Residents in the Village of Head of the Harbor and the surrounding area will again be able to express their opinions Aug. 16 regarding a proposed church at 481 North Country Road.

The Russian Orthodox Monastery of the Glorious Ascension, also known as the Monastery of Saint Dionysios the Areopagite, has owned the historic Timothy House since 2018 and is proposing a plan to construct a house of worship on the property and 36-space parking lot. A special use permit is needed to proceed with any construction.

At the June 21 village meeting, Joseph Buzzell, the monastery’s Melville-based attorney, explained that the proposed church building, with a planned maximum occupancy of 282 people, would not be a parish church but a monastery church. He said while people outside of the monastery at times decided to worship with the monks, the monastery is not looking to expand its congregation. 

Currently, the monks hold services inside Timothy House. According to village code, land, buildings and major landscaping on either side of 25A, also known as North Country Road, are declared a historic area if they extend to a depth of 500 feet within the village. In addition to the village code, covenants and restrictions were placed on the deed by historian and previous owner Barbara Van Liew in 1973 and 1997.

At previous village meetings, while some residents said they had no concerns, others were worried that the construction of a church and the addition of a parking lot may degrade the historical integrity of the property and the landscape.

In a phone interview, Buzzell said the monastery is not modifying the Timothy House. He said the monks have already paid more than $340,000 in maintenance and repairs on the structure.

Buzzell said the plans for the church had been changed twice to move it from the front of the property toward the back. He said there would be no widening of the driveway and no new lighting; however, he said the entrance posts would have to be moved farther apart.

He said the monks respect the historical integrity of the home and property, but he feels those who are against construction “don’t seem to want to take into consideration what’s been done,” he said.

The lawyer said the monastery being awarded the special exception permit is important.

“This action ensures the preservation of the house,” he said, adding Van Liew wouldn’t want to see the house put at risk.

Inspections

In a July 20, 2023, letter to Mayor Douglas Dahgard from Robert O’Shea, village building inspector, posted on the village’s website, the letter writer said he met with Father Vasileios Willard, deputy abbott, at the Timothy House for a tour. 

He said Willard pointed out some trees he would like to be removed, which O’Shea wrote an arborist will be submitting a report on the condition of the trees. In the letter, the building inspector stated that the grounds were properly maintained according to village and state codes.

Inside the house, new water heaters, waterproofing of basement walls, and structural repairs in the basement, first and second floors were among the new work done, according to O’Shea. 

He wrote the structure was in “good overall condition and is well-maintained.”

The State Historic Preservation Office also reviewed the monastery’s plans and found there would be no adverse effects on the property, but many, including village historian Leighton Coleman III, said they are concerned because a representative from SHPO didn’t visit and survey the property.

Covenants and restrictions

Among those who have criticized the proposed construction to the property has been St. James-based attorney Joseph Bollhofer, chair of the village’s zoning board of appeals. In an email to TBR News Media, he said, in addition to violating the covenants and restrictions placed by Van Liew, it “would violate various provisions of the village code, having to do with a special exception permit.”

At the June 21 meeting, Buzzell said his clients were not aware of the 1973 covenants, something that Bollhofer said would be part of a title search.

When asked by TBR about the comment, Buzzell said that the 1973 covenants did not turn up in the monastery’s title search in 2018 when the property was purchased. The attorney feels that the 1997 document amended and replaced the 1973 document.

But Bollhofer said the 1997 conventants wouldn’t replace or supersede the 1973 document.

“In every case, where one document supersedes or amends another, it must specifically state that,” Bollhofer said, adding, “Both documents state that they ‘run with the land’ and are binding upon all future owners.”

Traffic analysis

In a letter dated Aug. 2, Aaron Machtay, transportation project manager with Hauppauge-based civil engineering firm VHB, presented traffic and parking recommendations to Village Counsel Philip Butler after reviewing a traffic statement by Atlantic Traffic and Design prepared for the monastery earlier this year, and a site plan from architect Mark Wittenberg that was dated Aug. 30, 2022.

According to the letter, despite prior testimony that the driveway will remain at its 18-foot width, VHB suggested that the driveway be evaluated to see if it can accommodate two-way traffic. 

The business also suggested that the previous traffic statement was a conservative estimate and “projections for the future activity should be prepared based on the observed demand and compared against thresholds established for a significant impact.”

Among other suggestions, the letter stated that parking observations need to be reconciled “to present the actual peak parking demand expected for the site,” and due to the site driveway being located across and offset from the Route 25A and Northern Boulevard intersection, an analysis for the three-year crash experience should be provided, focusing on the three-year period before the COVID-19 pandemic began. 

