A new bill sponsored by Suffolk County Legislator Kara Hahn (D-Setauket) has been approved by the county Legislature.

Her resolution requires kits of naloxone — or Narcan, its brand name — to be supplied in close proximity to automated external defibrillators  in all county facilities. The bill was co-sponsored by county Legislator Tom Donnelly (D-Deer Park).

An April 4 press release stated that Narcan “is a lifesaving medication that can reverse the effects of an opioid overdose when administered in a timely manner.” Hahn believes this bill will help to improve the outcomes of the opioid overdoses seen in the county.

Hahn has been passionate about fighting the opioid epidemic for more than a decade now. In April of 2012, she sponsored a resolution which enabled police officers to administer Narcan to overdose victims. The press release for the current resolution noted, “According to SCPD statistics, patrol officers equipped with Narcan have saved thousands of lives in the 10 years since the [original] bill was enacted.”

Old Field resident Carole Trottere came up with the idea for this legislation and brought it to Hahn’s attention only a few months ago.    

“It’s really a no-brainer,” Trottere said. “Put them in wherever we have AEDs. … If you save one life, it’s sparing the parents the horrible grief that I go through and giving someone a second chance to try to get into recovery.”

Trottere has been reaching out to grieving parent groups. “You cannot believe how many groups there are on Long Island alone and nationally of grieving parents who have lost children to fentanyl and overdoses,” she said.

She has also been working with the Suffolk County Police Department’s Behavioral Health Unit. Trottere lost her son, Alex Sutton, to a drug overdose in 2018, and last year planned an event in memory of him at his favorite pizza place. Police attended and carried out Narcan training at the event. This is something they would offer to anyone else who would like to plan an event in memory of a loved one.

According to the press release, the Long Island Council on Alcoholism and Drug Dependence also supports Hahn’s efforts.

She said this bill will be beneficial because Narcan kits need to be readily available. “What is frightening about the disease of addiction is that it can happen to anyone,” she added. “So it does need to be everywhere.” 

Hahn also mentioned that street drugs are now sometimes laced with fentanyl, so someone could be taking what they think is a simple Xanax, but it’s actually unexpectedly laced with fentanyl.

“It’s probably the person who unexpectedly overdoses that will benefit the most from its placement,” she said. “If it’s ubiquitously placed, then more people will be saved.”

Hahn said she’s working with local universities to build the pipeline of clinical social workers, psychologists and psychiatrists that can help people battling mental health issues. She indicated the system is under-resourced, and she would like to work toward strengthening child, adolescent, and adult mental health in our communities.

In a sea of orange and green, Suffolk County officials, community groups and Irish Americans converged upon the H. Lee Dennison Building in Hauppauge on Friday, March 24, commemorating the first-ever Irish American Heritage Celebration in county history.

In 2019, the Suffolk County Legislature unanimously approved a resolution designating March as Irish American Heritage Month. Friday’s event marked the first such celebration sponsored by the county government.

“We’re celebrating the incredible contributions that the Irish have made to the United States of America and to the world,” said Suffolk County Executive Steve Bellone (D).

The county executive also used the occasion to acknowledge the Ancient Order of the Hibernians, an Irish American heritage group with nine divisions across the county, including Port Jefferson, Selden, Smithtown and Huntington. Bellone said the AOH enriches Suffolk communities by celebrating Irish culture while giving back through various charitable endeavors.

Legislators from each of the county’s 18 districts had an opportunity to recognize an Irish American making an impact within their communities. Presiding Officer Kevin McCaffrey (R-Lindenhurst) read off the biographical descriptions of each honoree.

Choral and bagpipe arrangements from several Irish American folk groups were performed, along with Irish historian Mike McCormack detailing the historical contributions of the Irish in Suffolk County.

Can we trust the Suffolk County Legislature?

We have had a “clean water” sales tax for years. When last I looked both Suffolk County and New York State took that “clean water” sales tax money and put it into their general budgets. Suffolk County was taken to court where it lost and was ordered to replace the improperly taken money. Suffolk then claimed this money was needed to offset the costs of COVID-19, won a referendum and never truly repaid this money. I call this legalized “stealing.”

Now we are being asked to increase and extend this legalized “stealing” [through a 1/8-cent county sales tax increase to fund water quality improvement projects, subject to a mandatory referendum]. Additionally, we are being asked to provide politically well-connected persons with positions as “a 17-member wastewater management district board of trustees” to administer this money.

We are told there will be one, countywide, sewer district with “zones of assessment.” Taxes collected within an established zone of assessment would be required to be kept segregated from taxes collected in other zones of assessment, except upon approval by the county Legislature on the recommendation of the district board of trustees.

Dog owners should respect a neighborhood park

Frank Melville Memorial Park in Setauket is a glorious place for all community members to enjoy year-round. It is particularly lovely in the spring when the trees are budding, the swans are nesting, the turtles are hanging out on the logs, the flowers are blooming, and people are emerging from their winter hibernation to walk the paths available for our enjoyment. I am one of those people, a community member who loves to bring her friendly chocolate Lab out for a walk on a regular basis. 

As a responsible dog owner, and more so, a considerate person, I take it upon myself to clean up after my large dog when he decides to do his business on park grounds. Sadly, and disgustingly, there are several individuals who have decided that they are above this inconvenient task and feel it is proper protocol to leave their piles wherever they may land so that others are subjected to not only the sight, but the aroma of their pets’ feces. Despite the fact that the park has not one, not two, but three receptacles and poop bag dispensaries, these individuals cannot be bothered to do what a respectful, unselfish person should do. Today was actually my favorite display as one person had taken it upon themself to pick up the poop, and then left the full bag in the middle of the grass adjacent to the pond. Perhaps this was meant to enhance the view? Seriously, what is wrong with you?

