Northport-East Northport school officials are asking their residents to call on elected officials for immediate help finding a resolution to their seven-year legal battle against Long Island Power Authority.

Northport school district held a call-to-action forum May 30 in which it asked all residents to reach out to their state and federally elected officials to take action in bringing about a solution to the district’s lawsuit against LIPA and National Grid as a June court date looms.

Assemblyman Andrew Raia (R-East Northport) were distributed for residents to sign and mail in to lawmakers. These letters call on elected officials to take action to help aid the school district stave off LIPA, which seeks a 90 percent reduction in taxes — a difference of approximately $56 million down to $8 million paid to the district — before the state Legislature’s sessions end June 20.

“LIPA must be stopped before it is too late,” reads a letter pre-addressed to Raia. “We are seeking your assistance in calling upon the governor to provide immediate assistance in Albany. Action by the governor’s office can stop the imminent harm to us as taxpayers, to our schools, our students and the community at large.”

As the June 11 court date rapidly approaches, Banzer and the Northport school district are pushing state officials to approve what they are putting forth as two possible solutions.

First, would be the passage of pending legislation of state Senate Bill No. S08235, sponsored by Flanagan with co-sponsor state Sen. Ken LaValle (R-Port Jefferson), and its corresponding state Assembly Bill No. A10496, which is co-sponsored by Raia. These bills would lengthen the time frame over which LIPA is seeking to have its taxes gradually reduced from nine years to a proposed 15 years. It would also grant those municipal governments and school districts who lost a tax assessment challenge to LIPA after April 1, 2018, access to the state’s electric generating facility cessation mitigation program, which provides funding to help offset any potential loss of tax revenue. In addition, the town government and schools would be granted the right to create reserve funds specifically for the purpose of reducing the future burden on their taxpayers.

“It would provide some mitigation of the impact to us,” Banzer said. This would provide a glide path, it would provide a somewhat softer landing should there be a [change in] assessment.”

Northport school officials are also asking residents to directly call on Cuomo and the state Legislature to intervene by directing that LIPA, as a utility company overseen by a state-appointed board, to offer a “reasonable and equitable” settlement offer.

While previous settlements have been declined, Banzer made clear, “we would never say we wouldn’t sit down and have conversation on how to mitigate this.”

On May 9, Northport school district attorney John Gross presented his argument in Suffolk County Supreme Court as to why he believes LIPA should be held to what school officials are calling the “1997 Promise.” Under this promise, school officials allege, LIPA and National Grid agreed not to challenge the annual taxes paid on the Northport Power Station as long as they were not abusively increased over time by Town of Huntington. A decision has not yet been issued by Judge Elizabeth Emerson, despite the June 11 trial date approaching.

“I think the community needs to communicate with town leadership,” Northport resident Jennifer Thompson said, citing the years Huntington Supervisor Chad Lupinacci (R) served in the state Assembly. “We need to continue to put pressure on them to speak for us on behalf of the community.”

Councilman Gene Cook (R) said he would call for Huntington Town Board to hold a public hearing regarding using eminent domain to acquire the Northport Power Station.

“LIPA has been lying to us,” Cook said.

The councilman claims that LIPA’s assessed value of $193 million for the Northport power plant focuses only on the electricity produced, but does not account for gas lines, cable transmissions or other public utilities that are received from the power station.

“I’m going to fight this,” he said. “I’m going to fight this to the end and I want you to know that.”

Town of Smithtown officials are counting the days to June 20 to see if state officials will take the necessary steps to help Kings Park sewers become a concrete reality.

Smithtown town board held a special session June 1 to approve an amended home rule bill requesting permission to alienate, or use, 11,000 square feet of parkland to construct a pump station necessary to move forward with sewering the Kings Park business district. The paperwork was overnighted to Albany, Smithtown Supervisor Ed Wehrheim (R) said, in hopes the legislation will pass before the state legislative session ends June 20.

“They are only in session for a few more weeks, if we miss the end of their legislative session it would put that whole project off for at least a year,” Wehrheim said.

