The Village of Port Jefferson Board of Trustees held its annual organizational meeting July 2, officially appointing new trustees alongside the announcement of commissioner appointments. 

Two new trustees were officially instated on the board: Kyle Hill and Xena Ugrinsky. Both Hill and Uginsky defeated Port Jefferson resident Marie Parziale in June. 

Hill, a Stony Brook University graduate, based his campaign largely on environmental issues and on the role of his relative youth in local politics. His background is in public policy, wherein he previously worked for U.S. Rep. Steve Israel (NY 2/3) in the Capitol. He is also a volunteer EMT in Port Jefferson. Hill was initially a Democratic candidate for the House seat in NY-1, but dropped out several months before the primary in June to run for the trustee position. 

Ugrinsky, a Russian immigrant, previously worked in the software and technology fields before transitioning to management consulting roles for national utilities companies including Con Edison and National Grid. She previously sat on the village’s Budget and Finance Committee and based much of her campaign on the future of the Port Jefferson power plant as well as fiscal responsibility and transparency. In an interview, with regard to the power plant, Ugrinsky said that her “goal was to figure out a way that I could help the village be involved in the broader conversation,” claiming that she believes “we have a moment in time where we have the opportunity to be in the forefront of what is happening in energy.” 

The two new trustees were elected following the departure of Deputy Mayor Rebecca Kassay to run for New York State Assembly District 4 and the end of trustee Drew Biondo’s term. 

Kassay advanced from the Democratic Primary June 25 to challenge incumbent Assemblyman Ed Flood (R-Port Jefferson) in November. 

Biondo, a communications professional, was appointed to replace Lauren Sheprow when she became mayor last year. In Biondo’s departing statement, he highlighted the importance of the newly-formed Ethics Committee, whose members were sworn in later in the meeting. 

Additionally, Sheprow announced new commissioner appointments at the meeting. Trustee Robert Juliano, elected in June 2023, was reappointed as commissioner of Public Works and Parks. He was also appointed to the position of deputy mayor, replacing Kassay. Juliano, who was previously village clerk, has spent a long career in municipal government and worked in banking. 

Sheprow said, “Bob has earnestly demonstrated his dedication and interest in good government, and he always has the best interests of the residents at heart,” describing him as “humble and kind” as well as “a great trustee.”

Newly-elected trustees Hill and Ugrinsky were appointed as commissioners. Sheprow noted that Ugrinsky’s experience in finance and data analytics, along with her focus on the Budget and Finance Committee and Power Plant Working Group, suited her for the role of commissioner of Finance. Hill will replace Sheprow as commissioner of Public Safety-Court/Code. 

Lastly, trustee Stan Loucks was appointed as commissioner of Recreation anLoucks is in his fifth term as a trustee, and previously worked as an athletic director in the Plainview school district. Faulknor is a former trustee and has been harbor commissioner previously. 

In addition to new appointments, the Board of Trustees received a report from police on instances of crime in the last year, including specific statistics regarding exact types of criminal activity. 

The meeting concluded with a public question-and-answer session.

Suffolk County Legislature voted 15-2 Tuesday, June 25, to approve I.R. 1461 which will extend and revise the Suffolk County Drinking Water Protection Program. County Executive Ed Romaine (R) is expected to sign the measure into law July 8 for the mandatory referendum to be added to the November ballot. 

This program, if passed via referendum, will establish the new Water Quality Restoration Fund supported by an additional sales and use tax of 1/8%. It is estimated the increase in sales tax collections will fund about $4 billion over 50 years to implement the county’s Subwatersheds Wastewater Plan.

In June and July 2023, a 10-7 vote along party lines doomed the measure from reaching that November’s ballot.

The 1.5 million people of Suffolk County currently rely on more than 380,000 cesspools and wastewater systems, including over 209,000 systems located in environmentally sensitive areas. This decentralized infrastructure has been a significant cause of nitrogen pollution across the county. In both surface-level and underground bodies of water, this nitrogen pollution causes harmful algae blooms, which can release toxins into fish, destroy ecosystems by consuming excessive oxygen in the water and cause a variety of conditions in exposed humans.

