The future of a Stony Brook shopping center has been put on hold until the Town of Brookhaven’s Planning Board members get some answers.

At the town’s Sept. 17 planning meeting, representatives for Little Rock Construction and its president Parviz Farahzad were seeking approval for modifications that were made to site plans to Stony Brook Square, a shopping center under construction across from the Stony Brook train station on Route 25A. A stop work order was issued after town inspectors discovered discrepancies between the site plans and what has already been completed on the construction site.

Among the modifications were the changing of two building locations, handicap accessible parking, cross access and grading.

Farahzad’s attorney, Hauppauge-based Tim Shea, contacted Three Village Civic Association representatives Herb Mones, chair of the association’s land use committee, and George Hoffman, 1st vice president of the association, Sept. 24 to go over the modifications, according to Mones.

“It’s so hard to believe that these kinds of major changes would be made to the site plan without any type of authorization or approval,” Mones said in a phone interview, adding in the past the town, civic association and community members provided input for the location’s plans.

Mones said a major objection from members of the civic association is the entryway changing from the initially approved 24 feet to 30. This adjustment means the largest building on the property is shifted 5 feet to the west from the original plans and closer to the historic home on the 3-acre site that Mones said during 25A visioning community meetings residents felt was essential to preserve and feature in the project.

At the Sept. 17 meeting, Farahzad’s engineer Michael Williams said his office was contacted earlier this year by the applicant to review claims by the site contractor that there were issues with Americans with Disabilities Act compliance in front of the building. He said the cross slope through the handicap accessible parking and access aisle was too steep pursuant to federal regulations. To alleviate the issue of the ADA ramp’s cross slope, the elevation of the site closest to the driveway entrance was changed, and the site was flattened, which increased the size of the entranceway.

Mones said the civic association also has issues with an area that was designated for land banking now being used for 19 parking spots. He explained that land banking allows for an area to be landscaped until it is proven a business owner needs it for parking.

He said while he appreciates the town was alerted to the changes and put a stop work order on the construction, he believes it still poses problems.

Mones said representatives from the civic association would be attending the Oct. 1 Planning Board meeting.

“We think that the town should adhere to the site plan that was developed, and since the project is far from being completed, it shouldn’t be difficult for [the developer] to adhere to the site plan that they originally planned on with the town, with the town planners and with the community,” Mones said.

The Planning Board members put their decision on hold until the Oct. 1 meeting, and Farahzad was advised to bring updated site plans Oct. 1 and to consult with the Three Village Civic Association about the modifications.

“I would like to see a plan that shows what’s existing — not proposed — and what we had previously approved and what has changed,” said assistant town attorney Beth Reilly at the Sept. 17 meeting. “Because when you look at this it looks like nothing is out there, but that’s not what our inspectors found when they did a stop work order on this job. I feel like the plans still don’t match what we’re being told.”

Farahzad did not respond to requests for comment.

The Town of Brookhaven is in the final stages of deciding whether to allow a controversial retirement community to be constructed. 

Commack-based Heatherwood Luxury Rentals has proposed plans to build on nearly 26 acres of its more than 70-acre golf course on the southeast corner of Arrowhead Lane and Route 347. It was put on the planning board’s decision calendar at its July 9 meeting, and now they have 62 days from July 9 to render a decision.

If approved, the company would construct Heatherwood Golf at Setauket, a 55 and over community with 200 rental housing units, 403 parking stalls and additional garages. Heatherwood also plans to redesign the golf course, reducing it from 18 holes to nine. The property falls in both the Comsewogue and Three Village school districts.

John Gobler, a 48-year homeowner in Heatherwood Village South in South Setauket, attended the July 9 meeting objecting to plans for the new development having only one entryway to exit and enter, which would dump traffic onto Arrowhead Lane. He said the intersection of Arrowhead Lane and Route 347 has been a problem for several years due to the number of cars exiting onto Arrowhead and the timing of lights at the corner, where he has witnessed only four or five cars being able to go through a green light.

He questioned a traffic engineering study by Stonefield Engineering & Design, LLC conducted June 13 of the traffic volume count of cars exiting Arrowhead to Route 347. He said the company found a total of 183 cars during 7 to 9 a.m. and 141 vehicles 4 to 7 p.m. Gobler said he sat at the intersection and monitored traffic for a 20-minute period, 8:55 to 9:15 a.m. three separate days when school wasn’t in session and counted exiting cars from Arrowhead. His average was 89 for the 20-minute intervals, which would be 266 cars during the morning rush hour. He said Stonefield’s count of 183 cars over a two-hour period would mean only 31 cars every 20 minutes.