The park has several signs stating that if your dog is unleashed you will be banned from the park. The same standard needs to be upheld for those who choose to befoul these grounds with dog excrement. Besides being unsanitary, it is unfair to those who use the park responsibly and have the decency to leash and clean up after their pets. If you refuse to abide by common courtesy, stay home.

Putting the park into parking in Port Jeff Village

The parking problem has persisted since the noted Long Island planner, Lee Koppelman, made Port Jefferson’s first village plan in 1965. Multiple updates continued to note this problem, including the 2030 Comprehensive Plan Update. 

As the village has increased parking capacity with more area and asphalt devoted to off-street parking, the less it has felt like an intimate village. Finding a spot, and the walk from your car — through other cars — to Main Street is not a pleasant start to a visit. In the planning to accommodate the car, the harbor front was converted from shipbuilding to parking, absurdly giving the car the best view of the harbor.

In 2006, sponsored by the BID, supported by the Village of Port Jefferson, we presented to the village community the concept of “Putting the Park into Parking” — as seen on the front page of this paper in 2006. The concept was to make a park on the harbor front and move the parking to a parking structure behind Main Street, replacing the asphalt wasteland with scaled-back street mews walks.

With rising tide predictions, the cars should be replaced — before they go under — with a sponge sustainable functioning education park. Parking is just one concern for quality of life in our village.

Uphold democracy by attending the April 3 village board meeting

When we think of dying democracies, we think of faraway lands, where democracies are overthrown by a military coup — like Myanmar in 2021 — or by rampant corruption and fraud, as in Haiti today. But there is a slower blight democracies die from: a gradual loss of trust in the electoral system. We can see that in our own backyard when local officials ignore and thus thwart the will of the majority. People still have the right to vote, but they no longer bother to do so. 

This fate threatens the Village of Port Jefferson today. We have some 6,000 registered voters in the village. Yet only about 1,200 vote in the mayoral election and even fewer for trustees. The current officers were elected with fewer than a thousand votes each in 2021 and 2022. 

Why is this? The residents have seen issue after issue decided by the Board of Trustees without considering the input of voters. The residents no longer even hope for a voice in village decisions.

Such recent decisions include building of apartment complexes in Upper and Lower Port despite strong opposition from residents; the $10 million bond that was floated to fund the “shield” solution to East Beach bluff erosion; and the parking lot built on the newly cleared forest at Mather Hospital.

But just last week, the Port Jefferson Board of Trustees added the keystone to the arch of despair that has developed over the years. The board and mayor unilaterally extended their terms of office from two years to four with no public debate whatsoever. Whether that extension would be bad or good for the village is not the issue. The issue is that, once again, the village residents’ rightful expectation that their will would be considered in their village government’s decisions was quashed. 

Village residents voted to incorporate as a village because we wanted to have self-governance, to make our own decisions about things that affect us the most. But this is now not the case.

As representatives of the Civic Association of Port Jefferson, we strongly urge the Board of Trustees, in their April 3 meeting, to rescind the undemocratic resolution to extend their terms they made at their last meeting.

We also urge the residents of Port Jefferson to show up at 6 p.m. at the April 3 board meeting at the Village Hall to express their disapproval. Don’t let democracy in our village die the death of apathy.

Local offices are on the ballot this November, with legislative positions at the county and town levels up for grabs.

Suffolk County’s 6th District

Six-term incumbent Suffolk County Legislator Sarah Anker is termed out, setting up an open contest to fill her seat. In Anker’s absence, two major party candidates — both attorneys — have emerged.

Dorothy Cavalier, Anker’s chief of staff, has received her party’s nod. Cavalier began her legal career with AIG and Dime Savings Bank of New York, later transitioning to a small family practice in Ronkonkoma.

She joined Anker’s staff in February 2019. Asked why she entered the 6th District race, she told TBR News Media that her four years in Anker’s office had opened her to the possibilities of government.

“I started to see all of the good things that can be done in government,” she said. “I would like to stay in office, hopefully taking her seat, so I can continue those good works and the good things that we started.”

She added, “There’s still a lot of work that needs to be done, and I think I’m the one who needs to be in the office to do it.”

If elected, Cavalier offered to prioritize environmental issues, focusing on measures promoting water quality and preserving open space.

“We need to protect our sole-source aquifer,” she said. “We need to continue to work on getting our water, keeping it clean and making it safe for everybody.”

The Democratic candidate cited coastal erosion along the North Shore as a critical situation for the 6th District. She also noted affordable housing and expanding mental health programs for veterans are priorities.

Representing the Republican Party in this race is Chad Lennon, an officer in the U.S. Marine Corps and an attorney focusing on military and veterans law. 

He has worked part-time for state Sen. Anthony Palumbo (R-New Suffolk) as a special assistant for veterans affairs and U.S. Congressman Nick LaLota (R-NY1) as a congressional aide.

“I have been someone who’s served my country, and I wanted to continue to do that at the local level,” he said. “I believe my experience with being an officer in the military, being an attorney, as well as the other positions I have held bring a level of leadership that no one else is bringing.”

He added, “I think I have an ability to lead from the front, put myself at the point of friction and make myself available to the constituents of the district.”