Passage of the referendum has economic as well as health benefits. Creating and maintaining new wastewater infrastructure will create a number of well-paying jobs for the county government. Additionally, the risks posed to businesses reliant on Suffolk County water cannot be understated, as well as the threats to beaches across Long Island.

The Water Quality Restoration Fund can be used for water quality improvement, such as enhancing and maintaining existing sewerage facilities, consolidating sewer districts and replacing and installing wastewater treatment systems in areas where sewers cannot be installed. 

The language of the referendum itself is straightforward: “A yes vote ensures county funding to 2060 for clean water projects, improvements in drinking water, bays and harbors, and a no vote continues water quality degradation.”

Romaine claimed that passage of the referendum will be vital to fund sewer constructions, especially in less developed areas of the county, and the broad swaths of land with only cesspools installed. Romaine said that he “cannot emphasize enough the importance of this referendum” to address water contaminants.

Romaine was also the primary sponsor of the bill, which was co-sponsored by Legislators James Mazzarella (R-Mastic) and Ann Welker (D-Southampton).

Legislator Stephanie Bontempi (R-Centerport), who voted for the bill, claimed in a statement that while the bill gives the county the authority to establish longer-term funding for wastewater improvement projects, it also allows the county to apply for “much-needed” matching grant funding from the New York State and federal governments. 

The final decision will rest in the hands of Suffolk County voters on Nov. 5.

In April 2023, the Smithtown Planning Board amended the Smithtown Town Code Chapter 322 to exclude “convalescent” and “resting” homes from being considered a special exception to zoning restrictions, thereby preventing a proposal submitted by Mills Pond Group LLC from progressing.

Mills Pond Group, owned by Frank Amicizia, filed a proposal to build a 97-bed living residence on the former Bull Run Farm in St. James the month prior to the board’s amendment. The proposal depended on the approval of the special exception application that would allow them to build the facility, Whisper Mills Assisted Living, in an area zoned as residential.

Before a public hearing could be scheduled regarding the special exception application, the code was changed, making the approval of the application impossible. 

On March 13, Mills Pond Group filed a lawsuit against the town for condemning the project to a state of “limbo”, where their only option is to apply for a discretionary change of zone.

Smithtown Public Information Officer Nicole Garguilo said that tightening the conditions of a special exception application has long been on the town’s list of objectives. The application has been “used to circumvent the process” of a zone change, which requires more scrupulous environmental review and is more expensive. As a result, Garguilo said the previous town code “incentivizes special application.”

Written by Mills Pond Group’s attorney Lidia Szczepanowski, the lawsuit argues the “hasty” change in the town code was specifically intended to bar their project. By this basis, she claims the amendment is discriminatory toward individuals with disabilities and the Fair Housing Act, and several individuals have come forth as plaintiffs. 

When the Town Board held a community meeting, there was what the lawsuit described as “vehement” opposition. Indeed, many residents were concerned with the congestion and influx of traffic such a large development would cause.

The lawsuit claims Town Board members verbally endorsed the project in 2019, when Amicizia proposed the development after buying the property, but changed their stance after hearing public opposition. 

“There wasn’t support from the Town Board. There wasn’t support from the community and the applicant decided to file a lawsuit,” Garguilo said. 

“Construction of a building of this size, with all the consequences that go with it, in the midst of single-family homes — in the midst of a bucolic, historic rural corridor — would be a huge step, a de facto spot zone change, and a mistake,” attorney and Smithtown resident Joseph Bollhofer wrote in a letter to Supervisor Ed Wehrheim (R) and the Town Board.

Among their grievances, Mills Pond Group claims that the town violated the 14th Amendment in neither granting nor rejecting their request for a public hearing. 

Some community members feel that the Town Board should hold a hearing. Bollhofer is opposed to the proposal, but wants a public hearing nonetheless.

“Although I still believe it is a bad application in that the applicant cannot show that is satisfies the code requirements as they existed at the time of application, basic due process dictates that a hearing is required,” he wrote in a letter to Wehrheim and the Town Board. 

