Brookhaven Town Board held a public hearing on Thursday, Nov. 9, to consider the 2024-2028 Preliminary Capital Budget, exclusive of special districts.

The Preliminary Capital Budget is a plan for capital expenditures, which are projects expected to have a useful life of more than one year. The budget includes projects such as road repairs, parks improvements, building renovations and landfill expansion.

The town’s commissioner of finance, Tamara Branson, opened the hearing by presenting highlights of the 2024 preliminary operating budget. The total appropriations for the operating budget amount to just over $335 million. This represents an increase in spending of 1.6%, with a rise in the town property tax levy of about 1%. 

In her presentation, Branson noted the preliminary budget will use no fund balance to balance the budget in the seven major tax districts. Outgoing town Supervisor Ed Romaine (R) — who is leaving office later this year to become Suffolk County executive — praised the budget.

“No fund balance has been used,” he said. “It’s all structurally balanced,” adding, “I think that’s important because some people lose that. Sometimes, you see towns using the fund balance or the reserves to balance a budget. We have not done that for years.”

The finance commissioner mentioned that the preliminary budget complies with New York State’s 2% levy cap, the town’s Tax Rate and Debt Management Cap and all fund balance policies adopted by the Town Board.

Branson’s presentation also noted no reduction in constituent services or total full-time staffing. The presentation further pointed out that the preliminary budget would lower property taxes across the nine ambulance districts by a combined 4.6%.

In the preliminary operating budget townwide summary, Branson noted the tax levy to be almost $195 million. Contrarily, to help balance the budget, the non-property tax revenues will equate to $140 million. To this, the finance commissioner commented on the work of the town Finance Department to help stabilize the budget.

“This is the area we have all been working on for the past decade,” Branson said. “To grow the non-property tax revenues.”

Romaine emphasized the importance of generating revenue from other sources, such as renewable energy.

“We want to encourage revenues from other sources, like solar,” he noted. “The more we grow non-property tax revenue, the less people have to pay — or the less we have to raise property taxes.”

Property taxes hold the most significant of the six major budget funds, supporting 54.5% of the total revenues. Second to property taxes, the town’s landfill, recycling and sustainability management contribute 22.3%. Building, fire prevention, and planning/environmental comprise the next biggest portion at 12.7%. The remainder of the total revenue includes parks, franchises, mortgage tax and state aid.

The preliminary budget’s planned expenditures are dedicated to employee compensation, employee benefits, contractual and equipment, and debt service. Romaine commented on the reduction of debt service, noting that the percentage of the town’s expenditures on debt service has decreased by 5% in the last decade.

The budget will feature new bond and reserve-funded projects totaling $47.9 million. Most of this sum will be allocated to highway development and improvement, focusing on roads, drainage, traffic safety, and updated machinery and equipment.

The remaining funds will support other projects such as parks and recreation facilities and equipment, open space preservation, public safety, planning and environmental, and landfill infrastructure improvements.

According to Romaine’s report of Sept. 29, the operating budget “reduces landfill revenues to reflect loss of volumes in 2023” and “grows the Landfill Post-Closure Reserve by $1 million to an anticipated $26 million.”

“I think this is a good budget,” the departing town supervisor indicated. “It is a very stable budget. It holds taxes very low — far below the rate of inflation — and allows us to move forward into the future.”

The board will consider the 2024-2028 Preliminary Capital Budget, exclusive of all special districts, during a public meeting on Thursday, Nov. 16.

Special education teacher and school administrator Gary Bodenburg (R) is challenging incumbent Councilmember Jonathan Kornreich (D-Stony Brook) to represent the Town of Brookhaven’s 1st Council District. The two faced off in a debate on local issues at the TBR News Media offices.

Bodenburg works in South Huntington’s school district and said he has spent a lot of time with at-risk populations, including students with special needs and victims of domestic violence. He said he thinks it’s important for average citizens to become “activated” for the benefit of the next generation.

“I’m trying to see the world through my 9-year-old’s eyes and make sure we make this place better and better each day,” he said.

Kornreich, who won his seat in a special election in 2021, has been a fixture in the Three Village area for years. He started his civic engagement with the board of North Shore Montessori School in Stony Brook when his kids were in preschool, then served on Three Village Central School District’s Board of Education and as president of Three Village Civic Association. He sees the town job as an extension of his deep personal interest in the community.

“I love serving the community,” he said. “It has nothing to do with the election — this is my life.”

Balancing redevelopment

Kornreich suggested the way to make redevelopment financially viable for developers is to have a mixed-use component, that is, build apartments on top of retail space like a grocery store, for example. This would also allow for more affordable housing for young people starting their careers and empty nesters downsizing, he said. But he cautioned that balance is key.

“We have to balance carrying capacity — How many people can our infrastructure, our roads, our single-source aquifer, our surface waters; how many people can this fragile little island support? — versus the need to redevelop blighted properties,” he said.

Bodenburg agreed redevelopment should balance environmental and quality-of-life concerns with the need for housing and safety. “When you see those buildings looking the way they are, it does attract undesirables to that area, and that just increases the issue of crime, and then we’re at a whole other set of spiraling,” he said, suggesting grants and other incentives for fixing up buildings and easing the burden on property owners.

