Suffolk County District Attorney Raymond A. Tierney on Dec. 8 announced that Ralph Pergola, 44, and Kristen Allen, 35, both undomiciled, were each indicted for alleged multiple counts of Burglary and other related charges, after allegedly breaking into and stealing from six small business in Suffolk County, including smoke shops, diners, a café, and a bagel shop, in less than a month’s time.

“Small businesses are the heart and soul of Suffolk County,” said District Attorney Tierney. “My office is dedicated to ensuring our local businesses thrive by rigorously prosecuting criminals who would pillage and steal from them.”

According to the investigation, from September 30, 2023 to October 23, 2023, between midnight and 5 a.m., Pergola and Allen allegedly burglarized multiple commercial businesses. To gain entry into the commercial establishments, Pergola would allegedly smash the glass door with a rock. Once the glass shattered, Pergola and Allen would allegedly enter the business to steal items. In total, the defendants allegedly stole approximately $1,500 in cash, cigarettes, candy, and an iPad.

Pergola is accused of burglarizing the following commercial business:
 September 30, 2023 – Heritage Diner, 275 Route 25A, Mount Sinai.

Pergola and Allen are accused of burglarizing the following commercial businesses, together:
 October 19, 2023 – Setauket Village Diner, 238 Route 25A, East Setauket.
 October 19, 2023 – Café Spiga, 176-8 North Country Road, Mount Sinai.
 October 21, 2023 – Smoke Shop and Hookah, 115 Mark Tree Road, Centereach.
 October 22, 2023 – Port Smoke, 683 Old Town Road, Port Jefferson.
 October 23, 2023 – Better on a Bagel, 25 Gibbs Road, Coram.

Pergola and Allen were arrested by members of the Suffolk County Police Department on October
23, 2023.

Pergola was indicted for:
 Six counts of Burglary in the Third Degree, Class D felonies;
 Five counts of Criminal Mischief in the Third Degree, Class E felonies;
 One count of Criminal Mischief in the Fourth Degree, a Class A misdemeanor; and
 One count of Loitering in the First Degree, a Class B misdemeanor.

Allen was indicted for:
 Five counts of Burglary in the Third Degree, Class D felonies; and
 One count of Loitering in the First Degree, a Class B misdemeanor.

On November 28, 2023, Allen was arraigned on the indictment before Acting Supreme Court Justice, the Honorable Anthony S. Senft, Jr. Justice Senft placed her on supervised release with GPS conditions. Allen is being represented by The Legal Society. She is due back in court on January 5, 2024.

On December 8, 2023, Pergola was arraigned on indictment. Judge Senft placed Pergola on supervised release with GPS conditions. Pergola is being represented by John Halverson, Esq. He is due back in court on January 17, 2024. If convicted, both defendants face up to two and one-third to seven years in prison on each burglary charge.

This case was indicted by Assistant District Attorney Patrick Mullen of the Grand Jury Unit and is being prosecuted by Assistant District Attorney Keri J. Wasson of the Major Crime Bureau.

Suffolk County Police arrested an Islandia man on Nov. 11 for allegedly burglarizing four businesses a total of 14 times during the past 11 months.

Following an investigation by Fifth Squad detectives, Christopher Lacker was identified as the man who allegedly committed multiple burglaries at storage facilities within the confines of the Fourth and Fifth Precinct between December 7, 2022 and November 9, 2023. During each burglary, Lacker allegedly entered storage facilities, cut locks from individual storage units, and stole property from within. Lacker, who was located by detectives at his home on November 11 at 4:33 p.m., burglarized the following locations:

• Public Storage, located at 770 Nesconset Highway in Nesconset, on December 7, 2022.
• Extra Space Storage, located at 3016 Express Drive in Islandia, on February 24 and 28,
September 29, October 3, 4, 13 and 14, November 8 and 9, 2023.
• Extra Space Storage, located at 1590 Lakeland Ave. in Bohemia, on September 27, 2023
• Public Storage, located at 745 Calebs Path, Hauppauge, on October 16, 2023.

Lacker, 42, was charged with 14 counts of Burglary 3rd Degree and one count of Criminal Possession of a Controlled Substance 7th Degree.

Suffolk County Police arrested a Kings Park man on Aug. 9 for allegedly burglarizing more than a dozen businesses throughout the county since May.

Robert Porter was sitting in an abandoned vehicle on First Avenue in Bay Shore at approximately 4 a.m. when Third Precinct Anti-Crime Officers Jeremy Reichling and John Tighe observed him in possession of cocaine.

Following an investigation by Third Squad detectives, along with First and Fifth Squad detectives, Porter was charged with burglarizing the following businesses:

*   The Hero Joint, 182 West Main St., Bay Shore, on May 23 at approximately 1 a.m.
*   Tequila Sunrise Wine and Liquor, 1752 Sunrise Highway, Bay Shore, on May 25 at approximately 10:30 p.m.
*   DMS Smoke Shop, 190 Islip Ave., Islip, on June 19 at approximately 1:25 a.m.
*   DMS Smoke Shop, 190 Islip Ave., Islip, on June 26 at approximately 11:30 p.m.
*   USA Gas, 225 Higbie Lane, West Islip, on June 29 at approximately 1:55 a.m.
*   Parkway Express Gas, 1490 Brentwood Road, Bay Shore, on June 29 at approximately 11:30 p.m.
*   Shell, 4576 Sunrise Highway, Oakdale, on July 18 at approximately 12:55 a.m.
*   D & B Beer & Smoke, 4509 Sunrise Highway North Service Road, Bohemia, on July 21 at approximately 1:30 a.m.
*   Lindenhurst Smoke Shop, 50 West Montauk Highway, Lindenhurst, on July 22 at 2 a.m.
*   Shell, 4576 Sunrise Highway, Oakdale, on July 25 at 4 a.m.
*   D & B Beer & Smoke, 4509 Sunrise Highway North Service Road, Bohemia, on July 26 at approximately 12:45 a.m.
*   Hershey’s Ice Cream Shop, 470 Union Blvd., West Islip, on July 31 at approximately 3:30 a.m.
*   Bang Bang Burritos, 464 Union Blvd., West Islip, on July 31 at approximately 3:35 a.m.
*   Le Belle Nail & Spa, 1201 Sunrise Highway North Service Road, Bay Shore, on August 2 at approximately 5 a.m.

During the burglaries, Porter allegedly stole cash, liquor, cigarettes, vaping products and lottery tickets.

Porter, 55, was charged with 14 counts of Burglary 3rd Degree and one count of Criminal Possession of a Controlled Substance 7th Degree. He will be held overnight at the Third Precinct and arraigned on August 10 at First District Court in Central Islip.

A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
