*Update* Officials confirmed Thursday, July 2 the Port Jefferson Village board was issuing a permit for a car parade this Saturday after the permit was deemed complete by Village Administrator Joe Palumbo.

After the Port Jefferson Fire Department announced it was canceling this year’s Fourth of July parade due to the ongoing pandemic, a local conservative group announced it would host its own parade to mark the standout American holiday. However, this new community-run parade has made some waves within the village because of the event’s political undertones.

The Setauket Patriots, a local right-wing social media group, established the event they called Patriot Day Parade which was advertised on Facebook. They invited local fire departments, floats, classic cars or anyone else looking to participate. Because of concerns with distancing, Village of Port Jefferson officials requested the parade take place in vehicles. The Setauket Patriots also advertised for people to wear masks.

“All politics aside, this is not a political event, all people are invited,” said a representative of the Setauket Patriots who asked not to be named so as to not be attacked on social media. “We should come together for the birth of our nation.”

The parade is scheduled to meet up at 10 a.m. at Railroad Avenue then start marching at 11. The Facebook event said it has been in contact with Suffolk County Police who will escort the parade and close all streets along the route, though police did not respond to requests for confirmation. The route will take it down Main Street, take a left on West Broadway and stop in front of Village Hall where it will disburse, according to Village Administrator Joe Palumbo.

The parade has at least partially been in response to a recent protest march held in Port Jefferson. The Setauket Patriots description of their parade on Facebook incorrectly states that the Village of Port Jefferson canceled the regular July 4 parade, as that event is instead handled annually by the fire department. The post points to the recent Black Lives Matter march held in Port Jefferson June 18, which village officials granted a permit for, as why a 4th of July parade should be hosted as well. That June protest was created by students at Stony Brook University, who submitted the permit application which was unanimously approved by the village board at its June 15 meeting.

The Setauket Patriots’ post said that march shut down Main Street for four hours, but a TBR News Media reporter who was on the scene said it only lasted for two, and after holding speeches at Village Hall the crowd quickly disbursed.

The Setauket Patriots also wrote that despite comments from detractors that the parade would be a rally for President Donald Trump (R), the march “is a July 4th Parade PERIOD.”

“It’s not a Trump rally, but anyone who attends is free to wave whatever flag they want because that’s what this country  is built on,” the post continued.

As of Tuesday, June 30, village officials said they have worked through the application with a Setauket Patriots representative. The group paid the application and safety fees attached to the permit application, which has been sent for review. Because the next official village meeting is scheduled for July 6, Palumbo said the village trustees and mayor are to be polled on the application, but no decision has been made as of time of reporting. Because July 4 is a federal holiday, the decision on the application must be made before that date.

In mid-June, the Port Jefferson Fire Department announced it would not be hosting its annual parade, and in a letter, Todd Stumpf, Port Jefferson Fire Department chief, cited COVID-19 concerns as why it was being canceled.

In May and early June, the village considered hosting its annual fireworks show at a later date than July 4, but by June 15 had canceled the show it usually hosts at East Beach, with officials citing safety needs and an inability for people to socially distance considering the numbers of crowds who usually come down for the annual display.

New York State Route 25, known as Middle Country Road, which crosses through several hamlets in the center of Brookhaven Town, has long gone without fixes to its cracked pavement and massive potholes. Civics, town officials and some state officials said the New York State Department of Transportation has reneged on promises to finally repair the broken asphalt this year.

“I have been at many meetings over the years to pave Middle Country Road, and last year they did promise us it would be done,” said town Councilwoman Jane Bonner (R-Rocky Point). “The issue has not been addressed for so long, this roadway now requires complete reconstruction. And you know why? Because cheap is expensive in the long run.” 

The road runs parallel to its sister highway Route 25A, which just recently received repaving in Rocky Point. Route 25, on the other hand, has received only minor patches in the past several years, officials said.

Town of Brookhaven officials said the state DOT had promised it would repave the section of road from Mount Sinai-Coram Road to Wading River Hollow Road in Calverton by July. However, officials said recent word from the state said it likely would not happen this year.

At a press conference held in Ridge June 25, state and town officials stood alongside local civic representatives and members of local fire departments calling for the road to be repaved.

Ridge Fire Department Chief Lou Keiser said the road’s uneven surface can make cars swerve and cause accidents. It also greatly impacts ambulance drivers who may be carrying injured people in the back of their vehicles.

“I have been here since 1991, and I haven’t seen it be repaved since then,” Keiser said. 

State Assemblyman Anthony Palumbo (R-New Suffolk), whose district partially covers a section of the state highway, said he was copied in on an email with state Sen. Ken LaValle (R-Port Jefferson) that the construction company wished to do the road in a different order, starting with a part of the road in Nassau. The DOT is repaving Route 25B in the Town of North Hempstead and Route 107 in Oyster Bay as part of the state’s repaving project.

“My office got a response from DOT that they’ve had more complaints over in that direction in Nassau,” he said. “The only reason the complaints stopped here, which were more voluminous than anything in Nassau, is because we were told the construction was coming.”

The press conference also brought in a measure of politics, even more emphasized during an election year. No local Democratic elected officials were there at the press conference. Members of the Town Board and local state Assembly members criticized the governor for what they called a dismissive attitude to the plight of local infrastructure.

Palumbo also referenced several state officials in Nassau who are seeking reelection this year for why construction was starting on that side of the Island. Palumbo is the Republican candidate looking to take the state Senate District 1 seat once LaValle vacates it at the end of the year.

In a statement, LaValle said, “My office has worked closely with the civics and constituents for well over a year in an attempt to fix the safety issues along this stretch of Route 25. We were given a commitment by DOT that repair and paving would begin this summer and completed in the 2020 calendar year. It is unacceptable that the DOT would do an about-face and put this project off for a year, especially in light of the fact that emergency vehicles cannot safely travel this stretch of road and driver safety is a major concern.”