Bodenburg acknowledged apartments above retail space could be useful for some, but he expressed concern about mixed-use buildings. He said residents he’s spoken to are not happy with the idea. “They do not want these apartment complexes, they feel it changes the character of their neighborhoods,” he said.

He also believed the town needs to act on the years of plans and studies for redevelopment in the area by working with local, county and state officials. “We’ve seen a lot of studying things to death with not necessarily something culminating or coming out of it,” he said, pointing to traffic backups he’d like to fix. “We need to start pulling the triggers on these things.”

Kornreich rebutted that redevelopment is something that happens over generations, and the studies are there to guide town decisions as the community changes happen over time.

“There’s no trigger to pull,” he said. “The Town of Brookhaven’s job is not to come in and tear buildings down and rebuild them according to the will of the community. This is an evolutionary process, and the visioning sets the long-term vision and roadmap for the way the community would like to see it.”

Kornreich added that mixed-use buildings would best go in already-built downtown areas, rather than within neighborhoods with single-family homes. He pointed to Patchogue as an example, with its many restaurants and walkable retail. “It’s a fun place in a preexisting downtown area. It’s really good reuse and redevelopment,” he said.

Landfill closure

Both candidates addressed the scheduled closing of Brookhaven’s landfill as a looming budgetary crisis, as it has brought sizable public revenue into the town’s coffers every year. They agreed that lack of planning over the past decades means the burden for making up the difference will largely fall to taxpayers.

Bodenburg said he’d go through the town budget to see where belts can be tightened, pointing to his experience as lead negotiator for his teachers union contracts. “Any time you’re looking at a major budget deficit, you have to start looking at other areas in order to cover those losses,” he said. “Negotiating [outside] contracts, making sure we’re getting the most bang for the buck when we’re hiring and contracting services for the town.”

Kornreich pointed to a wind-farm deal that should help make up some of the difference. He added that after he came to office and learned there was not much advanced planning, he was part of a group that rezoned the land around the landfill from residential to industrial, to make way for a solar farm that would also bring in revenue.

This was not a popular act with his party, he said. “I paid a political price, but it was the right thing to do because it was part of this process — at least from where I’m sitting — of scrambling now to try to fill that hole.”

Working across the political aisle

Kornreich has been the only elected Democrat in town government, something he said he has not let become an issue for him. “I’m the minority leader on the Town Board,” he joked. Calling himself a moderate Democrat, he said he’s made a point to work well with his colleagues across the political aisle.

“I’m trying to show that Democrats are people who are interested in good government and we’re interested in supporting the economy and supporting working people, supporting families and supporting kids,” he said. “We don’t have to get involved in the partisan warfare, and we can work together.”

Bodenburg said he, too, was not interested in political squabbles, and said “fake boundary lines that exist on paper” would not hold him back from working with all community members and other elected officials.

“My intentions are community-based — our kids, our families — and whatever is best for our community,” he said, adding that he would like to see more cohesiveness in the town. “I steer clear of politics and any type of issue that will throw a wrench in what’s best for our community.”

Kornreich’s willingness to work with Republicans has landed him in tricky situations, like with a vote in favor of the controversial town redistricting map last year. He said that vote, like many others he has taken, represented a compromise, and he is not a “bomb thrower” to vote “no” on policy he was part of helping to create.

“Is it a map that I would draw or support if I were in control? Absolutely not, no way. But it’s 6-1, so when you’re negotiating 6-1, I could take a performative vote and just vote ‘no,’” he said, clarifying that previous draft maps had significantly worse gerrymandering than the final version, and that the final map kept his district together. “Sometimes you’ve got to take a bad vote. You could choose bad or you could choose worse, and sometimes you have to choose bad — and that’s one of the realities of this job.”

Council District 1 voters will choose who will represent them when they hit the polls Tuesday, Nov. 7.

A lively debate took place between candidates Lillian Clayman (D) and Dan Panico (R) for Town of Brookhaven supervisor at the headquarters of TBR News Media. The incumbent supervisor, Ed Romaine (R), is running for Suffolk County executive. 

Candidates had two minutes each to respond to questions from the staff, with an optional 30-second rebuttal. The debate kicked off with the rundown of their credentials.

Clayman, 70, of Port Jefferson, honed her political skills as the three-term elected mayor of Hamden, Connecticut, from 1991 to ’97. She served as a city councilwoman in Connecticut, where she was the finance committee chair and managed a budget of about $200 million. Clayman noted that she spent 10 years as a financial planner and portfolio manager.

Since moving to Long Island 20 years ago, she has worked as a union organizer for 1199 SEIU (Service Employees International Union) and was chair of the Brookhaven Town Democratic Committee from 2016 to ’21. She holds a doctoral degree in American History from Rutgers in 2019.

Clayman was asked to step in when former Village of Port Jefferson Mayor Margot Garant withdrew from the race this June due to illness.

“As mayor of Hamden, I was in charge of the board of education budget, the sewers, the police department, the fire department, the libraries, all the roads, parks and recreation,” she said.