Frank Filiciotto, a traffic consultant with Stonefield, said there are always spikes in traffic, which could account for Gobler’s observation. He also said the 183 and 141 numbers represent one-hour volumes within the periods of time specified and not the entire time specified. He said the company has been monitoring traffic in the area for four years. One observation of cars entering and exiting nearby Fairfield Knolls North by the company showed a daily total of 218 cars observed during 7 to 9 a.m., 2 to 4 p.m. and 4 to 7 p.m. Stonefield broke the figures down to 60 in the morning period, 80 from 2 to 4 p.m., and 78 during the evening period. The monitored development is 0.65 miles northeast of the proposed apartments and is also age restricted. The company prorated the numbers since Fairfield Knolls has 91 more units than what is proposed for Heatherwood. He said the amount of traffic was similar to what they originally projected and should not negatively impact the area.

“This isn’t assumption,” Filiciotto said. “This isn’t opinions. This is fact. We went out, and we calculated the amount of traffic Fairfield North was generating during peak hours.”

In 2014, Councilman Dan Panico (R-Manorville) sponsored the resolution for a zone change for the property from A Residence 5, which allows one housing unit for every 5 acres, to Planned Retirement Community, which would allow a 55 and over community. On Dec. 16, 2014, the town board approved by a 4-3 vote. Councilwomen Valerie Cartright (D-Port Jefferson Station) and Connie Kepert (D-Middle Island) as well as Supervisor Ed Romaine (R) dissented. 

The town board placed conditions on its zone change approval, including requiring Heatherwood owner Doug Partrick to donate 40 acres of land to the Manorville Farm Protection Area, removing a billboard at the golf course and constructing a sidewalk on the east side of Arrowhead Lane. Panico’s office confirmed the town accepted the 40 acres of property in 2015 in lieu of the Pine Barrens Credit redemption required under the Planned Retirement Community code.

Development of the golf course has faced opposition from elected officials and local civic associations since it was first presented in 2014. Cartright remains opposed to the project as it stands, according to her legislative aide Jennifer Martin. 

Herb Mones, chair of the Three Village Civic Association’s land use committee, said the civic group opposed the initial zone change for the golf course, and he said many felt it was controversial due to the town board approving it over the objections of Cartright.

“The overpacking of the site with housing, adjacent to a residential neighborhood, and built on an already highly trafficked Route 347 demonstrates poor planning,” he said.

Sal Pitti, president of the Port Jefferson Station/Terryville Civic Association, said the group still stands opposed to the development.

“The community spoke in force back when the project was proposed, and they said we don’t want it,” Pitti said. “The aspect that bothered us the most for the acceptance of the project was that a donation of land went to another council district instead of ours.”

The Town of Brookhaven is ensuring a trip to a local beach remains educational as well as enjoyable.

The town board unanimously approved a license agreement between Brookhaven and town environmental educator Nicole Pocchiare June 14. The agreement allows Pocchiare to reside at the house known as the ranger’s cottage at West Meadow Beach.

Councilwoman Valerie Cartright (D-Port Jefferson Station) said she was pleased about the board voting unanimously in favor of the license agreement and understanding the importance of having a continuous presence at the beach.

“I think having an environmental educator present at West Meadow Beach is a benefit to the entire community,” Cartright said. “It allows her to keep a close eye on the sensitive ecosystem there and also provide programs in a manner that’s not ‘9-to-5-ish.’ She does programs early in the morning — she has late evening programs — and I think that the community is appreciative of that.”

Eileen Gerle became the first environmental educator for the town in 2009, and when she retired in October 2014, Molly Hastings took over the position until her suspension in September 2016, which the town has not provided a reason for. While Pocchiare has been an environmental educator for the town since April 2017, Cartright said it took some time before someone could live at the cottage again after Hastings left because the town councilmembers felt it was beneficial to set up a license agreement, where the resident could only live in the home as long as they were a town educator.

Cartright said residents have been consistent in their requests that they wanted someone present at the cottage at all times.

Civic leader Herb Mones, from Stony Brook, is one of those residents. He said he calls West Meadow Beach the “Fire Island of the North Shore” due to the similarities in views and native species, and feels it’s important the town has someone in place to educate beachgoers about its importance.

“I think it’s critical because it not only fulfills the state law for the preservation of West Meadow that stipulates that there be an environmental educator at the park, but what it does, it brings about a growing awareness and an appreciation for the ecosystem and the environment which is developed by their programs,” Mones said. “I think the more robust the program, the better the future for the park and the preserve.”

Pocchiare said she was excited to hear of the board’s approval because she feels it will make her job a bit easier living on the beach and also being close to West Meadow Creek. Currently, she has been traveling from her office at Brookhaven Town Hall whenever there is a program at the beach or someone is needed there. The educator said being on the grounds will make it easier to help representatives from organizations who may need to work on the site early in the morning or late at night. Most important of all, residing at the cottage will provide her more opportunities to interact with the public, even outside of town programs.