In response, Stephen Canzoneri, a DOT spokesperson, said the resurfacing project on Route 25 has always been the end of 2021, though there will be spot repairs on the highway for this year.

“The resurfacing of Route 25 was never anticipated to be completed this year,” he said. “In addition, the department plans to make temporary repairs to sections of Route 25 ahead of this winter.”

However, that directly contradicts comments sent to local officials last year. New York State DOT sent a letter April 8, 2019, to Suffolk County Legislator Sarah Anker (D-Mount Sinai) which stated that the resurfacing project on Route 25 has been “accelerated to a bid opening in early 2020” with a going out to bid in March and a schedule to start construction in spring of 2020 for the described section of the highway. 

The letter was signed by DOT Regional Planning and Program Manager Glenn Murrell. Anker said in reaching out to DOT officials, there seems to have been a mix up on their end for why she and other officials were told it was in the pipe for 2020. She added this issue has been constantly on electives’ minds, with more than a few letters being sent to the DOT over the past several years. 

“I will continue to follow this intensely as this has been going on for a number of years,” she said. “Hopefully we can see the whole road done sometime soon.”

For several weeks in a row people of all races have crowded the streets of Huntington, sidewalk to sidewalk, calling for an end to prejudice.

Those same streets in Huntington village have held other marches, but one started just under 30 years ago still holds unique significance today. Go back to June 9, 1991, the sky was open blue while the sun blazed down on people who also marched through Huntington against prejudice. It was a time of oversized glasses, poofy hair and tees tucked into jeans. Many marched with rainbow flags in their hands and pride on their faces, but some also reportedly marched with bags over their heads. It wasn’t a fashion statement, it was a way to hide their identities during a time when many people in the LGBT community would be retaliated against at the workplace or even at home. 

About 800 people stood between close to 3,000, according to what journalists wrote at the time. Most cheered for the marchers, but others screamed at them, warning of eternal damnation and holding signs reading, among other expletives, “Kill Yourself.” SWAT teams lined the surrounding roofs because there had been threats of violence toward the marchers.

It was June 10, 1991, when the first Long Island LGBT-led parade strode through Huntington. Marchers shouted “We’re here. We’re queer. Get used to it.” That parade would be a landmark day for the LGBTQ community on Long Island, but for the people who marched, it meant much more than that.

“It was the proudest day of my entire life,” said Leah Gustavson, a Rocky Point resident and one of the original members of the committee who established the parade. “I felt like we started something, stuck to it and got to an end goal.”

That parade took place 24 years before the U.S. Supreme Court gave gay people the right to marry. It was 29 years before the court confirmed it was unconstitutional for businesses to discriminate against people on the basis of sex, a huge boon to the LGBTQ community, which has long experienced discrimination when applying for jobs and in the workplace.

But getting it together would take months of backbreaking effort destroying barriers, including taking a Long Island town to federal court to win their right to assemble.

Today, as protests and marches have broken out at every corner of the U.S., the memories of the struggle to have voices heard three decades ago adds a new perspective for those advocating for an end to prejudice. It’s a glimpse of how far Long Island has come and how far it might still have to go.

Beginnings of the March

The Lesbian/Gay Pride and Freedom Committee was established after June, nominally known as pride month, in 1990. It was after the group had attended other major pride celebrations that year, including the New York City pride parade as well as one earlier in March on St. Patrick’s Day, where members of an Irish gay and lesbian protest group led a parade before the main parade could start.

A few members of the local gay and lesbian community were having meetings at a gathering place near Stony Brook University. The school had an active LGBT scene with a school club found in the basement of the old Union building on campus. It was in a space that was once a closet, something that became an oft-used joke in the small burgeoning community. 

No one who was there remembers who exactly brought up the idea, but everyone who was in that room one spring day remembers the conversation about pride parades and the simple question, why wasn’t there one on Long Island? Why didn’t they try to start one, because, after all, how hard could it be?

In that small group of likeminded people, what would become the 10-member Long Island Pride and Freedom Committee was born. Gustavson related that gung ho attitidue to a sense of ”ignorant optimism,” something that can be a powerful force, especially for people who know things need to change, and that now is the time to do it.

She, and other original members of the committee, said coming together to plan this march was a way for many of these people who have long felt marginalized on Long Island to finally show they have a voice. Even still, numerous people on the committee would only publicly go by their first name, knowing they could be retaliated against in the workplace.

Those who were there look back on it as a time that was not nearly as fraught and violent as previous decades, but there still was massive underlying prejudice toward the gay community. Steve Henaghan, of Mastic, was another of the original committee members trying to get the parade started. In the 1980s, he and other gay/lesbian rights activists helped create a political action committee called Citizens for Equal Rights PAC to raise money for candidates that would support issues of equality. 

“At that time very few would come forward and say they were supporting our issues,” Henaghan said. “In 1988 and ’91 we were making inroads politically especially within the Democratic Party.”

The committee approached several places throughout the Island to hold their march. In March of ’91 they received rejections from multiple towns and villages on the Island, including both the Village of Port Jefferson and Village of Northport. 

The Record, one of a few Port Jefferson area newspapers at that time, wrote about the village board rejecting the application, saying trustees felt the committee was not “locally based,” citing that it was based in Upton, though committee members argued that was simply their mailing address. 

The Port Jeff mayor at the time, Harold Sheprow, was cited as referencing the controversy of that year’s gay rights group in the New York City St. Patrick’s Day Parade. Trustees argued a Sunday march would hurt businesses, create congestion and open up the village to having to host other marches. Trustee William Glass Jr. was quoted at the time as saying, “This is political with a ‘P.’”

Henaghan could not help but laugh at hearing that quote read to him again.

