The Town of Brookhaven is in the final stages of deciding whether to allow a controversial retirement community to be constructed. 

Commack-based Heatherwood Luxury Rentals has proposed plans to build on nearly 26 acres of its more than 70-acre golf course on the southeast corner of Arrowhead Lane and Route 347. It was put on the planning board’s decision calendar at its July 9 meeting, and now they have 62 days from July 9 to render a decision.

If approved, the company would construct Heatherwood Golf at Setauket, a 55 and over community with 200 rental housing units, 403 parking stalls and additional garages. Heatherwood also plans to redesign the golf course, reducing it from 18 holes to nine. The property falls in both the Comsewogue and Three Village school districts.

John Gobler, a 48-year homeowner in Heatherwood Village South in South Setauket, attended the July 9 meeting objecting to plans for the new development having only one entryway to exit and enter, which would dump traffic onto Arrowhead Lane. He said the intersection of Arrowhead Lane and Route 347 has been a problem for several years due to the number of cars exiting onto Arrowhead and the timing of lights at the corner, where he has witnessed only four or five cars being able to go through a green light.

He questioned a traffic engineering study by Stonefield Engineering & Design, LLC conducted June 13 of the traffic volume count of cars exiting Arrowhead to Route 347. He said the company found a total of 183 cars during 7 to 9 a.m. and 141 vehicles 4 to 7 p.m. Gobler said he sat at the intersection and monitored traffic for a 20-minute period, 8:55 to 9:15 a.m. three separate days when school wasn’t in session and counted exiting cars from Arrowhead. His average was 89 for the 20-minute intervals, which would be 266 cars during the morning rush hour. He said Stonefield’s count of 183 cars over a two-hour period would mean only 31 cars every 20 minutes.

Frank Filiciotto, a traffic consultant with Stonefield, said there are always spikes in traffic, which could account for Gobler’s observation. He also said the 183 and 141 numbers represent one-hour volumes within the periods of time specified and not the entire time specified. He said the company has been monitoring traffic in the area for four years. One observation of cars entering and exiting nearby Fairfield Knolls North by the company showed a daily total of 218 cars observed during 7 to 9 a.m., 2 to 4 p.m. and 4 to 7 p.m. Stonefield broke the figures down to 60 in the morning period, 80 from 2 to 4 p.m., and 78 during the evening period. The monitored development is 0.65 miles northeast of the proposed apartments and is also age restricted. The company prorated the numbers since Fairfield Knolls has 91 more units than what is proposed for Heatherwood. He said the amount of traffic was similar to what they originally projected and should not negatively impact the area.

“This isn’t assumption,” Filiciotto said. “This isn’t opinions. This is fact. We went out, and we calculated the amount of traffic Fairfield North was generating during peak hours.”

In 2014, Councilman Dan Panico (R-Manorville) sponsored the resolution for a zone change for the property from A Residence 5, which allows one housing unit for every 5 acres, to Planned Retirement Community, which would allow a 55 and over community. On Dec. 16, 2014, the town board approved by a 4-3 vote. Councilwomen Valerie Cartright (D-Port Jefferson Station) and Connie Kepert (D-Middle Island) as well as Supervisor Ed Romaine (R) dissented. 

The town board placed conditions on its zone change approval, including requiring Heatherwood owner Doug Partrick to donate 40 acres of land to the Manorville Farm Protection Area, removing a billboard at the golf course and constructing a sidewalk on the east side of Arrowhead Lane. Panico’s office confirmed the town accepted the 40 acres of property in 2015 in lieu of the Pine Barrens Credit redemption required under the Planned Retirement Community code.

Development of the golf course has faced opposition from elected officials and local civic associations since it was first presented in 2014. Cartright remains opposed to the project as it stands, according to her legislative aide Jennifer Martin. 

Herb Mones, chair of the Three Village Civic Association’s land use committee, said the civic group opposed the initial zone change for the golf course, and he said many felt it was controversial due to the town board approving it over the objections of Cartright.

“The overpacking of the site with housing, adjacent to a residential neighborhood, and built on an already highly trafficked Route 347 demonstrates poor planning,” he said.