Panico, 45, of Center Moriches, represents the town’s 6th Council District, a position he has held since he was first elected in 2010.

Panico received his law degree from Touro Law School with an award for excellence in land use, zoning and planning. He has been deputy supervisor of the Town of Brookhaven since 2012.

“I’ve run as high as almost 79% of the vote because I know the job I do, and that is local government,” he said. “I don’t talk about national politics.”

Town supervisor’s role

When asked for their superpower, or the quality that makes them most qualified for the town’s highest post, the candidates offered varying perspectives.

Panico said, “My superpower is that my land use planning and zoning ability is unparalleled by anybody in the town. That is my superpower.”

Clayman, on the other hand, responded, “I can get people to work together. I work collaboratively.”

Land use

Panico said he believes the best land use decisions happen at the hyperlocal level in collaboration with communities and their elected district council representative.

“I’m deeply involved in all the redevelopment projects throughout the entire town,” the deputy supervisor said. “It’s without an exaggeration that I could be the councilperson for any of the six town council districts.”

He added, “I have the know-how to meet with developers and push the projects through, which are predominantly redevelopment, but also safeguard communities like Stony Brook and Setauket to make sure they are not overdeveloped.”

Clayman used her two minutes to focus on sewer infrastructure, which she believes is a critical aspect of sustainable development throughout the town.

“Without sewers, without IA [Innovative/Alternative] septic systems, we will continue to release nitrogen into our aquifers into our waterways,” she said. “Until we get new sewers and septics, we can’t even talk about development. We must be very careful because we are above our capacity.”

On the Town Board’s role in overseeing the planning and construction of new developments, both candidates agreed upon a hands-on approach from the supervisor’s office.

“I make it my business to know what’s going on across the entire town, although I represent the 6th town Council District,” Panico said. “I wrote the multifamily code with our planning department. I rewrote the [Planned Retirement Community code] and the [Commercial Redevelopment District code].”

Clayman offered a slightly varied perspective, noting the role of the town government in limiting overdevelopment. “The primary function of the Town Board is to make sure that areas are not overdeveloped,” she said. “All you have to do is look at Port Jefferson Station — there is an enormous amount of overdevelopment that is occurring in this area.”

Open space

Another critical component of the town’s land use arsenal is its open space fund. When pressed for their strategies for preserving open space, Panico highlighted the few undeveloped parcels that remain.

“I think we’re in a race to save what’s left,” the Republican said. “That’s what I believe, and I believe people in Brookhaven value open space,” adding, “We have the Joseph Macchia [Environmental Preservation] Capital Reserve Fund, open space funds that we use. I would certainly partner to preserve as much open space as we can and work with our villages.”

Clayman advocated for a grassroots, civic approach targeting parcels for preservation as open space. “Working with the civic associations and the Town Board to make sure that we have open space” would be critical, the Democratic candidate said. “We don’t need to develop every single piece of property that is available. That is something that occurred during the ’70s and ’80s, and we don’t need to do that now.”

Lawrence Aviation site

Lawrence Aviation is among the biggest Superfund sites on Long Island, and both Port Jefferson Station and the Village and Port Jefferson Station will likely bear most of the impacts from future redevelopment of that site. 

On how to accommodate residents of those areas, Panico said, “People have had to deal with that pollution for quite some time. If you are going to unveil solar in the area, give the affected population a reduced rate on their electric — you’re allowed to do that under New York State law. And give the residents of [Port Jefferson] Village a break on their tax bills. I think that would be a somewhat equitable thing to do.” 

Clayman said that the longstanding environmental impacts are not localized to Lawrence Aviation. “It’s not just Lawrence Aviation. At the town landfill, there are negative impacts from toxins that have seeped into our groundwater and our air. People swear that Lawrence Aviation has had a negative impact [on their health]. But I also think that what Dan said is a good idea for that property. I’m all for [tax breaks].”

Cost of living

For many seniors and young people throughout the region, the high standard of living is becoming untenable, prompting many to leave Long Island. To counteract these movements, Clayman advocated for increasing the amount of affordable housing units in the town. She pointed out that to live on the Island for a family of four, you need to make about $150,000 a year.

“That’s a lot of money,” she said. “The average family on Long Island is currently making about $86,000 a year. [Affordable] housing prices need to reflect that amount. That is something that can be part of any kind of development plan.”

Panico highlighted the town’s recent efforts in constructing new affordable units. “We’ve been very successful around the town in creating more units,” he said. “But if you listen to my opponent, we can’t build any more units. And to me, I live in reality, and I am pragmatic.”

He added, “I know that there needs to be redevelopment — redevelopment is the name of the game.”

Fentanyl crisis

Both candidates regarded the fentanyl crisis foremost as a mental health issue. Panico viewed the crisis as an issue that primarily needs addressing at the state and federal levels. Clayman, on the other hand, said there is an opportunity for expanded town, county and state partnerships in education and outreach.

“We can utilize the resources that we have with Channel 18 to have outreach to the communities and to the schools,” Panico said, “But ultimately, [combating the crisis] is going to come from a change in our federal government.”

Clayman outlined her more local outlook toward remediating the challenges. “I think the town has an important role to play,” she said. The town “needs to put more of our time and energy and focus not just into development projects but also look at how we can be of service to the community.”