“It didn’t surprise us we were rejected, it angered us,” Henaghan said. “We knew we were not necessarily welcome by people, but the point wasn’t to be welcomed, we were demanding that we would have equality.”

Northport rejected the parade for similar reasons, especially citing it was policy to only permit “community based organizations” to schedule parades. 

David Kilmnick was one of the original members of the LGPF Committee who now is president of the nonprofit LGBT Network, an association of nonprofits that looks to support the LGBT community on Long Island. He said if the committee didn’t end up securing a march route and permit, they were willing to do one anyway somewhere on Long Island, even if it potentially meant being arrested.

“We were told we would be arrested, we didn’t care,” he said. “It was our right to be able to do this. We were being flat out discriminated against because of our sexual orientation.”

With a number of rejections under their belts. LGPFC members knew they had to settle on one place, and that place was going to be Huntington.

Taking a Town to Court

The committee worked with police on creating a route through the town. Their original path was longer, about 1½ miles, but in speaking with Inspector Alden Berry of the Suffolk County Police Department, the group determined on a newer, shorter route that reduced the overtime cost for officers, closed only one lane of traffic and offered more protection to those demonstrating. By April 12, 1991, that route was approved by police and sent to Huntington.The group had already sent a request to the Huntington Highway Department. While they had confirmation the request was received, they didn’t hear back until after they sent out the notice of the parade route. 

Huntington Highway Superintendent William Naughton, a Democrat, responded to the marchers with a letter the same day they sent in the revised route. The language used in the letter would become the basis for further legal action, one that would bring in the support of the American Civil Liberties Union.

Along with citing overtime costs for the highway department and police, it said those looking to hold parades in the town should instead ask to be included in separate parades. It also read that, “Requests from several groups have been made in the past to hold additional parades, but my policy has always been to approve the traditional parades only.”

“We saw that as blatant discrimination, and we had the right just like every other group to have a march or parade,” said Kilmnick.

March planners got in contact with the New York Civil Liberties Union, which in turn picked out several attorneys to work on the issue. Two local attorneys were picked to lead the effort.

Mitchell Gittin, who is now an East Setauket resident and attorney with the Hauppauge-based Fitzgerald Law Firm, was then a volunteer on the legal committee of the NYCLU Suffolk Branch. He was tapped to lead the litigation effort alongside fellow attorney Joel Kupferman, who described himself as having been just recently out of law school back in early ’91.

“We tried to negotiate with them and asked them why they were so concerned and their reasons for denying the permit,” Kupferman said. At the time he was also a resident in Huntington. “[Huntington attorneys] said people get drunk and destroy property in these parades. I I told them we’ll concede that as soon as you stop having St. Patty’s Day parades — they were ridiculous concerns.”

The attorneys quickly noticed the language of the highway superintendent’s letter was not concurrent with basic tenets of the U.S. Constitution. Outright denying a march in line with the First Amendment because it was not one of those “traditional parades” did not stand up to scrutiny.

“That’s what was so gratifying with the case, because frankly the law was on our side,” Gittin said. “The other side didn’t have any kind of legal counterargument, you can put restrictions on gatherings … there was no reason from a logistical perspective the pride parade would have been more burdensome than any other parade — it really did come down really to discrimination.” 

The attorneys sent a letter to the town May 9, but did not receive a response. Both the committee and Town of Huntington would end up in court. 

The deadline of June 9 for the parade was fast approaching. In early June, both sides appeared in front of U.S. District Court Judge Leonard Wexler. Instead of a protracted back and forth, after just a few hours in court, the town agreed to grant the group a permit for the march.

Though the group did experience pushback from local elected officials there were a few that showed support, even if in small ways. New York State Sen. Jim Gaughran (D-Northport) was a Suffolk County legislator back in 1991. He said the LGPFC approached his office after being rejected by the Huntington highway superintendent. He told the assembled people that he was giving them approval to use his office’s parking lot as the end point for their parade.

“Back then there were a lot of officials who were afraid to take a stand,” he said. 

Gitten said that recalling the case gives him a unique sense of pride. 

“I look back on it, and not that it was a heroic thing, it was a lawyer job, I was in the right place at the right time,” he said. “It feels nice as a lawyer to look and having been part of a movement and part of a wave that’s still going on.” 

The Day Of

The parade itself would be just three quarters of a mile, a short jaunt made by many pedestrians today in what is normally glowing nights on the town in historic Huntington village, or at least it was prepandemic. For the people at the march, it would be an experience none of them would ever forget.

The committee members took up positions at the head of the column. Moving up along Gerard Street, they marched down New York Avenue then turned east onto Main Street. Above them, marchers could see the hints of helmets and glint of rifles in the sunlight. SWAT snipers had been positioned on rooftops to watch over them, as there had been several threats of violence.

That was when the marchers saw the true extent of the crowds. Newsday reported at the time 3,000 people came out to see those in the parade. It was more than they expected, and surprisingly many were shouting support. Of course, there were many community members shouting at them, saying they would “go to hell” for what they were doing. Before it became well known thanks to the show “Game of Thrones,” those marching found use in shouting “shame, shame” at those heckling their procession.

“Our adrenaline was flowing so hard and strong and then we turned the corner, that’s where the protesters were,” Henaghan said. “It was like electricity was running through our bodies, we were so charged. You realize at that moment, you are not standing down, you are going to stand up. It was one of the greatest days of our lives,”

There was a general sense of both exhilaration and apprehension. This was uncharted territory for them, despite participating in other pride parades. This one was theirs, and they had to own it.

“People would call it a parade, but it was a march,” Kilmnick said. “We didn’t have the pageantry, we marched down New York Avenue and had a rally in the back of Huntington Town Hall … In 30 years I will never forget that day, that day was a victory for all of Long Island.”

When they finally reached the end, the emotions of the day were overflowing. 

