Port Jefferson Village moved another chess piece in its match against the Long Island Power Authority last week, filing a lawsuit to dispute the utility’s property tax challenges from the last few years, which are still pending in court.

Village Attorney Brian Egan said at the board of trustees meeting Tuesday night that the village filed the lawsuit last Friday contending LIPA had promised not to challenge its property tax assessment at the Port Jefferson power plant unless the assessment was disproportionately increased.

That perceived promise links back to a 1997 letter from former LIPA chairman Richard Kessel, upon inking a power supply agreement between LIPA and the Long Island Lighting Company, as the former was taking over for the latter. That agreement covered power plants now owned and operated by energy company National Grid, which includes those in Port Jefferson and Northport.

Back then LIPA and local municipalities were embroiled in other tax assessment challenges. Kessel’s letter said the utility would drop those challenges and would not “initiate any further tax certiorari cases on any of their respective properties at any time in the future unless a municipality abusively increases its assessment rate.”

Port Jefferson has actually gone in the opposite direction on the neighborhood power plant’s assessment, officials confirmed Tuesday — LIPA’s assessment was only proportionately increased over time, and since it began challenging its assessment in 2010, it has in fact seen a decrease. Officials called that 10 percent decrease an act of good faith as they negotiated with the utility on the matter.

At the heart of the issue is a disagreement over the worth of the local power plant: LIPA contends it is grossly overassessed, forcing the utility to pay more in property taxes than it should.

The power plant is a large source of tax revenue for the area, particularly the Port Jefferson school district and the village. Smaller stakeholders include the Port Jefferson fire and library districts and the Town of Brookhaven.

As LIPA’s property tax challenges trickle through the court system, Port Jefferson’s latest lawsuit piggybacks on an idea from out west — Huntington Town and the Northport-East Northport school district filed a similar suit a couple of years ago in their battle on the Northport power plant, which mirrors the situation in Port Jefferson. That inceptive lawsuit, challenging LIPA’s ability to challenge its property tax assessment, faced a motion to dismiss that New York State’s highest court recently denied — allowing the case to play out. Seeing the ruling in favor of Huntington and Northport, Port Jefferson followed suit.

“I feel very strong,” Egan said about the case.

According to the village attorney, he will ask that court action on LIPA’s tax challenges be delayed until the new lawsuit is resolved.

The Port Jefferson and Huntington area lawsuits may also be joined, and it is possible more plaintiffs, such as Brookhaven Town and the Port Jefferson school district, could jump in.

At the time the courts denied LIPA’s motion to dismiss Huntington Town and the Northport school district’s lawsuit, a LIPA spokesperson said the utility does not comment on ongoing litigation.

If the municipalities win their lawsuits regarding LIPA’s right to challenge its property tax assessments, those pending challenges would be thrown out.

A bird has got new wind beneath its wings, thanks to rescue efforts by the Suffolk County Police Department’s Marine Bureau, whose officers freed the creature on Sunday after it became entangled on an offshore fuel platform in Northport.

Officers Charles Marchiselli and Michael O’Leary were aboard Marine Bravo when they observed the bird tangled in string along the railing of the platform, about two miles north of National Grid’s Northport power plant, at approximately 11:15 a.m. O’Leary distracted the bird with a wildlife pole while Marchiselli covered it with a blanket and cut the entangling lines.

The bird appeared uninjured and swam away after being freed, police said.

The officers saw the bird while they were conducting a homeland security check of the platform, which is used to offload fuel for the power plant.

National Grid owns and operates the plant, and sells its produced energy to utility PSEG Long Island, which distributes the power to Long Island residents.

Supreme Court judge throws out lawsuit against Shoreham solar project

Brookhaven Town reached the trifecta of adopting renewable energy codes when it embraced Suffolk County’s model solar code last week.