Smithtown and Suffolk County require approval from the state to turn parkland located on the property of Smithtown’s Department of Parks building, located at 110 E. Main St. in Kings Park, into a sewage pump station. While the state Senate previously granted its permission, the state Assembly took issue with the town’s request.

“The Assembly takes the alienation of parkland very seriously, there must be an equal or greater amount of land that is sterilized,” Assemblyman Michael Fitzpatrick (R-St. James) said. “There is never a net loss of parkland.”

The Assembly has requested three changes in order for the process to move forward, according to Wehrheim. The first requirement was to permanently preserve an additional 7,000 square feet of open space in exchange for constructing the pump station and to provide an aerial overview of the property to see the layout. Minor wording changes to the legislation were also requested.

“[The Assembly] wanted some additional data to make sure everything passes muster,” Fitzpatrick said.

The Suffolk County Legislature must take up the same amended home rule bill, pass it and send it back to the state legislature for approval as well, according to the assemblyman, for the project to move forward.

Wehrheim said he will be watching and waiting to make sure the alienation bill passes, while the project has funding from the state. New York Gov. Andrew Cuomo (D) has earmarked $20 million for sewering of the Kings Park business district in the 2018 state budget, but it is not in the town’s hands yet.

“We haven’t been notified by anyone or assured that the money will stay there until we are ready to do the project,” the supervisor said. “We are methodically pursuing it.”

Fitzpatrick said home rule requests, such as Smithtown’s to use parkland for the public purpose of creating a pump station to install sewer lines, are usually handled at the very end of a legislative session.

“I have every confidence on the Assembly side that we will get this done,” Fitzpatrick said. “The governor has made a commitment to Smithtown and Kings Park. I think we will continue to keep it.”

The amended bill must also be reapproved by the state Senate, which passed the prior version in May, but has been deadlocked in recent days.

“Once the home rule messages are adopted and filed by the town and county, the Senate has every intention of passing the bill again,” said the office of state Sen. John Flanagan (R-East Northport) in a statement.

The supervisor said the final draft of the Kings Park market analysis study to revitalize the area — in which sewers are noted to play a critical role — is expected to be finished shortly and presented to the public. The study, which cost $200,000 and was paid for by county taxpayers, could become outdated, according to Wehrheim, if the project gets delayed because the state approval isn’t granted this year.

“I understand the town supervisor is worried about getting this done,” Fitzpatrick said. “But it ain’t over till it’s over, and it ain’t over until June 20.”

Huntington town elected officials refused to entertain a request to hire additional legal help in its lawsuit against Long Island PowerAuthority, despite calls from Northport residents for help.

Huntington Councilman Gene Cook (R) offered a resolution at the June 5 town board meeting to hire Manhattan-based law firm Boies Schiller & Flexner LLP as additional legal counsel in the town’s pending tax certiorari case with LIPA and National Grid over the Northport Power Station as the case heads to trial in July.

“I believe this is a very needed law firm to hire at this point,” Cook said. “For the money that this law firm would [cost], it’s a whole lot less than the hundreds of millions we stand to lose.”

A request to hear and vote on a measure was shot down by a 3-2 vote, by Supervisor Chad Lupinacci (R), Councilman Mark Cuthbertson (D) and Councilwoman Joan Cergol (D).

“There are hundreds of thousands — millions of dollars at stake now in this case,” Lupinacci said. “Huntington has been fighting hard on behalf of the taxpayers. We will continue to use all legal options at our [disposal] to make sure LIPA and National Grid honor their contractual promises.”

LIPA filed a tax certiorari lawsuit against the town assessor’s office in 2010 seeking a 90 percent reduction in the tax assessed valuation of its Northport Power Station, and seeking repayment of all taxes it claims to have overpaid since 2010 — currently amounting to more than $550 million and growing.

Cook said the Manhattan-based law firm is one of the top litigation firms in the nation, although admittedly not specialized in cases related to power plants.

“We are losing a huge opportunity and it will hurt everyone out there by not doing this,” he said.