“The relief was palpable,” Gustavson said. “People were hugging each other and cheering … A lot of people came to celebrate with us. Some of them were not gay, but a lot of them were. It was a party in the best sense of the word, it was celebratory.”

Douglas Futuyma, Stony Brook professor emeritus of evolutionary biology,  was convinced to speak at the 1991 march in back of the town hall building. The professor has long been known on campus as an openly gay man, unafraid to talk about it in front of students when it came up. When it came time to speak at the rally, he wanted to talk about things beyond the biology of it, that gays and lesbians did not simply choose to be so, they were born that way. He spoke of Huntington’s native son Walt Whitman, and how that poet spoke to the quick of “humankind’s exploratory and vibrant spirit.” It was the fundamental question of human rights.

“It was certainly exhilarating, despite the heckling or harassment,” he said. “It was as it should have been, a celebration.”

Today and the Future

This month, the annual pride event was canceled due to the pandemic. Instead the LGBT Network held an online pride event June 14 featuring multiple celebrities and other local elected and civic leaders as speakers. 

It’s been a roller coaster ride for the past 30 years with the annual pride parade. Gustavson left the committee after the third year. Henaghan stood on for several years before leaving as well. He came back on in the early 2000s, but again left the committee to its own devices. 

The pride parade came under the auspices of the LGBT Network in its later years, and because of lagging participation a celebration was held instead of a parade in Huntington’s Heckscher Park. In 2017, the parade moved to Long Beach, and Kilmnick said the parade picked up steam once again. The LGBT Network president said last year an estimated 30,000 people participated. The biggest change from just a few decades ago, he said, is the number of young, school-age people coming out to march and support the annual parade.

“In ’93, so many kids were being bullied in school, afraid to come to the parade,” he said. “We didn’t have any student groups that marched in that parade. Now they make up more than 50 percent of that parade.”

This year, the parade was set to move to Jones Beach after a dispute with Long Beach over a $70,000 fee the LGBT Network said other organizations did not have to pay for similar events. Leaders of the parade are hoping for a renewed involvement come 2021, which will be the 31st pride parade and its true 30-year anniversary.

But the fight for equality is not one lane for just one group of people. Those who spoke about their experience with the first pride parade all identified with those marching against police brutality and racism today. 

Gustavson said things changed for the better in the past three decades, such as general awareness along with much more acceptance at the grade school level, but some things have not progressed nearly enough. For white gay people, she said things are “a lot better.” For gay people of color, trans people and especially trans people of color, there are way too many problems with prejudice both on the governmental and societal levels.

“I don’t want to see violence, I never want to see violence,” she said. “But there are times when that’s what gets people talking and thinking and there are always people who will never understand why riots happen and why they destroy their own sh**. They will never understand that, and it’s passionate. When you’re passionate and you’re screaming because you’re afraid for your life, that it doesn’t really matter so much what gets ruined as far as ‘things’ go. Things are things. We’re fighting for our lives here, we’re fighting for our sanity, we’re fighting for our ability to walk in society without fear of being beaten to death because you’re a ‘fag,’ or because you’re Black.”

Henaghan, despite saying he has occasional bouts with pessimism, does believe the world is heading in the right direction. His partner for 23 years became his husband eight years ago, just a year after the Supreme Court’s gay marriage decision. For the people marching in the streets today, he said many of those who spoke out against that march in ’91 are the same people or the ideological descendants of those who verbally harassed them 30 years ago.

“Many people will not let go of that hate they have, whether it’s for people of color, gays or lesbians, trans people, there are many people in our society they will not let go of that hate,” Henagan said. “They will fight you to the end. We still won’t stand for it.”

Numbers included are from those who went to the polls Tuesday and those who voted early. Due to the abundance of absentee ballots requested by Long Islanders a final tally of votes won’t be completed until July 1.

So far, results have shown close primaries for Democrats in both the U.S. District 1 Congressional seat and for the New York State Senate District 1 position. Perry Gershon leads for the congressional position with just 166 votes over the person currently in second place Nancy Goroff.

Laura Ahearn leads the pack of Dems with a total of 2,360 votes, a little more than 200 than the person in second place, Valerie Cartright.

Other races are not so close. U.S. Rep. Tom Suozzi (D-NY-3) leads with over 20 percent more than the next candidate.

Republican and Democratic congressmen from Long Island are promoting a bill that would cancel the taxable status placed on grants for prototype denitrifying septic systems in Suffolk County and offer relief to those who received those grants. 

Both U.S. Rep. Lee Zeldin (R-NY1) and Tom Suozzi (D-NY3) are promoting legislation that would essentially reverse the U.S. Internal Revenue Service’s ruling that grants for the experimental septic systems were taxable, despite Suffolk County and other local officials saying there was precedent for such grants on home-based environmental devices being tax free.

“Cesspools and septic systems have been identified as the largest single cause of degraded water quality on Long Island,” Suozzi said in a statement. “This bill may not sound exciting, but it has a real impact on real people’s lives and pocketbooks.”

The IRS ruling came down in January of this year after Suffolk County Comptroller John Kennedy Jr. (R) asked the IRS for such a decision. The comptroller sent tax bills to homeowners who had taken up such grants in 2019, saying the county should have constructed the program to make sure that the feds would tax the contractors, not those who received the grants. County Executive Steve Bellone (D) said in a statement that “the notion that Suffolk County homeowners would be taxed for participating in a water quality program that will make their water cleaner simply defies all logic.”

Zeldin said they have to protect taxpayers.

“This program’s goals are laudable, but we must ensure people can actually use the program to achieve those goals. While all levels of government work to find a solution, due to the urgency of this situation, we are running the gamut on every option, including this legislation to provide immediate relief,” he said in a release.

The bill would also retroactively allow people who received the grants to amend their 2019 tax returns for grants received in the same year.