Sal Pitti, president of the Port Jefferson Station/Terryville Civic Association, said the group still stands opposed to the development.

“The community spoke in force back when the project was proposed, and they said we don’t want it,” Pitti said. “The aspect that bothered us the most for the acceptance of the project was that a donation of land went to another council district instead of ours.”

Another large-scale development project is in the works for the Port Jefferson Station area.

Brookhaven Town approved a zone change at its July 12 meeting paving the way for the construction of a 170-unit assisted living facility on Route 112 in Port Jefferson Station on a parcel near The Meadow Club banquet hall. With plans already progressing in recent months to construct a 244-unit residential complex for senior citizens on North Bicycle Path just off of Route 112 and New York Gov. Andrew Cuomo’s allocating of $8 million in funds for a roughly 100-unit project for affordable and homeless housing on Route 112 near East Grove Street, this will be the third property set for massive development in a roughly mile and a half stretch of the state highway.

Baltimore-based developer Brightview Senior Living will be building and operating the assisted living facility, as it does with each of its 35 properties, according to Vice President of Development David Holland, who spoke during a town public hearing on the zone change July 12.

“We intend to be long-term citizens of Brookhaven and strive to be good neighbors to all who are around us,” Holland said.

The VP said the company expects the majority of its tenants to be in their 80s and 90s and in need of regular, daily care. Brightview’s current site plan for the approximately nine-acre plot of land includes a three-story building with dining venues, a theater, a pub, a library, indoor and outdoor lounges, as well as its own sewage treatment facility for the site.

The property was previously owned by area resident Jeff Kito and his family dating back to the 1950s, he said during the hearing. Kito is the former president of the Port Jefferson Station/Terryville Civic Association and lives on the nearby Canal Road currently. He said he and his brother decided to sell the property about three years ago and sought to find a developer interested in building something along the lines of what Brightview proposed. He said he has met with neighbors in the vicinity to discuss the plans.

“I think we’ll have a great facility for the community,” he said.

Kito’s former colleagues in the civic association submitted a letter to Brightview dated Jan. 25, 2017, stating the members had no objections to the project.

“We look forward to working with your firm as this assisted living facility proposal is further developed in our Port Jefferson Station Terryville Hamlet,” said the letter, signed by then-President Ed Garboski, who is now the vice president.

Current President Sal Pitti said in an email the civic association still has no objections related to the project. Town Councilwoman Valerie Cartright (D-Port Jefferson Station) and Anthony Guardino, an attorney representing the applicant at the July 12 hearing, each said they had received a single letter from a community member in opposition of the development in addition to several in favor, including one signed by all homeowners on Patty Ann Court, which is also nearby the boundaries of the parcel. The property is expected to have a significant buffer from other residential properties that will include sizable evergreen trees.

Holland indicated a demand for such a facility exists in the area, as Brightview determined about 1,500 assisted living beds are currently available in the town.

About 16 percent of Suffolk County’s population is 65 or older, according to the website www.censusreporter.org, which is slightly higher than the New York state and United States rates. Port Jefferson Station’s 80-plus population is substantially larger — about 20 percent — than that of the state and surrounding region, according to the site.

Homeless people living in Suffolk County might soon find a roof over their heads in Port Jefferson Station.

New York Gov. Andrew Cuomo (D) announced May 10 that $25.6 million has been awarded to four housing developments on Long Island to create 239 affordable homes.

There is $8.1 million set aside for construction of six two-story buildings on vacant land off Route 112 in Port Jefferson Station, north of East Grove Street and south of Washington Avenue. Phase One of the project would create 77 units, while a potential second phase would add an additional 31 apartments, according to Brookhaven Councilwoman Valerie Cartright (D-Port Jefferson Station) speaking during a May 22 Port Jefferson Station/Terryville Civic Association meeting. The site plan application for the project was listed as
“in-review” in Brookhaven documents as of April 30, though the property is already properly zoned for the requested use and it doesn’t require any variances, according to town spokesperson Kevin Molloy. The Port Jeff Station project would include 45 units for homeless individuals, half of which would be reserved for veterans, Cartright said.