Garguilo stated that the lack of support from the board and community prevented the special exception application from moving forward to a public hearing.

The current town code dictates that the board “may, upon application and after a public hearing … authorize a special exception for a hospital, nursing home, adult home or assisted living facility.” Convalescent and rest homes are excluded and the definitions of a nursing home, adult home and assisted living facility are altered. 

Mills Pond Group demands monetary reparation, the law nulled and their attorney fees reimbursed. A court date has not yet been set.

Through its Green Energy and Sustainability Initiative, the Town has been “greening-up” its operations and facilities while saving taxpayer money by utilizing new, and more energy efficient technologies and renewable energy sources. All these efforts lower operation costs and reduce Town carbon emissions. By encouraging waste diversion through recycling and composting, the Town can further realize spending and emissions reductions.

A hit-and-run incident in Patchogue March 2023, which claimed the life of 25-year-old Nicholas Puzio, has spurred local leaders into action. Puzio, a resident of Farmingville, was tragically struck by two separate vehicles while crossing Route 112. Both drivers fled the scene, leaving him to die. 

Hit-and-run collisions are those in which at least one person involved in a crash flees the scene before offering any, or sufficient, information or aid to the other involved person or fails to properly report the crash. Hit-and-run violations – which are criminal offenses – can create additional burdens for law enforcement and for families looking for remediation as well as medical and insurance support.

Although Long Island roads are among the deadliest, few drivers involved in crashes that kill pedestrians or cyclists face criminal charges. That is, unless they are caught after fleeing the scene, or it can be proven they were drunk, under the influence of drugs or speeding.

Walk Safe Long Island, a collaborative of health and transportation safety educators from Nassau and Suffolk counties, says over the past three years in Nassau and Suffolk counties, 515 people have been hit and injured while walking, jogging or biking.

Pedestrian safety continues to be a serious concern. The Institute for Traffic Safety Management & Research states that from 2016 to 2020, pedestrians accounted for almost one quarter of the fatalities on New York’s roadways.

According to information from the National Center for Health Statistics, Long Island averages 18.2 roadway deaths per month. However, in the summer months this number trends upward as it nearly doubled, reaching 31 in August of last year.

In response, state Sen. Dean Murray (R-East Patchogue) and Assemblyman Doug Smith (R-Holbrook) introduced “Nick’s Law” in 2023. The proposed legislation aims to increase penalties for those convicted of leaving the scene of an incident involving a death. The move comes in the wake of a lenient six-month sentence handed down to one of the drivers involved in Puzio’s death, highlighting the inadequacies of current laws.

“Two drivers made reckless choices and left my son dying in the street. Who does that? Does anyone have regard for human life? The laws in New York State are far too lenient,” Puzio’s mother, Terry Puzio, voiced her anguish and frustration in a statement.

Under current laws, individuals caught fleeing the scene of a fatal incident face a Class D felony and a fine of up to $5,000. “Nick’s Law” would elevate the crime to a Class B felony with a fine of $30,000. This increase in penalties is aimed at deterring drivers from fleeing the scene to avoid harsher consequences for other offenses such as driving under the influence.

The need for this legislation is represented by the alarming statistics. According to multiple sources, in 2023, Suffolk County alone witnessed 16 fatal hit-and-run incidents. This year, multiple similar incidents have already occurred, including the recent death of 22-year-old volunteer firefighter Christopher Hlavaty in East Patchogue.

Hlavaty’s mother, Janine Hlavaty, shared her desire for the bill’s passage in a statement, saying, “My hope for the passage of ‘Nick’s Law’ is that people will think twice before leaving the scene of these horrific, life-altering accidents.”

The push for “Nick’s Law” has garnered support from local lawmakers and officials who have emphasized the importance of holding hit-and-run drivers accountable. 

“When people can face lighter sentences if they are involved in an accident while drunk or on drugs by leaving an injured person in the road, there is a clear benefit to them to run and hide. That is unacceptable and it must be changed as soon as possible,” state Sen. Mario Mattera (R-St. James) said in a statement.