The legislation is expected to be included within a larger congressional infrastructure package that will be voted on within the next few weeks.

Crowds numbering in the several hundreds rallied at the corner of Route 112 and 347 in Port Jefferson Station June 22 calling for people to support police. It was a counterpoint to the over 100 protests all across Long Island calling for an end to police violence for the past several weeks.

People waved thin blue line flags and held signs supporting police reading “back the blue” and “respect and honor our law enforcement.”

The pro-police rally came three weeks after a protest against police violence in the same location, which some local progressive activists have called “resistance corner.” Some came with flags, signs or hats supporting President Donald Trump (R). Most people in the crowd at the June 22 rally were not wearing face masks, compared to other recent protests where the majority were wearing some kind of face covering.

Suffolk County Police officers stood at both sides of the protest line and entrance to the small park, and others milled about the crowd, with many people thanking them for their service. Most cars passing by honked in support, though there was a small number of counter protesters holding signs supporting Black Lives Matter on the other side of Route 347. Towards the start of the rally a woman pulled to the side of the road and got out of her car, cursing at the people standing on the sidewalk who responded with expletives of their own before a cop came by to tell her to get back in her car.

People at the rally said police have become disrespected since the start of the nationwide protests after the death of Minneapolis man George Floyd in police custody. Though they admitted what the police did in that situation was wrong, when one officer leaned his knee on Floyd’s neck for nearly nine minutes until EMTs arrived, they said most cops want to do good.

Annemarie Lopez, of Port Jefferson, said she was at the rally in remembrance of her brother, Christie Masone along with his partner Norman Cerullo who were shot and killed in the line of duty in 1978.

“There are good cops and bad cops, but these are people putting their lives on the line,” Lopez said.

Others said the calls for police budgets to be cut will ultimately make the Island less safe.

“Cops are being treated unfairly — this will be detrimental to our safety, we don’t need cuts to police,” said Maria Leonette, a nurse at Stony Brook University Hospital.

The Suffolk County Police Benevolent Association had a large presence, sporting a trailer which handed out water to people during the hot June afternoon.

PBA President Noel DiGerolamo saw it as an incredible turnout that showed a “humbling support for the men and women of law enforcement. The silent majority isn’t silent anymore.”

At the height of the rally, the crowds gathered under the trees in the center of the park to hear people speak, including former chairman of the Suffolk County Republican Party John Jay LaValle, who was introduced as a spokesperson for Trump.

One of the two main organizers for the rally, Jonathan Stuart of Manorville, said “I could not let the broad stroke of social justice, virtue signaling and cancel culture paint all the police in the shot of the heinous death of George Floyd,” adding, “Is every person who puts on their bullet proof vest, turn their radio on, holster their pistol, shine their badge and kiss their family goodbye a murderer? No. Racist? No.”

With a June 23 date for the New York State primary fast approaching, TBR News Media hosted an online debate to hear directly from those Democrats running for the District 1 State Senate seat. 

The position has been held for the past 40 years by Sen. Ken LaValle (R-Port Jefferson). At the beginning of the year, LaValle announced this year would be his last in the Senate.

Yet even before the venerable senator made his announcement, Democratic contenders were lining up for the seat. By late January, five Dems were in the race. Meanwhile, the Republicans have already settled on their front-runner, state Assemblyman Anthony Palumbo (R-New Suffolk). 

Candidates 19-year-old activist Skyler Johnson, Southampton Town Councilman Tommy John Schiavoni, founder of Parents for Megan’s Law Laura Ahearn and Brookhaven Town Councilwoman Valerie Cartright (D-Port Jefferson Station) all responded to TBR’s requests for a debate. Nora Higgins, a Ridge resident and the regional coordinator of the Public Employees Federation, did not respond to multiple requests for her availability in the debate.

With the number of cases of COVID-19 in New York dropping, and with the reopening process happening, how would you like to see Long Island continue to reopen, while still putting in safeguards to prevent a resurgence?

Many candidates called the fact the state allowed big-box stores to stay open was unfair while small businesses were forced to close and lose out on several months of business. 

Cartright said she and her fellow members of the town board have decried the state’s unequal practices of forcing small businesses to remain closed for months while stores like Walmart or Target stayed open. She touted the town’s small business reopening task force made up of local business leaders to look at this issue.

“As we move forward [in reopening], we find gaps, we find things that are not necessarily equitable,” Cartright said. “We have been on calls for the past four months each day talking about how we can best service our constituency — we cannot stop that process now.”

Johnson said the virus spread because of people not being able to call in sick for work or leave their jobs, especially if they might lose health insurance. He called for the passage of the New York Health Act, which would allow universal health coverage for residents.

“We need more places where business owners can reach out to, to keep themselves, their employees and their customers safe,” he said.

Ahearn said the state needs to ensure it’s not limiting small businesses, and called for further tax incentives beyond the federal stimulus money given to small shops to ensure they can continue. 

“Small businesses are really struggling out there,” Ahearn said. “If Walmart is open, and people are buying tchotchke, why couldn’t they go to local stores and buy that tchotchke?”

Schiavoni, a former teacher for almost 30 years, also said New York needs to “unify” the health care systems, including hospitals and walk-in clinics, and said New York State will need to lobby the federal government for additional financial relief for local municipalities. With 34 school districts in Senate District 1, many could very well lose close to 20 percent of state aid, which means cuts that could be “absolutely staggering.”

“Which means we’re cutting jobs when we really shouldn’t,” he said.

With the ongoing protests, and with bills recently passed in the state Legislature with most already signed by the governor, what is your opinion of protester calls for reform, and what more should state and local governments do to bridge the divide of race relations on Long Island?

Johnson said he helped organize two separate protests, one in Port Jefferson Station and another in Stony Brook, which he said he was “very proud of.” 