Lennon committed to tackling issues associated with public safety, stabilizing the county’s budget and finances and thoroughly investigating the September ransomware attack against the county’s information technology network.

He pledged to “work with the county to make sure we find out what happened with the cybersecurity breach and make sure that we have accountability, policies and training put in place to make sure that this kind of breach does not happen at our county in the future,” he said.

The Republican also cited the need for “standing with local officials to stop the ‘Queensification’ of Suffolk County that Gov. [Kathy] Hochul [D] is seeking.”

Brookhaven’s 2nd Council District

The boundaries of Brookhaven’s 2nd Council District underwent a considerable transformation during last year’s redistricting process. Most notably, the district stretched southward, now encompassing a sizable swath of Coram.

Incumbent Town of Brookhaven Councilwoman Jane Bonner (R-Rocky Point) is up for reelection this year, along with the other six members of the Town Board. Before entering office in 2007, Bonner served as a legislative aide to Dan Losquadro (R), then-Suffolk County legislator and now incumbent Brookhaven highway superintendent. 

Bonner also served as a trustee on the Rocky Point board of education and president of the Rocky Point Civic Association. In an interview, Bonner said she is running for reelection to continue working on various long-term projects.

“Every year you serve is like peeling another layer on the onion to tackle long-term issues,” she said. “In my years in office, we’ve done major stormwater remediation projects all along the North Shore, upgrades to our parks,” adding, “I would say, succinctly — to continue to do the good work on behalf of the residents.”

If reelected, Bonner said she would focus on the environment, noting, “We continue to battle and deal with climate change. The North Shore is always under attack, and there are more projects that I’d like to see come to fruition.”

Referencing examples of initiatives she has worked on with the Town Board, she cited cybersecurity, tax and spending caps and anti-nepotism legislation. The incumbent added that she would “continue fighting for Long Island to be a suburb and not a city.”

Challenging Bonner is Carol Russell, a resident of Coram. A retired nurse and trial attorney, she spent nearly 30 years defending doctors, nurses and other health care providers in litigation. Russell has also served as a mentor for the Dress for Success Brookhaven initiative and has volunteered to coach the mock trial team at Longwood High School.

“I look at our society, nationally and locally, and I see it is so divided and so broken,” she said. “I think people want to be listened to and included. I think our Town Board can do a better job at that, and I want to be a part of that.”

She referred to existing dynamics within the town government as “sort of a one-party rule for a good number of years now, and I’m not really sure the Town Board understands its residents or at least part of its residents.”

She regarded the two central issues within the town as the affordability crisis and the looming Brookhaven landfill closure.

“I’d like to see what can be done to alleviate some of the tax burdens on our residents,” she said, adding, “And I’m particularly concerned about the closing of the landfill, which is going to leave a huge gap in our budget.”

She further cited homelessness as an area of concern, particularly in Coram. “Homelessness is not exclusively but predominantly a mental health issue,” she said. “I think that there are ways that we as a town, in partnership with the county and the state, can do better.”

Local legislative elections are shaping up, with candidates across levels of government gearing up for county, town and village races.

Suffolk’s 5th District

Suffolk County Legislator Kara Hahn (D-Setauket), whose 5th District encompasses Port Jefferson, Port Jefferson Station/Terryville and Three Village, is termed out due to 12-year term limits for county legislators. To fill the open seat, former New York State Assemblyman Steve Englebright (D-Setauket) and former congressional candidate Anthony Figliola have stepped up.

Before receiving his party’s nomination, Englebright had previously occupied the seat from 1984 to 1992, after which he entered the state Assembly. He described this year’s bid as “coming home.”

“It’s been some 30 years in Albany, but my heart is always here in the community,” he said. “There’s a lot of work to be done.”

The core issues facing the 5th District, Englebright contended, are those related to the environment and public health. He stated his core priorities are protecting Long Island’s sole-source aquifer and its coastal waters.

“Science has advanced, and the connection between our drinking water and our tidal waters is more explicitly understood now,” the former assemblyman said. “The challenges are awaiting a legislative response to the science, so I’d like to be a part of that. I think I can make a meaningful contribution.”

He said he hoped to continue working toward preserving open space if elected and also emphasized protecting the Setauket and Port Jefferson harbors from contamination. He viewed restoring the county’s information technology systems, promoting affordable housing and limiting sprawl as central.

Figliola was the third-place finisher in 2022 during the GOP primary for New York’s 1st Congressional District. Among his professional credentials, he has served as deputy supervisor of the Town of Brookhaven and is currently executive vice president of a government relations and economic development business. A resident of East Setauket, he will represent the Republican Party in this year’s 5th District contest.

“With Kara leaving, we need someone who has a plan for the future of our district to make sure that we represent everybody,” he told TBR News Media. “I’ve done a tremendous amount of work with small business, with the environment and volunteerism in this community.”

He added, “I just jumped at the opportunity to be able to represent the people that I live and work with.”

Like Englebright, Figliola stressed the importance of water quality in the Setauket and Port Jeff harbors. He said he would also explore opportunities for more sewers, addressing electrification of the Port Jefferson Branch line of the Long Island Rail Road as an area of concern.

“I want to continue the work that I’ve been doing on a volunteer basis for almost seven years, which is to help bring the electrification of the Port Jefferson rail line here,” he said.

He added that supporting small business districts, preserving and developing parks, and encouraging community-based planning will be in focus.