The community’s outcry and the introduction of “Nick’s Law” showcases a collective demand for justice and safety on the roads. For now, the community awaits legislative action, hoping that “Nick’s Law” will bring about the change to deter future hit-and-run tragedies and provide justice for those who have lost their lives on the roads of Long Island.

The Village of Port Jefferson Board of Trustees held a work session June 12 to discuss new plans ranging from parking to funding. Mayor Lauren Sheprow spearheaded the meeting as each trustee brought their issues to the table. 

Parking was one of the major plans discussed throughout the meeting as throughout much of the village parking for residents and nonresidents has not been cohesive. Trustee Drew Biondo said, “The parking committee is ongoing with their work.” Beach parking lots will become resident only and discussions for other lots are largely yet to be decided. 

The parking updates will go into effect by the opening of beaches on June 22. The swimming area ropes were due to be installed June 19. The beaches remain open to all — only the parking is restrictive.

The village firework show on July 3 will be viewable from the East and West beaches. Sheprow announced that the show will have two new additions — a food truck and a DJ. To ensure safety and lawfulness, trustee Bob Juliano attended a firework committee in regards to the event. He shared once again that the event is open to nonresidents, though parking is strictly for residents only. 

Sheprow also touched on difficulties the village has been having in attracting businesses. She believes there is a misconception about the village not having enough foot traffic.

“The village is packed every weekend and many nights of the week,” she said, adding she is hoping to bring in more businesses. 

Juliano also shared that the repairs at Rocket Ship Park are complete, to which the board discussed the possibility of repairing the sidewalks in the area. 

Another major discussion of the meeting was the recession of the East Beach bluff on top of which the Port Jefferson Country Club is located — an issue the village has been facing for years. 

Deputy Mayor Rebecca Kassay admitted the recession is inevitable and that no amount of funding can reverse it. In the meeting, Kassay suggested making a “strategic retreat” from the bluff. Although the group did not decide what the retreat would look like, the board agreed a comprehensive plan would become necessary further down the line. However, the village will continue to fund the protection of the club for the time being as a new plan is developed. 

The Board of Trustees also addressed the Long Island Seaport and Eco Center’s Whaleboat 1776 Project, which received a grant allowing construction to be completed on the historic boat in 2025.

The next trustee meeting will be held on June 26.

To address the insidious, costly scams disproportionately affecting Americans over 60, state Sen Anthony Palumbo (R-New Suffolk) and state Assemblyman Ed Flood (R-Port Jefferson) will be collaborating to host the Senior Scam Prevention Program on Thursday, June 20, at 3:30 p.m. The event will take place at Brightview Port Jefferson Senior Living facility, 1175 Route 112, Port Jefferson Station, and though it is geared toward seniors, anyone can attend.

“My office invites caregivers or older adults to attend the Senior Scam Prevention Program to learn a variety of information on how to stay vigilant and protect themselves and their loved ones from scams,” Flood said. “Many scammers target our seniors as easily as a brief interview to gain their financial information and it’s growing easier each day with advanced technology.”

According to the FBI’s 2023 Elder Fraud Report, over 101,000 seniors reported this crime, with an average loss of $33,915 per complainant. Tech support scams, personal data breaches, confidence and romance scams, nonpayment and nondelivery scams and investment scams are the top five most common types of fraud, in that order. 

“In 2023, total losses reported to the [Internet Crime Complaint Center] by those over the age of 60 topped $3.4 billion, an almost 11% increase in reported losses from 2022,” FBI Assistant Director Michael Nordwall wrote.

The skyrocketing number of older New Yorkers who have lost thousands to remote pickpocketing prompted Palumbo’s office, the Suffolk County District Attorney’s Office and the Suffolk County Police Department to band together and create the program.

“The program provides information on the latest scams and tips to avoid being a victim of these crimes,” a DA’s representative of the program, Chris Stazio, said. “The presentation is given by both the District Attorney’s Office and Suffolk County Police Department.”

