Resident trying to repair cracked bulkhead calls fee "highway robbery"

Things are rocky between the North Shore Beach Property Owners Association and surrounding residents.

Locals from the close-knit beach community of Culross Drive in Rocky Point are voicing their frustrations over what they call an egregious hike in fees and membership requirements put in place by board members of the private beach association in the aftermath of Hurricane Sandy.

According to residents, the association has been charging homeowners who live on the bluff up to $3,800, and now possibly more, just to gain access to their beach. If a Culross Drive resident has a bulkhead in need of repair, the fee is for vehicles to drive a few hundred feet over the association’s private beach in order to reach Culross Beach homes.

There is no other way for the machinery to enter Culross Beach, residents said, and in the past all who needed access through the association’s property were charged with a performance bond of about $250 and asked that the contractor include the association on their construction insurance policy in case any damage to their beach occurred.

The North Shore Beach Property Owners Association so far has not provided an explanation to residents as to why the fee was raised so high, despite numerous attempts to get answers by email and phone.

The group did not respond to multiple requests for comment. Only members can log onto the website in order to read the constitution and by-laws.

While repairs to bulkheads are usually few and far between — as most are projected to last several decades — bulkhead maintenance is crucial for those who live in the beach side community, according to Susan McCormick, a Culross Drive resident since 1981.

“We are religious about it here,” McCormick said. “Every single one of us, at some point in time, have needed bulkhead repairs. If you don’t maintain it, all of the sand slides down, the bulkhead could disappear and then the sand would  just creep onto the next property. Once all that slides down, the top of your property is going to go. It’s cost me a fortune over the last few years — after the two hurricanes — to repair.”

McCormick, 66, the co-owner of School of Fish Swim and Scuba in Rocky Point, said she first heard of the hiked-up fee about a month ago when she pursued the replacement of a cracked piling on her bulkhead.

“It’s cruel and they don’t need this money. I can’t imagine what they’re even using it for or what their excuse is for doing it.”

After a neighbor informed her of the $3,800 charge just to get the repair equipment over to her property, she called the association. She didn’t receive a response, and proceeded to contact members of local government, including Brookhaven Town Councilwoman Jane Bonner (C-Rocky Point), Highway Superintendent Dan Losquadro (R), and a representative from the Environmental Conservation Office in Stony Brook.

While she said those in Brookhaven have been sympathetic and supportive of her concerns, McCormick was told there was nothing the town could do about it because the beach belonging to the association is private property.

She said the association did not waive the fee, even for a neighbor whose house was and still is in danger of sliding down the bluff due to severe damage from Hurricane Sandy.

“It’s wrong what the North Shore Beach Association is doing and I’m not giving up,” McCormick said of her determination to speak with someone on the association’s board. “I would never do to another person what they’re doing. It’s cruel and they don’t need this money. I can’t imagine what they’re even using it for or what their excuse is for doing it. We’re not doing any damage to their little section of beach. This is what I call highway robbery — they’re making money from people’s misfortunes.”

Pete Falcetta, president of the private Culross Corporation said McCormick is doing the right thing.

“[She’s] trying to make an emergency repair the proper way by stopping the bleeding, and yet she’s being forced to pay this exorbitant fee that’s more than the original repair,” he said.

Mickey Wolcson, one of McCormick’s neighbors who has lived on Culross Drive for 11 years, said he’s long thought about filing a lawsuit against the association ever since he became the first and last person to pay the $3,800 charge two years ago. His house and bluff plantings were in danger of sliding down, so he needed to make the urgent repair. He said he was flabbergasted when he discovered how much it would cost.

According to Wolcson, the association also pushed a 10-year membership on him in order to maintain his bulkhead. When he called and finally reached someone on the board at the time, he said he received no sympathy.

Recalling the conversation, Wolcson said when he informed the board member he didn’t want the 10-year membership, explaining that he had his own beach, he was told, “that’s the only way that this can happen.”

“They’re forcing you to become a member even when you don’t want to be one,” Wolcson said. “There’s no justification in this. I think it’s just pure greed. I don’t think they want more members, they want more money. Are they running on a deficit? Why are they stealing money from their neighbors?”

Losquadro called the access charge “excessive and unwarranted” in an email.

“I have been contacted many times about this issue and the sentiment is always the same; the association is just punishing the very neighbors they are purportedly protecting,” Losquadro stated.

Bonner said she is also continually contacted by people losing bulkheads and running the risk of losing their homes because of the charge.