The May 10 announcement ignited a strong reaction from the Port Jefferson Station community both on social media and at the May 22 meeting. Civic association President Sal Pitti said he, Cartright and representatives from Concern for Independent Living Inc., the nonprofit agency seeking to construct the facility, met in March to discuss the potential project, concerns of the community and the agency’s efforts to gain tax exempt status for the project from the state. Cartright and Brookhaven Supervisor Ed Romaine (R) both said May 22 they were caught off guard by the governor’s announcement about the funding.

“As soon as I found out anything about it, I ran into the supervisor’s office asking him what he knew about it and wanted to make sure that I had all the information necessary,” Cartright said. “Immediately afterwards we contacted the civic association … it was news to us as well.”

Pitti said he thought the organization had been less than forthcoming about its plans, suggesting Concern for Independent Living initially didn’t mention the potential second phase, which is also not referenced in Cuomo’s announcement.

“Our biggest concern, besides the tax part that they’re not bringing any kind of revenue to our community, is also the amount of kids that may come out of this facility, because more kids in our school district means more taxes on top of the taxes we’re already paying for that location,” he said.

Elizabeth Lunde, Senior Associate Executive Director for Concern for Independent Living said leadership of the civic association had been invited to visit one of the organizations other facilities, and the invitation remains on the table.

“Concern for Independent Living is a local organization that has been providing quality housing in Suffolk County for decades,” she said in an email. “We were founded in 1972 and our first office was located in Port Jefferson Station. We currently operate over 1,000 units of affordable rental housing that has made a very positive impact in Suffolk and Nassau Counties as well as Brooklyn and the Bronx.”

Several attendees of the May 22 civic meeting expressed displeasure about the project, suggesting Port Jeff Station already has its fair share of facilities for homeless people.

“Homeless families need a place to live — our community is a very giving community,” civic association Vice President Edward Garboski said May 22. A resident at the meeting responded, summing up a sentiment seemingly shared by most of the attendees: “We don’t want to be the only community giving.”

The Port Jefferson project is receiving only a small part of more than $200 million the state is awarding to build or preserve more than 2,800 affordable apartments across New York, according to a press
release from Cuomo’s office. The governor called the $200 million investment a “giant step forward to increase access to homes for families, seniors and our most vulnerable men and women across the state.”

RuthAnne Visnauskas, commissioner of New York State Homes and Community Renewal program, said the investment would address the crisis of homelessness among other benefits.

“By delivering affordable homes to Long Island, we continue to grow its economy,” she said in a statement.

Romaine said the town is concerned about the governor’s announcement and suggested other ways he thought the money could be better used. He also instructed concerned residents to start a petition and direct it to Cuomo’s office.

“We’ve been begging the state of New York to give us some money to fix up zombie homes, and to make them available to first time home buyers and veterans,” he said. “We’d like that money going toward that housing, instead of building something new, how about we rebuild some of the neighborhoods that we lost during the Great Recession to foreclosures and zombie houses. How about giving homes to our veterans and first-time home buyers who are leaving the area.”

A viral video of a lewd act in public and rumors about a large-scale new development project are probably why most attended the meeting, but emotions set the tone.

Anger, passion, fear and compassion flowed like a river during a nearly three-hour meeting of the Port Jefferson Station/Terryville Civic Association at the Comsewogue Public Library May 22. It was the civic’s scheduled meeting for May, but the regular members acknowledged this was an out-of-the-ordinary community gathering.

Earlier this month, a cellphone video of two people, believed to be homeless, having sex at a Suffolk County bus stop in Port Jefferson Station spread not only across the community, but the country. As a result of that incident, and in an effort to ascertain the facts about an announcement made by New York Gov. Andrew Cuomo’s (D) office May 10 that he was allocating about $8 million in funding for a large-scale affordable housing apartment complex for the homeless in Port Jeff Station, the civic association invited leaders from across local government to attend and field resident questions and concerns.

“This is how it starts,” civic association President Edward Garboski said at one point during the meeting, as tensions rose among the approximately 200 people who crammed into The Richard Lusak Community Room at the library. “None of these people are going to give you a solution to this problem tonight. Most of the people in this room have never been to a civic meeting. This is how it starts. We invited all these people here. They’re going to hear us speak. We continue to fight — together.”