Several prominent Northport residents had pleaded with the town officials to support Cook’s resolution Tuesday afternoon including Northport school board trustee David Stein, who spoke as a private resident in support of the measure.

“LIPA and National Grid have brought in a veritable army of lawyers, lobbyists and [public relations] attack dogs,” Stein said, painting an image of a David-versus-Goliath fight. “The army of attorneys, lobbyists and PR titans that we are against now requires an outsized army of our own. And so, I urge you to engage the services of the biggest, best, brightest and most well-known in all of these areas now.”

Under Cook’s proposed contract, attorneys from Boies Schiller & Flexner would have been paid an hourly rate of not more than $1,650 an hour to assist the town’s current legal representatives from Lewis & Greer P.C. in determining a strategy and arguments for the upcoming trial. These accumulated attorney fees could not be bonded under state law, according to the town supervisor, but would have required dipping into the town’s capital reserves.

“If spending $1,650 were a silver bullet that would achieve something here, I would do it,” Cuthbertson said. “The law firm Cook would like to hire has absolutely no experience in tax certiorari cases that involve power plants.”

Lupinacci said he was willing to consider looking into other prominent litigation law firms which might be able to serve the town at a lower cost.

“Sometimes when [law firms] look at a municipality, they believe they are looking at deep pockets,” the supervisor said. “We have to do some outside the box thinking and leave no stone unturned.”

Northport Village Deputy Mayor Thomas Kehoe and Northport resident Tammy Topel both urged the Huntington town officials to take more aggressive action in light of additional information that has become public — spoken widely about by Cook — calling the Northport Power Station a hub through which natural gas lines and fiber optic networks for internet pass through.

“I believe these are misguided attempts to incorporate other aspects into the valuation process that just aren’t there,” Cuthbertson said. “It’s a red herring and unfair to the public.”

Cook vehemently disagreed with his fellow councilman in open debate.

The town is moving forward by pursuing help from its state elected officials, according to the supervisor, including scheduling a meeting with New York Gov. Andrew Cuomo (D) to garner his support for a resolution to the case. Lupinacci said the town still remains open to negotiations.

“We are always speaking with the other side to see if there is some kind of resolution, but we are probably not going to achieve a resolution that is going to be beneficial to the taxpayers of Huntington and to our students,” Lupinacci said. “We are prepared to take this case to trial.”

Travelers are used to parking their car, but few have likely thought about parking their dog.

The Suffolk County Vanderbilt Museum in Centerport will be the first place on Long Island to host a DogSpot, a smart dog house where pet owners can make sure man’s best friend has a comfortable place to rest while they take in the museum’s exhibits.

“I’ve always felt bad turning away people who weren’t aware they couldn’t bring a dog onto the property even though we have 43 acres,” said Lance Reinheimer, executive director of the Vanderbilt Museum.

In recent years, Reinheimer said he has seen a growing number of visitors who want to bring their canine companions with them while traveling. Unfortunately, this poses a number of issues for the museum, according to the executive director, due to the delicate nature of its exhibits, the Vanderbilt mansion and the potential issues that could arise between dogs and other guests.

Chelsea Brownridge, co-founder of DogSpot, said her smart dog house was designed to offer businesses an alternative to turning away potential customers, or guests, and their four-legged friends.

“We started this company with the mission of giving people a safe way to lead active lives with their dogs,” she said. “They now have a safe alternative to tying them up, as you see in walkable communities, or leaving them in the car.”

Brownridge said a DogSpot modular dog house is made of veterinarian-grade, nonporous plastic fully ventilated with air conditioning to control the temperature. Pet owners can call the museum in advance to reserve the kennel for up to 90 minutes at a time.

“The summer months are a great time to start doing this, as this time of year it gets more dangerous to leave your dog in the car,” she said.

The housing units also contain an ultraviolet sanitation light, built into the roof, that zaps the unit between uses to eliminate any germs or bacteria, according to Brownridge, to prevent the spread of communicable diseases like kennel cough. It is also serviced once per day, cleaned inside and out by hand to remove any muddy paw prints or dog hair.