The Village of Head of the Harbor will hold its next meeting and the public hearing Wednesday, Aug. 16, at 7 p.m. Village Hall is located at 500 N. Country Rd, St. James.

Monday, July 10, marked Lauren Sheprow’s first Village of Port Jefferson Board of Trustees meeting as village mayor. 

Sheprow led the new board through their business and reorganization meeting, in which the reconfigured village board voted to reject proposed code changes slated for the Maryhaven Center of Hope property on Myrtle Avenue.

Maryhaven Center of Hope

The proposed code amendments were an effort by the previous administration to preserve the historic building on the Maryhaven site. [See story, “For Maryhaven, Port Jeff village board weighs historic preservation, density and conservation,” April 29, TBR News Media website.] 

It would have created a special permit application to allow the village board to designate specific parcels that contribute to Port Jefferson’s architectural and aesthetic character. 

If approved, an applicant meeting these criteria would have qualified for relaxed standards for land use, allowing for additional height and stories without additional clearing.

During the public comment period Monday night, former village trustee Barbara Ransome addressed the continuing concerns over the property.

“I’m hoping that there are no quick decisions about changing codes for potential developers,” she said. “I think we heard at the [May 1] public hearing a lot of concern about the infrastructure, about losing a wonderful area that people feel is just going to be too crowded with that kind of density.”

Reorganization

But not all went smoothly at Village Hall.

Trustee Stan Loucks, who ran in this year’s village election alongside mayoral candidate Kathianne Snaden, left directly after the board’s reorganization meeting, skipping the general meeting altogether after Sheprow revealed he would no longer serve as liaison to the Port Jefferson Country Club.

“I feel very strongly that I’ve had an impact on the resurgence of the country club,” Loucks said. He went on to say that he did not think he could “work any further with this board.” 

Village clerk Barbara Sakovich will leave the village government after more than 13 years in that role. Her retirement will take effect July 19. The trustees expressed their gratitude for her years of service. Silvia Pirillo will take over as the new clerk.

Sheprow appointed trustee Rebecca Kassay as deputy mayor and commissioner of environmental stability.

“It is an honor to step into the position of deputy mayor because it helps me better serve the village and work [especially with] flood resilience and climate studies,” Kassay said in an interview after the meeting. 

“I’ve been talking to organizations like [the United States Geological Survey], and having the title of deputy mayor shows that the village is taking these climate resilience issues very seriously,” she noted. “I’m very glad to be representing the village in this way.”

Trustee Bob Juliano will serve as commissioner of public works and parks. Loucks was appointed commissioner of recreation, and newly appointed trustee Drew Biondo will be commissioner of buildings and communications.

Harry Faulknor will continue as the Port Jefferson Harbor commissioner.

Sheprow will serve as commissioner of finance and public safety/court/code.

A motion to appoint Donald Pearce as village treasurer failed — he held the post previously before resigning in 2015. Juliano suggested that while Pearce is excellent to work with, he was displeased that Denise Mordente was not reappointed.

Public safety

The general meeting started with a brief presentation from Code Enforcement Bureau chief Andy Owen and chief of patrol James Murdocco.

Owen clarified that the code department does not save and store private information through its automatic license plate readers, which are used to identify if a car has a valid Port Jefferson parking permit or a meter is paid.

He also announced that foot patrols downtown would begin after this weekend’s Port Paws Dog Festival. Owen said he is also planning on starting a bike patrol unit.

In June, 60 incident reports were written, consisting of noise complaints, traffic conditions and public disturbances.

A total of 206 summonses were written in June for incidents such as uninspected vehicles, missing license plates, parking without a permit or overtime meter parking. 

Murdocco reported there have been over 200 incidents at the Port Jefferson train station since January, with many happening after 9 p.m.

Murdocco also announced the start of an informational Facebook page for the code bureau.

Public comment

During the public comment portion, held before the trustee reports, multiple residents voiced concerns about the potential overdevelopment of the park at Roosevelt Avenue. Myrna Gordon, along with other residents, suggested these developments would not be conducive to the area’s quiet character.

Sheprow announced a planned Parks and Rec Advisory Council meeting on July 26. All residents of the Roosevelt Avenue area are invited.

Michael Mart also touched upon the issue of transient housing — such as Airbnb facilities — in Port Jefferson, expressing a desire for the board to limit the rental time of a house to 30 days per renter.

After a resident asked how villagers could get involved with the different committees and task forces, Kassay said they are currently working on an online forum where residents could enter their information and the committees on which they would like to participate.

Reports

Juliano announced he would be starting office hours and that his door was always open. He also said that he gave the interim attorney a proposed code change so that when developers apply through the Industrial Development Agency for pilots or property tax exemptions, they would start at whatever they were paying now instead of at zero.