As a follow-up, the TBR staff inquired how the candidates sought to finance an expanded role in combating the fentanyl crisis within the town.

Clayman suggested looking within the current budget as a possible source of financing a community response to the crisis: “I would look through vendor contracts, for example, and examine [the spending on] those vendor contracts.”

Panico objected to this proposal. “We’re going to look into vendor contracts and solve the fentanyl crisis?” he asked. “To me, it doesn’t make any sense. The fact of the matter is, it’s better when one level of government is focused on this issue.”

Energy costs

Both candidates agreed that the town’s Community Choice Aggregation program, launched in Brookhaven in 2022, is a well-intentioned initiative by the Town Board.

Clayman, however, questioned the rollout of the program as mired in confusing bureaucracy, putting the responsibility on town residents to figure out how to maximize cost savings.

“While maybe it was good intentioned, it doesn’t serve the residents,” she said. “And worst of all, nobody knows about it.”

Panico acknowledged that the town could do a better job of explaining the program to residents but believes it is a worthwhile endeavor nonetheless.

“Our aim is to save people money,” he indicated. “If you are a savvy consumer, you can opt out when the price is low and opt back into our program and save real money.”

“That’s unfair,” Clayman responded. “The program is based on putting the responsibility on [residents] to opt out of a program they are automatically enrolled in. As a consumer, I would much rather learn about a program beforehand and then make a decision as to whether or not I want to participate.”

Panico countered by adding, “Scores of people have used the program, and the town has an active outreach program to educate residents on their choices. The town publishes National Grid rates on their website so that people can track the rates.”

Brookhaven animal shelter

Earlier this year, residents publicly witnessed some frayed relations between volunteers and staff at the town-operated animal shelter on Horseblock Road. [See story, “Volunteers and officials express concerns over Brookhaven animal shelter,” Aug. 5, TBR News Media.]

“Just this morning, [New York] State declared the animal shelter unsatisfactory,” Clayman said. “The volunteers at the animal shelter were [the ones] that brought [the issues] to the public eye. This is one of the areas that Brookhaven needs to be more transparent.”

She added, “An attorney was hired to oversee the animal shelter — you don’t need an attorney to be in charge of an animal shelter. He directed that the volunteers had to sign non-disclosure agreements.”

Panico defended the administration for its handling of the shelter and pointed to progress at the facility since the initial dispute.

“We hired, for the first time, a full-time veterinarian at the animal shelter,” he said. “I met with some of the more prominent volunteers — they’re happy with the progress. We are making a big effort to bring up the animal shelter. But also, we hired somebody specifically for social media to get these dogs and cats adopted.”

Clayman responded, “But it is indicative of the way the town government has been run that volunteers have to meet in secret with a potential candidate for office.”

Panico countered, “Under my administration, there will be no NDAs or anything like that. We’re going to calm the waters.”

Active-use trails

Both candidates endorsed park preservation, linear park expansion and linkage of existing trails within the town.

Panico pointed to his record as councilman in park preservation, including negotiating with developers to preserve or create park spaces.

“Our parks and trails are absolutely beautiful in the Town of Brookhaven,” he stated. “I’ve made it [almost] through the Rails to Trails with myself and my 4-year-old on the back of my bike and my 9-year-old [on his bike].”

Clayman touted her record as the mayor of Hamden in building new biking and walking amenities.

“I built the Farmington Canal trail, which is a rails-to-trail linear park,” she said. “I would work very hard in linking [Brookhaven trails] up and to build more.”

Self-reflection

TBR asked each candidate on a personal level for their greatest frustration in their respective professional lives.

“I sometimes wonder if other people spend as much time [as I do] kicking themselves in the butt over something that I thought that I should do better,” Clayman said.

For Panico, “I wrestle with whether I should stick to what I know and stay in my lane in town government, or should I get more involved in other levels of government,” he said. “Professionally, I wrestle with this issue. I’ve chosen to stick predominantly with staying in my lane. I think I’ve made the right decision.”

When asked if they had a magic wand that could immediately resolve two issues within the town, the town supervisor candidates offered insightful perspectives.

“That’s easy,” Clayman said. “I would clean up the water, I would clean up the aquifer — that would be number one. I would make sure that the air was good to breathe. That would be wonderful if I could do that.”

Panico replied, “If I had a magic wand, I would help homeless people and the mental health crisis on the Island because it’s a Herculean task, but I would if I could solve that. Litter is something that is pervasive on the Island. It’s almost societal, and there’s no easy way to tackle it.”

Residents townwide will decide between these two candidates. Election Day is Tuesday, Nov. 7.

Several years after discovering “forever chemicals” leaking into Long Island’s groundwater near the Town of Brookhaven Landfill, located on Horseblock Road in Yaphank, the New York State Department of Environmental Conservation calls for “corrective action.”

A plume of highly lethal PFAS, PFOS, and 1,4-dioxane contamination has been uncovered in downgradient wells within the town landfill. The contaminants, commonly called “forever chemicals,” cannot be broken down by the human body or the environment.