Reinheimer said the smart dog house will be installed near the museum’s gatehouse, adjacent to the parking lot, as the building is manned round the clock by personnel. That way, if a dog needs help or is in distress,
museum staff will have a way to access the unit and help the animal.

Pet owners can download the DogSpot app on their smartphone, allowing them to view their dog through the dog house’s webcam to check in. There is a 24/7 hotline where users can report any problems, such as a malfunctioning air conditioner or a lost key card.

“Each house is internet connected, so we can handle a number of issues remotely including checking the temperature and unlocking it if necessary,” Brownridge said.

There have been 50 DogSpot houses deployed across Brooklyn outside grocery stores, restaurants and coffee shops as part of a pilot program for the last two years. The company’s co-founder said it went well, but they have temporarily been pulled as they work with city officials to figure out long-term rules and regulations.

“We are currently expanding on Long Island and other places on private properties,” Brownridge said.

One Northport business owner, Flemming Hansen of Copenhagen Bakery & Café, said he already has an interest in having a unit outside his shop. Hansen said he gets a lot of customers who come by with dogs, that cannot be allowed to enter the bakery.

“A lot of people are very protective of their dogs and treat them like a child, they are part of the family,” he said. “I think it would probably do well in Northport and give people in town something to talk about.”

A Smithtown contractor has pled guilty to scamming Hurricane Sandy victims out of more than $100,000, according to the Nassau County district attorney’s office.

Lee Moser, 49, pleaded guilty to third-degree grand larceny, a class D felony, and first-degree scheme to defraud, a class E felony, June 1 in Nassau County Supreme Court before Justice Robert Bogle.

“Superstorm Sandy savaged our communities, and contractors who defraud those who suffered from the storm’s wrath are especially despicable,” District Attorney Madeline Singas said in a press statement. “This unscrupulous defendant took his victims’ money to help them rebuild, regaled them with excuses for delay and never performed the work.”

From April 2015 to August 2016, Moser signed contracts with five Nassau County homeowners to perform work on their homes that have been severely damaged by Superstorm Sandy, according to Singas. In most of these cases, the defendants wrote Moser a down payment check for the work, using funds from New York Rising, made payable to his business Capstone Remodeling.

New York Rising is the state-run program that assists homeowners impacted by natural disasters. The homeowners had applied for and received money from New York Rising to rehabilitate their homes after they were damaged by the Oct. 29, 2012, storm.

Instead of performing the contracted work, Moser repeatedly provided excuses as to why his business had not started, such as he was in the hospital or caring for his sick mother, according to prosecutors. In total, Singas said he is suspected of stealing $113,485 from Nassau homeowners. Moser allegedly spent these funds on gasoline, dining at restaurants, telephone services and other expenditures to continue running his construction business that were unrelated to the homeowners’ contracts, according to the district attorney’s office.

The Nassau County Office of Consumer Affairs received five complaints from victims of Capstone Remodeling between June 2016 and April 2017, which were forwarded to the district attorney’s office. An investigation immediately commenced.

To date, the district attorney said that Moser is currently an unlicensed contractor and has not attempted to repay any of the homeowners.

Moser is due back in court July 12, where he is expected to be sentenced to 45 days in jail and five years of probation, if he pays $50,000 in restitution to New York Rising and pays the remaining amount while on probation. If he does not pay restitution, he would be sentenced to one year in jail, according to the district attorney’s office.

Smithtown supervisor promises to reach out to county to see if traffic signal can be installed

Fort Salonga and Kings Park residents are calling on Town of Smithtown officials for a second time to take steps to address the issue of commercial vehicles cutting through their neighborhood streets.

Several Kings Park residents attended the May 24 Smithtown town board meeting to ask for elected officials help in addressing an increasing number of Dejana Truck & Utility Equipment company trucks driving through their local residential streets, particularly Orchard Drive. Kings Park and Fort Salonga residents have been pushing for the issue to be addressed since February.

