhorn said. “Tomorrow, we’ll start looking at those other decisions.”

While crews from several states continued to restore power this week after the outage caused by Tropical Storm Isaias, frustrated residents and politicians expressed their dismay at PSEG for the pace at which they were restoring power and for the communications problems from a storm that passed more than a week earlier.

Indeed, Brookhaven Town Supervisor Ed Romaine (R) characterized PSEG’s response to the storm as “underwhelming” and “disappointing.” He expressed further frustration at the moving target PSEG had for restoring power.

Romaine called on PSEG to give families and businesses that lost power for more than 48 hours $500 to cover the cost of lost food. He also said he plans to send Governor Andrew Cuomo (D) a letter calling for the appointment of an independent arbitrator who could hear the claims of businesses in a “swift” and proper manner.

President and Chief Operating Officer of PSEG Long Island Dan Eichhorn said the company is still discussing any possible reimbursement to customers and hasn’t made a final assessment.

Meanwhile, State Attorney General Letitia James (D) launched an investigation of PSEG in connection with their response to a storm that knocked out power to 420,000 customers.

As of mid-day Tuesday, a week after the storm hit, 3,800 homes were without power directly from the storm. At the same time, PSEG Long Island reported 25,142 total customers without power, which includes new outages after the storm.

Eichhorn acknowledged the call for accountability from local and state leaders.

“We know there’s been a couple of agencies that want to come in and do an investigation and audits,” Eichhorn said in a press conference Sunday night. “The way I would characterize this storm [is that we] did a very good job of preparing for it. Our communications were not up to our expectations. We know that created a lot of angst.”

PSEG, which has operated under the direction of LIPA since 2014, planned to conduct its own internal analysis.

“We do recognize that our communications channels did not meet our customers’ expectations. We’re going to look at that immediately, make fixes” and will improve those processes, Eichhorn said.

PSEG has maintained during the aftermath of Isaias that the communications problems did not impede the company’s ability to restore power and that it brought in numerous additional crews and continued to request additional staff even on Tuesday.

Over the weekend and into the beginning of the week, PSEG Long Island brought in close to 2,000 more lineworkers, tree trimmers and other personnel, bringing the total to over 6,000,

That compares with the Long Island crews and contractors the company operates on a daily basis of about 600 people, bringing the response teams to about 10 times the usual operating staff levels.

Eichhorn said the crews were practicing safe social distancing protocols and were also polled prior to the start of work about how they were feeling. The PSEG executive recognized the frustration residents have felt during the outage.

“We know customers have waited a long time,” Eichhorn said.

Several politicians have threatened consequences for PSEG’s storm response, including Governor Andrew Cuomo (D) who floated the idea of revoking the franchise. Eichhorn suggested the company’s legal team would consider Cuomo’s comments.

Romaine said PSEG sent in four crews to Brookhaven, the largest town by area in the state, the first day and 10 the second. Given the number of downed trees, Romaine said he believes that should have been closer to 30.

Councilman Kevin LaValle (R-Selden) said the area was fortunate this wasn’t a bigger storm because a larger hurricane, with more rain and more intense winds, could have caused more of the population to lose power for a longer period of time.

Residents were upset that they couldn’t talk to somebody at PSEG to get answers.

Starting in 2015, PSEG received $729 million secured by Cuomo over a three-year period to strengthen the resiliency of the electric grid.

Eichhorn said that investment protected many of the customers who would otherwise have lost their power during this storm.

Local leaders, however, didn’t feel so fortunate.

“This is something that was not supposed to happen again,” Assemblyman Steve Englebright (D-Seatuket) said.

Englebright further said his office has heard of numerous problematic situations in restoring power, including in the S section of Stony Brook, where one side of a street had power and the other didn’t. When residents saw a repair truck and expressed their appreciation and excitement about power returning, the crew told them they were “here for the other side of the street” and drove off, Englebright said.

Englebright recognized the context for solutions to the ongoing problem of restoring power after major storms, including hurricanes that could come during this active season later this year.

He urged a short term plan, in which the area could return to the way things stood the week before last, and a long term plan, which could include more than cutting overhanging branches before storms wreak havoc.

Englebright and Romaine urged the area to consider burying some vulnerable lines. Romaine suggested burying one to two percent of the lines for the next several decades, increasing the resilience of the grid.

This storm serves as a wake-up call for the area, said Englebright, who lost power for four days and whose mother in Stony Brook lost power for five days.

To prepare for the storms that may come later this year, Long Island should have fuel depots with generators that are fitted for gas stations to prevent a shortage of gas, which occurred in the aftermath of Superstorm Sandy, Englebright said. He also urged greater preparation for people who are home bound and who need special medicine.