Biondo shared that he had toured a few of Port Jefferson’s facilities as the liaison to building and planning. He said he would discuss with the mayor and village attorney how they can streamline government processes.

Kassay said the Complete Streets and Walkability Plan is moving forward. She also said the board is still working on mitigating flooding challenges, though the problems cannot be eliminated. However, they are working on a study to see which areas need to be focused on for flood mitigation.

Kassay and Andrew Kelly, from Hauppauge-based VHB civil engineering company, are working on assisting grant writers with the documentation needed to apply to the New York State Environmental Protection Fund to progress to the next step for the planned Six Acre Park, which consists of taking a concept and making “show ready” plans for the park. 

Sheprow announced she had appointed an ethics attorney to update the village’s ethics code. She also said that she has met with representatives from Stony Brook University’s Student Affairs office, and they have expressed interest in using Port Jefferson as a “living laboratory.”

The Board of Trustees also passed a resolution to create a budget and finance committee, and has been working to recruit members of a short-term and long-term rental evaluation working group.

Sheprow added that the board is considering establishing a working group to advise on policies related to the Port Jefferson Power Station to explore declining public revenue and possible repowering.

The board will reconvene Monday, July 24, at 3:30 p.m.

With an approaching May 1 public hearing on the Maryhaven Center of Hope property on Myrtle Avenue, tensions are simmering within the Village of Port Jefferson Board of Trustees.

During an April 18 business meeting, trustee Lauren Sheprow clashed with Mayor Margot Garant and members of her administration over “the process” in which potential zoning code changes have been handled to date. This dispute comes as the village enters the heart of election season, with decisions over term extensions, term limits and election administration hanging in the balance.

The Six Acre Park Committee also inched closer toward a concept plan for the last remaining tract of undeveloped open space in Upper Port.

Maryhaven

As the village board prepares for the highly anticipated May 1 public hearing, Sheprow is at odds with some of her colleagues over how decisions with the property have been advanced. “I’m wondering about the process,” she said.

Responding, Garant said deliberations over Maryhaven predate Sheprow’s entry to the board in July 2022 as the previous board held a work session approximately 18 months ago with Alison LaPointe, former special village attorney for building and planning. At the time, LaPointe had advised the board to consider rezoning the property, the mayor said.

Gradually, the matter has become a question of historic preservation as maintaining the existing building is in the village’s interest, Garant added. 

“We’d like to see the building be maintained or preserved somehow,” the mayor said.

Village attorney Brian Egan gave additional context, saying the process began in 2019 when Catholic Health notified the village it would sell the property. The issue, Egan noted, lingered for some time though Garant started pushing for the structure’s preservation.

“It became the village’s initiative — the mayor’s initiative — of engaging with Catholic Health, saying, ‘We’re going to work toward trying to save that building,’” Egan said. “That was really impetuous and got us to this point to say, ‘How can we save the building for an adaptive reuse as opposed to putting it all into a landfill.’”

He continued, “The policy of the Village of Port Jefferson — hopefully, if this board adopts it — is to preserve the historic building that’s on it and encourage its adaptive reuse as opposed to demolition.” Egan added, “The ideal process is to draft the zoning that this board wants to see, and make the developers work to that standard.”

Sheprow expressed her appreciation for Egan’s clarification, adding, “I appreciate that explanation very much, just would have loved to have had that before opening it up for a public hearing so that we all kind of understood the entirety of the concept.”

The board agreed to set a work session on Tuesday, April 25, at 2 p.m. to discuss the matter further.

Elections

Trustee Rebecca Kassay reported she had received resident interest in creating a task force to oversee the restructuring of village government and elections, exploring issues such as term limits and extensions, change of election month and counting ballots by hand or machine.

Sheprow shared that PJV is working to obtain a document from the Village of Southampton for reference. Southampton “had a panel that went through this process,” she said. “So maybe we can use that document as a guide to help look at best practices.”

Conversations surrounding election changes were prompted by a notification from the Suffolk County Board of Elections that its electronic voting machines would not be made available to the village, to be used instead for primary elections this June.

Sheprow inquired whether the village could rent or purchase voting machines to administer the upcoming June 20 election for village mayor and trustees, especially as at least two other Long Island villages will be using such devices.

Egan clarified the legality of this proposal. The village attorney cited the New York State Election Law, which bars villages from renting machines from vendors outside their county BOE.

“It’s not a question of the integrity of the machines,” the village attorney said. “It’s a question about whether the Election Law will allow us to do it, and the Election Law is very clear that it does not, and [the New York Conference of Mayors] is very clear that it does not.”

Six Acre Park

The Six Acre Park Committee met with the board, along with representatives of the Hauppauge-based civil engineering company VHB, toward finalizing conceptual plans for the 6-acre parcel along Highlands Boulevard.