He called for more police reform than the bills passed in the Legislature. As a proponent of what is called “defunding the police,” he said it is more about taking money given to departments and investing it into communities. He also called for demilitarizing departments, citing Los Angeles police just recently having been forced to get rid of their grenade launchers.

“We need to be passing reforms on every level to reform police departments,” Johnson said. “We need to pass reforms that combat if a black and a white man are arrested, the black man will likely receive a harsher sentence.”

Schiavoni said that Suffolk has “great police officers who need to be lauded,” and those people need to be leaders to get rid of racist elements in the ranks.

“Those officers that shouldn’t be in the ranks, let’s face it, they kill people,” Schiavoni said. 

He said the state needs to alter the way police are trained and led, and also enfranchise the people of the community to help police their own communities. 

Cartright said the killing of George Floyd was just the inciting incident that “helped open the eyes of people to what’s been happening to black and brown people for centuries.”

When looking at the bills that passed the state Legislature, she cited that many of the bills had been on the docket for years “with no traction.” Before she became a councilwoman, she had been working as one of those looking to “push the needle” toward reform.

Cartright added that it’s on the state and people to make sure local governments are not circumventing this newly passed legislation, and that this is “just the beginning.”

Ahearn said as the person who runs Suffolk’s Crime Victims Center, she deals with local police on a day-to-day basis and sees the “overwhelming majority of our law enforcement officers are great cops,” including public safety and police, but the state “needs to weed out the bad ones, because they are literally killing people in our community.” 

She said she supports the ongoing protests that will eventually lead to the end of structural racism not only in police but in health care, housing and much more.

She said the terminology of “defunding” police is wrong, but the state should restructure to allow for de-escalation training and community outreach.

Many young graduates may be looking at a job market similar to those graduating in 2008. What have we learned since then, and how do we make Long Island more affordable to help both young and old consider staying?

Ahearn said she is a strong proponent of transit-based housing, especially citing the county’s work on the Ronkonkoma Hub project, adding that a general need to make investments in infrastructure to help generate funds as both local governments and states have been severely impacted by the pandemic.

“Our young people, our millennials just can’t afford to live here because they don’t have the good, high-paying jobs that are going to give them the income they need,” Ahearn said. 

Cartright said it will take the revitalization of communities to create “additional options for housing.” She said it’s difficult to convince people to step past the initial NIMBYism thought to consider affordable housing options in their communities. She cited her work with the Port Jefferson Station/Terryville hub study for an example of looking at transit-based development, and how it will require sewers before revitalization occurs.

The state, she said, should shift the system that allows young people to buy homes, especially since student loan debt is taken into account when applying for a mortgage, and add more incentives to incorporate affordable components in new developments.

Schiavoni cited his work with Southampton Town creating affordable housing complexes. He said it will require new rezoning laws to allow for mixed-use structures. 

He also mentioned the five East End towns’ Community Preservation Fund, which creates a transfer of some money sales of new homes over $400,000 toward a pool of affordable housing funds.

“These are the kind of innovative ideas we need to employ to keep our people here,” he said. 

Johnson said that, as someone who just recently graduated from Suffolk County Community College, very few young people who when they graduate say they will buy a house and remain on Long Island, but instead say they will leave. 

“I’ve spoken to people in the district who have not only been here for years, but families have been for years, who are saying they need to leave Long Island as soon as possible,” he said.

He said his plan includes taking vacant or derelict homes that go through the demolition process in towns and instead remake and use them to house people. He said he would create a lottery system for these homes, where those would be responsible for certain costs based on their income.

Sen. LaValle has been a proponent of the electrification of the Long Island Rail Road. Where do you stand on electrification and how would you go forward with a plan for a study?

On June 8, the New York State Senate voted to clear several police reform bills in the wake of Minneapolis man George Floyd, who was killed in police custody, and the massive wave of protests that have swept across New York, the city and Long Island. 

The bills ranged from a repeal of 50-a, a civil rights law that protected the personnel records of cops, firefighters and correction officers from public scrutiny, to banning the police’ use of chokeholds to restrain alleged perps.

Some bills received universal bipartisan support, while others were divided on party lines. Some votes stick out. All Long Island senators voted yes to bills that police must report the discharge of a service weapon immediately, and all voted yes to banning the use of chokeholds by police. Still, Republicans came together against a special office for investigating incidents of death of people when in police custody and against 50-a.

Sen. John Flanagan (R-Northport),, the senate minority leader, said in a statement that while there is no excuse for police brutality, the repeal of 50-a “denies due process for our law enforcement officers whose records already were available under a court’s discretion,” and provides “false accusations” made against officers.

It is not a reason to vilify and punish every man and woman in law enforcement who serves to protect and serve our communities in New York, nor should it be a reason to sow division,” he said in a statement.

Gaughran, a Democrat, voted yes to all reform bills.

Our nation is at a pivotal moment in its history and people on Long Island have taken to the streets to peacefully demand change,” Gaughran said in a statement. “This package of justice reform legislation is important to ensuring trust between the brave men and women of law enforcement and the communities they work tirelessly to keep safe.”

State Sen. Ken LaValle was one of only two senators to vote no on a bill that confirms the police are required to see to the medical or mental health needs of a person in custody.

LaValle’s office did not return requests for comment about his votes.

Gov. Andrew Cuomo (D) has signed off on a majority of the bills so far, and has also signed an executive order mandating police all over the state come up with plans to overhaul their departments or face loss of state funding.

  • Senate Bill S.8496: repealing Civil Rights Law 50-a, which helped shield the records of law enforcement. With the repeal, citizens and groups can make Freedom of Information Law requests for those records, which will not reveal the private information of individuals.

In light of the George Floyd killing in Minneapolis and the subsequent protests locally and nationwide, Brookhaven Town Councilwoman Valerie Cartright (D-Port Jefferson Station) hosted a virtual forum June 11 to discuss race and policing on Long Island. Speakers included civil rights activists, law enforcement reform experts, NAACP and New York Civil Liberties Union leaders, also local attorneys. 