After previously adopting the county’s geothermal and wind energy codes, the Brookhaven Town Board approved the one for solar, which will permit solar energy production facilities by planning board special permit in the town’s industrial zones. According to Suffolk County Planning Commission Chairman Dave Calone, the town is the first in the county to adopt all three model codes.

“Brookhaven is the place where renewable energy is moving forward,” Calone said prior to a public hearing on the matter on Aug. 6.

Deputy Town Attorney Beth Reilly said the code applies to the town’s industrial districts, L Industrial 1, light industry; L Industrial 2, heavy industry; and L Industrial 4. Permitted uses in light industry include banks, agricultural or nursery uses, places of worship, day cares, health clubs, manufacturing within a building, offices and warehouse spaces, while uses in heavy industry include manufacturing of asphalt, cement fertilizers, and chemicals; junkyards; farmers markets and stockyards. L4 districts deal solely with the generation, transmission and distribution of electrical energy.

“The intent of this section [is] to provide adequate safeguards for the location, siting and operation of solar production facilities,” the code states.

The day before the Town Board’s adoption, a state Supreme Court judge dismissed a lawsuit against the town, its planning board and zoning board of appeals that sought to overturn the town’s approvals for a solar-energy production facility in Shoreham.

Eight Shoreham residents listed under the community group Shoreham Wading River Advocates for Justice filed the lawsuit in November against the town entities, along with sPower, a renewable energy company based in Utah and California, and utilities PSEG Long Island and the Long Island Power Authority. sPower has an agreement to sell power generated at a future 50,000-solar panel facility, located on the DeLalio Sod Farm, to PSEG. Many residents who live near the farm have advocated against it, saying the project is too large for a residential area.

Calone said he believes the new solar code, which outlines where the solar arrays should be located, will lead to new projects being welcomed to communities.

The total coverage of solar panels cannot exceed 60 percent of the lot area and freestanding panels cannot reach more than 20 feet above the ground, according to the code, which also adds buffer and setback restrictions. In addition, the code outlines design standards for the solar panels.

Supervisor Ed Romaine (R) thanked Calone and Councilmembers Valerie Cartright (D-Port Jefferson Station), Jane Bonner (C-Rocky Point) and Connie Kepert (D-Middle Island), who worked with the county on the code.

“The one thing that is so beneficial is getting uniform code that can apply to all 10 towns so there is no guessing,” Romaine said. “It isn’t different from one town to another. It makes it simple for alternative energy to move forward.”

The first net-zero energy use store in New York opened in Miller Place on Friday.

Brinkmann True Value Hardware is the first building in the state to earn the net-zero status, according to PSEG Long Island. This means the total amount of annual energy used is approximately equal to the amount of renewable energy created on the property.

Local elected officials, members of PSEG Long Island and Green Logic Energy, a renewable energy design and installation company, attended the grand opening.

“We were always interested in solar power, but when we met Al, it grew into something bigger. Net-zero energy got in our head, as soon as we heard of the idea we fell in love with it,” co-owner Ben Brinkmann said.

Al, or Albert Harsch, renewable energy consultant for Green Logic Energy, was very excited to see the idea come to fruition.

“It stands as an example of what businesses can do on Long Island and I want to congratulate the Brinkmann family for being pioneers in this.”

Green Logic Energy was contracted by the Brinkmann family to design and enhance the different technologies needed to effectively and efficiently create a net-zero result.

During the planning and construction phase, the family also worked with PSEG through the utility’s Commercial Efficiency Program, which offers resources as well as rebates to customers who install energy efficient equipment.

The Brinkmann family was surprised to find out that they were the first net-zero building not only in their industry, but also the first retail facility in the state.

Energy efficiency measures for the store include solar panels, geothermal heating and air conditioning, LED lighting and equipment, and a thermoplastic cool roof. The cool roof is able to reflect sunlight and heat away from a building, which reduces the roof temperature.

By employing energy efficient measures, store will save 64,000-kilowatt hours of energy per year, for savings of roughly $11,000 annually.