The discussion began with Suffolk County Department of Social Services Commissioner John O’Neill answering questions for about an hour. O’Neill was pressed with questions about the concentration of shelters for the homeless in the Port Jefferson Station area, oversight of the locations and curfew rules, and how the locations are selected. He said it was against the law to publicize the location of homeless shelters, though he said if he were legally allowed he would compile a list by zip code. He said the shelters in most cases are privately owned, and if they are compliant with state and federal regulations, they are approved with no consideration taken regarding volume of like facilities in the area. O’Neill also said checks are done regularly at all county shelters to ensure they are in compliance with regulations.

“The argument with the homeless is they need help, we know this,” PJS/TCA Vice President Sal Pitti said. “Everybody here in one way, shape or form has collected food, done something for a homeless individual. I think our biggest issue is the lack of supervision at these locations.”

Suffolk County Legislator Kara Hahn (D-Setauket), Brookhaven Town Councilwoman Valerie Cartright (D-Port Jefferson Station), Brookhaven Town Supervisor Ed Romaine (R) and Suffolk County Police Department 6th Precinct Inspector Patrick Reilly also attended the meeting and fielded questions from the attendees.

“I live in Port Jefferson Station as well, so I’m not coming from another community saying ‘Oh, it’s not that bad,’” Cartright said. “I love where I live, but there are issues and we need to deal with them. It’s a complex
issue and it doesn’t happen overnight. We are committed — I can say that for each of us that are sitting here today — to trying to make a difference and coming up with solutions.”

One suggestion that emerged from the meeting is the necessity for a 24-hour hotline to contact the county DSS when issues occur in the community. Currently the hotline only operates during business hours. Reilly said he believes a viable answer to reduce crime in the area, especially in the vicinity of Jefferson Shopping Plaza, would be the installation of more police surveillance cameras. Residents were also repeatedly urged to call the police when observing illegal activities, and to stay engaged with civic association efforts to foster a strength-in-numbers approach.

Many of the elected officials said they plan to be back at the association’s next meeting July 24 to unveil plans for revitalization in the area near the Port Jefferson Long Island Rail Road station.

During a Three Village Civic Association meeting June 5, Brookhaven Councilwoman Valerie Cartright (D-Port Jefferson Station) provided a look into the future of Port Jefferson Station.

In 2014 the Brookhaven town board approved a study for a potential hub project for Port Jefferson Station, specifically in the area of Route 112 north of Route 347 and south of the Long Island Rail Road train tracks near Hallock Avenue. The goal of the study and community-visioning document was to gauge public interest and provide in-depth plans for what a walkable, downtown Main Street residence and commercial retail space might look like in Port Jeff Station. In the time since the study was conducted, Cartright, who has played an instrumental role in the progress of the plan, which preceded her taking office, since taking over, said a steering committee has been appointed to continue moving the project forward. Cartright said in an email the town has been working with the steering committee to discuss potential projects and proposals with landowners in the area.

“The community has expressed a desire for revitalization in the study area in Port Jefferson Station/Terryville,” she said in an email through spokeswoman Jennifer Martin. “From a town perspective, we agree with the community that this area calls for a flourishing and vibrant ‘walkable’ downtown that has an appropriate mix of commercial and residential. Both the town and the community wish to see a smoother transition from Port Jefferson Village to the station in that corridor.”

Cartright added the next step in the process is to determine the compatibility of landowners’ visions for the future of the area with the plans laid out in the hub study-visioning document.

Lee Koppelman, a longtime Suffolk County planner and a current professor at Stony Brook University, submitted a letter in support of the proposed project.

“The overall goal sought for the corridor is to achieve improvements that will transform this core of the hamlet into a destination center with improved, coordinated architectural design; safe walkable ambience; and the preservation of historical sites,” he said.

A survey was sent out to 6,500 residences in 2013 to assess if the community would be behind a project like this. Some responses included “the idea for a real downtown is great,” “the area is terrible — clean it up!” and “beautification is always welcome.” Others suggested building affordable housing would be preferable, congestion in the area is already excessive and abandoned buildings should not be replaced with brand new ones.

