Proposal would add community notice, input

Huntington Town residents looking to create two-family homes could face new requirements for approval, if a proposed law gets the green light.

Councilwoman Tracey Edwards (D) is behind a new measure that would change the process for residents to create two-family homes in the R-5 Residence District. Currently, residents are permitted as-of-right to create or convert properties into owner-occupied two-family homes in R-5 without going through any planning or zoning board review. This legislation would mandate owners apply to obtain a special-use permit from the Huntington Town Zoning Board of Appeals, which would review the application on a number of criteria and would also consider community input.

Those criteria include aesthetics, like ensuring the house looks like a single-family home of no more than two stories, and restricting features like exposed cellars, large attics, tall roofs, multiple driveways and decks and
prominent secondary entrances, according to the proposed law. The owner also has to demonstrate to the satisfaction of the board that he or she would sustain “severe hardship” if the application was denied and that the hardship wasn’t self-created.

The goal of the law, Edwards said, is to afford neighbors the chance to comment on the application. Edwards said she was inspired to create this legislation after speaking with a Greenlawn resident who came home one day surprised to find a two-family home in the community.

“You shouldn’t be able to go to work one day thinking that the house being built next to you is a single family and come home from work and find it’s a two-family house,” Edwards said. “Intuitively, that just doesn’t sound like something we want to do.”

It’s not a great number of properties this would affect, according to Edwards. Since 1992, the annual number of permits issued for two-family homes averages about .8 a year. 

Edwards added that the new requirements would bring creating two-family housing in line with the public notice requirements for residents looking to create
accessory apartments.

“I’m not anti-two-family housing, so don’t get me wrong,” she said. “The only thing that I want this to do is to give the property owners the same right they have today, meet the same requirements, but add the fact that a community in your neighborhood that you are building a two-family house [in] should be able to
receive notification.”

When polled about their thoughts on the legislation, which will be up for a town board public hearing next month, Councilwoman Susan Berland (D) and Councilman Gene Cook (I) offered differing views.

Berland said she doesn’t think property owners should have “an unfettered right” to convert a one-family home into a two-family home.

“I’m more concerned about the community than I am about the property owner in this instance.”

The councilwoman said she supports the legislation but hasn’t made up her mind yet on how she’d vote, and she looks forward to hearing what people say at the public hearing.

Cook said he was researching the law. He expressed concern about the legislation being burdensome. “I just think it’s another way of overregulating.”

Richard Koubek, the president of the Huntington Township Housing Coalition, said his group is vetting the proposal at an Aug. 31 steering committee meeting, but at a glance, it appears the that the code change is “a smart move” to involve community input.

“The coalition supports multiple modes of housing and we understand that when you change from the single family to different housing modes, it creates some real nervousness,” he said. “And so the more that we can dispel and control that nervousness on the part of neighbors, with sound, sensible regulations, the better.”

The public hearing will take place on Sept. 16 at 2 p.m.

Town board, hospital ink helipad agreement

Huntington Hospital is flying high.

The town board on Tuesday approved a license agreement with the hospital to use a portion of the town’s parking facility adjoining Mill Dam Park as a helipad. The agreement spans from August to July 31, 2017.

With the helipad, the hospital will be air-transporting, via helicopter, patients in need of urgent or emergent care to the most appropriate health care facility to address their needs. The hospital will also transport “harvested organs to and from the Huntington Hospital,” according to the town board resolution.

“North Shore – LIJ Health System has developed a new air medical service program called SkyHealth, which is staffed by highly skilled medical professionals,” Randolph Howard, vice president of operations at Huntington Hospital said in a statement through a hospital spokeswoman. “Developing a heliport in Huntington provides a key location from which SkyHealth can transport critically ill patients who require immediate medical transportation. Through this heliport, SkyHealth will provide a vital service to the residents of the greater Huntington area.”

James Margolin, an attorney with the firm Margolin & Margolin, said the helipad already exists, but it is in need of an upgrade — one that the hospital will undertake.

“We thank the town board for its continuing commitment to getting the lifesaving community service into effect,” he said.

SkyHealth is a partnership with Yale New Haven Health in Connecticut and the North Shore- LIJ Health System. Patients of both health systems in need of lifesaving care for major traumas, heart attack, stroke and other life-threatening brain injuries will receive emergency medical care by helicopter and be quickly flown to the most appropriate hospital, according to the North Shore-LIJ Health System’s website.

The helicopter would be staffed with a nurse, a critical care paramedic, all certified in New York and Connecticut, and a pilot. That would be the “standard crew,” according to Gene Tangney, senior vice president and chief administrative officer of North Shore-LIJ in a SkyHealth promotional video.

Huntington Hospital will pay the town $14,062 upon the execution of the license agreement, and another $14,062 at the end of the agreement, according to the resolution.

Councilwoman Tracey Edwards (D) requested quarterly reports from the hospital to ensure the volume is “consistent with what we agreed upon.” Margolin agreed to the request.

Public hearing on code changes to take place May 5

Come May 5, the Huntington Town Board will hear from the public on proposed revisions to its own ethics code.

The changes to the code expand who must file a disclosure statement and what must be disclosed. The revisions also include a comprehensive code of conduct for town employees, according to a town statement. The proposal also calls for a plain-language booklet explaining the ethics code, and for the booklet to be prominently displayed on the town’s website.

Tweaks to the code are the product of work between the town’s ethics board and Councilwoman Tracey Edwards (D).

“These changes have been in the works for many months, clarifying portions of the previous code and adding new features to further reassure our residents that Huntington conducts its government according to the highest ethical standards,” Supervisor Frank Petrone (D) said in a statement.

Edwards said the revisions take into consideration comments made by residents at a recent ethics board public hearing.

“This new code incorporates recent ethics changes enacted by the state, state court decisions, language from the New York State Comptroller’s model code of ethics, suggestions from ethics experts and, most importantly, public input at the recent hearing the Ethics Board conducted,” she said in the statement. “The new code also enhances the education requirements, so town officials and employees clearly know what conduct is allowed and what is not. This is a code we can be proud of, and I hope it will be well-received.”

The new version divides the code into three sections: a code of conduct; expanded disclosure requirements; and powers and duties of the Board of Ethics and Financial Disclosure. It expands the universe of people required to file financial disclosures to include policy makers and requires all public officials to disclose specific client information.

Those interested can view the proposed code at the Huntington Town Clerk’s office, and on the town’s website at huntingtonny.gov. Also, Edwards will be meeting with some who made specific recommendations for code tweaks at the ethics board hearing.

The board is expected to vote on the changes at its June 9 meeting, according to the statement.

Also at the April 21 meeting, the board appointed Edward William Billia of Huntington Station and reappointed Ralph Crafa of Northport to the ethics board. One vacancy still remains on the five-member board.