The Town of Brookhaven will conduct a one-time only bulk collection of storm debris on Monday, Aug. 10. All debris must be placed at the curb by the evening of Sunday, Aug. 9.

Branches, leaves and other vegetative debris from the storm should be brought curbside for bulk collection by town crews utilizing heavy equipment.

The town asked that residents do not put any non-vegetative debris out. Storm debris mixed with household garbage or construction debris will not be picked up.

Officials also asked that people keep fire hydrants and mailboxes clear of any debris that is brought to the curb. Any storm debris brought to the curb after Sunday, Aug. 9 won’t be picked up as part of this one-time
bulk collection and will be subject to ordinary yard waste rules requiring branches to be cut in four-foot sections and bundled for collection.

Brookhaven town Bay Constables issued summonses against a group of people they said were illegally harvesting oysters from Mount Sinai Harbor. Officials suspect the group was harvesting for use in a restaurant upstate.

On Tuesday, July 28 Brookhaven Bay Constables were patrolling Mount Sinai Harbor by boat and observed approximately eight people harvesting oysters. They radioed a senior bay constable who was on shore patrol to respond to a road ending where these individuals were. The constables found that the group had approximately 100 oysters in their possession and issued a summons for taking shellfish from uncertified waters.  

A town spokesperson said bay constables had been alerted to several incidents of illegal shellfishing over the past several weeks in Mount Sinai Harbor, where the taking of shellfish is prohibited by the New York State Department of Environmental Conservation from May 1 through October 31.

The town said the vehicle the group were travelling in was registered to Wasabi and Ginger Sushi Restaurant in Larchmont.

Town Supervisor Ed Romaine (R) said in a release that taking shellfish from uncertified waters can be a health risk, and he urged state and Westchester county officials track the oyster robbery back to the restaurant “to investigate the restaurant these individuals were associated with to ensure that the food they are serving is safe for the public.”

Brookhaven Town operates one of Long Island’s largest municipal shellfish hatcheries in Mount Sinai Harbor, growing more than 2,000,000 oysters and 1,000,000 clams at the mariculture facility. These shellfish are planted in bays and harbors throughout the town when they reach maturity to help clean local waters and revive local fisheries. 

“Our harbors, bays and waterways are tremendous assets, and part of the reason so many of us call Brookhaven our home,” Romaine added.

The inevitable closure of the Brookhaven Landfill in 2024 looms large on Long Island and the surrounding region. The burden of how to dispose of millions of solid waste still remains unresolved. The Town of Brookhaven has been considering its options, and one of them could be a new ashfill just east of where the current landfill is located in Brookhaven hamlet.

Town Supervisor Ed Romaine (R) said 500 acres of additional land owned by the town could be used for such a site. 

“There are probably 200 acres that we could take a look at for a regional ashfill,” he said. “We are looking to get feedback from other municipalities, we are in the premature stages.”

The site would handle only ash, and the town would not take any construction and demolition debris. While the money brought in from an ash site would bring in much-needed funds to Brookhaven, Romaine said it still leaves them with the issue of the construction and demolition debris, adding that with the closure of the landfill and no alternative for an on-Island site accepting that refuse, it would cause a crisis in the construction and building industry.

Romaine said he hasn’t had any direct conversations with state officials or the state Department of Environmental Conservation on the idea of a new ashfill site. Though he mentioned some members of his staff may have had conversations on the matter. 

For such a site there would be the need for an environmental impact study as well as DEC approval. The Town Board would also have to make a decision as well. 

Though news about what could be another site of dumping in an area that has already complained about odor issues has not gone well with town critics.

Will Ferraro, activist and a 2019 Democratic candidate for Brookhaven supervisor, has created a petition against the proposed ashfill site. He said an ashfill site does nothing to solve long-term fiscal problems. 

“Instead of making a proposal to solve our long-term solid waste crisis and the serious environmental health issues related to it, this will only exacerbate the threats to our air quality and groundwater,” he said. 

Ferraro created the petition following a Newsday blog post discussing the potential ashfill site. His petition, “Say No to a Second Landfill in Brookhaven,” begs the Town Board to reject any proposals relating to a second landfill or ashfill site, as well as to develop a “comprehensive proposal to deal with our solid waste crisis, that can be brought to our regional partners at the state, county and town levels,” among other demands. 

Romaine reiterated that the town is not considering a second landfill, but only an ashfill. Back in February at a Long Island Regional Planning Council panel, the Brookhaven supervisor called for collaboration to solve what he called a “regional crisis.” 

In a June 15 letter to the council, Romaine reaffirmed his stance by urging it to work with the 13 towns, two counties, two cities and the New York State Department of Environmental Conservation to develop solutions. 