“The community is extremely upset,” said Karen Wellus, of Fort Salonga. “Dejana is pretty much running wild and doing whatever they want with very little input from the community and those of us who are affected.”

Dejana currently has an application pending with the town to construct a second building next to its current existing facility, at 490 Pulaski Road in Kings Park, according to town spokeswoman Nicole Garguilo. While the building is under construction, the company has been entering and exiting the site using an entrance on Pulaski Road, which is a county-owned road.

“Dejana Trucking has still not acknowledged the traffic and safety concerns of Fort Salonga residents that we brought to their attention in a petition February 2018,” Orchard Drive resident Kathleen Montemurro said, reading from a letter sent out to the community. “To summarize, Suffolk County mandates that all trucks exiting the new Dejana facility must exit eastbound on Pulaski Road. The most expedient route is to turn around and head westbound through Orchard Drive.”

Melissa Langino, an Orchard Drive resident, said as a mother of four children under age 10 that she is highly concerned about increased truck traffic and possibly larger vehicles coming down her residential block, rather than sticking to larger roadways.

“I think they have a legitimate argument, that if you send traffic out right-turn only they will, but through the residential areas instead of driving all the way north to Main Street in Kings Park to head west,” Supervisor Ed Wehrheim (R) said.

The supervisor said he has instructed members of the town’s Department of Public Safety to evaluate traffic on Orchard Drive while he reaches out to Suffolk County to discuss the issue.

Wehrheim said he has also reached out to Dejana’s attorney Vincent Trimarco to see if the company would be willing to have a traffic signal installed at their property’s entrance on Pulaski Road to allow trucks to safely exit heading westbound. The trucking company would be responsible for paying for the signal’s installation, according to the supervisor.

Trimarco could not be reached for comment by press time, but Smithtown town officials said they’ve been informed that, “his client is willing to work with the community.

The town was also in court against Dejana May 29 for violating the zoning code by allegedly storing commercial vehicles outdoors. Wehrheim said the trucking company purchased a new piece of property, graded it and is allegedly storing trucks there.

“We’ll clean that issue up in court and hopefully have some answers from the county on whether they will make an application to put a traffic signal in,” Wehrheim said.

John "Johnny Boy" Ambrosio admits to being a member of the Gambino family

A Huntington man pled guilty Thursday to participating in a racketeering conspiracy, by admitting his role as an acting captain for the infamous Gambino organized-crime family.

John Ambrosio, 75, was the last of seven associates of La Cosa Nostra, as the crime family is also called, to plead guilty May 31 in United States District Court for the Eastern District of New York to acts including loansharking and running an illegal gambling business, according to prosecutors.

Ambrosio, known as “Johnny Boy,” and his six co-conspirators — including Anthony Rodolico, 46, of Huntington — were arrested by federal law enforcement officials Dec. 12, 2017. Earlier that day, federal officers who executed search warrants at various locations, including a Nassau County storage facility, found and recovered gambling and loansharking records, electronic gaming machines, narcotics and related paraphernalia and numerous firearms, including an AR-15, a .38 caliber revolver and a sawed-off shotgun, according to the U.S. attorney’s office. Law enforcement officials also found letters addressed to Ambrosio from the Bonanno family boss Michael “The Nose” Mancuso and former Gambino family boss John Gotti.

Prosecutors said they believe Ambrosio and his associates engaged in a racketeering conspiracy from January 2014 to December 2017. In entering his guilty plea, Ambrosio admitted to participating in the Gambino family’s activities by extorting a loan from one victim and supervising a gambling business that involved poker games, electronic gaming machines and sports betting, according to the U.S. attorney’s office. Under the terms of his plea deal, he will forfeit $100,000, including $66,116 in cash that was seized from his Huntington home at the time of his arrest.

When Ambrosio and Rodolico are sentenced, they each face a maximum sentence of 20 years in jail. The federal case is being handled by Assistant U.S. Attorney Artie McConnell.

Starting June 11, Huntington Station commuters may want to leave themselves a little additional time to park their cars at the railroad station.