“It increases the appreciation and increases then the conservation of the beach,” she said. “Even if it’s just a tidbit that they learn, it brings them closer to the beach and the creek.”

Pocchiare said programs for the current year include educational activities for all ages including nature exploration, full moon and nature walks, and birding by the beach.

The educator, who currently lives in Selden and grew up in Holbrook, said she remembers going to West Meadow Beach for the first time 10 years ago and meeting Gerle.

“I remember loving this little beach,” she said. “I was used to the South Shore because I was a Sachem girl and grew up in Holbrook. But I think I’ve grown to really love the North Shore beaches. The sand flats that West Meadow has and those beautiful sunsets because of it being situated from north to south, overlooking the west. And then having the creek and the salt marsh on the other side of Trustees Road is something so unique to West Meadow which sets it apart from all the other beaches.”

The Three Village Civic Association is taking action to prevent a gas station from “changing the scenery” in the area.

Magid Setauket Associates LLC, owner of Shell gas station on Route 25A and Jones Street, applied for variances to the Town of Brookhaven Board of Zoning Appeals in the beginning of March. The company submitted proposed plans to construct a large canopy and a lighted electric sign at the gas station.

Members of the civic association have expressed concerns over the proposed plans to build the fuel canopy, which would measure 79 feet in length, 26 feet in width and approximately 25 feet in height, setback 14 1/2 feet from 25A, which is less than the distance required by the town. The company has proposed plans to install a 72-square-foot freestanding ground sign that exceeds the 24 square feet permitted by Brookhaven, with a maximum illuminance that also surpasses the town’s requirements.

After receiving news of the proposed variances, the civic association informed its members via email and stated that between a seven-mile stretch along 25A, from St. James to Port Jefferson, there are no gas station canopies.

“This canopy and the associated digital sign would make this a precedent-setting project which would open the door for all the other stations along 25A to do the same,” the email read.

Representatives from Magid Setauket Associates were originally scheduled to
appear before the board March 21, but due to inclement weather, the meeting was postponed until March 28. The company’s
petition was then scheduled as a holdover for the board’s April 18 meeting.

Herb Mones, chair of the civic’s land use committee, said he is hopeful the postponement may mean the applicant is rethinking their proposals. He said state Assemblyman Steven Englebright (D-Setauket) and town Councilwoman Valerie Cartright (D-Port Jefferson Station) wrote letters to the town’s Board of Zoning Appeals to oppose the station’s request for variances.

“The large canopy proposed by the Shell station is unusual and out of place in our historic downtown Setauket,” Mones said. “Simply put — it overwhelms the sense of place we have worked so hard to preserve and protect in the Three Villages. The electronic sign, positioned close to the roadway, may be well suited for a four-lane highway, not for our historic Main Street.”

The civic association was one of the key organizations involved in the Route 25A resident visioning meetings that were spearheaded by Cartright in 2017, and its officers have discussed changes at the Shell station with Magid Setauket Associates in the past, including the addition of a convenience store, according to George Hoffman, the civic’s first vice president.

“We opposed the plan, citing the location and limited parking space on the property,” Hoffman said. “The civic association hopes the current plan is not a way to gain approval by seeking several variances from the ZBA and, once in hand, seeking the final approval for the convenience store.”

Omar Ishtiaque, who owns Cupeez Drive-Thru less than a quarter of a mile west from the Shell station, said he and a few of his customers also have concerns. The business owner said he has seen many changes along the roadways since his family opened the store 35 years ago. He said he feels the historical aspect of the village is something that draws people in and makes residents appreciate their surroundings.

“As far as our position on this, we’re basically about how it affects our community, how it affects our children, how it affects the traffic,” he said.

Ishtiaque said while he’s not against development, a sense of place is important to him, and with his own business, he has taken down signage that was near the roadway and has tried to keep the store as traditional looking as possible.

“When a lot of the newer changes come in with corporations funding these type of businesses, yes, it’s great in a lot of ways, but at the same time I think it takes away a piece of our community,” he said.

The Friends of the Greenway is hosting another cleanup event for the Setauket to Port Jefferson Station Greenway Trail on Saturday, Aug. 29, from 8 to 10 a.m.

Volunteers who want to help mow, prune, clip and beautify the community hiking and biking trail should bring gloves, trash bags, clippers, mowers, brooms or shovels along with any gardening tools. The helpers can choose an area on the trail to beautify and head straight to work — but please contact Charlie McAteer from Friends of the Greenway at [email protected] to report the location — or they can report to one of the trailheads for an assigned task.

Participants can also help distribute information to trail visitors at either the Port Jefferson Station end or the Setauket end of the trail.

The Greenway Trail runs between Limroy Lane in East Setauket and the New York State Department of Transportation parking lot in Port Jefferson Station, near Route 112 at Hallock Avenue.