According to PSEG, the initiative is equivalent to removing 27 cars from the road or 14,804 gallons of gas not consumed, annually.

“These small businesses continue to invest in the community, and we’re seeing a resurgence of these kind of establishments, our residents want a personal touch when they shop,” Brookhaven Highway Superintendent Dan Losquadro (R) said.

Losquadro said he hopes the store will serve as an inspiration and model for the town.

The Brinkmann family is in no way done with their efforts.

“We have more expansion planned, it’s our goal by 2025 to be net-zero company-wide,” Brinkmann said.

A new Huntington Town citizens group will boost a movement to upgrade the Northport power plant, independently studying the issue and submitting ideas to town officials.

The town board, on Tuesday, unanimously supported a measure co-sponsored by Huntington Town Supervisor Frank Petrone (D) and Councilman Mark Cuthbertson (D) to create the Repower Now Citizens Committee, a group of nine who will weigh in on an analysis the Long Island Power Authority and National Grid are conducting with respect to repowering, or upgrading, the plant.

Earlier this year, the state charged LIPA and National Grid with studying the feasibility of repowering the Northport power plant, the Port Jefferson power plant and others. Having the Repower Now Citizens Committee can only boost that effort, Cuthbertson and Petrone said in interviews with reporters after Tuesday’s meeting.

Local leaders want to see the aging Northport plant repowered so it will remain a source of energy and property tax revenue for years to come. Several local budgets, including that of the Northport-East Northport school district, rely heavily on the tax revenue.

Upgrading the Northport power plant can be done, Petrone said. It will be the new group’s responsibility to support repowering by producing a factual analysis on the issue.

“Our plant is probably the most viable plant to be utilized for that,” Petrone said, explaining Northport’s advantages in being repowered. “It has property available and it can be expanded. The need now is to put together a group to basically put some kind of study together … to support this. And there are many people out there that have expertise that we would wish to tap.”

Membership would include at least one person each from Northport and Asharoken villages, someone from the Northport-East Northport school district and members with engineering and sustainable energy backgrounds.

Repowering has another benefit: It may help settle a lawsuit LIPA brought against the town, challenging it over the value of the power plant.

LIPA claims the plant has been grossly over-assessed and the utility has overpaid taxes to the town. If LIPA’s suit is successful, the judgment could translate into double-digit tax increases for other Huntington Town and Northport-East Northport school district taxpayers.

If, however, the utility chooses to repower by upgrading the facility, the town has offered to keep its assessment flat, preventing those skyrocketing taxes.

“It’s a lawsuit that’s a very, very high-stakes lawsuit,” Cuthbertson told reporters after the meeting. “We have to look at both legal and political solutions, and political being through legislation. This is a part of trying to formulate a legislative solution and come up with a compromise that we might be able to work through.”

Petrone said he hopes to have the repowering citizens group assembled within a month.

Port Jefferson Village will study its own potential in hooking up the community to a backup energy grid, thanks to a $100,000 grant it won last week.

The governor recently announced that several dozen communities across New York, including Port Jefferson, were awarded grants through a New York State Energy Research and Development Authority competition to perform feasibility studies on building the backup grids, known as microgrids.

Microgrids are independent of the regional grid and rely on their own power-generating resources — and thus can keep communities going during power outages. According to the governor’s office, the grids “would integrate renewable power with other advanced energy technologies to create a cleaner, more affordable and more resilient localized energy grid for a limited number of users.”

Port Jefferson Village officials began exploring the idea earlier this year because the area has several critical community and emergency services packed into a small area, and those services cannot stop when an event like a hurricane or a snowstorm knocks out power.

“During a severe weather event such as we had with [hurricanes] Irene and Sandy, where the hospitals lost power and some of us lost power — some up to 14 days, [and the] hospitals were out eight to 10 days — those … patients that were on critical care services were put in harm’s way,” Mayor Margot Garant said during a previous village board meeting. “So basically if we have a microgrid during those severe weather systems … where the overall grid goes down, we flick a switch and keep our critical services online.”