Brookhaven’s 1st Council District

Incumbent Town of Brookhaven Councilmember Jonathan Kornreich (D-Stony Brook), the sole elected Democrat in the town, is up for reelection this year. He entered the Town Board after a special election in March 2021 to replace former Councilwoman Valerie Cartright (D-Port Jefferson Station), who had won a seat on the state Supreme Court.

“Serving this community is something I’ve been doing for almost two decades through service on the [Three Village] school board, the [Three Village] Civic Association and other nonprofits like the Boys and Girls Club,” he said. “Community service is really my life’s passion.”

Kornreich stated that land use would remain a top-level interest if reelected, expressing concerns with Gov. Kathy Hochul’s (D) housing proposal for Long Island.

“One of the big looming policy issues that we’re facing is this potential threat from the governor’s office about seizing zoning control and handing it over to bureaucrats in Albany who don’t understand our communities,” he said.

The incumbent added, “We do have an affordable housing crisis — it’s just very difficult for people to find affordable places to live, and we have to address that. But we have to address it in a thoughtful way that’s sensitive to the makeup of these communities and the built environment where they currently exist.”

He also touched upon the quality of life issues that affect his constituents, such as overdevelopment and sprawl. He pledged to focus on building viable downtowns and parks while protecting the environment.

Carrying the Republican Party’s nomination in the race for CD1 is Gary Bodenburg, a special education teacher who ran for the Comsewogue Board of Education last year.

“I believe good government is needed at all levels, so I plan on continuing the mission and vision of [Brookhaven Town Supervisor] Ed Romaine [R] in maintaining fiscal responsibility by controlling taxes and spending, addressing environmental concerns and also keeping a close eye over the overdevelopment of our suburbs,” Bodenburg said.

The Republican candidate addressed other policy concerns, such as streamlining services within the town government to “provide better value for our tax dollars.”

“Specifically, I think it’s important that we address a 25A corridor study,” he said, adding, “I also look to finalize plans with Lawrence Aviation, as well as better enforcement of housing codes for problems with off-campus student housing.”

Bodenburg said that reducing the impact of traffic and improving town parks and marinas would also be on his agenda.

Port Jefferson’s Board of Trustees

So far, only two candidates have emerged in the villagewide race for the Port Jefferson Board of Trustees election on June 20. Two seats are up for grabs — one uncontested, as Deputy Mayor Kathianne Snaden is running for mayor.

Trustee Stan Loucks will seek his fifth election, having joined the board in 2015. During his tenure, he has served as trustee liaison to the parks department and Port Jefferson Country Club, coordinating with the administration on stabilization plans for the East Beach bluff.

“I love working for the village, specifically the areas that I’m assigned to,” Loucks said. “I just want to keep going. That’s the bottom line.”

Asked what policies he would seek to implement in the coming term, Loucks said reinvigoration of PJCC would be a continued area of emphasis. “I’d like to see more social activities and more community get-togethers focusing around what I think is the gem of the village, and that’s the country club,” he said.

Between new racket sports facilities, recreational programs and the finalization of coastal engineering projects along the bluff, he expressed optimism for such a revival of PJCC. “I want to see it come back,” he said.

Former village clerk Bob Juliano is also in the running. He has had considerable professional experience in municipal government, holding various administrative posts throughout his career in Port Jeff, Westbury and Lindenhurst villages.

“I have the knowledge and experience of being a clerk and a treasurer for the past 30 years for three different municipalities,” Juliano said. “I figured I could use that expertise and my knowledge and my know-how and put it to good use for the community that I live in.”

If elected, Juliano said he would like to “slow down what’s going on uptown.” Like Kornreich, he expressed apprehensions over Hochul’s housing priorities. And similar to Loucks, he proposed exploring a better use for PJCC.

“I’m very concerned about the country club,” he said. “I know they’re progressing with the wall and everything, which is a fantastic thing, but I’d like to see the country club be more viable as well as more welcoming.”

The Suffolk County School Bus Safety Program has drawn criticism from Republicans within the county government. Stock photo

The Suffolk County School Bus Safety Program has drawn scrutiny from Republican county officials targeting the program for alleged mismanagement.

Enacted unanimously by the county Legislature in 2021, this traffic safety program uses cameras attached near the stop arm of school buses to enforce the New York Vehicle and Traffic Law. The county has partnered with Virginia-based BusPatrol to operate the program.

Under state law, offenders caught passing buses while the stop arm is extended receive a $250 fine. The county code states, “net proceeds of any penalty … shall be expended for programs related to improving traffic safety and/or school district safety in Suffolk County.”

County Comptroller John Kennedy Jr. (R) recently announced his office is conducting an audit of the School Bus Safety program. He stated the program had captured his attention when numerous residents complained about receiving potentially erroneous violations.

“My interest in any program is always that a program is being operated as the laws that adopted it … sought to have it operate,” Kennedy said. “How is the revenue that’s being collected from the program being allocated? Is it being done under the terms of the contract? Is the vendor fulfilling all of their requirements?” 

He added, “That’s the audit function, and it is universal across the board.”

Legislative purpose

Marykate Guilfoyle, a spokesperson for Suffolk County Executive Steve Bellone (D), summarized the motive for developing the program in the first place.

“The goal of the School Bus Safety program is to protect children as they get on and off the bus and to reduce the number of drivers illegally passing stopped school buses, which endangers the lives of students,” Guilfoyle said in an email. “The program is completely violator funded, and county proceeds are used to support public safety, traffic safety and school safety initiatives.”