According to a statement from the Brookhaven Landfill Action and Remediation Group, or BLARG, exposure to these chemicals “has been linked to some cancers, immune, fertility, thyroid and other health conditions.”

NYSDEC is requiring Brookhaven to begin assessing the current damage and determining a course of immediate action. The town is set to issue a notice to the public detailing the extent of the situation, its effect on local wildlife and communities and the next step in removing and properly disposing of the chemicals. Brookhaven will also hold a public forum to gather community feedback.

BLARG’s statement considered NYSDEC’s action “a day late and a dollar short.”

Kerim Odekon, a BLARG member, stated, “The only news is now DEC acknowledges the problem, which community members have raised to NYS and the town for years.”

Although NYSDEC determined the PFAS levels present “no new threats to drinking water,” community members are still concerned about the long-term effects on private water sources and wildlife.

Town Councilmember Jonathan Kornreich (D-Stony Brook) said he believes the fault should not be placed on the town exclusively, maintaining that “there is no question that the state has to step in as well,” he said.

Kornreich also noted the role of individual consumers and community members in remediating the issue. 

“We have to figure out our role in the larger question — that most of us dispose of large amounts of garbage every day,” he said, adding that consumers should consider how they as individuals contribute to the root problems.

The landfill is set to cease collection of certain trash and demolition debris by December 2024. Once the landfill reaches its capacity, the next step is to transfer out ash, potentially adding years to the timeline for full-scale closure.

BLARG continued to urge that the Brookhaven Landfill be shut down sooner rather than later, suggesting that the plume has gone too far.

“The first step is to set a closure date for the Brookhaven Landfill,” the BLARG statement reads, adding, “DEC must step in to set a date for the closure of the landfill.”

Following former Port Jefferson Village Mayor Margot Garant’s unexpected departure from the race, the Brookhaven Town Democratic Committee has tapped Lillian Clayman to stand in this year’s election for Town of Brookhaven supervisor.

Incumbent town Supervisor Ed Romaine (R) is running for Suffolk County executive this November, creating an open contest for his seat. The Brookhaven Republican Committee selected Deputy Supervisor Dan Panico (R-Manorville) to head the ticket.

Garant, opposing Panico on the Democratic line, suspended her campaign last week due to an “unforeseen health issue,” according to the BTDC. 

In an exclusive interview, Clayman opened up about her professional experiences and plans for the town. The new Democratic nominee centered her platform around the Brookhaven Town landfill while offering various administrative reforms.

A Port Jefferson resident, Clayman is an adjunct professor of labor and industrial relations at SUNY Old Westbury. She worked as a political organizer for health care union 1199SEIU United Healthcare Workers East and spent a decade as a financial adviser/stockbroker at Manhattan-based global insurance corporation AIG.

Clayman served as mayor of Hamden, Connecticut, from 1991-97. She was chair of BTDC from 2016-20, and has run several political campaigns in Connecticut and on Long Island.

Clayman said she was approached last week by party leaders, who had asked to lead the ticket in Garant’s absence.

“Given the fact that I have government administrative experience as well as political experience, and given the truncated time frame, I said that I would be happy to do so,” she said.

The town landfill — located on Horseblock Road in Yaphank and scheduled to be closed to construction and demolition debris by December 2024 — is a centerpiece of Clayman’s campaign.

“We need to do something quickly about the Brookhaven landfill,” she said. “This is something that has been ignored while taxes have gone up [and] elected officials’ salaries have gone up.”

“The Brookhaven landfill and all of its impacts on the environment today and in the future has been ignored,” she added. “It’s been kicked down the road.”

Concerning intervention and remediation of the pending landfill closure, Clayman said, “The easy environmental fruit has been picked,” suggesting expediency has been advanced while root causes go neglected.

“It’s easy to be for open space,” she said. “It’s a lot harder to find a solution to something as complex as the Brookhaven landfill,” calling the facility “a Titanic headed for an iceberg.”

The Democratic candidate maintained that supervising the landfill closure — and the expected challenges precipitating from it — will require close collaboration with all interested parties.

“My plan and my approach is to bring in all of the players, all of the stakeholders in the community, so that we can make sure that we can protect our environment for real, not just with words,” Clayman said.

Along with the landfill, she proposed several administrative reforms, proposing to “bring good government” to Town Hall.

“Good government means putting contracts out to bid fairly, without regard to whether or not they contribute to your campaign,” she said. “It’s also an approach that [assesses] whether or not we actually need a service, so I do use a little bit of zero-based budgeting in my approach to providing services.”

In stating why she entered the race, Clayman indicated that the town government requires greater proactiveness and energy to serve its residents most effectively.

“There’s a lot of work to do,” she said. “There have been years of neglect and coasting, and I intend to get to work on day one.”

Residents deserve better than one-party rule

In the May 4 edition, the editorial board highlights that the Brookhaven landfill is a major issue in this year’s Town of Brookhaven elections [“The landfill election”]. We need bold leadership to tackle Long Island’s decades-long solid waste crisis. This is an issue of economic, environmental and racial justice that we can no longer afford to ignore.