In most cases, scammers are able to prey on a lack of understanding or awareness of current technology and common phishing tactics. For example, the FBI’s 2024 Elder Fraud Report indicates that around 12,000 victims identified cryptocurrency as “the medium or tool used to facilitate the crime.” Anyone who knows little about crypto or other elusive tech can be a much easier target. 

Additionally, innocuous business email compromise scams were responsible for $382 million in losses last year, even though phishing emails can be obvious to identify once you know what to look for. 

In an attempt to reach as many people as possible, numerous iterations of the program have been held in varied locations.

“Our office has had several events throughout the 1st Senate District including at the Rose Caracappa Senior Center, Peconic Landing and local libraries,” Stazio said. “We have had great attendance at each event but have found that events located at senior facilities have the best attendance.”

Flood added, “We decided on Brightview because my office is working with senior centers across the district to keep them informed of this valuable information.”

This event aims to provide clarity and thus fortify the elderly community against online attacks. Anyone seeking to learn more about the scamming epidemic is welcome and encouraged to join Palumbo and Flood at Brightview Senior Living in Port Jefferson this Thursday afternoon.

A lithium battery storage facility will not be built on property owned by real estate agent Ray Manzoni near Mount Sinai-Coram Road and Route 25A.

The Brookhaven Town Board will not consider a proposal to change the zoning in the proposed area from “J Business District, Transitional Business Zone” to “L Industrial 1, Light Industrial Zone,” according to a June 5 press release from the Town of Brookhaven.

In the press release, town Supervisor Dan Panico (R) stated that after attending the latest Mount Sinai Civic Association meeting, “people preferred the current zoning and/or the possibility of the redevelopment of the parcel into a use more compatible with the zoning.”

He also stated there is “significant confusion regarding the New York State climate action goals and implementation of these battery energy storage systems.”

In an interview after the June 6 Town Board meeting, Panico said more public education on how the state government’s climate action laws work was necessary.

“I find throughout the town, a lot of people are not aware of what it entails going forward, the costs associated with the enactment, procuring the equipment,” he said.

“People have questions with regard to the sustainability of the electrical grid itself, but I think a lot more needs to be done as we move toward implementing the goals,” he added.

Other matters

During the Brookhaven Town Board meeting, which fell on the 80th anniversary of D-Day, U.S. veterans were honored when Suffolk County Veterans Service Agency Director Marcelle Leis and Deputy Director James Brennan displayed an American flag that was flown at Memorial Day services at the Long Island National Cemetery, Calverton National Cemetery, Stony Brook Veterans Home and the Babylon Grade School. 

The flag can currently be found at the county’s H. Lee Dennison Building in Hauppauge.

The Town Board also honored Aman Mistry and Siddhant Desai, two Stony Brook University scholarship medicine program students who, along with creating the Scholarship Medicine Society — which partakes in community outreach efforts in health care — hosted an innovation challenge that saw 60 students participate in brainstorming innovative solutions in respect of the lack of access and equity in health care, supported by faculty mentorship.

Additionally, three eighth graders from Center Moriches, Addison Raupp, Kristin Luna, and Adrianna Loesch, were honored after raising $8,000 for banners on street lights that display the names of hometown veterans.

The Town Board presented a proclamation recognizing and commemorating June as Pride Month in the Town of Brookhaven.

The board also passed an amendment to a code that previously allowed residents to own up to six chickens on any parcel of land. The new code permits residents to own up to 12 chickens on land larger than 20,000 square feet. However, only six chickens are permitted on land 20,000 square feet or smaller, and no roosters are allowed. There will also be a 10-foot setback from the property line for the chickens.

At the Monday, June 10, Port Jefferson Civic Association meeting, new officers were sworn in, an update on the looming Staller development in Port Jefferson Station was given, and civic members took part in brainstorming ideas and solutions for the village’s most pressing issues.

The new leadership team, with terms expiring in 2026, were officially sworn in by neighboring civic president Ira Costell. The officers sworn in were Ana Hozyainova as civic president, Holly Fils-Aimé as vice president, Marilyn Damaskos as treasurer, Janice Fleischman-Eaton as recording secretary and Kathleen Mc Lane as corresponding and outreach secretary. 