County Legislator Kara Hahn (D-Setauket) defended the School Bus Safety program. She said her office’s most frequent complaints are related to roadway safety and other traffic concerns.

“Red light cameras and school bus cameras are a way to prevent death and injuries without needing a paid police officer at every intersection and following every bus,” she said. “It’s a very efficient way for providing the consequence for breaking the rules of the road.”

Before the program took effect, Hahn added, few violators ever got caught. Today, they receive a fine, incentivizing better roadway behavior and creating a safer traffic environment.

“Now people have to change their behavior to no longer do the illegal action that puts people’s lives at risk,” the county legislator said. 

Questions over potential misapplication

County Legislator Rob Trotta (R-Fort Salonga) said the School Bus Safety program is one of the few measures for which he wishes he could rescind his “yes” vote. He said the Legislature was misled when the program was pitched.

Figures obtained by Trotta indicate the program grossed $23 million last year, with $13 million retained by the county and the outstanding $10 million collected by the vendor. Kennedy estimated the county government netted approximately $11 million.

“We don’t have all the net revenue,” Kennedy said. “That’s been another consequence of the hack” against the county government in September. By statute, the net proceeds generated by the School Bus Safety program must support various educational programs related to school bus and traffic safety. Asked how the revenue is being spent, an administration official said the 2022 revenue figures are still being finalized.

Guilfoyle, however, cited specific examples of how the revenue supports countywide traffic education initiatives: “Examples of the county’s efforts include dedicating more than $1 million to school districts and $125,000 in [public service announcements] during the back-to-school months to educate drivers on the state law surrounding stopping for buses.”

Trotta viewed the school bus program as a lucrative moneymaker for the county and vendor rather than a measure promoting bus safety. He said the law is applied unfairly, ticketing busy multilane corridors in the same manner as residential neighborhoods.

“I’ve checked with all the school districts, and kids aren’t crossing major thoroughfares,” Trotta said. “I’m all for giving a ticket to someone who passes a school bus on a residential avenue because it’s dangerous. I’m not at all for 1,000 people on Jericho Turnpike getting tickets.”

While the county code imposes rigid reporting requirements regarding expenditures of revenues generated from the program, Kennedy said he has yet to see any reports to date.

Competing perspectives

Following an initial spike when programs such as this are first instituted, Hahn said offenses start to wane “because people begin to change their behaviors — they stop at red lights because they’re afraid of getting a ticket.” 

In time, the legislator added, drivers throughout Suffolk “will no longer go around stopped school buses,” but “if they choose to break the law, they will get tickets.”

Trotta said he is pushing to repeal the School Bus Safety program altogether. “The reality is it’s a sham, and it’s not what we were told it was going to be,” he said.

While Kennedy acknowledged the importance of traffic safety, he held that the audit is to determine whether the program is administered correctly.

“I never want to see somebody blowing a stopped school bus sign — it’s just heinous,” the county comptroller said. “But if [the program] is not being operated in a fair and proper and consistent manner by the school bus drivers and the vendor … then it’s a problem.”

Kennedy expects the audit to be finalized by the second quarter of 2023.

New York State Assemblyman Steve Englebright (D-Setauket) has held elective office continuously since 1983. Englebright’s long tenure now comes to a close. 

In a tight state election for District 4 last month, Englebright narrowly lost to his Republican Party challenger Ed Flood (R-Port Jefferson). In an exit interview, the outgoing assemblyman reflected upon his pathway into government, the legislative victories throughout that time and the meaning of public service.

The road to politics

Growing up, the young Englebright spent much of his time in libraries. He found refuge in books, which satiated his curiosity and “compelling interest in how things worked.” He also nourished a lifelong fascination with history through those hours devoted to learning.

Leading up to his first run for office, Englebright said he was deeply disturbed by the environmental degradation characteristic of those times. The “almost daily reports” of overdevelopment and sprawl, oil spills and drinking water contamination, each had left a deep and abiding impression on him.

He was teaching geology at Stony Brook University when he began considering public life. “I realized that drinking water was the first limiting factor for the continued well-being of this Island, and I was not really seeing any meaningful public policy growing out of the reports of chaos,” he said.

The late professor Hugh Cleland, from the SBU Department of History, would prove to be the catalyst behind Englebright’s ascent to politics. Cleland sat down with him at the campus student union. For several hours, the two discussed a possible bid for a Suffolk County legislative seat.

“This was a really serious and credible and well thought-out request that he was making,” Englebright said. “So I didn’t just wave it off. I gave it some thought and, sure enough, I found myself saying, ‘What’s next?’” 

After that meeting, Englebright decided to run and was elected to the county Legislature in 1983. He won election after election for the next four decades.

County Legislature

Upon entering the county Legislature, Englebright simultaneously confronted an array of environmental dilemmas. He described the defunct Long Island Lighting Company, the precursor to today’s Long Island Power Authority, as “at that time wanting to build a small galaxy of nuclear power plants on Long Island.” He stressed that the utility company was favoring its shareholder interests at the residents’ expense. 

Englebright successfully championed, along with a grassroots movement of LILCO ratepayers, against the construction of the Shoreham Nuclear Power Plant and other nuclear plants to follow. Their resistance efforts were grounded primarily in the risks associated with evacuation.

Another major policy issue during his early political career was the protection of groundwater and surface waters in Suffolk County. “I pushed successfully for the largest county-level open space program in the nation,” he said. He was one of the earliest critics against sprawl. 

