Landlord of MS Property Also Owns Historic Derelict House in Port Jeff

Though it is just one of a huge slate of derelict homes the Town of Brookhaven deals with on a monthly basis, one house in Mount Sinai has been causing more issues than others recently.

At the Feb. 27 Town Board meeting, the council members voted to demolish a garage located at 63 Shore Drive in Mount Sinai, though the house would remain untouched.

This set off a press of neighbors angry the Town would not be touching the residential part of the property, which they said has been a problem property for years.

Lynn Capobianco, a Mount Sinai resident and previous president of the school board, said while she appreciates the Town coming in with work crews to keep the property somewhat tame, the issue with the house remains.

“We’ve been saying that for a long time — it’s only in the last year the Town has started to listen,” she said.

In a 2019 report by Hauppauge-based firm Cashin Spinelli and Ferretti LLC, the building was cited as being “in extremely poor condition,” with the inside filled with trash and debris. Additionally, ceilings were collapsing due to water damage, with engineers also suspecting mold. The inspectors cited the property for multiple fire and safety violations. The house was originally boarded up after the report in June 2019. 

Town officials said another reconnaissance of the property was done Feb. 24 of this year. Inspectors did not go into the residential portion of the property, said Brendan Sweeney, who works for the Town, often presenting to the board about these zombie homes. He also said the new analysis by the inspector, “did not certify the house was unsafe.” 

The garage was reportedly collapsing with a building full of debris and garbage. Town officials said inspectors recommended the garage be torn down. The owner has 30 days to file permits showing he’s making an effort to fix the garage before the building is removed.

Some local residents took umbrage with this, citing the 2019 engineering report and their own personal dealings with the property. Several cited issues such as young people exploring the empty structure and animals inhabiting within. 

Kerry Hogan, a neighbor who has worked in and taught construction arts, said on visits to the property the damage was such that the best recourse is to simply tear it down and build something new.

“Once I saw [the] condition, I knew I would not bid on the house when it became available,” she said at the meeting.

Councilwoman Jane Bonner (R-Rocky Point) directed all inquiries about the house and plans for demolition to the law department.

Town attorney Annette Eaderesto said the Town senior building inspector went to the house Feb. 24 and saw that the garage was in immediate danger of collapse, while the house wasn’t. 

“This is not the first time we’ve taken down a shed or garage instead of the main residence first,” she said. 

Part of the process, the Town attorney said, takes into account the house is in a transitional historic area. That requires a review from the Historic District Advisory Committee, which meets the second Tuesday of every month. The process is the same whether the building is in the transition zone or the historic district.

Edna Giffen, the recording secretary of the Miller Place-Mount Sinai Historical Society, said the transition zone is basically a buffer between the Town and the main historic district in Mount Sinai. While the rules affecting property are laxer in the transition zone than the main historic district, she confirmed the Town’s advisory committee still has to look at every permit for property in both. 

Still, she said it was a shame to watch it and other houses deteriorate. Two other buildings, one in the main historic and the other in the transition zone, have been taken down by the Town since 2012 and the impact of Superstorm Sandy.

“It’s a sad situation it was allowed to deteriorate so much,” she said. “It’s like watching an old poor soul die a slow death.”

Since the 2008 mortgage crisis and subsequent recession, the Town has been inundated with thousands of these derelict or zombie homes. Brookhaven has taken the unique approach to dealing with the situation by taking care of flagrant properties, mowing the grass and boarding up homes, then putting liens on these properties. If owners cannot be reached or cannot handle reconstituting the property, then the Town will hire contractors to demolish them, putting the cost as additional liens on the property.

However, in this case, Town officials said they have come across hiccups due to the historic nature of the surrounding area. This does not mean the Town would not be able to demolish the full property in the future.

At the Feb. 27 meeting, Supervisor Ed Romaine (R) and Bonner both said they would like to do an additional engineering report on the property.