Carting our garbage off of Long Island to another community is not a sustainable solution. We must reduce our waste, and this cannot only rest on individual households, but also on businesses and producers. We can incentivize waste reduction with pay-as-you-throw programs. We can also utilize the knowledge of experts like Stony Brook University’s research associate professor David Tonjes, whose work on waste management provides guidance on how we can address this crisis with innovation and ingenuity. We are capable of long-term, sustainable policy, but only if we have the political and moral courage to do so.

It is clear to me that the current Town Board are not the people to meet this moment. The past decade of one-party rule in Brookhaven includes a botched rollout of the recycling program, our roads in disrepair, and gerrymandering our council districts to bolster a weak incumbent in the 4th Council District. They have left us with a solid waste crisis, used nearly $250,000 of our taxpayer dollars to pay an EPA fine for air quality violations in 2020, and ignored the voices of the directly impacted residents of North Bellport time and again. They do not deserve to be reelected in 2023.

Outgoing Supervisor Ed Romaine [R] must be held accountable for his role in the failures of the Town Board he has led. Romaine is seeking the office of Suffolk county executive, and he must be questioned about the harm he has had a hand in creating in the Town of Brookhaven. We as voters must consider if he is fit to handle higher office, given the mismanagement of our municipal government under his leadership.

We deserve better elected officials than we currently have in our town government. The communities of color who have been disproportionately impacted by the landfill crisis deserve to be listened to by our representatives. There is too much at stake to accept the status quo and small-minded thinking of the current Town Board. It is time for bold solutions that meet the urgency of the moment. It is time for change.

Still no funding for Port Jeff Branch electrification

Funding to pay for a number of transportation projects and pay increases for transit workers were items missing from Gov. Kathy Hochul’s [D] $229 billion budget.

There is no new funding to advance Hochul’s three favorite NYC transportation projects: the $8 billion Penn Station improvements; $7.7 billion Second Avenue Subway Phase 2; and $5.5 billion Brooklyn-Queens Interborough Express light rail connection. Also missing was funding to advance the $3.6 billion Long Island Rail Road Port Jefferson Branch electrification project. All Port Jefferson LIRR riders have to date is the ongoing LIRR diesel territory electrification feasibility study.

There was no additional funding to pay for upcoming 2023 NYC Transport Workers Union Local 100 contracts for LIRR and Metro-North Railroad employees. The MTA only budgeted for a 2% increase. NYC TWU president, Richard Davis, will ask for far more so his 40,000 members can keep up with inflation. Both LIRR and MNR unions, with thousands of members, will want the same.

Maryhaven: a breakdown of process

Our village process is broken. Let’s take the Maryhaven project as a recent example of what’s wrong.

This proposed development should have been brought to the Port Jefferson Village Board of Trustees via the Planning Board, which is responsible for overseeing all building-related matters.

But during the recent public hearing, we learned from the developer that he’d been in discussions with the mayor, deputy mayor and village clerk for well over a year, despite the fact there was still no proposal before the Planning Board. The first time the rest of the trustees heard about the project was when it was announced by the deputy mayor at a public meeting on March 6 of this year.

It’s likely the village attorney was also aware of these talks. As previously reported in this paper, he was pressing the village to be “proactive” and change the code to rezone the property in order to clear the path for the developers, whenever they were ready to apply. To that end, he proposed the May 1 public hearing. The attorney also suggested that if the code modification wasn’t suitable to the residents as is, there would be an opportunity to make adjustments. That is not entirely accurate.

We know this from our experience with the Mather Hospital expansion. Before the project came to a public hearing, the village made several decisions, from seemingly irrelevant (at the time) code changes to the most crucial, allowing the hospital a variance for extra clearance. The latter resulted in 2 precious acres of forest being cleared.

The impression the village gave at the time was that residents would still have a chance to weigh in. But when that time came, despite nearly 70 letters protesting the clearing of the forest and all the objections raised at the hearing, it was too late.

The Planning Board’s position was that its hands were tied by all those prior decisions, and it did not have the tools to consider the objections. In other words, we should have been paying attention when Mather first announced the master plan.

So forgive us if we’re skeptical when the village attorney tells us that we’ll have an opportunity to comment on the project overall at a later date.

Declining public revenue in Port Jeff

The spirit of New York’s Freedom Of Information Act is transparency and access. Its introduction states, “The people’s right to know the process of governmental decision-making and to review the documents and statistics leading to determinations is basic to our society. Access to such information should not be thwarted by shrouding it with the cloak of secrecy or confidentiality.”

The issue of the future tax revenue from the Port Jefferson Power Station is critically important to both the Village of Port Jefferson and the Port Jefferson School District. So, it is surprising to me that the LIPA settlement agreement is not made available on the village or school district websites. And when I asked the village that a link be included, I was told that the village attorney advised the village not to put it on the website. I would have to complete a FOIL application. I did so. It had no redactions, and nothing in the document contained any confidentiality clause. The Town of Huntington puts its Northport Power Plant LIPA agreement on its website. So what is the objection to making the Port Jefferson agreement accessible to all on our websites? Would they prefer to have the fewest taxpayers know its full terms and potential consequences?