Jefferson Plaza development proposal updates

Following the official business, Costell, president of the Port Jefferson Station/Terryville Civic Association shared some updates pertaining to the proposed Staller redevelopment of Jefferson Plaza, a development he feels will have a big impact on nearby communities.

“This significant development will, for better or worse, change the face and future of our community, as well as impacting Lower Port,” Costell shared. Back in March, Costell, on behalf of the PJSTCA, wrote a letter to Town of Brookhaven board and the town’s Highway Department [see “Port Jefferson Station/Terryville civic requests traffic study,” from May 3] asking for a comprehensive study to assess the influx of traffic from this proposal. 

Since then, the PJSTCA has heard back from Town of Brookhaven councilmember, Jonathan Kornreich (D-Stony Brook), who agreed with the sentiments expressed in the letter and assured that the town “shares the concern about the cumulative impact these developments may have on traffic” and “would like to stay ahead of it.” 

Others chimed into Costell’s speech and shared concerns about the potential impact on traffic, as well as quality of life and affordability, while others emphasized the need for comprehensive planning and coordination — something Costell has advocated for since the developer’s initial proposal. 

“Our community has chosen to not throw up a blockade and say no more, not in our backyard,” Costell said. “We embrace and want to engage with a future that makes sense for our community, that we can digest properly. Without comprehensive planning and coordination, it could be a nightmare that’s going to impact our communities negatively.”

In recent years, the village has seen substantial development and its impacts on the community. Both, the Overbay and The Shipyard complexes have left an impact on the community as residents feel the respective developers were not overtly transparent in their building plans.

Local architect, Heather Brin, echoed these sentiments sharing notes from her expertise, “The Shipyard, downtown, is illegal in terms of the height,” Brin alleged. “The developers raised the level of the berm that the property sits on so they could build as high as they did.” 

Civic members have since questioned the Staller project’s viability, safety concerns and the importance of finding a balance between developer and community needs. The PJSTCA will host Staller Associates on June 20 at 7 p.m. at the Comsewogue Public Library, 170 Terryville Road, Port Jefferson Station, to continue the community conversation.

Village issues going forward

Shifting gears, Hozyainova asked civic members to bring issues, concerns and wishes for the village to the forefront of the conversation. From this, several pressing issues resurfaced and some new ones emerged. 

Residents campaigned for increased walkability of the village, sharing notes of overgrown vegetation limiting sidewalk access. To this, Fils-Aimé asked for increased volunteerism and formation of committees dedicated to their respective concerns.

“Bring a proposal forward, somebody has to lead the charge,” she said. “We can have multiple committees, maybe a couple people are interested in that [issue] or maybe you want to bring them here and have them join the civic association.” 

Others shared their respective concerns over the Port Jefferson power plant and its future, capital projects in the village and in the school district, village constable’s office hours, the future of the country club and the East Beach bluff, keeping and restoring trees and other natural vegetation, were among some of the many issues brought to the metaphorical table. 

LIRR electrification

Adding to the growing list of village concerns, Port Jefferson resident Bruce Miller brought a motion before the civic requesting that Gov. Kathy Hochul (D) makes enforcement of the state’s Climate Leadership and Community Protection Act a priority of the Metropolitan Transportation Authority and the Long Island Rail Road in their new 20-year plan. 

Miller explained in his motion that diesel locomotion is no longer acceptable transportation under this act and that riders along the Port Jefferson Branch are “forced to use their internal combustion vehicles to drive to Ronkonkoma for a decent ride,” 

In addition to concerns with ridership and the environment, Miller also detailed that the utilization of hydrogen rail or separate-car battery transportation could allow for a large industry based in New York state — to the benefit of many. 

The motion to approve Miller’s proposal asking Hochul and LIRR President Robert Free to meet with the civic association and Suffolk County’s elected representatives was approved and will be subsequently shared with all necessary parties. 

The next Port Jefferson Civic Association meeting will be held on Aug. 12 at the Port Jefferson Free Library, 100 Thompson St., at 6:30 p.m.