Neighbors also said the owner had brought in unlicensed contractors to fix the building’s roof in 2018, but after calls from residents the Town had put a stop-work order on that construction.

The property is owned by TAB Suffolk Acquisitions, an elusive real estate company reportedly based at 63 George St. in Roslyn Heights, according to the Town. Local officials, including from Port Jefferson village and state Assemblyman Steve Englebright (D-Setauket), have been on the hunt for the company owner as it has also purchased a derelict property at 49 Sheep Pasture Road in Port Jefferson. That house has significant historic worth, according to local historians. The assemblyman interjected before the property could be demolished by the village, and the house has remained boarded up ever since.

Sweeney said the owner of 63 Shore Drive had come to the meeting but left without speaking. He did not get the owner’s name. 

Councilman Dan Panico (R-Manorville) said TAB Suffolk Acquisitions has bought up a lot of property in Suffolk foreclosures, according to their data from the comptroller’s office. Bonner criticized the company for sitting on such properties and not doing anything with them.

“There’s a lot of money coming out of the city and western Nassau — there’s a lot of property being bought up,” Panico said. “This is one of those companies that buys up a ton of houses.”

Neighbors said they knew the owner only as “Sam.” They said he has been cordial in the past but has largely been absent.

When called, the person on the other end who confirmed he was the owner of the property said they are in the process of getting permits from the Town to fix up the property, “within 30 days.”

He spoke about his prior attempts to fix the roof before the Town put a stop-work order on those repairs. As to residents’ complaints, he said residents have known and stayed silent on the state of the house for longer than recent efforts to demolish it.

“The house has been in this shape for years,” he said.

After he said his name was Sam, he hung up the phone and did not answer further calls for comment. 

Tracy Kosciuk hopes to take incumbent Valerie Cartright's seat for Council District 1 in Brookhaven.

Valerie Cartright (D-Port Jefferson Station) is running for her fourth term as Brookhaven Town councilwoman in District 1. Her challenger is one of her neighbors, Tracy Kosciuk.

Cartright sat down with the TBR News Media editorial staff Oct. 25 to talk about her accomplishments and initiatives, while Kosciuk, a registered nurse at St. Charles Hospital, answered questions via email due to being on a trip to Albany. The nurse is a local union president who travels to the state capital to lobby for improved working conditions.

Kosciuk said if elected to the Town Council she plans to continue working as a nurse and promises she would give town issues the same 24/7 attention she gives to her nurses, as she recognizes the council position is a full-time job.

“I am a multitasker, ask any of my nurses, friends or family — I work with commitment to the task and get the job done,” Kosciuk said.

She said the primary reason she is running this year is the frustration people feel when one doesn’t fulfill the obligations of their job. The nurse and union leader said she is also a wife and a mother, who cares for a sick parent. A firm believer in time management, she said she will make the necessary adjustments to her life “to guarantee to my constituents a much better degree of responsiveness and dedication to my office than what they are currently receiving.”

Cartright said being a councilwoman is a full-time job, and because of that while she maintains her license to practice law, she only handles two or three cases annually. She said she spends the majority of her time in Town Hall meeting with various departments, dealing with constituents’ issues and meeting with residents at her mobile offices or in people’s homes. She said there are also community events to attend and meetings with civic groups and chambers of commerce.

“I’m very much a hands-on person,” she said. “I’m visual. I need to see what it is that the constituents are talking about.”

Cartright said she and her staff handle an average of 3,000 to 3,500 calls on a yearly basis and receive more requests via email. The issues can vary from a pothole in front of someone’s house to drainage problems to a resident asking for help with National Grid to get their lights turned back on. She encourages people to call her in addition to the department or entity responsible as she said she considers herself an advocate for her constituents.

Both candidates are focused on local issues, including revitalization in the district.

Kosciuk said she believes one of the largest issues facing the town is “the prevalence of illegal housing and also buildings that are referred to as ‘zombie homes.’” While she believes Supervisor Ed Romaine (R) and other town councilpersons have been addressing the issue, she said in Council District 1, based on her walking through the communities and talking to residents, that it hasn’t been sufficiently addressed.

