The $4.2 billion Clean Water, Clean Air, and Green Job Bond Act proposition on our ballot in 2022 will allow our state to undertake vital and urgent environmental improvement projects via issuing bonds; not a tax increase.

Long Island’s waterways are impaired by failing sewage and septic systems, and algae and nitrogen pollution impacts our sole-source aquifer system which provides drinking water to three million state residents. We need to find a way to conserve open space to benefit wildlife habitats, food production, and outdoor recreation. Many marginalized communities are harmed by pollution and have no access to open space, clean air and water.

There have been eleven environmental bond acts passed since the early 20th century. The conservation movement of the late 19th and early 20th centuries was a response to vast deforestation, natural resource depletion and industrialization. The “forever wild” clause was added to the New York State Constitution in 1894 to enshrine the protection of lands in the Adirondacks and Catskills. 

In 1910 voters passed a bond act for $2.5 million, in 1916, for $10 million, and in 1924, for $15 million, all for the purposes of land acquisition and the establishment of parks. The 1965 Bond Act funded infrastructure to limit the flow of wastewater from untreated sewage overflows. In the 1970’s and 80’s, attention was galvanized by the problems with Love Canal, near Niagara Falls, the site of thousands of tons of toxic waste from the Hooker Chemical Company, which led policymakers in the US to establish hazardous waste regulatory systems.  The majority of the funding from the Environmental Quality Bond Act of 1986 went to manage hazardous waste in sites under the State Superfund program which had been established in 1979. The Clean Water/Clean Air Bond Act of 1996 allocated the bulk of its $1.75 billion to safe drinking water and treatment of solid waste. 

The infrastructure in New York City, which supplied water to approximately 40 percent of NYS’s population, had already exceeded its life span by 2008 when the NYS Department of Health estimated that $38.7 billion would be needed over the next twenty years for drinking water infrastructure. The Legislature responded with an initial allocation in 2017 of $2.5 billion. In 2019 it passed the Climate Leadership and Community Protection Act, which established clear statewide goals for emissions reduction and clear energy. 

Governor Hochul’s budget released the Clean Water, Clean Air, and Green Jobs Environmental Act of 2022. The final version, $4.2 billion, makes climate change its largest category of funding and designates that a portion of the total funding must be allocated to disadvantaged communities that bear a disproportionate share of negative environmental consequences. The 2022 Bond Act includes:

Climate Change Mitigation (includes money for electrifying school buses) — $1.5 billion: Will fund projects that expand clean energy infrastructure, increase energy efficiency, reduce green gas emissions, and protect air and water quality to help fight and mitigate climate change. 

Restoration and Flood Risk Reduction — $1.1 billion: Damage caused by severe storms and flooding is projected to cost over $50 billion statewide. Funding would provide investments in NY’s natural and manufactured coastal resilience systems such as shoreline protection, wetland restoration, local waterfront revitalization, green infrastructure, and voluntary buyout programs.

Open Space Land Conservation and Recreation — $ 650 million: The Bond Act funding will expand open space conservation programs, promote outdoor recreation, protect natural resources, improve biodiversity, benefit threatened and endangered species and help farmers who are facing the challenges of climate change. Funding will invest in restoring and maintaining native fish populations and increasing public access to our waterways to support LI’s maritime culture. 

Water Quality Improvement and Resilient Infrastructure — $650 million: A long-term solution is needed to fund our backlog of water quality and infrastructure needs which continue to outpace available funding; the Bond Act will help fill the gaps in funding by investing at least $659 million in protecting water quality, spending 35% of the total in disadvantaged communities.

In January 2020, former President Donald Trump (R) signed an executive order that replaced the U.S. Environmental Protection Agency’s and the U.S. Army Corps of Engineers definition of what is considered a federal body of water under the Waters of the United States rule, known as WOTUS. 

In his election campaign, President Joe Biden (D) promised to undo these changes, which are currently under review. 

But what does all of this mean for Long Island?

Wetlands are areas where water covers the soil, or is present near the surface of the soil all year for varying periods of time. According to a U.S. Fish and Wildlife Service report, as at 2004 6% of Long Island was made up of wetlands — that’s about 51,000 acres. 

Wetlands, due to their beneficial services to people and wildlife — including providing habitats to multiple species, improving water quality and assisting with flood protections —are among some of the most productive ecosystems in the world.

Wetland protections can also create problems for business developers and farmers. One of Trump’s main reasons for passing his executive order in 2020 was to redefine the definitions of which bodies of water could be protected under WOTUS in order to remove legal roadblocks to farmers caused by the need to determine whether water on their land fell under control of the federal government.

“After decades of landowners relying on expensive attorneys to determine what water on their land may or may not fall under federal regulations, our new Navigable Waters Protection Rule strikes the proper balance between Washington and the states in managing land and water resources while protecting our nation’s navigable waters, and it does so within the authority Congress provided,” said EPA administrator, Andrew Wheeler, in a January 2020 news release.

Now, due to the undoing of restrictions by Trump’s administration, local conservationists are worried about the long-term effects on Long Island’s wetlands.

Coby Klein, a conservationist at the Huntington-Oyster Bay Audubon Society and adjunct professor of Natural Sciences at Baruch College, said that Long Island’s wetlands are beneficial to both the community and the organisms that dwell in them, and they need to be preserved.