“One of the nice things about Rocky Point is that it’s a very cohesive community and everyone works very well together, except in this instance, and it’s very disappointing,” the councilwoman said. “It’s just not neighborly and is an instance where some compassion and kindness would go a very long way, especially when you’re talking about people that run the very real risk of losing their house.”

The phrase “rocky road” will be reserved exclusively for ice cream in Rocky Point following the completion of a large paving project.

Brookhaven Town Highway Superintendent Dan Losquadro (R) and Councilwoman Jane Bonner (C-Rocky Point) were on sight at Magnolia Drive to announce the completion of a 17-road paving project in the residential neighborhood.

“The residents can now drive more easily and safely through this neighborhood since the repaving has been completed,” Bonner said. “I thank Superintendent Losquadro and the men and women of the highway department for the important work they do in my district and throughout the Town of Brookhaven.”

While this project did not involve any concrete work, 60 drains were repaired or replaced before milling and paving began. The total cost for this paving project was $537,000.

Roads paved during this project included: Acacia Road, Beech Road, Cedar Road, Club House Drive, Dogwood Road, Elm Road, Forest Road, Garden Road, Grove Road, Hickory Road, Lincoln Drive, Magnolia Drive, Queen Road, Robin Road, Sycamore Road, Tulip Road and Vine Road.

“Many of the side streets off of Magnolia and Hickory Drive were in severe need of repair,” Losquadro said. “I am happy to complete this project and provide residents and motorists who travel these roadways on a daily basis with some much-needed relief.”

The town also completed a 16-road paving project in the area soon after. The two were big projects that were completed during 2017’s pavng season.

Like the first, this project also did not involve any concrete work, and 45 drains were repaired or replaced before milling and paving  took place. The total cost for this paving project was $390,000. 

Losquadro said milling and paving proved to be challending with some of the narrow, hilly roadwars in the area, but the department managed to get it done.

“Residents and motorists who travel these roads on a daily basis can now enjoy a safer, smoother ride,” he said.

Roads resurfaced include: Aloma Road, Azur Road, Corona Road, Floral Road, Mars Road, Misty Road, Nimbus Road, Pearl Road, Phoenix Road, Pigeon Road, Shell Road, Sky Road, Somerset Road, Sunburst Drive, Surf Road and Woodlawn Road.

“Rocky Point residents can drive again with confidence,” Bonner said, “knowing that these roads are much safer now that they are repaved and drainage is improved.”

Sound Beach’s shoreline is now stabilized.

In October 2012, Hurricane Sandy changed the typography of much of the North Shore’s beaches and dunes. In Sound Beach, the bluff at Shore Road and Amagansett Drive became severely eroded. With roads and homes at risk, the Town of Brookhaven Highway Department began a four-year, multiphase $1.3 million project in May 2013 to steady it.

“The hardening of our infrastructure leaves us less vulnerable to damage from future storms,” Highway Superintendent Dan Losquadro (R) said. “In the long run, the results of this project will save taxpayer dollars due to fewer erosion costs in the area.”

To stabilize the bluff, almost 2,000 cubic yards of clean fill was added and an outfall pipe replaced, which broke during Hurricane Sandy. The work was approved by the Federal Emergency Management Agency, and $233,651 in federal assistance was received to help with the cost of the project.

The work on the bluff and the repair of the pipe were never meant to complete the project, but, according to Losquadro, was just a first phase.

“It was just a temporary ‘Band-Aid’ so the bluff wouldn’t erode any further and jeopardize the structural integrity of the drainage pipe,” he said. “Our ultimate goal was to eliminate the outfall over the bluff completely, abandon the drainage pipe and direct all of the water from this stream into a newly constructed recharge basin to the east of Amagansett Drive.”

He said the project offered the town the rare ability to eliminate an outfall pipe, preventing stormwater runoff from flooding the beach and entering the Long Island Sound, while also taking erosion pressure off the face of the bluff.

Once construction of the recharge basin near the intersection of Amagansett Drive and Shore Drive was completed in 2015, the final phase of the project began, which included the abandonment of the pipe and permanent stabilization of the bluff through the installation of a three- to four-ton armoring stone revetment wall, erosion control matting, wood terracing and native plantings. The project also included the installation of a new staircase from Shore Drive.

“As a town, we need to make sure there is reliable access that will be there season after season for our fire department and police in the event of an emergency,” Losquadro said.

This phase was completed with in-house resources and came in under budget.