While both the village and school district are quick to tell us how little our tax bills will rise when promoting 30-year bond proposals, their assumptions are highly suspect given the lack of any reasonable assurance that the LIPA benefit will survive beyond the glide path expiration just four years away. Both the Port Jeff and the Northport agreements state that any extensions under the same terms beyond the 2027 expirations are dependent on power needs of National Grid. With repowering off the table, and the state’s goal of 70% renewable energy by 2030, it would seem there is little likelihood of any significant extension beyond expiration. The Port Jefferson Village budget for 2023-24 reveals LIPA taxes covering 36% of property taxes while the school district budget includes LIPA representing 42%.

It’s time for the village and school district to face the elephant in the room and (1) make critical information available on their websites and (2) for any discussion of potential costs to taxpayers, include calculations that consider a potentially abandoned power plant and taxpayers having to face 60%-plus tax increases to make up the LIPA loss.

Time to put the brakes on spending

Port Jefferson and Belle Terre residents are facing a school district budget and bond vote Tuesday, May 16, at the Port Jefferson high school from 6 a.m. until 9 p.m.

It’s a rather hefty price tag being proposed: $47 million for the proposed 2023-24 budget and close to $16 million additional for a bond focused entirely on enhancements to the high school.

While district residents have been more than generous in past years in support of our schools, maybe it’s time to ask if spending over $50,000 each year to educate a student is really feasible. (That’s the amount when you divide the proposed 2023-24 budget by the 933 students in the district, as suggested by Deputy Superintendent Sean Leister as a simple approximation of the per pupil costs, at the village board meeting on May 1.)

Perhaps this is the time to put the brakes on this spending and take a hard look at the future of the high school and consider alternatives.

We need to say ‘no’ to the school bond

Port Jefferson School District residents will be asked May 16 to approve an almost $16 million bond entirely for the benefit of the high school building. The more crucial question to be asked is: “Why are we considering this enormous expenditure when our high school student population is still dwindling?”

According to the school district’s own numbers — found on the district website or online (Long Range Planning Study, Port Jefferson Union Free School District 2021-22) — our enrollment numbers are declining precipitously. On page 18 of the report, our high school’s total enrollment grades 9-12 by 2031 will be a mere 233 students. Divide that number by the four grades in the school and your average graduating class size by 2031 would be only 58 students.

Port Jefferson high school’s small size cannot be compared to that of a prestigious private high school. Even most of the top private schools like Choate, Phillips and Exeter keep their total high school enrollment over 800 students. Most parents want a high school atmosphere that is academically, athletically and socially rich for their children — a true preparation for college. A high school with less than 240 students can’t realistically provide that.

Our high school is presently functioning with the classroom configurations it has had for decades. Before we invest many millions to move art, tech ed and music to the main building to create team and trainer rooms, let’s first focus on what we do if the high school population keeps dwindling, as the district study projects. 

Perhaps we could maintain a strong pre-K through 8th grade school system here and investigate tuitioning out our high school students to Three Village and/or Mount Sinai. This solution has been used successfully by many small school districts. Other larger local districts are facing declining enrollments as well, undoubtedly because of the high home prices and high taxes presenting an obstacle to young families seeking to move to this area. Given that reality, neighboring school districts would welcome our high school students.

Right now, we need to say “no” to the school bond. Before we spend almost $16 million on the high school building, we must find a solution to this ongoing decline in enrollment. To keep ignoring this serious issue is unfair to our already stressed-out taxpayers — and equally unfair to our future high school students.

Experience matters

Kathianne Snaden is running for mayor and Stan Loucks is running for reelection as a trustee for the Village of Port Jefferson. They have worked together on the village board for four years. 

Kathianne has shown to be tireless and dedicated to the betterment of every facet of our village. She has opened the doors to the internal workings of government by live streaming the board meetings, originating the Port eReport and the practice of responding to every and all questions from everyone. As the liaison to the Code Enforcement Bureau, she is totally committed to improving public safety and was responsible for increasing the presence of the Suffolk County Police Department. Kathianne is also our liaison to the Port Jefferson School District. This is an important relationship that was absent and created by Kathianne. 

Stan Loucks has been devoting his retirement years to the Village of Port Jefferson. Prior to his election to the village board in 2015, he was on the tennis board, the board of governors, the greens committee and the Port Jefferson Country Club management advisory committee for a total of 20 years, including chair. Stan has been the liaison to the parks and recreation departments, deputy mayor and liaison to the country club. 

He is a hands-on person who will always be directly involved in any issue related to his duties. He has been directly responsible for numerous projects and improvements such as renovation of the golf course; building a new maintenance facility, driving range, fitness center, membership office; upgrading village parks; initiating relationships with our schools and much more. 

Kathianne was TBR News Media Person of the Year in 2019, and Stan was Person of the Year in 2021. Seems like they would be the team that we would want to represent our village.

Experience, knowledge, integrity, dedication and hard working are qualities that we need.

In the race to fill Brookhaven Town Clerk Kevin LaValle’s (R) seat on the Town Board, Neil Manzella (R-Selden) handily secured victory on Tuesday, April 25.