“Wetlands provide protection from flooding, especially the coastal wetlands, the salt marshes and things like that,” he said. “They also help work to mitigate climate change. When plants die in these wetland areas, they don’t decompose very quickly. They serve as what’s called a carbon sink. Instead of carbon being put back into the atmosphere when a plant dies, it gets stored in the soil and in the muck in the water.”

Victoria O’Neill, Long Island Sound Study habitat restoration coordinator at the state Department of Environmental Conservation, is another local conservationist who confirms that healthy wetlands are important to Long Island.

“Tidal wetlands provide many different ecosystem services to Long Island communities,” she said. “They help provide protection from coastal storm surge, improve water quality, provide recreational enjoyment and serve as nesting, breeding and resting grounds for commercial and recreationally important fish and shellfish.”

With all of the benefits wetlands provide to Long Island communities and ecosystems, why did the federal government want to push back on protecting them? Klein said it is because, “they get in the way.”

“When there’s any type of pollution that gets into a body of water, it ends up in a wetland,” Klein said.  “That’s bad news for the things that grow there and live there. Salt marshes are very susceptible to nitrogen pollution, and that’s a big problem on Long Island because almost everybody around here fertilizes their lawns, and they tend to overfertilize.” 

He added that because of the high volume of sewage systems on Long Island, the excess fertilizer from people’s lawns and farmers’ fields tends to go from the sewage systems to large bodies of water and then eventually into rivers and wetlands. This causes excess nitrogen that is detrimental to those ecosystems.

Under Trump’s redefinition of protected waters under WOTUS, it has become easier for developers and farmers to make those kinds of damages to wetlands but, according to the DEC, New York is taking great steps forward as a leader in the efforts to protect state wetlands and their invaluable natural habitat.

“It is estimated that the Navigable Waters Protection Rule will remove federal protections for about half the nation’s wetlands,” the state DEC said in a 2020 statement. “Thankfully, existing strong protections of waters in New York state will reduce the impact of the Navigable Waters Protection Rule compared to many other states. However, not all wetlands are protected under New York law and we rely on federal protection and our water quality certification review to protect smaller wetlands. Recent changes in the definition of Waters of the United States have resulted in fewer of these smaller wetlands receiving any regulatory protection.”

According to O’Neill, active steps are being taken to restore wetland habitats that have been lost.

“The tidal wetland ecosystem target in the LISS’s 2015 Comprehensive Conservation & Management Plan set a goal to restore 515 additional acres of tidal wetlands by 2035 from a 2014 baseline,” she said. “As of 2020, we are 15.5% toward our goal.”

Klein said that restoration projects are time sensitive and need to happen as soon as possible.

“Wetlands provide us with all kinds of important ecosystem services and even more important than that, they’re just pleasant places,” he said. “We should try to preserve them simply because there are so many creatures besides us that depend on them. So even if they didn’t do all this important stuff for us, we should still try to conserve them because they do important things for other species.”

It’s hot. It’s muddy. It’s dirty. But it’s exciting work, if you like that sort of thing.

That was how Nancy Grant of the Friends of Flax Pond chose to describe her group’s latest initiative this summer tracking Diamondback Terrapin turtles at West Meadow Beach. And while they may move slowly, the Friends have been acting quickly to spot the four-legged reptiles at the height of their nesting season and working to preserve their species.

“I think a lot of people don’t realize we actually have turtles here,” Grant said of the program, which has been in operation annually since 2004. “You think you have to go someplace exotic to observes them, but you don’t.”

From the third week of June through the entire month of July, the Friends of Flax Pond has set out to conduct its annual six-week search for evidence of nesting turtles, documenting the population numbers and behaviors of what Grant called an important keystone species. The group meets every Sunday at West Meadow Beach at the park ranger sign at 9:30 a.m. and is accepting volunteers on an ongoing basis.

The Friends of Flax Pond have been keeping a vigilant eye on the shorelines of West Meadow Beach and Flax Pond with hopes of spotting the exotic creatures, as Grant referred to them as a vital way of keeping a finger on the pulse of the North Shore’s environment.

“They determine the health of the area,” she said. “It’s important to protect them because their numbers have gone down. They used to be over at Flax Pond, but we haven’t seen any there since 2009, with the exception of one recently.”

The Friends have spotted on average between nine and 10 nests a year, depending on the number of volunteers, Grant said. Once they find the nest, volunteers dig around it, put a cage over it and hold it in with tent stakes to keep predators away.

They’ll even go as far as using cayenne pepper to deter animals from some nests, but Grant admitted the nearby threats like foxes and birds were becoming privy to their methods and becoming less deterred by them.

From an educational standpoint, the group has also been working to launch its own Flax Pond Summer Research Institute this summer. For a $100 fee, the Friends is offering up an internship program at the Flax Pond Lab and salt marsh as well as West Meadow Beach that links up with academic marine scientists to gather data to document changes in the marshes there. This year, the group said it planned on documenting the status of species prior to a possible dredging of the Flax Pond inlet — a 146-acre tidal wetland on the North Shore — which the Friends has been adamantly advocating for.

Earlier this year, Old Field Mayor Michael Levine and the board of trustees called on legislators from the county, state and town levels to join with Stony Brook University and the New York State Department of Environmental Conservation to see the pond dredged and protect the fin and shellfish populations known to once thrive there.

“If you don’t have a marsh there, you have nothing between you and those major waves,” Grant said. “It protects real estate. As much as having a dock is nice, it won’t matter if you don’t have those plants there.”