The $100,000 the village won was in the first stage of grants through NYSERDA’s microgrid funding competition. After Port Jefferson works with consultants and local stakeholders, such as the fire department, over the coming months to research its project proposal from technical, operational and financial standpoints, it may apply for more funding to advance microgrid construction efforts.

In choosing which projects to award grants to, NYSERDA is using criteria such as the area’s level of vulnerability to outages, how a microgrid would improve community function and the possible effect on ratepayers.

“We have two major hospitals, a ferry, a railroad station, our own school district, a village hall, a wastewater treatment facility, a groundwater treatment facility, an ambulance company,” Garant said. “We have a lot of emergency services-related components within a very small radius.”

Port Jefferson is not the only local government working toward microgrid grant money. The Town of Brookhaven and the Town of Huntington were also awarded $100,000 grants to perform studies on their own proposed projects — Brookhaven Town, with help from Brookhaven National Laboratory, is seeking to put in a grid to support Town Hall as an emergency operations center and two nearby Sachem schools as emergency shelters; Huntington Town wants to build a backup grid for their own Town Hall, Huntington Hospital, the local wastewater treatment plant and community centers.

Between Nassau and Suffolk counties, NYSERDA awarded grants to 14 projects.

Power generation and distribution in the U.S. used to operate at a local level, but grids became more regional over time to make utilities more cost-effective and reliable, according to NYSERDA’s website.

“These systems are, however, vulnerable to outages that can impact large regions and thousands of businesses and citizens, particularly as a consequence of extreme, destructive weather events.”

The idea of installing solar panels to a roof as a source of electricity for a home is not exactly prehistoric.

Reducing the use of electricity or gas to power and heat homes undoubtedly has a positive effect on the environment. Despite being fairly new to the market, solar panels may be supplanted soon by a less expensive, more effective alternative.

Solar shingles have been available in the United States for about five years, according to an estimate by Richard Ciota, a Stony Brook resident who owns Division 7 Inc. Ciota’s 21-year-old roofing company is located in Lake Grove. Its residential division is the only one in the Suffolk County, Nassau County and New York City areas permitted to sell Dow Powerhouse solar shingles.

Solar panels have been available for decades, Ciota said in an interview at Division 7’s main office. They are at this point more efficient in generating electricity than shingles in terms of kilowatts per-square-foot of roof space, though there are problems associated with panels that contribute to the higher cost Ciota said.

“When you’re putting a solar panel onto a roof surface, you’re mounting that solar panel to the rafters through the existing roof,” Ciota said about the older technology, which his company offered prior to the availability of shingles. “So the waterproof technology has got to be perfect because you could be putting 40, 50, 60 penetrations through a perfectly good roof.”

Wind, shade from trees, excessive heat and animals are other factors that Ciota said are enemies to solar panels, which are installed on top of asphalt shingles and leave wiring exposed to the elements. Wind can cause the panels to pull the asphalt shingles away from the roof, which is an annoying and costly problem to have to fix after panels are installed.

Solar shingles replace asphalt shingles. They are waterproof and work in the same way that any conventional asphalt shingle would along with the added benefit of a reduced electric bill and a more environmentally friendly home than one that runs on electricity or gas heating.

Despite availability and the obvious benefits, solar panels only currently exist on about 5 percent of Long Island homes, according to Ciota. The number of homes with solar shingles is exponentially smaller.

John Petroski, Division 7’s director of solar and residential operations, estimated that the company has done about 70 shingle installations on Long Island since 2012 when Dow partnered with Division 7 Inc. Petroski said they have about 35 booked jobs left to complete, as part of Dow’s pilot program, which offered leasing or purchasing options to consumers.

“The way [Dow] is moving forward with the technology of the shingles, the improvements they’re making — they’re covering their bases,” Petroski said in reference to the notion that unanticipated issues have arisen as solar panels have gotten older, which could also happen to the shingles.