“As I have said many times, these illegal housing conditions are a magnet for crime, drugs and an undesirable element that our communities and neighborhoods can do without,” the nurse said.

Cartright, who bought a zombie home when she moved to Port Jeff Station from Queens 14 years ago, said she encourages residents to alert her office about homes they believe may be abandoned or if there are drug issues.

For the past few years, Cartright has been working on revitalization projects for the Route 25A corridor in the Three Village area and to create a walkable downtown hub in Port Jefferson Station between the train tracks and Route 347.

“I look forward to tackling the remaining quality of life issues,” she said.

Regarding the PJS plan, she has met with the two major landowners to discuss recommended density and site plans. She is also working with Suffolk County to create a sewer district in the area. With the Three Village 25A corridor plan, she said the work is more about historical architectural continuity, something that residents showed a concern for during visioning meetings she spearheaded.

Kosciuk, on her website, stated she would continue with current revitalization projects and help small business owners succeed, calling them the cornerstone of the community.

“There are several projects that have been in the planning stages for years — stagnated by red tape,” she said.

“It is to our benefit that these projects are completed in order to revive our community and provide a much-needed ‘face-lift’ for our district,” Kosciuk said.

The incumbent said the process can be long at times due to the need for land-use plans before work truly begins.

When it comes to quality of life issues, Cartright is currently working to allow town vehicles to provide transportation for those who are looking to enter temporary housing or clinics. The initiative was inspired by a couple who the councilwoman said she waited three hours with after they agreed to go into temporary housing. The cab was a third party hired by the county, but there was miscommunication that left her and the couple stranded. She is currently working with a task force to deal with homeless issues that includes the Port Jefferson Station/Terryville Civic Association and Port Jeff village officials. She said the group has spent six months gathering information.

“There are a lot of misconceptions, in my opinion, as to where the root of all of this is coming from,” she said.

Both candidates hope to tackle the drug crisis in the area.

“It is essential to work with area hospitals and treatment centers to establish a more comprehensive discharge plan for patients suffering from this disease,” she said, adding the importance of providing resources to educate residents on the dangers of illicit drugs.

Cartright helped to form a community-based drug prevention coalition that holds education events, which will also include vaping cessation workshops for teenagers. The councilwoman said she hopes the workshops will be an alternative to students being suspended from school. The coalition was formed after Sal Pitti, president of the Port Jefferson Station/Terryville Civic Association, approached her saying he identified money from the federal government.

“We did that because a community member felt comfortable enough and was willing to say, ‘Valerie, can you help?’ and I believe government is supposed to help people and not hinder initiatives,” she said.

Port Jeff currently looking at more than 10 zombie homes

A new intermunicipal agreement between the village and town could mean more zombie homes in Port Jeff may have a larger target on their heads.

At its Oct. 3 meeting, the Brookhaven Town board voted unanimously to enter into an intermunicipal agreement to let town workers assist, if requested, with demolition projects and then dispose of the waste at the town’s landfill in Brookhaven hamlet.

Under the agreement, Port Jefferson would pay the expenses of inspecting the property, demolition and carting away the debris.

In previous meetings, the village identified little more than 10 zombie homes in the village boundaries. These colloquially named “zombie homes” are derelict houses that have slowly started to degrade where the owner is absent. The village’s Zombie Task Force, run by the constabulary, goes weekly to these houses to check in, looking to see if there are vagrants or squatters at the premises and checking for other illicit activity.

Mayor Margot Garant said this will mean shearing costs for the village.

“Tremendous savings for us, because we can just call it in and schedule it, instead of going out to bid and doing everything like that,” she said. “If it works out, it will be great.” 