As a county legislator, he initiated the first plastics ban in the nation. Though ahead of his time on the issue, he admitted that not enough has been done elsewhere to counteract the problem, which he said “has exploded into a worldwide catastrophe.”

He sponsored legislation excising a small fee on hotel and motel rooms, considering the measure as a fee on tourists allowing for their continued enjoyment of the area through reinvestment into the county’s most attractive destinations.

“If you wonder why county Legislator [Kara] Hahn [D-Setauket] is able to have some discretion to provide funding to Gallery North or the Reboli Center, that funding is coming from the hotel/motel room fee,” he said.

As a state assemblyman, Englebright quickly picked up where he left off, building upon and expanding his county policies at the state level. Among his earliest actions was the Long Island Pine Barrens Protection Act, a state law ensuring the preservation of the Pine Barrens as open space.

He sponsored some of the original laws in New York state related to solar power and other renewables. “In my first year in the state Legislature, I was successfully pushing for legislation that had paved the way for the electronic age,” he said.

Englebright added that the Climate Leadership and Community Protection Act was the most crucial legislation he ever sponsored. This ambitious law aims to reduce statewide greenhouse gas emissions by 85% from 1990 levels by 2050.

Englebright also successfully led a statewide ban on purse seining, a highly efficient fishing technique responsible for the depletion of menhaden, or bunker, in New York’s surrounding waters.

“The marine world all depends on having this abundant fish at the base of the food chain,” the assemblyman said. Purse seining allowed large-scale fishing operations to collect “whole schools of menhaden, millions and millions of fish.”

One of the fondest moments throughout his tenure happened just last summer. On a boat trip off the coast of Montauk Point during early morning hours, the sun rising off the horizon line, he witnessed entire schools of menhaden beneath the water.

“The sea was boiling with fish,” he said. “Menhaden, they were back by the billions.”

Reminiscent of his earliest years in libraries, historic preservation would be a significant point of emphasis for Englebright. “I’m very proud of the many properties that are preserved, the historic sites.” Such sites either preserved or to be preserved include Patriots Rock and Roe Tavern in Setauket and William Tooker House in Port Jefferson, among many others.

Even in his final days in office, Englebright made historic breakthroughs. Though his reelection bid was unsuccessful, Englebright rejoiced in yet another major victory for environmental sustainability. Last month, New Yorkers overwhelmingly approved a recent $4.2 billion environmental bond act, a multiyear investment in clean water, air, wildlife and the environment.

Reflections from his community

During his extended time in political service, Englebright has worked alongside countless public representatives at all levels of government. He maintained “they’re not all scoundrels,” adding that many were “superb public servants.”

In a series of written statements and phone interviews, several public representatives and close Englebright associates and friends had an opportunity to weigh in on his legacy of service and commitment to his community. 

Englebright “proved himself to be an environmental pioneer, a champion for the causes and concerns of his constituents and an unflinching fighter for the communities he served,” Hahn said. “For those of us who served in elected office with him during his tenure, irrespective of political persuasion or level of government, Steve proved himself to be a friend and mentor who embodied the role of effective leadership in the lives of those we represent.”

 As recently as Dec. 6, the Three Village Community Trust honored the assemblyman by renaming the Greenway trail as The Steve Englebright Setauket to Port Jefferson Station Greenway.

Port Jefferson Mayor Margot Garant commented on the characteristics that set Englebright apart from other politicians. She said his scientific background and wide-ranging interests added depth to his political persona.

 “He’s a unique legislator in that he’s so well rounded in those other areas and that he’s not just focused on the hard line of the law,” she said. “He’s involved with his community, he’s approachable, he’s caring, he’s kind. He’s a very unique representative, and we’re going to miss him sorely.”

 Like Englebright, Port Jefferson village trustee Rebecca Kassay worked in environmental advocacy before entering government. She discussed Englebright’s ongoing extended producer responsibility legislation, which would require producers of packaging materials, rather than taxpayers, to be responsible for managing post-consumer packaging material waste.

 “This can be a step toward addressing a multitude of waste management, environmental and financial issues facing municipalities and individuals,” Kassay said. “I hope to see the assemblyman’s colleagues and successor continue advocating for policies with long-term solutions,” adding, “Englebright is the type of commonsense representative we’d like to see more of in government.”

 In a joint statement, George Hoffman and Laurie Vetere of the Setauket Harbor Task Force reflected upon Englebright’s importance to local harbors.

 “In his time as our state representative, Steve Englebright never forgot the importance of the harbor,” they said. “Assemblyman Englebright found ways to secure needed dollars from Albany to help the task force in its mission of protecting water quality and the sustainability of Setauket and Port Jefferson harbors.” 

Joan Nickeson, community liaison of the Port Jefferson Station/Terryville Chamber of Commerce, credited Englebright for the continued flourishment of her area. She said the hotel/motel tax he sponsored had enabled the chamber to conduct its annual summer concert series at the Train Car Park.

 “Assemblyman Englebright has continued to be a friend of the chamber by supporting our local businesses and attending our ribbon-cutting ceremonies,” she said.

 Within those 40 years, countless other acts and initiatives have come to fruition with Englebright’s assistance. Reflecting on his time in public service, he outlined his political doctrine.

 “The proper role of government is to protect the people who sent you,” he said. “If you keep your eye on the prize, you can achieve things for the people who invested their trust in you.” 

 On the role of the public representative, he added, “Use the office as a bully pulpit, speak truth to power, identify things that are wrong and right them, and treat the office as an opportunity to do good.”