In the survey residents were able to weigh in on aspects of the project they might like to see. Of those who responded to the questionnaire, 82 percent said they wanted to see a historic looking downtown area, 92 percent were in favor of public Wi-Fi and 87 percent would be in favor of a grocery store. A vast majority of those who responded also said they would not patronize stores in the area if they were required to pay for parking — about 89 percent.

Port Jefferson Village secured grant money from New York State and Suffolk County earlier this year to improve the train station, parking surrounding the train station and to fix blighted buildings in the area just north of the station on Main Street.

Drug addiction on the North Shore and across Suffolk County is a complicated problem, so the police department and the community are coming together to come up with strategies to combat it.

One of the reasons Salvatore Pitti, a retired New York City police officer, left the Big Apple to live on Long Island he said in part was to escape drug-related crime. But in recent years, he has seen what he called an alarming uptick in heroin and opioid-related overdoses and deaths in the suburbs — so he decided to do something about it.

“We need to put the fear of God into our kids about this problem,” Pitti said April 11 during a Crime Awareness Committee meeting at Brookhaven Town Hall. “I’ve had the misfortune, in my career, to scoop three or four children off the street, dead. I don’t want to see that.”

Pitti, vice president of the Port Jefferson Station/Terryville Civic Association and leader of a local neighborhood watch group designed to eliminate local criminal activity, co-sponsored the event along with Brookhaven Town.

Joined by several guest speakers including Supervisor Ed Romaine (R), Councilwoman Valerie Cartright (D-Port Jefferson) and Suffolk County Police Department Commissioner Tim Sini, Pitti spoke with local organization leaders and residents about how they can help make their communities safer.

Sini, who became commissioner last year, has already rolled out several initiatives through the SCPD to address the issues of illegal drug sales, abuse and overdoses as well as prevention and recovery in his short time leading the department.

Many of them rely on police department collaboration with the public.

“I can’t tell you the number of times that information from people in this room or from folks like you have helped us solve crimes,” Sini said, highlighting such programs as the NARC hotline, a partnership with Suffolk County Crime Stoppers, where callers can give crime tips anonymously and receive cash rewards for those that lead to arrests.

Another initiative, Sini said, is the Long Island Heroin Task Force, which targets drug dealers causing overdoses and the areas that have the biggest spikes in overdoses through data collected in the department. Programs are also being implemented in local schools that teach about the consequences of taking drugs, offer prevention and recovery steps, and even train parents and teens on how to administer Narcan, the nasal spray used to reverse heroin overdoses.

“We need to get people off drugs and into treatment for recovery,” Sini said. “Please think of ways the SCPD can partner with you to promote drug prevention in your community.”

Cartright said she understands the importance of a partnership with local law enforcement.

“I grew up in Queens, in an urban community where there was a lot of crime, and there was no interaction with the police department the way we interact with the police department here,” the councilwoman said. “They come in and ask, ‘how can we work with you?’ That’s something, 25 years ago, I didn’t have when I was growing up. This is not a problem we can solve alone.”

Pitti said he started the Crime Awareness Committee three years ago to shine a spotlight on a local marijuana dealer in his neighborhood. Due to his effort and a collaboration with neighbors and the police, the dealer was ultimately pushed off the block.

Even though the group has since grown, he said he wants more community involvement.

“When I first started this, I received a civic email list but, unfortunately, it was antiquated and outdated,” he said. “We’re working together on it, to try and fix it and put more emails in. That, to me, is the first problem. If we can’t call each other, how can we help each other?”

He handed out a packet to attendees of the meeting outlining ways to identify dangerous people in the community. The packet gives details on how to check if houses in a neighborhood have rental permits; report town code violations; deter underage drinking at parties and neighborhood gatherings; and a detailed physical description form to fill out upon witnessing suspicious activity.

President announces candidacy against Valerie Cartright

Ed Garboski will be taking a leave from his role as civic president as he works to unseat Councilwoman Valerie Cartright in the fall.

Garboski, of the Port Jefferson Station/Terryville Civic Association, announced his run against one-term incumbent Cartright (D-Port Jefferson Station) for Brookhaven Town Board’s 1st District at the civic’s meeting on Wednesday night — opening up much debate.