Exploring the Blue Line: A Real Discussion on the Reality of Race, a more than two-hour discussion touched on a number of topics including needed policy changes, police reform on Long Island and what must continue to be done in order to make meaningful change. 

Tracey Edwards, NAACP Long Island regional director, said systemic racism goes beyond the police system. 

“We have entrenched policies and practices that have been in place to either harm a group as a whole or in part, intentionally or not,” she said. “This is the structure that treats race differently.”

It is a real problem that is not going away, she added. 

“You have Larry Kudlow, who is the top economic person for the country who stood in front of a microphone and said we do not have any institutional or systemic issues,” she said. “If we first have to convince those that are in power that there is a problem — our issues are far broader than we thought.”

Despite New York State recently voting to institute several police reform policies, including the repeal of Civil Rights Law 50-a which prevented people from accessing service records of police, Edwards said there is more work to be done. 

“We’re just getting started, this is just one piece of the issue,” said the NAACP Long Island regional director. “It is going to take a lot to fix a lot of the issues we face — it’s going to take a lot to fix a lot of the issues we face. On Long Island it runs deep.”

The panelists discussed the demographics of Long Island police officers. 

Jose Perez, deputy general counsel for LatinoJustice PRLDEF, a New York-based national civil rights organization, said people of color including African Americans make up a small percentage of officers in both Nassau and Suffolk counties. 

A 2016 study done by the NYCLU, dubbed “Behind the Badge,” found that people of color in Suffolk accounted for 13 percent of the police department. Out of the 136 individuals in upper ranks, only five were people of color. In Nassau, people of color make up 18 percent of the department, a total of 70 officers “in addition to the 326 white sworn personnel.” Of the 47 personnel who held positions other than detective, only three were people of color.

“When we look at the police, we don’t see ourselves, we see others,” Perez said. “That contributes to the overall policing impact on people of color.”

Frederick Brewington, a civil rights attorney from Hempstead, said the structure in departments makes it difficult for people of color to move up the ladder as well. 

“Even though there may be a small percentage that make it into the ranks of a police department, those individuals are likely to never get to the ranks above sergeant,” he said. “Even those that get to that level or above, their longevity is usually not very long. Their culture is one that is not welcoming to individuals who may be people of color, particular African Americans.” 

The disparities have trickled down to other areas of the criminal justice system. 

Derrick Magwood and Larry Flowers, attorneys and members of the Amistad Long Island Black Bar Association, said there are very few attorneys of color in local courthouses. 

“In Nassau, there are maybe five or six [attorneys] in criminal defense and two at the district attorney’s office,’’ Flowers said. 

In Suffolk, there four of five attorneys but both Magwood and Flowers said they haven’t seen an attorney of color in the DA’s office. In district court, there are currently two African American judges but none in county court. 

Edwards also brought up how these disparities are seen in public education on the Island. 

“Long Island, out of 642 schools, 61 percent do not have a single black teacher,” she said. “That’s 212,000 children who will never interact with a black teacher from kindergarten to 12th grade. That’s not just an impact on black children, that’s an impact on all children.”

Perez spoke on overt police bias, which “can be formed by what they have experienced, or what they have been taught.” He added, “They feel like they could get away with it based on their privilege, uniform and color of their skin. It is important we understand this reality and we have to address it head on.” 

Brewington said it comes down to inadequate training. 

“The reason why police struggle with dealing with the systemic issues is because they don’t have the background education,” he said. 

The civil rights attorney said he believes they are asked to do a job they are not equipped to do. 

“Six months of training at the [Police] Academy, when someone goes to be a doctor, psychologist or social worker, it takes them a minimum of four years,” Brewington said. “Then they are given a gun and told to go out and enforce — not help, but enforce.”

Other panelists agreed that six months at the academy is not enough and called for a minimum of two years. 

In terms of additional police reform and policy changes, individuals mentioned increasing body-camera funding at the county, village and town levels. The need for some type of automatic penalty if an officer is found tampering with his or her body camera, yearly mental health evaluations for officers, an outside investigator to step in when it comes to cases of police brutality and misconduct, better cultural sensitivity and diversity training, and civilian review boards.

“We have to stay the course — we need to coalesce and act together,” Perez said. “This struggle will not be won individually. Every individual coming together becomes a force to be reckoned with.”

On June 1, the League of Women Voters of the Hamptons and North Fork held a debate between the four candidates vying for the Democratic nomination and who will then face off against incumbent Lee Zeldin (R-NY1) for the New York’s 1st Congressional District seat. The nominees in the upcoming primary election June 23 are Suffolk County Legislator Bridget Fleming (D-Sag Harbor), last year’s front-runner Perry Gershon, former educator Nancy Goroff and Gregory Fisher, who has run for multiple local offices over the years.

Though the debate went on for more than an hour and a half, it did not touch on points such as the current protests against racism and police violence currently rocking the nation.

Here’s what they had to say on a number of key issues and challenges facing the district.

1.On what issues do you think there is a reasonable possibility of enacting legislation to benefit the country?

Bridget Fleming

Fleming: I’m known as someone who has reached across the aisle and looks at problems and challenges with an eye toward hearing from all stakeholders. Then taking on the tough decisions to move forward. I have a proven record on that.

There are a number of issues that face our congressional district. One, for instance, is immigration. Many people feel that the current immigration system needs comprehensive reform. Individuals are so enamored with special interests.

Another issue is the epidemic of gun violence. There is a consensus in the country on commonsense background checks, on a ban on assault weapons, and a ban on high-capacity magazines. There are many issues upon which the country agrees but because of the influence of special interests and someone like Lee Zeldin, who has a perfect record from the NRA, caters to those special interests. We can get beyond that.