Although the temporary stabilization of the bluff received funding from FEMA, the storm hardening and total bluff restoration was paid for through town capital funds. The total cost for Phase II — construction of the recharge basin — was $633,333 and for Phase III — storm hardening and bluff restoration — was $450,000.

“Completion of this project on time and under budget after being stalled by [Hurricane] Sandy is a welcome event to the residents of Sound Beach,” Brookhaven Town Councilwoman Jane Bonner (C-Rocky Point) said. “The bluffs along the North Shore are especially vulnerable to erosion, but the more we can do to stabilize our shoreline, the safer it will be.”

Six more weeks of winter or an early spring?

Pennsylvania may have the legendary groundhog, Punxsutawney Phil, but New York has Malverne Mel, Holtsville Hal, Sweetbriar Sam and even Staten Island Chuck and Dunkirk Dave.

In the Town of Brookhaven, the great prognosticator of prognosticators, Holtsville Hal will be the star of the day as the Brookhaven Wildlife and Ecology Center Animal Preserve will celebrate with its annual Groundhog Day event on Feb. 2 with the gates opening at 7 a.m. Wayne Carrington will return as the master of ceremonies and Hal will be handled by Greg Drossel.

According to tradition, if a groundhog sees its shadow after stirring from hibernation on Groundhog Day, there will be six more weeks of winter weather; if not, spring should arrive early. Highway Superintendent Dan Losquadro (R) will serve as Mayor of the Day and reveal Hal’s forecast at approximately 7:25 a.m. “Our annual Groundhog Day celebration is an enjoyable tradition for many local families,” Losquadro said. “While I’m always hopeful Hal will not see his shadow, predicting an early spring, either way this is a much-anticipated event each year in Brookhaven Town.”

“Groundhog Day at the Ecology Site is always fun for families who have made it an annual tradition and for those who come for the very first time,” said Brookhaven Town Supervisor Ed Romaine (R). “I always look forward to Holtsville Hal’s prognostication, but I hope he doesn’t see his shadow and we have an early spring.”

Although he’s sure to be the center of attention, Holtsville Hal will not be the only animal available for viewing on Feb. 2. Following the ceremony, the community is welcome to stay and enjoy some free hot chocolate and visit the more than 100 animals that live at the animal preserve, which will remain open until 3 p.m. at no charge.

The Town of Brookhaven is embracing the modern age to help prepare for severe weather.

With snowstorm season fast approaching, Highway Superintendent Dan Losquadro (R) is making it a whole lot easier to clear roadways with the roll out of a new app designed to help foremen streamline the process of contacting hired drivers and achieve efficiency through technology.

The “call-out app,” created by Losquadro and staff in the Division of Information Technology, will do away with the old system in which foremen had to go to their offices and make calls to each individual driver to confirm who was working, what town to respond to and what time their services would be needed. With 1,194 active snow removal vendors throughout the district, that process could take up to four hours — precious time that could be better spent plowing the streets.

With the new app, drivers provide their cell phone numbers and email addresses, and from the comfort of their iPads or iPhones, foremen can simply send a text or email about the specifics of the job — what yard to report to, what equipment or vehicle to use, what time to start — and get instant yes or no responses as to who’s available to work.  Foremen are able to see, in real time, who is coming in, who isn’t, and can dictate how many total vendors will be in specific areas.

Address hyperlinks are also included, so with the click of a button, the driver is brought directly to a map with directions to the given job site.

By automating the process and having such an immediate call-out, snow removal vendors can get to roads faster by several hours, saving the Town and its residents time and money.

“There’s no reason government needs to be archaic and not operate with the same technology that we’re using everyday of our lives outside of government,” Losquadro said. “I’ve been striving to bring us into the modern age, and this is just another step toward that. This is technology that everyone is very comfortable and well-acquainted with. The app is going to make us more efficient; we can actually spend our time doing the work that needs to be done.”

Losquadro introduced and trained supervisors and field workers on a custom-built, electronic work order system last year, developed a system to track work orders during severe weather the year before that, and is currently in the process of making an electronic time sheet program that will keep track of work hours operational before the end of this snow season.

He said he and the IT staff have been able to build these programs in-house, rather than go out to consultants and spend thousands of taxpayer dollars. From concept to reality, the call-out app took roughly four months to get off the ground and functions on an Apple-operating system, making it as user-friendly as possible. The app can run on desktop computers, tablets and iPhones.

Matt Sabatello, an IT staff member, said a test of the app was conducted in early December and feedback from foremen has been incredible.