“Even if we are able to do so now, it will still take several years to implement any changes,” he said, adding, “If we don’t address this issue now, it is going to be yet another thing that will make Long Island a less desirable place to live and work.”

One of the perks of living on Long Island’s North Shore is access to miles of beachfront, though some Rocky Point residents have said that enjoyment has been cut short well before sandals touch sand. Part of the confusion revolves around the complexity of who has access to the many miles of beachfront property.

Several residents have lately been making complaints on social media about security personnel at the beach ramp on Hallock Landing, a portion of which along with the majority of that beach is owned and operated by the North Shore Beach Property Owners Association. People on social media have complained of being yelled at, physically confronted and not being told or shown the correct access for Brookhaven town residents versus members of the NSBPOA. Some residents have rallied that overzealous security have made accessing the beach via the public ramp an issue. 

Residents have sent complaints to the association, Brookhaven town representatives as well as Suffolk County Police. Many complaints lacked video or picture evidence to confirm what exactly happened in these instances, though many residents say previous complaints about security have gone unheeded for the past few years. 

And as the hotter weather rolled in while pandemic restrictions were released, more and more people have sought to cool their heels in the Long Island Sound during the past few holidays and weekends. The issues were only exacerbated by more out-of-town people looking to use the beachfront after restrictions were lifted allowing Brookhaven residents to use the beach.  

Michael Gorton, a past president and current treasurer of the NSBPOA, said the association created a Security Review Board after the board received a complaint about security in June, which the board found “was unfounded and verified by witnesses that accusations were false,” he stated in an email.

According to a statement by the property owners association, the review board has “been made aware of all situations regarding complaints at Hallock Landing,” and has since acted and made changes to security protocol, though a request for clarification on what those changes was not responded to by press time. The association’s board decided to increase security at the location this year.  

“In the emails or phone calls directed to members of the board or to the association, the board took these complaints seriously,” the statement read. “Allegations or complaints from Facebook [posts] will be ignored and we will not address any of them. This has been the policy for years whether they are from last year or this year.”  

Complaints have centered around two volunteers who belong to the association, husband and wife Tom and Leah Buttacavoli, who were acting as volunteer security at the beach’s edge alongside another security guard. The third guard’s name could not be confirmed by official sources, though NSBPOA released a statement saying he is an ex-NYPD officer and a licensed security guard. Guards, the statement says, do not carry tasers but the one hired guard does carry pepper spray to be used in self-defense. Many residents have complained online of that guard’s overzealous nature in maintaining the beach’s private status, including alleged instances of threatening to pepper spray individuals on the beach during Fourth of July or running along the beach in the morning. 

Though police have been called to the location, requests for comment to the SCPD were not responded to by press time.

Thomas Buttacavoli did not respond to requests for comment via Facebook, though in June in posts to a community Facebook group he denied several claims he was the instigator of an issue with a group of young people at the entrance, saying he had been accosted by the individuals and that police responded and had concurred with his assessment of the situation.

The Town of Brookhaven and police have received numerous complaints of people coming from as far as New York City to come to private beaches on the North Shore, including areas around Cedar Beach in Mount Sinai and Rocky Point, according to several local officials. The town has hired its own private security guard to check for Brookhaven residents along its right of ways, including its access ramp next to the association-owned access.

Town Councilwoman Jane Bonner (R-Rocky Point) said she has spoken to the NSBPOA about the security issues. The town-hired guard only checks for some kind of proof of town residency, which could be anything from a driver’s license to a library card. Those residents are allowed up to the mean high tide mark, which is considered public property. Bonner said residents cannot be restricted from accessing that space using a town ramp.

“We have easement agreements with all private associations, this instance at Hallock Landing, that is town property, that is our right of way, and we have permission to use their property for our stormwater infrastructure,” Bonner said. “Hallock Landing is a public access site, and [residents] have been restricted where they shouldn’t have been.” 

As an entity, the NSBPOA owns the ramps at three separate locations in Rocky Point, some parts of the roads leading up to the beaches and the clubhouse located right off of Lincoln Drive. The association is very private about its membership as well as the people on its board. The names of trustees are not publicly available on the website. 

Part of the Hallock Landing area before the ramps down to the beach is privately owned by the association, and one of the ramps is only accessible by members. The area that is part of the stormwater runoff pipes is owned by Brookhaven and is a town right of way. The private portion goes from the western-most part of the yellow gate to points north and east, as well as the rain garden and parking spaces right of the ramp. 

“We have the right to prohibit access to our property to non-dues-paying members at the yellow gate that is in front of the ramp, due north and east of it,” the NSBPOA statement reads. “Public access can only be attained via the town right of way.”
