Suffolk County District Attorney Raymond A. Tierney announced on May 18 that QHAMEL DICKERSON, 28, of Huntington Station, and RASHIED SMITH, 41,  of Central Islip, were both sentenced for selling fentanyl that resulted in two unrelated overdose  deaths of Suffolk County residents.

“The fentanyl epidemic has claimed the lives of two more innocent women, and the unfortunate  reality is that this problem will continue to worsen without action,” said District Attorney Tierney.  “The dangers of fentanyl are not breaking news anymore. Not in Suffolk County, not in Albany,  and not to the drug dealers who continue to push this poison into our communities. Cheap  manufacturing and lethally high potency have exposed the legislative gaps that hinder law  enforcement’s ability to effectively manage the situation. That is why I will continue to push for a  death by dealer statute. We owe it to the victims and their families to hold all dealers of fentanyl  dealers accountable for the deaths they cause.”  

According to court documents and DICKERSON’s admission during his guilty plea allocution, on  July 5, 2022, the Suffolk County Police Department responded to East Northport for a fatal drug  overdose of a 23-year-old female. 

The victim’s cell phone, found at the scene, contained text messages between the victim and  DICKERSON in which DICKERSON agreed to sell the victim illicit pills. On July 4, 2022,  DICKERSON met with the victim and sold her counterfeit pills that bore the color, shape, and  markings of oxycodone, but contained fentanyl instead.  

In August 2022, DICKERSON used the same cell phone to communicate with an undercover  detective from the Suffolk County Police Department, where DICKERSON agreed to sell the  undercover detective the same type of pills he sold to the overdose victim. Thereafter, at a location  in Suffolk County, DICKERSON met with the undercover detective and sold them counterfeit  oxycodone pills containing fentanyl. DICKERSON was arrested on September 1, 2022.

On March 10, 2023, DICKERSON pleaded guilty before Acting Supreme Court Justice, the  Honorable Anthony S. Senft, Jr., to two counts of Criminal Sale of a Controlled Substance in the  Third Degree, a Class B felony. DICKERSON faced up to nine years in prison at sentencing. On  April 18, 2023, Judge Senft sentenced DICKERSON to five years in prison followed by two years  of post-release supervision. The District Attorney’s Office had requested an eight-year prison  sentence. DICKERSON was represented by Scott Zerner, Esq.  

In a separate case, on the morning of June 23, 2022, the Suffolk County Police Department  responded to a home in Mastic and discovered a 43-year-old woman had fatally overdosed. The  police recovered the victim’s cell phone which contained text messages between her and SMITH  from the night before her death. In those text message conversations, SMITH agreed to sell the  victim crack cocaine and fentanyl. Police learned that SMITH had met the victim in Central Islip  where he sold her the drugs.  

Within 48 hours of the victim’s death, SMITH sold crack cocaine to an undercover detective in  the Suffolk County Police Department. A couple of days later, Smith sold crack cocaine and  fentanyl to the undercover detective. A search warrant was executed at SMITH’s residence where  police found the cell phone he used to negotiate the sales of crack cocaine and fentanyl with both  the victim and the undercover detective. 

Police also found an illegal loaded Taurus semi-automatic firearm, crack cocaine, and a digital  scale used for weighing narcotics for sale. SMITH was arrested on June 29, 2022.  

On April 7, 2023, SMITH pleaded guilty before Supreme Court Justice, the Honorable Richard  Ambro, to two counts of Criminal Sale of a Controlled Substance in the Third Degree, a Class B  felony, and one count of Criminal Possession of a Weapon in the Second Degree, a Class C violent  felony. SMITH faced up to 12 years in prison at sentencing.  

On May 18, 2023, Judge Ambro sentenced SMITH to seven years in prison followed by five years  of post-release supervision. The District Attorney’s Office had requested a 10-year prison  sentence. SMITH was represented by Lonnie Hart, Jr., Esq.  

Prior to the conviction in this case, SMITH had multiple prior convictions related to drug  possession, including two separate convictions for Criminal Possession of a Controlled Substance  in the Fourth Degree, a Class C felony, in both 2016 and 2019, as well as a felony conviction for  Violating the Sex Offender Registry Requirement as a Second Offense in 2013.

Suffolk County Police arrested five people on May 18 for allegedly selling alcohol and e-liquid nicotine products to  persons under 21 during compliance checks at businesses in the Sixth Precinct.  

In response to community complaints, Sixth Precinct Crime Section officers conducted an investigation  into the sale of alcohol and e-liquid nicotine to minors during which nine businesses were checked for  compliance in the Port Jefferson Station and Mt. Sinai areas.  

During the investigation, three people were arrested and charged with alleged Unlawfully Dealing with a Child 1st Degree for selling alcohol to minors: 

  • Dharam Singh, 29, of New Hyde Park, an employee of Sunoco, located at 200 Route 112, Port  Jeff Station. 
  • Kamalpreet Singh, 21, of Port Jeff Station, an employee of Port Jefferson Grapes & Grains, located at 650 Route 112, Port Jeff Station. 
  • Buddika Kurukulasuriya 35, of Mt. Sinai, an employee of Sunoco, located at 572 Route 25A, Mt. Sinai. 

The following people were arrested and charged with alleged Unlawfully Dealing with a Child 2nd Degree for  selling e-liquid nicotine to minors.  

  • Muhammad Khan, 29, of Selden, an employee at Smiley Smoke Shop, located at 650 Route 112 in Port Jefferson Station.
  • Sanket Patel, 25, of Riverhead, an employee of Mount Sinai Smoke Shop, located at 160 Route  25A, Mt. Sinai. 