Suffolk County Legislator Sarah Anker (D-Mount Sinai) presented Sound Beach resident Bea Ruberto with a proclamation.

The proclamation recognizes Ruberto as a Woman of Distinction in 2022 and for her ongoing dedication to her community. In addition to serving as president of the Sound Beach Civic Association, Ruberto is the co-owner of Pern Editorial Services, a member of the Brookhaven Anti-Litter Task Force, and a leader in local diversity, equity and inclusion efforts. She also served as president of the auxiliary of the Sound Beach Fire Department. 

“It is not primarily the geography of a town that makes it remarkable,” Anker said. “It is the passion and dedication of its residents that make a community distinguished. Bea makes Sound Beach shine, and it fills me with joy to present her with this recognition.”

County legislators convened at the William H. Rogers Legislature Building in Hauppauge on Monday, Dec. 5, announcing the formation of a bipartisan special committee to investigate the recent cyberattack against the county government.

A confirmed ransomware event was first reported in early September. [See story, “Suffolk County cyberattack offers a window into the dangers of the digital age,” Nov. 17, TBR News Media website.] The attack crippled the county’s IT infrastructure, shutting down the system for over a month, with systems slowly coming back online.

The county press release relating to the new committee indicated that, “Information regarding the effects of the attack continues to be made public, including the admission that the personal information of as many as 470,000 residents and 26,000 past and current employees has been stolen by the hackers.” 

Kevin McCaffrey (R-Lindenhurst), presiding officer of the county Legislature, announced the appointment of Legislator Anthony Piccirillo (R-Holtsville) as chair of the newly formed special committee. With these two legislators, the rest of the committee will comprise Minority Leader Jason Richberg (D-West Babylon), and Legislators Sarah Anker (D-Mount Sinai), Jim Mazzarella (R-Moriches) and Rob Trotta (R-Fort Salonga).

“The purpose of this committee is to do one thing and one thing only, and that is to find out what happened and how we can prevent that from happening again,” McCaffrey said.

The presiding officer described the impact felt by county officials and residents alike due to the cyber event. He stated that sensitive information of county employees was likely accessed, with many details still unknown.

“There’s been an impact on each and every one of our residents,” he said, adding, “Employees, including myself, have now found out that our Social Security numbers have been compromised. We need to make sure that this doesn’t happen again.”

Piccirillo outlined his priorities and intended goals as chair. He regarded the Legislature as a coequal branch of the county government with a constitutional obligation to conduct oversight activities. 

“We’re going to execute our constitutional duty of oversight,” he said. “We passed a procedural motion that we now have subpoena power to call witnesses under oath and bring them in if they refuse to come in.”

The committee chairman added, “I do expect full cooperation from anyone that we ask to come in, but we do have that tool in our toolbox, where if people start to refuse to speak to the Legislature then we can have them here under subpoena.”

Piccirillo maintained that openness and transparency would be necessary to restore government operations and public trust.

“The best disinfectant is sunlight, so we’re going to open the windows and let the sun in here to shine and make sure that we get the truth,” he said. “We’re going to follow the facts and conduct the thorough investigation that the residents of Suffolk County deserve.”

Richberg detailed the collective shock and disbelief experienced by county officials when reports first circulated of the cybersecurity breach. He said a proper diagnosis of the problems leading up to the attack would help thwart a similar scenario from unfolding.

“I think understanding and diagnosing the problem from the beginning and having a bipartisan approach to asking the questions in the sunlight … is really important,” the minority leader said. “Most importantly, we need full structures for us to move forward, so this doesn’t happen again and that we are appropriately protected from anything that could happen to us in the future.”

In an interview, Anker discussed the gravity of the moment and the importance of the government coordinating its response correctly. “I know we’re spending up to $12 million to address this, if not more,” she said. “We need to get all the experts in the field to address what we’re dealing with and how to best deal with it.”

Anker also addressed the criminal nature of this cyber intrusion and the need to grasp cybercrime trends and criminal culture online.

“The dark web, that’s where all of this stuff is happening,” the county legislator said. “It’s the Wild, Wild West of our times, and if we don’t address that in a more aggressive way, it’s going to ripple throughout our country.”

While the committee’s work is just getting underway, McCaffrey said the process will culminate in a report detailing its findings. “We expect to be able to roll this out and tell a good story about what happened from beginning to end,” he said.

The recent ransomware attack against the Suffolk County government has raised important questions about the relationship between citizens, governments and technologies.

A confirmed ransomware event took place in early September. The hack crippled the county’s information technology infrastructure, and recovery efforts remain ongoing. 

In the wake of these events, the hack prompted critics to question the digitization of sensitive information and how governments can better secure their IT networks.

What is ransomware?

Nick Nikiforakis is an associate professor in the Department of Computer Science at Stony Brook University. His research focuses on web security and privacy. In an interview, he described how ransomware works.

“Ransomware is, effectively, malicious software that infiltrates a machine, starts encrypting all sorts of private documents, spreadsheets, anything that is of value, and then leaks out to the attacker the encryption key and potentially the data that was encrypted,” he said. 

Some forms of ransomware affect only a single machine, according to Nikiforakis. Other strains may spread into several devices, potentially infecting an entire network.

Ransomware is the confirmed vector of attack for Suffolk County. However, how hackers first entered the county’s system is unknown to the public. 

While the details of the county hack are scanty, Nikiforakis said cyberattackers commonly use emails with malicious attachments. In other instances, they can locate vulnerable software within a network, exploit that weakness and breach that system. Once hackers gain access to the system, they hold sensitive information for ransom. 