Garant outlined the committee’s purpose and the current status of the project. “The whole reason why we got this structure in place with the committee and the design team of VHB is because there’s a New York State grant that we are positioning ourselves to make an application for,” the mayor said. “We’re just trying to get to that point where we have what we need to make a submission.”

Andrew Kelly, a VHB landscape architect, presented three concept plans to the committee and board. Kelly said most spaces within the 6 acres would be open, tree-lined areas with native plantings. All options accommodate a realignment of, and on-street parking along, Highlands Boulevard.

Plans are to include security lighting, Kelly said. Kassay, trustee liaison to the Six Acre Park Committee, added that transitioning this area into parkland would discourage people from camping on-site.

“Projects like this have been proven to greatly increase the safety and security of an area,” she said.

The next steps are to decide upon a conceptual plan, likely integrating elements of all three concept proposals presented during the meeting. The mayor added that the board would soon return for a final round of public input as it completes the conceptual planning phase.

Study could help officials push along revitalization

An upcoming study of blight along Main Street in uptown Port Jefferson could help the village revitalize the area, according to the officials who set it into motion.

The board of trustees approved the study at a recent meeting, in part to identify properties that potentially could be seized through a process called eminent domain, in which a municipality takes control of land to perform a public benefit and compensates the owner. Although eminent domain is classically used for public works projects like building new roadways or widening existing ones, Village Attorney Brian Egan explained that the Port Jefferson government could use the coming analysis of blight uptown as ammunition to make a case for applying eminent domain to less common purposes.

Seizing blighted properties along Main Street in the village’s troubled uptown area could help officials push along their revitalization efforts there.

Although cleaning up upper Port and creating a more pedestrian-friendly district with both business and residential space has been a priority for some years, progress has been slow. Residents and some local business owners have been calling for improvements as well, citing safety concerns stemming from a roaming homeless population and drug-related crime. One of the more recent and most visible changes to Main Street occurred when the decrepit, crumbling diner — previously known as the Station Diner and the Old Port Diner — was demolished in January, after months of discussion between officials and the property owner. However, a new building has still not been erected in its place.

East Coast-based engineering firm VHB is conducting the blight study. That firm is no stranger to Port Jefferson: In addition to various work around the village, the engineers have completed other projects specifically for the uptown area in the past, including a traffic study that was included in the upper Port revitalization section of the village’s new comprehensive plan.

When the trustees approved the new study on Nov. 2, they specified that it should not take more than 12 weeks to complete.

Work will add parking spots, greenery near historic area

Village officials have lined up a construction company to redo the parking lot behind the Fifth Season restaurant, recently dubbed the Baker’s Alley lot, as part of a larger project that aims to restore a downtown historical area.

The Port Jefferson Village Board of Trustees hired East Moriches-based Rosemar Construction, the lower of two bidders on the work, at its meeting on Monday night. At the municipal lot by Mariners Way, the work includes repaving and striping, putting in a pedestrian walkway and adding landscaping.

In addition to the parking field east of Mariners Way, the lot includes 14 spaces in a strip on the road’s western side.

Restriping will make room for seven to eight more parking spots, Mayor Margot Garant said at the meeting.

It will also eliminate a dead end in the middle of the parking lot, improving access for public works employees when they remove snow from the village’s lots in the winter.

East Coast-based engineering firm VHB — the group that put together the construction drawings and plans for redoing the metered parking lot based on designs by Port Jefferson’s Campani and Schwarting Architects — still has to review Rosemar’s bid, which came in close to $350,000 and will be funded by village parking meter revenue.

“I’m told that this is quite a good price,” Trustee Larry LaPointe said. “VHB expected it to come in significantly higher.”

Officials are now calling the area the Baker’s Alley parking lot, making it the namesake of a nearby path the village is working to restore. Baker’s Alley was, in turn, named as a nod to Port Jefferson’s so-called bakery wars that took place there in the early 1900s, in which William West’s New England Bakery famously competed with another local shop. The feud fully erupted in 1916, when both owners changed the establishments’ names to Port Jefferson Bakery.

The now-overgrown and often overlooked dirt path starts at East Main Street, heads down to the parking lot and turns north toward East Broadway. Village officials are looking to turn the alley into a brick walkway, with classic lighting and native plants along the way. After turning north, it would run along a short stone wall as it passes between the parking lot and adjacent businesses, then connect with the small Founders Park at East Broadway.

The village has not yet received bids on the alley portion of the project, LaPointe said, but officials want to get moving on the parking lot work.

“We need to get started as quickly as possible so we don’t interfere any more than necessary with the use of that lot in the high season.”