Town Supervisor Ed Romaine (R) said the agreement will mean the town’s engineers that usually inspect these derelict houses, Hauppauge-based Cashin Spinelli & Ferretti, will inspect homes in Port Jefferson upon request and report to the village. Then, depending on the decision by the board after a public hearing, a vote to demolish will mean either Brookhaven employees will demolish the home, or a private company will be contracted in the case where asbestos is on the premises. The area will be cleared, and debris taken to the town landfill. The village will then have to put a lien on the property for any unpaid taxes and for the cost of demolition.

Costs range on average from $25,000 to $40,000, depending on the size and type of home being demolished, according to the supervisor.

Romaine said this is just one deal in a long line of 35 intermunicipal agreements between the Brookhaven and smaller municipalities such as Port Jefferson Village for close to a year. The town has made these deals as part of a $20M Municipal Consolidation and Efficiency grant from New York State. Other agreements have included plowing snow in the Village of Shoreham and completing road repairs in the Village of Patchogue.

“We have contracts and things of that nature that they can benefit from, and we’re happy to help with that,” he said. “It helps reduce the overall cost of government.”

Recently the village announced it would be working on two zombie homes, one on Sheep Pasture Road and another at Nadia Court. The former was soon found to be a nearly 300-year-old historic structure, and the village has promised not to touch the property while local historians and New York State Assemblyman Steve Englebright (D-Setauket) work to find ways to preserve it, though the difficulty comes from the owner, Jericho-based Tab Suffolk Acquisitions, not responding to any calls or having a set location. 

While the village has not made any move on the property, other than to continue to board it up and monitor for vagrancy, Garant said the village is not willing to pick up the tab for any restoration, citing the costs associated with fixing up the Drowned Meadow House.

“Until you find a full-time [caretaker] for [the house], it’s going to be a big challenge,” she said. 

This is just one in a line of intermunicipal agreements between the village and town. Earlier this year the town and village announced a new intermunicipal agreement to consolidate property tax collections. The village has also worked out an agreement over salt and sand between the two municipalities.

Brookhaven Town Supervisor Ed Romaine (R) got into politics to get things done. After two terms as the town’s leader, which came after a lengthy career working for the county, the 70-year-old Center Moriches resident says he still has a job to do.

“What gets me up every single morning is that I want to build a better Brookhaven,” Romaine said. “This town can look a lot better than it does. I have a sense of purpose and it drives me every day. While I don’t think my job will ever be complete, I hope to leave more good than bad whenever I leave this office — and I work every day to accomplish that.”

The incumbent supervisor will run for a third full term in Brookhaven in an election this November against challenger Jack Harrington (D), a Stony Brook attorney and political newcomer.

Romaine, the former high school history teacher-turned-county legislator, grew up in Bayport and Central Islip, graduated with history and political science degrees from Adelphi and Long Island universities. He said he devotes any time outside town hall to his two grandchildren. If re-elected, Romaine said he will build on his long list of initiatives to move Brookhaven forward.

Since taking over the position from former Supervisor Mark Lesko (D) after a special election in 2012, Romaine has helped pull the township out of its fiscal crisis to become the only municipality on Long Island to pay off all of its pension debt. For the last two years, Brookhaven has secured a AAA bond rating, the highest designation issued by Standard & Poor’s Financial Services of New York City.

A lifelong advocate for environmental preservation, Romaine consistently pushes for greener, cleaner living across Brookhaven and has been endorsed by the Sierra Club and Long Island Environmental Voters Forum during past campaigns. He also pledged a commitment to the Paris agreement in the wake of the June decision of President Donald Trump (R) to withdraw from the climate change agreement.

“I intend to defend the environment,” Romaine said. “I’m a big open-space guy. I believe in preservation because I do not want to see the wave of development that has swept east to west across this Island continue.”

Under Romaine’s supervision, the town created nitrogen protection zones to preserve local waterways, kick-started a multiyear project to convert all of Brookhaven’s streetlights to LED bulbs, opposed dumping of dredge spoils into the Long Island Sound and opposed plans to clear 800 acres of woodlands near the former Shoreham power plant.