Gershon: The goal when I’m your congressman is to enact policy that we can do on a bipartisan basis whenever possible. There is a crying need for certain policies as we go forward and try to climb out of the coronavirus-based recession. That’s building jobs. How do you do that? With infrastructure and investing in our economy. There was a glaring need for infrastructure even before coronavirus, and it’s doubled or tripled now.

We have the opportunity for green jobs, green energy in a new economy. We need Democrats and Republicans cooperating with each other. That obviously starts with getting [President] Donald Trump (R) out of the White House. With a uniter in the White House we can pass policies and take it beyond infrastructure, we can go to health care, the other real priority for America. We can build on the Affordable Care Act. We can make sure Americans understand that health care is a right not a privilege.

Goroff: If I’m elected my top priority is to make sure we are taking meaningful action on climate change, which is the largest threat we face to our way of life, even today. I can do that by acting as a resource for members of Congress from both sides of the aisle — making sure they have access to the best information available, making sure all their questions are answered and holding their feet to the fire to ensure we are taking action. We will make sure we are setting ambitious targets as we strive for a carbon zero economy.

We invest in deploying existing technologies, in reusable energy, in clean vehicles, and in clean buildings.

Fisher: One of the important issues is that voters don’t feel like they are being listened to. They are looking at a lack of access to their representatives. We are crippled economically, people are out of a job and can’t pay their bills. They want to know how you are going to get things done and get us out of trouble.

I subscribed to a philosophy called a decentralized autonomous organization, where citizens can input every detail, on what they want to influence. I have an economic plan that will eliminate the scarcity caused by this long-term economic shutdown.

2. As a congressperson what specific proposals would you support to improve our immigration system?

Nancy Goroff

Goroff: We need to take action toward making comprehensive immigration reform. We must prepare a pathway to citizenship for our Dreamers and we must make sure we are allowing families to be reunited. We can’t be separating children from their families at the border and we should be considering more effective/humane ways to help people coming in who want to claim asylum.

The fact that people have to wait for months or years, and now we are imprisoning them — is unnecessary and unconscionable. We should be looking at why we have such a stream of refugees coming to our border. There are programs that were started in Central America by the Obama administration to help refugees on the ground, so they don’t have to leave. We need to make sure we are reinstating these programs that can keep refugees from thinking the only opportunity is to walk 1,000 miles across Mexico. Our policy must be humane and must live up to our American values.

Fisher: Most citizens want several points addressed. They want registration, they don’t want a secret population, they want taxation, they want to make sure they are paying their share. The other one is assimilation and education so that those people are ready for our society.

There are people out there that are starving for the opportunity to be a part of this American dream.

Fleming: The immigration system in the United States is deeply broken and needs comprehensive immigration reform. It needs to be the top priority of anyone’s agenda who is looking to take a job on Capitol Hill.

We need to fix our broken visa system. Luckily in Suffolk County, we have allies in the farm community who have been deeply hurt by the system and can’t find enough workers to harvest their crops. That is an alliance we can lean on in Suffolk County to move that process forward and make reforms.

We need to end separations of families at the border. It is inhumane and unacceptable. We need a clean DACA [Deferred Action for Childhood Arrivals] bill, we need to restore TPS [Temporary Protected Status]. We need to ensure that the border is secure, but secure because we have undertaken a system of immigration that is fair and humane.

Perry Gershon

Gershon: It’s no secret that immigration was a challenge in this country even before the election of Donald Trump. We have been trying to solve our immigration issue for many years and under many different presidents.

Trump has made a bad situation and made it worse. We’ve got to take care of the Dreamers, people who are in this country through no fault of their own, who did not commit a crime, and have no nation they call home except America. We need to give them a path to citizenship, we need to take care of TPS recipients. We need to have defensible borders, we need to have a system where people do not just flock into America. We need to be able to secure our borders and be able to maintain them while we take care of the people here.

3.How can we bring affordable housing, job creation to LI, especially for millennials?:

Goroff: Now with COVID-19, millennials are facing another challenge in getting their careers started. As a lifelong educator, I believe in making education available to people and to make it affordable. That means making sure we have sufficient Pell grants for our students. So people and families can afford excellent degrees and they can get good jobs.

We also need to make sure all jobs are paying a true livable wage and that means investing in new jobs here, like clean energy and increasing the minimum wage. We also need to address the health care issue because it is a burden on businesses.

Fisher:We have created a generation of homeless millennials. Why? Because they can’t leave their parents’ homes, they can’t afford to buy a house or pay the rent for an apartment. They are living late in life at their parent’s houses. My plan would include a revamp of the tax system, so we have money to invest [in the economy]. Education should be a right, we need to build America.  We need to fundamentally make a new commitment to young people and realize that we have betrayed them.

Gregory Fischer

Fleming: This is one of the critical challenges here in Suffolk County and in NY1. It is something at the county legislature we have attacked with real intention and real success. For instance, look at the Village of Patchogue and the surrounding areas.

The developments of these vibrant downtowns are encouraging young people to stay on Long Island and make a life here.

I’ve been fighting for affordable housing since my time on the [Southampton] town board.

Gershon: People want to stay here and not to be forced to move away because of better jobs. The way we fix that is get better paying jobs here on Long Island so that young people can move here. Also, we need to improve their educational prospects by not having them come out of school massively burdened by student debt. We need to do things like reducing the cost of student debt. The federal government should not be making a profit off it by lending to our students so they can afford to go to college. The government should be facilitating college education.

We can give people the opportunity to pay off some of their student debt in exchange for national service. Let them be teachers, let them do things that will improve our own society.

On affordable housing, we need to bring money into Long Island. We need to fund housing for the middle class, we need to find a way that doesn’t force people away. The government can do that, it can be a federal policy. We need fair development as well.