“The app allows for better decision-making for foremen,” he said. “It gives them a good idea of which vendors are responding to work in what areas and, if need be, allows them to react immediately to reassign a vendor to an area that nobody may have been calling in about.”

With Brookhaven being such a large township, Losquadro said “there’s no reason we shouldn’t be leading the way.”

“I’m very proud of what we’ve been able to accomplish,” he said. “I’ve had a lot of ideas about what I’ve wanted to do, and being able to [see them through] has been very satisfying. The app is a fully live and operational system and, God willing, I won’t have to use it that much this year.”

Receiving keys can be a magical moment for anyone, but for Joe Cognitore and Mark Baisch, they’re more excited about handing them over.

The Rocky Point VFW Post 6249 commander and the developer and owner of Landmark Properties, respectively, have been building and giving homes to veterans for the last four years. They’ve created 11 homes so far, and this year, the duo amped up the intensity to build three homes, with a fourth in the works.

For their work in the community and for dedicating their time and efforts to honoring and helping those who served our country, Cognitore and Baisch are Times Beacon Record News Media’s People of the Year for 2016.

“It’s bittersweet,” Cognitore said. “There’s many candidates that we come across and every one of them deserves the home. Just to hear their stories is amazing.”

Cognitore first met Baisch at a fundraiser Brookhaven Town Highway Superintendent Dan Losquadro (R) was hosting. Not knowing anyone at the event, the two found themselves sitting at the same table, and Cognitore began talking about the possibility of building a home for a disabled veteran.

“I thought it’d be one and done,” Baisch said, laughing, while thinking about the first home. “I never thought it would get to this level, but what we’re able to do for these families is so good that it would be hard for me to think about not doing this.”

The two recently unveiled the 11th home for returning veterans to the Cote family, who now own a home in Miller Place. The Bonacasas and Johnsons also received homes this year.

“I’m at a loss with words for everything they did for me and my family,” Deborah Bonacasa said. She is an Air Force veteran whose husband, Staff Sgt. Louis Bonacasa from Coram, died after a suicide bomber detonated himself outside Bagram Airfield in northwest Afghanistan. “They’re professional and thoughtful. I think it’s great what they’re doing for veterans and recognizing and advocating and stepping up to do things for those who do so much for our country. This house is, and they are, a constant reminder that there are great people still out there willing to help people.”

Rocky Point social studies teacher Rich Acritelli said no one cares more about veterans — and the entire hamlet — than Cognitore.

“He’s always got the community at his heart,” he said. “He personifies everything that a citizen should be, in terms of national and local service, between being in the military and always working for the betterment of his community.”

Suffolk County Legislator Sarah Anker (D-Mount Sinai) was proud to see how the two stepped up for the Cote family, who were kicked out of their home when the landlord let the Sound Beach property fall into foreclosure. The family has also struggled with illness. Mother Renée Cote has acute intermittent porphyria, a rare and painful metabolic disorder that requires expensive biweekly treatments, which she has undergone for 14 years at John T. Mather Memorial Hospital in Port Jefferson. Her 7-year-old son, Zachary, was diagnosed with Grade 4 medulloblastoma, brain cancer, in June 2014, and endured 42 rounds of radiation and nine months of intense chemotherapy, until he was also diagnosed with acute intermittent porphyria.

“They are literally warriors to those that need help,” Anker said. “They get out there, they understand the struggles and they’re there to help, and that’s what’s so important. When Mark heard about Zachary Cote’s situation, he came to the rescue. Talk about superheroes, they are our local superheroes.”

Cote’s husband Glen was a U.S. Army combat medic in the Gulf War, before coming home and suffering an on-the-job injury that disabled him.

“Anyone that met them couldn’t believe what a great family,” Cognitore said. “Especially Zachary, what a little gentleman.”

But Renée Cote said she can’t believe what a great group Cognitore, Baisch and the rest of the developers and donators are.

“I could sit there and write a million thank you cards, and to me, it would not be enough for what they’re doing,” she said. “And I don’t even think they realize what they’re doing. To first serve our country, and then to give back — and I mean give back in a huge way — it’s good to be surrounded by people like that. They’re angels walking the Earth.”

Baisch said his contractors and the community showed more support for the Cotes’ new home in Miller Place than on any other house. There were over 30 volunteers, some of whom have been helping Baisch since the first home. Many of them donate windows, garage doors, bathtubs and furniture. Local supermarkets and civic associations also give gift cards to help the new family acclimate to the area.