The association’s bylaws do not contain a provision for taking a leave of absence, which originally created a tricky situation for the membership during the discussion. The room was divided — and at times argumentative — over whether Garboski should resign his position as he runs for political office on the Republican and Conservative tickets.

Faith Cardone said she felt it would be a conflict of interest for him to remain the president while running a political campaign for the Town Board.

Garboski said he had wanted to take a leave of absence, largely because he foresees having less time to fulfill his presidential duties, but was limited because of the bylaws’ shortcoming. He pushed back, however, when some called for his resignation, including fellow civic executive board member Joan Nickeson.

“I don’t think that I need to resign as of right now,” he said. “Where’s the conflict [of interest]?”

Other members also spoke up against Garboski remaining in his civic position.

“I don’t want to insult your integrity, Ed,” Gerard Maxim said, but having Garboski serve as president while also running for Town Board “makes it awkward for us.”

There were, however, voices of support in the audience.

Kevin Spence, a Comsewogue library board member, said there is no ethical problem before Election Day.

“I don’t see where this is a conflict until he gets elected.”

After some back and forth, Garboski relented somewhat, saying, “if this is such a big problem … if it’s that important to this membership here that I step down, I’ll step down.”

But instead, another library board member, Rich Meyer, made a motion for civic members to vote on granting Garboski a leave of absence starting in August and ending after the election, overriding the bylaws.

The members unanimously approved the motion for his leave.

Once Garboski departs in August, Vice President Diane Lenihan-Guidice will step into his shoes, including running the civic meetings for the months he is away.

Cartright, who is running for a second term on the Democratic, Working Families and Independence lines, said in a statement she and Garboski “will continue to work together to address community concerns. As a sitting elected representative, I firmly believe government always comes before politics.”

She said if re-elected she would “address the needs and ideas of the community and advocate for an informative and transparent local government.”

Local civic members are going all-in to fight a proposed gambling facility in Brookhaven Town.

After New York voters passed a referendum in 2013 that allowed for seven casinos in the state, the Suffolk Regional Off-Track Betting Corporation proposed putting a 1,000-machine casino at the former Brookhaven Multiplex Cinemas in Medford. But town residents, particularly those living in the Medford area, have railed against the project, citing concerns about it causing traffic congestion and promoting crime, drug use and prostitution.

The proposal, for a nearly 32-acre site off of the Long Island Expressway near Exit 64, is awaiting approval from the Suffolk County Planning Commission.

Delaware North, the company that runs the Finger Lakes Gaming & Racetrack and Hamburg Gaming in upstate New York, would operate the Medford facility.

The local residents who oppose the 1,000 lottery machines, known as video lottery terminals, have found allies in the Port Jefferson Station/Terryville Civic Association. At the group’s March 25 meeting, the members voted to take an official stand against the gambling facility, upon a suggestion from executive board member Frank Gibbons.

The Terryville resident said residents must push their elected officials to derail the casino.

“If all of us get united across this entire township and say, ‘You do this and we’re going to vote you all out of office,’ I bet they’ll find a way.”

Town officials have said that their hands are tied, and they have no role in choosing where the gambling facility will be built. The town board has hired global law firm Nixon Peabody LLP to issue its own legal opinion on the matter.
The town board also approved an anti-casino statement in late January, introduced by Councilman Neil Foley (R-Blue Point).

“These are blights in a community and serve no purpose in the suburbs,” Councilwoman Jane Bonner (C-Rocky Point) said at the time.

The Port Jefferson Station/Terryville civic members voted against a gambling facility being built at the proposed site in Medford or anywhere else in Brookhaven Town.

“Because if it’s not Medford, it could be Bicycle Path,” President Ed Garboski said. “It could be Centereach.”

Jeff Napoleon, a Port Jefferson Station resident, said members should authorize the executive board to “to make our feelings known that we’re against this and to take whatever steps … in any way they deem appropriate. That way as they uncover things, they can take action.”

The civic supported that measure, adding it to their vote of opposition to the gambling facility.

“This is obviously a complicated issue,” Napoleon said. “A lot of angles to it.”