LaValle took over as town clerk in February, vacating the 3rd District and triggering a special election to complete his term, which ends in December. An unofficial tally from the Suffolk County Board of Elections indicates Manzella comfortably defeated his Democratic opponent, Alyson Bass, of Centereach, holding a 57-43% margin of victory.

The councilman-elect explained that there was little time to celebrate. The true test will be this November when he and Bass will be back on the ballot to compete again for a four-year term.

In exclusive post-election interviews with Manzella and Bass, the two CD3 candidates set the table for round two. Following resident feedback heard throughout the special election cycle, repaving the district’s roadways will be a primary focus.

“One of the biggest topics that I heard from the district [residents] themselves is the condition of the roads,” Manzella said. “One of my plans is to go and sit down with the Highway Department — the Superintendent of Highways [Dan Losquadro (R)] — and try to see if we get that taken care of during the summer months.”

Bass, too, heard from district residents about the disrepair of the roadways. To mitigate those concerns, she proposed enacting measures to promote transparency within the road prioritization process.

“You hear of roads being paved multiple times while other roads haven’t been paved in six or seven years,” she said. “How does that happen? There are definitely areas in our district that are neglected, and there are other districts that are not neglected at all.”

The two candidates also narrowed in on the other major overhanging issue for the area, commercial redevelopment. CD3 contains two prominent commercial corridors along Middle Country and Portion roads. The candidates departed in their approach to building up the many undeveloped parcels.

Bass approached the redevelopment issue with caution, noting the need to protect open spaces and restrain sprawl. 

“We’re looking at every piece of green land being sold with no inhibition,” the Democrat said. “You have shopping centers with less than 50 percent capacity, parking lots that are barely used, yet all of our green spaces are being sold.”

Manzella offered a different perspective on redevelopment, viewing the undeveloped lots as a potential tax base for the town while building upon the aesthetic character of the area.

“I see our district trying to thrive in the commercial region,” the councilman-elect said. “I want to push redevelopment of areas along our Middle Country and Portion roads. I want to push redevelopment that can help fill vacancies, empty lots, to make it a more aesthetic and more business-friendly [area].”

Ahead of this November, the closure of the Brookhaven Town landfill looms as one of the most pressing issues facing residents townwide, with regional implications as well. 

Manzella said his campaign has yet to focus on the landfill closure but expressed optimism toward working with his colleagues to remediate the issue.

“The plans for what happens when the landfill closes is not something that I would have even been a part of before now,” he said. “But now that I am in a role where I can contribute to it, I can’t wait to have that conversation.”

Bass said the Town Board staying proactive in the landfill closure would serve the best interest of the residents townwide. “I think pushing to have a plan in place so that we aren’t so affected by the closure of the town dump is huge,” she said in an earlier interview.

Residents of the 3rd Council District will decide upon these two candidates again in just over six months. Election Day is Tuesday, Nov. 7.

Planning and decision making in our county needs to be a more open, thoughtful process. There is a concern on the part of communities in the area surrounding the Brookhaven Town Landfill that the plans for closing it in 2024 are unclear and have not been fully disclosed to the public. 

The League’s March 2021 TBR column on zero waste (https://tbrnewsmedia.com/making-democracy-work-how-can-we-get-to-zero-waste/) set the stage … our goal is to significantly reduce our garbage, but we are far from getting significant action from our neighbors (and our consumer/disposable society) in the next few years. Thus, what the Town of Brookhaven (TOB) does with the landfill site, the surrounding area, and the ash disposal will be a major factor for central Suffolk residents in the coming years. 

The TOB landfill was established on vacant land zoned mostly residential in 1974. Hamlets, developments, neighborhoods now surround the landfill site, including the areas of North Bellport and Horizon Village. 

Looking ahead to the closing of the landfill, TOB officials have proposed changing the zoning of 136 acres on the landfill site from residential to light industry and selling some of the land for an industrial park, with a codicil to prevent certain waste-related uses. (The remaining acres include the municipal recycling facility and yard waste and composting operations and undisturbed woodland.) 

At the zoning hearing held by the TOB in July, residents from all parts of the town protested the plan to sell the acreage and suggested instead that the town seek community input about how to remediate and re-purpose the entire landfill property. Clearly information is required about possible contamination of water and soil and the testing results over the past 50 years (think of the Bethpage and Brookhaven Lab plumes). 

The League is focused on civic education and government transparency. We urge the TOB Supervisor and Board to THINK BIG! The problems and possible solutions to the landfill closure, possible pollution, health effects and ash-disposal are just one part of a proposed ongoing discussion. 

Appointing a sustainability committee could lead the TOB toward better understanding of the problem and solutions and lead a community education effort. The town needs to communicate the issues openly with the public and hold public listening sessions to get constituents’ input. Garbage itself, and its costs in dollars, health, property values, and yes, our children’s future, MUST be described and garbage volume reduced significantly. If the landfill is to close in 2024, time is of the essence. Everyone should have the opportunity to be heard.

In a time of contentiousness and public strife, it’s critical that government brings its citizens/residents into the tent and that accurate, thorough information is the basis. The people must be heard, and decision-making must be transparent and accessible. The Town of Brookhaven owes this to the people who elected them and placed their trust in these representatives.