The Town of Huntington announced that it has hired a new contractor to finish up waterproofing the concrete parking deck on Level 2 of the south parking garage at the Huntington Long Island Rail Road station.

“This is one of the many improvements the town has been coordinating with the LIRR at the Huntington train station,” Supervisor Chad Lupinacci (R) said. “This project will make the south parking garage safer for Huntington commuters.”

The work will include replacement of some of the structure’s construction joints, waterproofing of the concrete deck, and then painting on new pavement markings once the waterproofing is complete. It is anticipated the work will take approximately four to six weeks to complete.

The south parking garage will remain open for public use while under construction, according to Lauren Lembo, Huntington public information officer, as the necessary work will affect only a portion of the second floor and all three stairwells. Those areas the town anticipates will be closed or impacted include: the western half of parking Level 2, including the eight handicapped accessible parking stalls; a portion of the entry ramp to Level 2; the ramp from Level 2 up to Level 3; and all three stairwells from the ground floor to Level 5.

“Traffic patterns within the garage will be modified to bypass the construction zones,” Lembo said in a statement.

Those commuters affected should be able to find additional parking across the street from the south parking garage, according to Lembo, and in the town-owned parking lots north of the railroad tracks on the west side of Route 110.

Waterproofing the parking garage’s second level is the last step in long-awaited renovations in a project that has been left unfinished for more than two years. In 2015, the town hired Tonawanda-based general contractor Patterson-Stevens to oversee several improvements to parking garage including waterproofing of the entire structure. Work on the second level of the train station parking was slated to begin the first week in May 2016.

After less than two weeks, the Patterson-Stevens contract was suspended May 9 by the town, who said the company was allegedly violating New York State’s apprenticeship training program. Upon further investigation, town officials terminated the contract Aug. 8, 2016, according to Lembo, claiming that
issues had not been resolved with the general contractor within 90 days.

Lembo said Huntington town officials decided to take over these remaining renovations in-house, having town employees act in place of a general contractor. The list of projects that was undertaken by town employees included painting parking stall lines and traffic signals on the second floor and roof (Level 5), installing handrails and guards for the stairs between floors, and the conversion of some ground-level parking spots to handicapped accessible slots.

The waterproofing of the second floor is the last step that has yet to be completed at this time. The renovations are expected to be finished in July.

Judge rules to adjourn June 11 trial date for LIPA versus Town of Huntington

Northport school officials are inviting all district residents to a community meeting May 30 to address the potential impact of its lawsuit against Long Island Power Authority.

Superintendent Robert Banzer will provide residents with a brief update on the status of the district’s lawsuit against LIPA, legislation and what steps it can take to make sure resident’s concerns are being heard. The high school is located at 154 Laurel Hill Road in Northport.

This is the second meeting the school district will hold this month to address concerns over the LIPA lawsuit. School officials held a May 1 meeting where attorney John Gross presented his argument on why the utility company should be forced to uphold a 1997 promise not to attempt to lower the taxes on the Northport power plant.

LIPA has filed a lawsuit that is currently pending against the Town of Huntington to lower the Northport Power Station’s assessed tax valuation by 90 percent along with a reimbursement of all overpaid taxes since 2010. The Town of Huntington and LIPA appeared in court May 29 after which the judge adjourned the previously scheduled June 11 trial date, according to town spokeswoman Lauren Lembo at 1:10 p.m. Tuesday.

No additional information was immediately available on why the June 11 court date was adjourned.

Hundreds of St. James residents wore red, white and blue this Memorial Day to pay solemn remembrance to those who have served our country.

St. James held its annual Memorial Day parade and remembrance ceremony May 28. The parade stepped off from Woodlawn and Lake avenues at 10 a.m. featuring local marching bands, fire departments and both Boy Scout and Girl Scout troops.

The community gathered for a wreath-laying ceremony outside Saint James Elementary School. Each veterans group laid a wreath to honor its members, before the names of each member of the services who had passed away in the last year was read while a bell was rung.