“The original idea behind ransomware is that if you don’t pay the attacker the money that they ask, then you lose access to your data,” Nikiforakis said. 

Backup software was developed, in part, to mitigate this concern. Regardless, as technologies have evolved, so has cybercrime. 

“Even if you have the ability to restore your data from backups, now you have to deal with the attacker having access to your data and threatening you with making that data public, which is what’s happening in this case,” Nikiforakis said.

Based on the information available, Nikiforakis said the attackers likely gained access to speeding tickets and various titles, among other sensitive materials. “This is definitely a cause for concern, and that is why, in certain cases, people decide to pay, to avoid this blowback that will come from the data being made publicly available.”

A question of payment

Ransomware raises an ethical dilemma for government officials, namely whether to use public funds to pay a ransom.

“People can take a philosophical approach and say, ‘We don’t negotiate with terrorists,’ and I understand that,” Nikiforakis said, “But then the rational thing for the attacker to do is to make that data available to the public. Because if he doesn’t, then the next victim will also not pay him.” 

The profitability of the ransomware operation depends upon the victim trusting that the criminals will comply with the conditions of the transaction. The ransomware business model would fail if cyberattackers generally went against their word.

For this reason, Nikiforakis said payment and compliance could sometimes be in the interests of both parties. 

“I think it’s a very rational decision to say, ‘Let’s pay and accept this as a financial loss and let’s make sure that this doesn’t happen again,’” he said.

In Suffolk County, however, putting this theoretical framework into action is more complicated. Responsibility for paying ransomware payments would be vested in the Office of the Comptroller, which oversees the county’s finances. 

During an election interview last month with county Comptroller John Kennedy Jr. (R), he hinted that compromising with cybercriminals is off the table.

“There is no predicate in the charter, in the New York State County Law, in the Suffolk County code, to take taxpayer money and give it to a criminal,” he said.

The effect on the county’s government operations

The ransomware attack has also aggravated concerns over securing the county’s IT apparatus. Kennedy likened the problem to a fire code, saying fire codes often include provisions for masonry walls and other buffers that reduce the spread of a fire.

“If a fire starts, it doesn’t take down the whole complex. It stops at the masonry wall,” he said. “Our system was not configured with those hard breaks, other than some separation of function out in Riverhead in the County Clerk’s Office.” 

Suffolk County Legislator Sarah Anker (D-Mount Sinai), whose office was attacked by ransomware in 2017, has advocated for serious IT reform for some time. She followed the county’s technology closely and expressed frustration over how the initial attack occurred.

“I could tell, and I could feel, that there needed to be more done,” she said. “It has hampered the government, it has affected our constituents. Maybe it could have been worse, but it should have never happened.”

Suffolk County Sheriff Errol Toulon Jr. (D) explained his office’s many challenges since the hack. Though communications systems are slowly returning online, the initial attack disrupted both external and internal communications within the Sheriff’s Office.

“From a jail and police perspective, it really hindered us in the beginning,” he said. “Emails that we received from other law enforcement agencies or any communication with our community was stopped for a significant amount of time.”

New York State’s Division of Homeland Security and Emergency assisted the Sheriff’s Office as Toulon’s staff worked without an operational communication network. Because of this coordination, Toulon maintained that the functions of the jails were more or less appropriately executed.

“We wanted to make sure that any individual that was supposed to be released from our custody was released on time,” the county sheriff said. “No one was incarcerated longer than they had to be.” 

Preparing for the future

Toulon suggested the existing IT network is too centralized and interconnected. To prevent future failure of the entire network, he proposed creating separate silos for each department.

“I feel that the District Attorney’s Office, the Sheriff’s Office, the [County] Clerk’s Office and the Comptroller’s Office should be totally separate from the County Executive’s Office,” Toulon said, “So if, god forbid, this were to happen again in the future, we wouldn’t be directly impacted like everyone else.”

Anker said she and a newly formed panel of county legislators are beginning to explore ways to harden the network and apply strategies that work elsewhere.

“As we move forward, we need to see what the other municipalities and corporations are doing,” she said. “What types of programs and software do they have that prevent these attacks?”

The rate of software development, according to Anker, is outpacing the ability of governments to respond effectively. While IT departments must remain ahead of the cybercriminals to keep their digital infrastructure safe, staying out front is easier said than done.

“Technology is moving so quickly that it is incredibly challenging for government to keep up,” she said. “I would like to see more accountability in all respects and from everyone as we move forward with new technology.”

While the recent cyberattack focuses on the government, Anker believes ordinary citizens are also at risk from hostile online actors. The county legislator contended more work should be done to alert community members of these dangers.

“Not enough is being done regarding community outreach,” she said. “There needs to be more education on preventing an attack even on your home computer.”

Nikiforakis proposed that greater attention be given to digitizing personal records. According to him, those records in the wrong hands could unleash great harm. 

“Ransomware was a big game-changer for attackers because it allows them to monetize data that would not be traditionally monetizable,” he said. “Through ransomware, suddenly everything that is of value can be monetized.”

The SBU associate professor supports software upgrades, cybersecurity protocols and other measures that protect against ransomware. But, he said, a broader conversation needs to take place about the nature of digitization and whether individuals and governments should store sensitive files online.

“More and more things that didn’t used to be online are suddenly available online,” he said. “We have to reassess the eagerness with which we put everything online and see whether the convenience that we get out of these systems being online is a good return on investment, given the risks.”