“They just continue to give and give and give every time we do one of these homes, and they never let me down,” Baisch said of his contractors. “It’s really the only way these homes could come together. We’re not a charity; we consider these homes a hand up, not a hand out. They do the best they can and it’s amazing how much they keep giving. It shocks me after 11 houses that they’re like ‘Mark, let’s do more.’”

Cognitore said he enjoys creating a community of veterans.

“Once they get into these homes, they’re a great neighbor, a great citizen, they keep up their homes, they pay their taxes, so everything works out,” he said. “It’s a win for everybody.”

The veterans appreciate that as well.

“It makes me feel at home knowing there are veterans out there like me,” Bonacasa said. “If we ever needed each other, we’re right there.”

Brookhaven Town Councilwoman Jane Bonner (C-Rocky Point) said she’s thankful that most of the homes have been built in her district.

“It’s very heartwarming,” she said of the welcome-home ceremonies. “It’s impossible to not get choked up. Especially the most recent one with the Cote family — they’ve had some significant challenges. They were struggling, and Joe and Mark saved them.”

Baisch said that the real tragedy of it all is the fact that without his help, the families wouldn’t be able to remain on Long Island.

“They had no real chance of having a family here and living here if it weren’t for these homes, so that’s the all-encompassing enjoyment out of it,” he said. “These people would have been long gone, and they’re not the types of people we’d like to see leave Long Island. They served their country and they’re Long Islanders, each and every one of them. For them to have to leave because they can’t afford to live here, there’s something wrong with that.”

Bonner said what the “dynamic duo” does shows their true character.

“Mark is very altruistic, and he’s never looking for a pat on the back about it, he just feels passionately about it and does it because he thinks it’s the right thing to do,” she said. “And Joe is a tremendous advocate for veterans and a true Patriot. Their hearts are bigger than their wallets. It’s more about doing the right thing than it is about making money.”

Baisch said as long as Landmark Properties is around, he’ll continue to do something like this.

“It’s one of the best feelings of my life,” Baisch said. “I can’t explain it. I can’t come up with words enough to tell how wonderful it feels. The thought of not continuing doing this doesn’t even enter my mind.”

Town of Brookhaven Highway Superintendent Daniel P. Losquadro recently announced the return of the annual Brookhaven Town Holiday Spectacular, an indoor, walk-through holiday light show benefiting the animals at the Holtsville Ecology Site.

Last year, several thousand people walked through the winter wonderland of lighted, festive displays, before stopping to take their photos with Santa in his workshop. Admission to this event is $5 per person; children 3 and under are free. There are additional fees for raffles and photos with Santa. All proceeds benefit the Brookhaven Wildlife Center, Inc. and go directly to the feed and care of the more than 100 animals residing at the Ecology Site.

“This is a fun-filled, affordable entertainment option for families who want to come and enjoy the spirit of the holidays,” Superintendent Losquadro said. “I want to thank my staff at the Ecology Site for working so diligently to transform the greenhouses and make this event so memorable. Over the years, walking through the Holiday Spectacular has become a wonderful holiday tradition for many families.”

The show will run Dec. 3, 4, 9, 10, 11, 16, 17 and 18; hours on Fridays and Saturdays are 5 p.m. to 9 p.m., Sundays, 5 p.m. to 8 p.m. The Holtsville Ecology Site is located at 249 Buckley Road in Holtsville. For more information, call 631-758-9664.

“The enhancements made along College Road, across from both the VFW and SCCC, will allow for increased pedestrian safety in the area,” Losquadro said.

The highway superintendent said the VFW Memorial Post 400 offered the use of its parking lot as an overflow lot for students from Suffolk County Community College, many of them returning vets.

“Vehicle and pedestrian traffic is very heavy in the area around the college and the new sidewalk will make it much safer for all, especially for our student veterans,” LaValle said. “I thank Superintendent Losquadro and the Highway Department for the work that they did to complete this project.”

VFW Memorial Post 400 Commander John Rago also extended thanks to all of the Town of Brookhaven members involved in the project.

“They may think that they built a sidewalk and a crosswalk,” Rago said, “but what they really built is a bridge that connects those veterans who attend Suffolk County Community College with our VFW Post, where they can receive support from fellow veterans.”

Two candidates are vying to serve the unexpired term of former Smithtown Highway Superintendent Glenn Jorgensen (R), who resigned in October 2015 shortly before pleading guilty to felony and misdemeanor charges.

When the two candidates were interviewed together at the TBR News Media’s main office earlier this month, it seemed the battle lines were drawn according to age. Deputy Highway Supervisor Robert Murphy (R) has been the acting supervisor for almost a year, since the town board named him to replace Jorgensen. He is 53.