All five were issued Field Appearance Tickets and are scheduled for arraignment at First District Court  in Central Islip on June 7.

Suffolk County Police  arrested a Centereach man on May 17 for alleged Use of a Child in a Sexual Performance for incidents that occurred last month.

Jordan Viscomi, a dance instructor at David Sanders Dance Dynamics, located at 4110 Sunrise Highway in Oakdale, met and befriended two female juveniles, aged 15 and 16, who were dance students there. Over the course of three days in April 2023, Viscomi allegedly engaged the two victims in live video chats and phone text messages, where he exchanged sexual content with them.

Following an investigation by Fourth Squad detectives, Viscomi, 30, was charged with alleged six counts of Use of a Child in a Sexual Performance, four counts of Promoting a Sexual Performance by a Child, four counts of Disseminating Indecent Material to Minors 1st Degree, two counts of Disseminating Indecent Material to Minors 2nd Degree, and two counts of Endangering the Welfare of a Child.

Police are asking anyone who may have been victimized by Viscomi to call the Fourth Squad at 631- 854-8552.

Suffolk County Crime Stoppers and Suffolk County Police Fourth Squad detectives are
seeking the public’s help to identify and locate three people who allegedly used a stolen credit card at a Commack store.

Three people allegedly used a stolen credit card to make a $522 purchase at Home Depot, located at 5025 Jericho Turnpike, on April 5. A $510 purchase was attempted and declined at
Walgreens, located at 5001 Jericho Turnpike in Commack, the same day. The card was
stolen from a woman’s purse in Home Goods in Commack earlier in the day.

A man allegedly stole TaylorMade Stealth golf clubs from Dick’s Sporting Goods, located at 870 Walt Whitman Road, at 10:27 a.m. on April 22. The merchandise was valued at
approximately $1,100.

Suffolk County Police arrested a Kings Park man on May 15 for allegedly taking pictures of children without permission at a Smithtown gymnastics school.

Robert Colyvas entered Gold Medal Gymnastics Center, located at 253 West Main Street, on April 29 between 12:40 p.m. and 1 p.m. and allegedly took pictures of the staff and children without consent. Following an investigation by Fourth Precinct Crime Section officers, Colyvas was arrested at his home at 8:28 p.m.

Colyvas, 29, of Orchard Drive in Kings Park, was charged with allegedly Endangering the Welfare of a Child.

The Suffolk County Police Department will host three community meetings to provide information and address concerns regarding the upcoming implementation of ShotSpotter in Suffolk County communities.

According to ShotSpotter, the technology detects 90% of gunshots in the coverage area, a contrast to the nationwide average of less than 20% of gunfire being reported to police. ShotSpotter notifies police in less than one minute with information including the location, number of shots and time of discharge.

The placement of ShotSpotter sensors were selected based on previous calls for shots fired. ShotSpotter will be installed in Bay Shore, Brentwood, Central Islip, Coram, Huntington Station, Mastic, North Amityville, North Bellport and Wyandanch.

“This technology is another tool in our arsenal to continue our efforts to reduce crime and remain proactive here in Suffolk County,” Suffolk County Executive Steve Bellone said. “ShotSpotter is a part of our comprehensive approach to enhance our Department’s ability to investigate, prevent and respond to criminal incidents in our communities.”

“While Suffolk County is considered one of the safest communities in the country, the utilization of ShotSpotter will be an additional tool to deter gun violence,” Suffolk County Police Commissioner Rodney K. Harrison said. “The implementation of this technology will aid officers when responding to calls of shots fired by notifying them sooner, and more accurately, as well as during subsequent investigations.”

The meetings will be held at the SCPD Second Precinct, located at 1071 Park Ave. in Huntington, on May 15 at 6 p.m.; at the Brentwood Public Library, located at 34 Second Ave. in Brentwood, on May 16 at 6 p.m.; and at the SCPD Sixth Precinct, located at 400 Route 25 in Selden, on May 17 at 6 p.m.

Suffolk County District Attorney Raymond A. Tierney announced on May 15 that Gregory Vasicek, 60, of Queens, and president of the Queens-based charitable organization Play4Autism, pleaded guilty to the charge of Scheme to Defraud in the First Degree, and admitted to promising to pay thousands of dollars to various vendors for goods and services for which he never paid.

“This defendant preyed upon the goodwill of Suffolk County residents and business owners under the guise of helping autistic children to benefit himself,” said District Attorney Tierney. “My Office will continue to hold accountable all those who manipulate, steal, and violate the public’s trust.”

According to the investigation and the defendant’s admissions during his plea allocution, between April 21, 2022 and May 2, 2022, Vasicek wrote numerous checks from his charity’s bank account, while knowing that the funds in the organization’s account would be insufficient to pay for the services and property being purchased. Among the victims of the defendant’s scheme were a golf course and restaurant in Manorville, and an amusement park in Farmingdale. Despite repeated attempts to obtain payment from the defendant by these vendors, Vasicek never paid for the goods and services provided to him in connection with those purchases.

page1image21187008The investigation also revealed that the defendant fraudulently solicited and received hundreds of dollars in registration fees from donors for a golf outing that he represented was to occur at the Manorville golf course on October 19, 2022. No such outing was ever scheduled to take place on that date, or any subsequent date at that location.

On May 12, 2023, Vasicek pleaded guilty before Acting Supreme Court Justice, the Honorable Richard I. Horowitz to the charge of, Scheme to Defraud in the First Degree, a Class E felony. He is due back in court for sentencing on July 6, 2023. Vasicek is being represented by the Legal Aid Society of Suffolk County.

This case is being prosecuted by Assistant District Attorney Stuart P. Levy of the Public Corruption Bureau.