“I personally think the solar shingle will take over the marketplace,” Ciota said about the future as the technology continues to be upgraded. “There are new generations of solar shingles that will be coming out that will increase its efficiency and eventually they’ll probably tie up and meet [the efficiency of panels].”

Other companies sell solar shingles on Long Island, though Dow’s are widely considered to be on the cutting edge. In 2012 Dow received a Breakthrough Award from the magazine Popular Mechanics for pioneering an integrated solar roofing system, according to a press release on Dow’s website.

A new Smithtown code has already translated into some cash.

PSEG Long Island presented Smithtown Supervisor Pat Vecchio (R) with a $10,000 check last Friday for adopting a new model geothermal code.

The utility provided an incentive program for any Long Island township that embraced the new geothermal codes, which utilize the constant, belowground temperature to heat and cool buildings, and help homes save both energy and money. PSEG Long Island committed to provide implementation assistance of $10,000 to each township and $5,000 to the first 10 villages with a population greater than 5,000 in Suffolk and Nassau counties that adopted the model geothermal code by May 31.

This particular new geothermal code helps municipal and private industry installers streamline the evaluation and installation process of the geothermal system in Suffolk County and ensures high quality installations to protect the county’s groundwater.

Vecchio said he was proud that Smithtown was the first town to adopt the code.

“I believe it’ll be a wave of the future;  we want to be the first ones to allow this new energy to come in,” he said.

When PSEG Long Island and the Long Island Geothermal Energy Organization unveiled the new energy code back in November, Suffolk County Executive Steve Bellone (D) stood with the organizations, urging towns to consider the adoption.

Smithtown’s Town Board voted in March to make Smithtown the first town in Suffolk County to adopt the new alternative energy geothermal code for residential and commercial properties.

This is not the first time Smithtown has been one of the firsts to adopt alternative energy codes, signing onto a model code crafted at the Suffolk County Planning Commission for solar energy. The model code helps municipalities evaluate proposed solar energy systems for both commercial and residential properties.

Back in March when Smithtown adopted the code, Michael Kaufman, of the county Planning Commission helped draft the model code and said he believed that Smithtown residents needed to act locally by going green as much as possible because of the energy crisis on Long Island, with Long Island having some of the highest electrical rates in the nation.

“There is an energy crisis on Long Island,” Kaufman said at a previous town meeting. “We have some of the highest electric rates in the entire nation. Fossil fuel energy has high costs and we have severe environmental costs when fossil fuels are used. Town of Smithtown residents need to think globally and act locally by going green as much as possible.”

With several emergency services packed into a small area, Port Jefferson Village officials hope to secure a grant from the New York State Energy Research and Development Authority toward building a local backup energy grid to be used in case of a crisis.

The village applied for the NYSERDA grant to build the backup grid, known as a microgrid, through a statewide competition because of the critical community services that cannot stop functioning during a power outage, Mayor Margot Garant said.

“During a severe weather event such as we had with [hurricanes] Irene and Sandy, where the hospitals lost power and some of us lost power — some up to 14 days, [and the] hospitals were out eight to 10 days — those … patients that were on critical care services were put in harm’s way,” Garant said at the village board of trustees meeting Monday night. “So basically if we have a microgrid during those severe weather systems … where the overall grid goes down, we flick a switch and keep our critical services online.”

Port Jefferson Village is not the only municipality on Long Island applying for a slice of the pie. Huntington Town officials recently agreed to pursue the grant funding for their own microgrid, to support buildings like Huntington Hospital and the town’s wastewater treatment plant. And a month ago, NYSERDA awarded the first five grants — $100,000 each — to communities from Buffalo to East Hampton, so the applicants could perform feasibility studies on their projects.

NYSERDA expects to announce the next round of grant winners soon.

The other zones are Long Beach, Montauk, Hewlett Bay and Inwood. Statewide, there are eight other regions that have their own opportunity zones.
