Brookhaven Town failed to fully abide by New York’s affordable housing law, according to a state comptroller audit.

The audit, released Jan. 8, singled out eight governments across Long Island, including Brookhaven, zeroing in on their compliance with the Long Island Workforce Housing Act. State Comptroller Tom DiNapoli (D) said the town “generally complied” with the act, but did not properly manage an optional trust fund set aside for affordable housing.

The Long Island Workforce Housing Act was passed in 2008 to require developers building five or more homes on a property to allocate 10 percent of their prospective residential units to affordable workforce housing units, meant for people earning up to about $105,000. The law also said that developers could avoid building affordable housing units by paying a fee to the town, which would be deposited into a trust fund for the purpose of building affordable housing.

The towns of Babylon, Huntington, Islip and North Hempstead and the villages of Hempstead, Farmingdale and Mineola were also evaluated in the audit. Each government either reached or exceeded the 10 percent affordable housing requirement, the audit said.

However, in the audit DiNapoli said Brookhaven adopted a resolution in August 2014 establishing a housing trust fund, but did not set up guidelines and procedures establishing how the expenditures from that fund would be used until September 2015 — which was later than the mandated six-month timeframe required to set up those rules.

The audit noted that “there have been no expenditures from the trust fund during the audit period.”

But Brookhaven officials said they did not agree with the comptroller’s assessment. Diana Weir, commissioner of Housing and Human Services in Brookhaven, said the town was in full compliance before the comptroller released the audit.

“The issue with Brookhaven is that we’ve never given a developer that option,” Weir said about the fees for the fund, which was not mandatory to create. “To us [making developers build the affordable units was] better because we are actually building the units. But just in case we figured we’d [establish] a trust fund.”

Town Supervisor Ed Romaine (R) said he was unhappy with the state’s assessment that the town only generally complied with the law. Because the town makes developers build affordable homes instead of paying to avoid the requirement, there isn’t any money in the trust fund account, Romaine said.

Of Brookhaven’s 924 housing units, 10 percent are affordable workforce housing units, according to the audit.

“What did Brookhaven do wrong?” Romaine (R) asked in a phone interview. “If Brookhaven required [developers] to build [affordable homes], why did we need a trust fund account? We’re actually fulfilling the law.”

In the preliminary draft of the audit, the comptroller suggested the town establish guidelines for the fund. That suggestion came several days after Brookhaven established rules for the fund. Despite this, the final audit didn’t reflect or acknowledge the change.

Brookhaven has always required developers to make affordable homes. During the recession, developers needed to allocate 20 percent of the residential units for affordable housing. Weir said purchasing affordable homes at the time was easier for prospective homeowners as prices of homes dropped. The town dropped the requirement to 10 percent once the market started improving.

“What the audit should have said is, ‘We recommend in the future that you set [the affordable workforce housing trust fund] up, but you’ve complied,’” Romaine said.

Residents and members of the Civic Association of the Setaukets and Stony Brook want more walking and less driving, at least when it comes to the new Stony Brook Shopping Center proposal.

On Monday, Nov. 2, the association met with residents to discuss developer Parviz Farahzad’s proposal of the Stony Brook Square shopping center. His proposal aims to improve the Route 25A corridor across from Stony Brook’s Long Island Rail Road station, which was once known as the old Gustafson property. Farahzad’s Stony Brook Square will include restaurants, a bank and a coffee shop, among other small businesses.

Shawn Nuzzo, president of The Civic Association of the Setaukets and Stony Brook, voiced concerns of residents and civic members, saying the civic had met and discussed the proposal and were contemplating long-term impacts with help from the Three Village Chamber of Commerce and Stony Brook Fire Department.

“For years, the Three Village community has been advocating for a Route 25A corridor study, with hopes of improving the area near the train station,” he said. “Without a comprehensive plan, which examines how an area functions as a whole, we end up with ad hoc planning and dysfunctional neighborhoods.”

Nuzzo said that after meeting with various neighborhood stakeholders over next few weeks, he and the civic plan on submitting comments to the town and developer.

According to Farahzad, creating the plan was a yearlong process. As a Three Village resident he said the center is something that’s “needed for [Stony Brook University … and the community]. He added that he wanted to do something that was attractive for the area.

The proposal falls under the J Business district zone, which means that the developer is allowed to build his desired plan as per a zoning change that took place in the 1990s.

Although he did not attend the meeting and is not fully aware of residents’ concerns regarding the proposal, Farahzad said he might alter the proposal to accommodate various suggestions if necessary. He also admitted that the proposal doesn’t meet the required number of 197 parking stalls. Currently the proposal caters for 139 parking spaces.

According to Nuzzo, no one did anything with the property for years until Farahzad purchased the land. The association was pushing for a plan for several years to get a sense of what that area could look like in the future.

Tullio Bertoli, commissioner of Planning, Environment and Land Management for the Town of Brookhaven didn’t respond to messages when asked to comment on Farahzad’s shopping center plan.

The Huntington Town Board postponed a decision on whether to rezone a historic Huntington village property that once hosted George Washington for dinner in 1790.

The deadline for the decision was Sept. 7, but the board voted to extend that until Dec. 6.

The project area is the site of the former Platt’s Tavern, one of the first buildings in the area. According to town documents, Washington dined at the establishment on April 23, 1790, during a tour of Long Island.

Developer Dominick Mavellia wants to change the zoning of a parcel on the corner of Route 25A and Park Avenue from R-15 Residence District to C-1 Office Residence District to make way for a 10,000-square-foot medical office building at the site. Of that space, GoHealth Urgent Care would occupy 3,000 square feet, and 7,000 square feet would be regular medical office space for North Shore-LIJ Health System.

Part of the plan would also include situating a life-sized statue of George Washington beside his horse on the property.

At a public hearing on June 9, residents said they wanted a more historic look incorporated into the application — particularly with the proposed design of the structure. Supervisor Frank Petrone (D) said the extra time on the decision is in part to afford the developer and the community more time to work on the application.

“The owner of the property continues to work with residents and historical groups to tweak the property to reflect their concerns and comments, so this gives him extra time to do more tweaking,” town spokesman A.J. Carter said in an interview this week.