His Democratic challenger is lifelong Smithtown resident and attorney Justin Smiloff, who said he “doesn’t need the job, but wants it because he thinks he can make a difference.” In addition to a law degree, he has an undergraduate degree in accounting, which he said he would use to “see what I can do to get more for less.” He is 35.

Among the topics of contention was the restoration of free leaf bag distribution to residents. “The leaf bag program is beneficial to taxpayers,” Smiloff said, “and if cost is a problem, cuts should be made from other areas.”

Murphy said the last time leaf bags were distributed was 10 years ago, at a cost of $187,000.

“With the 2 percent cap Gov. Andrew Cuomo (D) established, some services have had to be eliminated,” he said, adding he thinks the brown paper bags could be mulched with leaves and don’t serve their intended purpose if they’ve been sitting out in the rain.

Technology use in the Highway Department was also discussed. Smiloff said his youth is an advantage in that area. He wants to see a modern, user-friendly website and feels residents should be able to text message the department. In addition, he will look at technology used in other places. Murphy said he is already networking with other highway superintendents. The Town of Brookhaven’s Dan Losquadro (R) has shared information about geographic information system currently being used to identify potholes.

Another item of debate was the use of energy-efficient vehicles.

“If we reduce the cost for fuel, money could be used for more beneficial things to help residents,” Smiloff said. On this, Murphy was in agreement. However, with $800,000 a year you can buy only four trucks, he said, indicating it will take some time to achieve true energy efficiency.

Smiloff promises voters “a new day and a new start.”

“I would deliver for taxpayers in a manner they haven’t seen before,” he said. He believes a clean sweep is necessary for taxpayers’ peace of mind.

In contrast, Murphy said his experience is worth its weight in gold.

“I have over 30 years in the field — 20 years in the private sector and [about] 10 in public civil engineering — and I have been at the department for the last five years,” he said.

In the year he’s run the department, he said he’s seen where improvements need to be made. He noted that his morals and ethics have never been questioned, and he will make sure that everything is done legally.

The Sept. 29 Brookhaven Town Board meeting seemed to provide proof of Margaret Mead’s assertion: “Never doubt that a small group of thoughtful, committed citizens can change the world; indeed, it’s the only thing that ever has.”

Homeowners from the Strathmore M-section of Stony Brook were in attendance at the meeting, again seeking help to retain sycamore trees on their streets, which had been marked for removal by the Highway Department in preparation for repaving several roads. They listened as town Attorney Annette Eaderesto gave a statement at the beginning of the meeting.

Referencing the residents’ concerns, expressed at the Sept. 1 board meeting, Eaderesto said, “The supervisor directed the Law office and [the Division of] Land Management to get involved in this situation,” explaining that John Turner [the town’s open space program coordinator] visited the area, took many pictures and also took pictures of other roads, which had been paved using curb bump-outs, so that the trees would be saved.

“The project is totally on hold now,” Eaderesto said. “Your trees are not in danger.”

She added she had confirmed the hold with the deputy supervisor of highways, Steve Tricarico. Further, she indicated that Supervisor Ed Romaine (R) would put forth a resolution at the next Town Board meeting, which will establish a “tree committee” so situations like this will not recur in the future. “There’ll be much more communication,” she said. Eaderesto’s statement was met with audience applause.

“We’ll be dealing with a solar code that will not allow any solar [projects] to be done by taking down trees,” Romaine said. “We think Brookhaven should stay as green as it possibly can.”

Eight speakers addressed the board regarding the progress made on retaining the trees. Most of them expressed gratitude to the board, the supervisor and the town attorney for listening and responding to their pleas.

The organizers of this community effort are cautiously optimistic.

“We were surprised [by the town attorney’s statement],” said Susan Ackerman. “We’d like to find out specifics before we truly relax. What is the plan for the M-section?”

While the residents want to preserve the healthy, mature trees in the M-section, Ackerman said she’d also like to see a more modern paving policy throughout Brookhaven town.

“We had so much stuff we were going to say [at the board meeting],” said M-section homeowner Tom Caputo. “We think it was good [referring to the town attorney’s statement], but we’re still walking on eggshells.”

They both plan to watch the Sept. 29 board meeting video online, so they can listen closely to Eaderesto’s words.

“The paving project is on hold while we evaluate all of the options available to minimize disruptions to the neighborhood, while improving our infrastructure,” wrote the office of town Highway Superintendent Dan Losquadro (R) in an email statement.