In July, the town launched a food scrap composting program at town hall to reduce food waste and use the materials for garden beds around town buildings. Also, more than 100 abandoned homes have been demolished across the hamlets, the supervisor said, in an effort to stamp out eyesores and criminal activity in quaint neighborhoods.

“The thing I like most about this job is you can actually make a difference,” Romaine said, adding that successes are made possible because of a mixed-party town board — four Republicans, one Democrat and one Conservative — that he said votes together 99.9 percent of the time.

He made it clear he works with people of all parties and values common ground.

“It’s less about party affiliations and more about common sense and practicality, and doing what works,” Romaine said. “You’re not coming to put boxing gloves on. You’re coming here to do some heavy lifting and that requires teamwork. I am blessed with six good people who vote together, don’t look to create party differences or personality disputes, which you do see in other towns.”

High among his Democratic allies is state Assemblyman Steve Englebright (D-Setauket), who was elected into public office on the same day as Romaine nearly 40 years ago. The two have since worked together on countless issues, oftentimes pertaining to preserving the waterways and natural environment of Brookhaven Town and Long Island as a whole.

During a recent interview, Englebright called Romaine “a peacemaker” who can draw people to their commonalities and pays attention to the things that bring people together.

The assemblyman also credited Romaine with serving as a conduit to Republican state Sens. John Flanagan and Ken LaValle, who have taken up the mantle of inviting local leaders from both parties “into the photo,” so to speak.

Councilwoman Jane Bonner (C-Rocky Point) said all levels of government could learn a lesson from how Romaine leads Brookhaven.

“He eats and sleeps this job,” Bonner said, adding how effective she believes Romaine is. “A board that works as well as we do together benefits the taxpayer. His breadth of knowledge is incredibly impressive, and I always learn something when I’m with him.”

But for all its strength, Romaine said he’s not blind to Brookhaven’s shortcomings and, on a daily basis, asks himself, “What can we do to make this town better?”

He said he wants to dissolve many special districts in the town in order to cut costs and streamline services, push for better treatment and vocational training facilities for struggling drug addicts, and build better public transportation systems.

At the start of Romaine’s career, he taught history in the Hauppauge school district for 10 years and a parochial school in Cedarhurst for two, all the while writing grants for the school district. In 1980, he entered public service and became Brookhaven’s first commissioner of housing and community development before being appointed director of economic development.

Romaine was elected to the Suffolk County Legislature for two terms, in 1985 and 1987, and became Suffolk County clerk in 1989, a post he served for 16 years.

On the side, he took a job at Dowling College teaching managerial economics for seven years, then moved over to teaching history courses at Suffolk County Community College for another seven before landing at Stony Brook University teaching administrative law at the graduate level in 2005 — the same year he was elected again as county legislator of the 1st Legislative District.

When he was eventually approached by Jesse Garcia, chairman of the Brookhaven Town Republican Committee, to throw his hat into the ring for supervisor, Romaine hesitated. He said he loved his job as legislator too much.

“I didn’t want to do it,” Romaine recalled. But it was the memory of his late son, former Brookhaven Councilman Keith Romaine, who died in 2009 from pneumonia-related conditions at age 36, that finally convinced him to pursue the position. “I knew if he had lived, he would have been supervisor. Unfortunately, while it’s usually sons that follow fathers, I did it in reverse.”

He said such personal lows in his life have helped inform how he approaches the position.

“The bottom line is, it’s a very short life,” he said. “I didn’t get into politics to call people names. I got into politics to get something done. This job has a lot of frustrations and I’ll be happy when I leave it, but I’m doing my time here because I still have a sense of purpose.”

Garcia said he’s glad Romaine accepted the job when he did.

“What separates Ed Romaine from the rest is just his ability to not look at challenges but look at solutions that benefit the people of this town,” Garcia said, commending the supervisor on his record of tax control, job growth and bipartisanship. “He will, arguably, go down as one of the most effective, approachable and innovative supervisors in the history of this great town.”
